From Sounds Bites To Sound Policy: Reclaiming The High Ground In Criminal Justice Policy-Making, Anthony C. Thompson Jan 2011

From Sounds Bites To Sound Policy: Reclaiming The High Ground In Criminal Justice Policy-Making, Anthony C. Thompson

Fordham Urban Law Journal

In this article, the author contemplates the way the criminal justice system is portrayed in the media and suggests how the media's emphasis on "sound bites" - which makes it difficult to separate fact from hype - has had significant policy ramifications. The author makes a point of exploring the many ways that conceptions of crime are formed and influenced, as well as how the media has shaped legislation. In the author's opinion, in order to curb the excessive influence of most mainstream representations of the criminal justice system, there must be some mechanism for oversight of both the media …

Excluding Coerced Witness Testimony To Protect A Criminal Defendant's Right To Due Process Of Law And Adequately Deter Police Misconduct, Katherine Sheridan

Fordham Urban Law Journal

This Note argues that the Due Process Clause must protect criminal defendants from the admission of an involuntary statement made by a witness. Part I discusses the history of the use of involuntary statements, specifically the justifications for the exclusion of coerced confessions. Part II examines how various courts have addressed the issue and have come to different conclusions. Part III explains why involuntary witness statements should be excluded under the Due Process Clause in criminal trials.

From Cook County To Pretoria: A Long Walk To Justice For Children, Dr. Ann Skelton Jan 2011

From Cook County To Pretoria: A Long Walk To Justice For Children, Dr. Ann Skelton

Northwestern Journal of Law & Social Policy

This Article begins by recording the history of the development of juvenile justice in the United States and explores the extent to which that system influenced South Africa's child justice system. The Article argues that because South Africa never fully embraced a separate juvenile justice model children were subjected to the mainstream criminal justice system in South Africa during the whole of the twentieth century. The end of apartheid, however, created opportunities for transformation of the law. This Article explains why, at that time, the United States was not setting a positive example for reformers to follow. Finally, this article …

Development And Remembrance The Use Of Transitional Justice Mechanisms In Transforming A State From Conflict, Jennifer Lieb

Theses & ETDs

In the current global political climate, states emerging from conflict are expected to reform past abusive regimes and institutions and work towards implementing a more liberal form of government committed to defending the rights of citizens. Transitional justice mechanisms are meant to facilitate growth and development in this manner to establish the foundations for sustainable peace. A vast array of mechanisms can be employed, and it is often up to the state to decide which mechanisms will best fit its needs. This portfolio examines how and why post-conflict states implement and institutionalize these mechanisms, as well as the vital role …

The Signaling Function Of Religious Speech In Domestic Counterterrorism, Aziz Huq Jan 2011

The Signaling Function Of Religious Speech In Domestic Counterterrorism, Aziz Huq

Articles

A wave of attempted domestic terrorism attacks in 2009 and 2010 has sharpened attention to the threat of domestic-source terrorism inspired or directed by al Qaeda. Seeking to preempt that terror, governments face an information problem. They must separate signals of terrorism risk from potentially overwhelming background noise and persuade juries or fact finders that those signals warrant coercive action. Selection of accurate signals of terrorism danger in the information-poor circumstances of domestic counterterrorism is arguably a central challenge today for law enforcement tasked with preventing further terrorist attacks. To an underappreciated extent, governments have used religious speech as a …
