Rethinking The Indefinite Detention Of Sex Offenders, Fredrick E. Vars
Rethinking The Indefinite Detention Of Sex Offenders, Fredrick E. Vars
Connecticut Law Review
Thousands of sex offenders in the United States are being held indefinitely under civil commitment programs. The analysis in this Article suggests that none (or precious few) belong there. Specifically, in a large dataset, an instrument as good as the one most widely used by experts (the "Static-99") could not identify even one sex offender who met the legal standards for commitment. Supplementing such instruments with additional information does not appear to improve matters, so the failure of the instrument is profoundly disturbing. There are three possible responses to this failure: (1) improve instruments to meet existing standards; (2) lower …

Constituted By A Series Of Contestations: Critical Race Theory As A Social Movement Commentary: Critical Race Theory: A Commemoration: Response, George Lipsitz
Connecticut Law Review
The ideas, insights, and analyses that define the Critical Race Theory (CRT) project have made critical contributions to scholarship in law and many other disciplines. Yet CRT has never been merely a project of intellectual engagement and argument. The movement emerged from and contributed to the Black freedom struggle of the twentieth century. It drew many of its determinate features from lessons learned through political engagement and struggle. The occluded history of CRT speaks powerfully to the problems we face in the present as a result of our society's continuing failure to recognize the role that racism plays in preserving …
Disappearing Parents: Immigration Enforcement And The Child Welfare System, Nina Rabin
Disappearing Parents: Immigration Enforcement And The Child Welfare System, Nina Rabin
Connecticut Law Review
This Article presents original empirical research that documents systemic failures of the federal immigration enforcement and state child welfare systems when immigrant parents in detention and deportation proceedings have children in state custody. The intertwined but uncoordinated workings of the federal and state systems result in severe family disruptions and raise concerns regarding parental rights of constitutional magnitude. This Article documents this phenomenon in two ways. First, it presents an "anatomy of a deportation, "providing a case study of an actual parent whose detention and eventual deportation has separated her from her four young children for over two years and …
Confrontation And Domestic Violence Post-Davis: Is There And Should There Be A Doctrinal Exception, Eleanor Simon
Confrontation And Domestic Violence Post-Davis: Is There And Should There Be A Doctrinal Exception, Eleanor Simon
Michigan Journal of Gender & Law
Close to five million intimate partner rapes and physical assaults are perpetrated against women in the United States annually. Domestic violence accounts for twenty percent of all non-fatal crime experienced by women in this county. Despite these statistics, many have argued that in the past six years the Supreme Court has "put a target on [the] back" of the domestic violence victim, has "significantly eroded offender accountability in domestic violence prosecutions," and has directly instigated a substantial decline in domestic violence prosecutions. The asserted cause is the Court's complete and groundbreaking re-conceptualization of the Sixth Amendment right of a criminal …

The Relationship Between Religiosity And Substance Abuse Among African Americans: A Systematic Review Of 30 Years Of Research, Jeongah Kim
Faculty Publications - College of Social Work
The main purpose of this study is to systematically examine research conducted over the past 30 years regarding the effects of religiosity on substance abuse among African American. The present study was designed to examine whether there is empirical support for a relationship between religiosity and substance abuse among African American. This study is a partial replication of a systematic review by Johnson et al. (2000) on the effect of religion on delinquent behaviors. Johnson and his colleagues (2000) found that there is a consistent negative relationship between religiosity and deviance in the most rigorous research. Given that various types …

Addressing The Overrepresentation Of The Maori In New Zealand's Criminal Justice System At The Sentencing Stage: How Australia Can Provide A Model For Change, Joanna Hess
Washington International Law Journal
New Zealand’s 2002 Sentencing Act provides several ways a sentencing court may take an offender’s cultural or ethnic background into account. Given the disproportionate rate of recidivism among New Zealand’s indigenous Maori offenders and international and domestic concerns regarding this problem, the Act’s provisions offer one method for addressing and mitigating this issue. However, these sentencing provisions remain largely unknown or underused. This comment argues that in order to tackle these concerns, left unaddressed by the current Sentencing Act, New Zealand should restructure its sentencing provisions to follow the legislative model that is developing in Australian states, particularly the model …

The Effects Of Racially-Motivated Emotional Arousal On The Eating Behaviors Of African American Women, Lenwood W. Hayman
The Effects Of Racially-Motivated Emotional Arousal On The Eating Behaviors Of African American Women, Lenwood W. Hayman
Wayne State University Dissertations
Disparities between African Americans and Caucasians remain vast across a wide variety of health indicators. Chronic stress has been identified as a risk factor for a variety of chronic illnesses and poor health outcomes. One type of chronic stress that has been linked to health disparities is the stress associated with experiences of racial discrimination. The stress African Americans encounter as a result of their racist experiences contributes to a chronic elevation of their physiological stress response. In addition to stress, a major risk factor for coronary heart disease and diabetes is obesity, which has been established as a major …
California Penal Code Sec. 270.1: A Constitutionally Impermissible Attempt To Combat Truancy, Alison Cordova
California Penal Code Sec. 270.1: A Constitutionally Impermissible Attempt To Combat Truancy, Alison Cordova
UC Law Constitutional Quarterly
In the 2008-2009 academic school year, over a quarter of the California public school student population was truant. There is a well established correlation between truancy and dropping out of high school. And high school dropouts make up over three quarters of the prison population of the State of California.
Responding to this alarming domino effect, the California Legislature enacted Penal Code section 270.1 in September, 2010. This statute imposes criminal liability on parents of chronically truant students for not encouraging or supervising their child's school attendance. While the aim of this law is clearly to attack criminality before it …

The End Of Innocence? Federal Habeas Corpus Law After In Re Davis, Joshua M. Lott
The End Of Innocence? Federal Habeas Corpus Law After In Re Davis, Joshua M. Lott
Georgia State University Law Review
“This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is ‘actually’ innocent.” Justice Scalia may already be well known for a strict approach to statutory construction, but his dissenting statement in the 2009 Supreme Court decision, In re Davis, caused quite a buzz among national media. Although callous in appearance, Justice Scalia’s words provide a technically correct reading of Supreme Court precedent and federal habeas corpus law: actual innocence is not a recognized claim of …
Beyond Rehabilitation: A New Theory Of Indeterminate Sentencing, Michael M. O'Hear
Beyond Rehabilitation: A New Theory Of Indeterminate Sentencing, Michael M. O'Hear
Faculty Publications
Indeterminate sentencing - that is, sentencing offenders to a range of potential imprisonment with the actual release date determined later, typically by a parole board - fell into disrepute among theorists and policymakers in the last three decades of the twentieth century. This sentencing practice had been closely associated with the rehabilitative paradigm in criminal law, which also fell from favor in the 1970’s. In the years that followed, most states eliminated or pared back the various devices that had been used to implement indeterminate sentencing, especially parole release. Yet, sentencing remained indeterminate most places to varying degrees, and now …
