Research Publications (2011 to 2015)
HIV-infected prisoners in Malaysia represent a critical target population for secondary HIV risk reduction interventions and care. We report on the process and outcome of our formative research aimed at systematically selecting and adapting an EBI designed to reduce secondary HIV risk and improve adherence to antiretroviral therapy among soon-to-be-released HIV-infected prisoners. Our formative work involved a critical examination of established EBIs and associated published reports complemented by data elicited through structured interviews and focus groups with key stakeholders, members of the target population, and their family members. Based on all information, we adapted the Holistic Health Recovery Program targeting …
Constructing Some Possibilities For Compensation As Part Of Legal Remedies For Rape Survivors: The Case Of Malaysia, S.Z. Ismail
Constructing Some Possibilities For Compensation As Part Of Legal Remedies For Rape Survivors: The Case Of Malaysia, S.Z. Ismail
Research Publications (2011 to 2015)
The idea of compensating rape victims is fast gaining momentum around the globe amidst the cry to seek justice for crime victims in general. Several NGOs in Malaysia see the importance of setting up an agency to response to the plight of these women. The law is seen as inadequately responsive towards the victims. Even by imposing stiffer punishment on the rapists, this does not bring any good to the victims. Some are left with various physical injuries, contracting sexually-related diseases and unwanted pregnancy, but almost all find it hard to overcome the psychological trauma, the effects that are more …

The Nature And Nurture Of Violence: Early Intervention Services For The Families Of Maoa-Low Children As A Means To Reduce Violent Crime And The Costs Of Violent Crime Note, Jennifer Brooks-Crozier
Connecticut Law Review
In 1993, scientist Hans Brunner discovered that several male members of a large Dutch family who exhibited behaviors such as impulsive aggression, arson, and attempted rape possessed a mutant copy of the MAOA gene, the gene that codes for the production of the enzyme monoamine oxidase A ("MAOA"). Brunner and his colleagues demonstrated that carrier males produced less MA OA, or were "MAOA-low. " They hypothesized that this MAA deficiency caused abnormal aggressive behavior in MAOA-low males. Subsequent research, however, demonstrated that the genetic mutation, acting alone, does not produce the abnormal, aggressive behavior observed by Brunner and his colleagues. …

The 1963 decision of the Supreme Court of Montana in Carroll v. Beardon occupies less than three full pages in the Pacific Reporter and involves a simple real estate transaction in which a "madam" sold a house used for prostitution to another "madam." The opinion is the last in a long line of cases which speak specifically to the issue of enforcement of facially legitimate contracts that in some manner involve or are related to prostitution. It is commonly cited in treatises and hornbooks as representative of the movement by courts toward enforcement of such contracts under the law of …

The Role Of The Committee On The Rights Of The Child In Interpreting And Developing International Humanitarian Law, David Weissbrodt, Joseph C. Hansen, Nathaniel H. Nesbitt
Articles
The interaction between human rights law and international humanitarian law (IHL) has received a great deal of scholarly attention. Commentators note the increased presence of IHL in the work of human rights bodies. There remains an interesting gap in the debate, however: while human rights bodies may be referencing international humanitarian law, what are they doing with it? To what extent are they interpreting its protections under a human rights framework? Are they performing substantive or precedential analysis of IHL? This article addresses one measure of that gap by comprehensively examining the work of the Committee on the Rights of …
Does Judicial Philosophy Matter?: A Case Study, Francisco J. Benzoni, Christopher S. Dodrill
Does Judicial Philosophy Matter?: A Case Study, Francisco J. Benzoni, Christopher S. Dodrill
West Virginia Law Review
A leading theory in the study of judicial behavior is the attitudinal model. This theory maintains that a judge's political ideology can be used to predict how a judge will decide certain cases; other factors, such as the judge's judicial philosophy, tend to be unimportant. Under this theory, two judges with the same political ideology, but different judicial philosophies, should virtually always vote the same way in cases with predicted ideological outcomes. This manuscript tests the attitudinal model by examining opinions by two judges with very similar political ideologies but different judicial philosophies: Judge Michael Luttig and Judge Harvie Wilkinson …

A Poisoned Apple? The Use Of Secret Evidence And Secret Hearings To Combat Terrorism In Australia, Michael Crowley
A Poisoned Apple? The Use Of Secret Evidence And Secret Hearings To Combat Terrorism In Australia, Michael Crowley
Australian Counter Terrorism Conference
The use of secrecy in the form of secret evidence and secret hearings had a limited role in modern democracies where the focus is on open justice. This changed after the events of 11 September 2001. Secrecy may be a necessary adjunct to maintaining military options, for combating organised crime and countering terrorism but like a double-edged sword it can also cut into the fabric of the democratic state via abuses of power, and the maintenance and expansion of organisations beyond their usefulness. This paper considers the use of secrecy in Australia with particular reference to its impact on the …

Systems Architecture For The Acquisition And Preservation Of Wireless Network Traffic, Brian Cusack, Thomas Laurenson
Australian Digital Forensics Conference
Wireless networking provides a ready and cost effective solution for business applications. It has escalated in popularity mainly due to the ability to form computer networks without a wired based infrastructure. However, accompanying the widespread usage also comes the inherent prospect of criminal misuse, including unauthorized application and the launch of system attacks. This paper presents the testing of an innovative Wireless Forensic Model (WFM) system that provides capability for acquisition and preservation of wireless network traffic (802.11) frames by implementing a wireless drone architecture. It is thus a forensic readiness system providing available evidence for forensic investigation. The results …
The Timely Demise Of The Fourth Amendment Third Party Doctrine, Stephen E. Henderson
The Timely Demise Of The Fourth Amendment Third Party Doctrine, Stephen E. Henderson
Faculty Articles
In what may be a slightly premature obituary, in this response to a forthcoming paper by Matthew Tokson I argue that the Fourth Amendment third party doctrine "has at least taken ill, and it can be hoped it is an illness from which it will never recover." It is increasingly unpopular as a matter of state constitutional law, has long been assailed in scholarship but now thoughtful alternatives are percolating, and it cannot – or at least should not – withstand the pressures which technology and social norms are placing upon it. Even the Supreme Court seems loath to defend …

Issues continue to arise about judicial independence in the United States. The term judicial independence is often not defined with precision. Judicial independence has its roots in the doctrine of separation of powers. It is also grounded in due process and in ethical standards that require judges to be competent and impartial decision-makers. Judicial independence depends upon society having faith in the integrity of the courts. Accountability is thus the handmaid of an independent judiciary. This article defines both the structures and the ethical standards that ensure an independent judiciary.
