U.S. Immigration Policy And Immigrant Children's Well-Being: The Impact Of Policy Shifts, David K. Androff, Cecilia Ayon, David Becerra, Maria Gurrola, Lorraine Salas, Judy Krysik, Karen Gerdes, Elizabeth Segal Mar 2011

U.S. Immigration Policy And Immigrant Children's Well-Being: The Impact Of Policy Shifts, David K. Androff, Cecilia Ayon, David Becerra, Maria Gurrola, Lorraine Salas, Judy Krysik, Karen Gerdes, Elizabeth Segal

The Journal of Sociology & Social Welfare

America is built upon a history of immigration; yet current immigration policy and anti-immigrant sentiment negatively affect the vulnerable population of immigrant families and children. Immigrant children face many problems, including economic insecurity, barriers to education, poor health outcomes, the arrest and deportation of family members, discrimination, and trauma and harm to their communities. These areas of immigrant children's economic and material well-being are examined in light of restrictive and punitive immigration policies at the federal and local level. Implications for social policy reform, such as decriminalization, are discussed.

Promoting Smooth School Transitions For Children In Foster Care, Ghyslyn T. Laviolette Mar 2011

Promoting Smooth School Transitions For Children In Foster Care, Ghyslyn T. Laviolette

Electronic Theses and Dissertations

Children in foster care move two times per year on average. School records are not always transferred in a timely manner, which leads to a lack of services. Schools often are not aware of the legal issues surrounding foster care, such as who has legal rights to sign field trip permission slips or consent for educational evaluations. This study led to the development of an informational guideline as to how best support the school transition process for children in foster care. The Delphi technique was used to enlist the expertise of four respondent groups: foster parents, Guardians ad Litem, school …

Visual Violations: The Ban On Extreme Pornography, Politics Of Representation, And The Discursive Creation Of ‘Docile Bodies’, Mika Pasanen Mar 2011

Visual Violations: The Ban On Extreme Pornography, Politics Of Representation, And The Discursive Creation Of ‘Docile Bodies’, Mika Pasanen

Journal of International Women's Studies

This paper focuses on a law that came into force in January 2009 in the United Kingdom prohibiting the viewing and possessing of ‘extreme pornography.’ This law will be approached through Foucaultian notions of discursive power and ‘docile body.’ This will be used to create a framework for understanding the production of sexuality in/through the family, and pornography’s relationship with the family. The paper then moves on to the problematic nature of the politics of representation and the realm of the imagination. The argument here suggests that the law aims to create ‘docile bodies’ through the control and regulation of …

And Death Shall Have No Dominion: How To Achieve The Categorical Exemption Of Mentally Retarded Defendants From Execution, J. Amy Dillard Mar 2011

And Death Shall Have No Dominion: How To Achieve The Categorical Exemption Of Mentally Retarded Defendants From Execution, J. Amy Dillard

All Faculty Scholarship

This article examines the Court’s categorical exclusion of mentally retarded defendants from execution and explores how trial courts should employ procedures to accomplish heightened reliability in the mental retardation determination; it maintains that if a mentally retarded defendant is subjected to a death sentence then the Atkins directive has been ignored. To satisfy the Atkins Court’s objective of protecting mentally retarded defendants from the “special risk of wrongful execution,” the article explores whether trial courts should engage in a unified, pre-trial competency assessment in all capital cases where the defendant asserts mental retardation as a bar to execution and how …

Nebraska Law Review

The National Collegiate Athletic Association (NCAA) Division I Committee on Infractions (Infractions Committee) hears and resolves cases involving institutional culpability for major violations of NCAA rules. Its work is among the most important done by any NCAA committee, cabinet, or council. Its decisions have substantial import for institutions and involved individuals alleged to have committed violations. Its decisions also have substantial import for other institutions looking to the committee to uphold competitive equity and to deter cheating and other behaviors injurious to student-athletes and detrimental both to individual institutional integrity and to the public perception of varsity athletics as part …

The Aftermath Of Melendez-Diaz V. Massachusetts, 129 S. Ct. 2527 (2009)—Identifying The Analyst Who Can Satisfy Confrontation, Ryan Sullivan Mar 2011

The Aftermath Of Melendez-Diaz V. Massachusetts, 129 S. Ct. 2527 (2009)—Identifying The Analyst Who Can Satisfy Confrontation, Ryan Sullivan

Nebraska Law Review

This Note begins by briefly exploring the development of the Confrontation Clause over the last thirty years, followed by a discussion of the holding in Melendez-Diaz and a summary of the Court’s responses to arguments made in opposition to its ruling. Part III begins by identifying a significant issue on which the Court’s ruling left inadequate guidance: Who must testify in order to admit the contents of the analyst report? Oftentimes, several technicians are involved in the analysis of a single sample, yet Melendez-Dias fails to identify which of these analysts alone would satisfy confrontation requirements, leaving open the possibility …

Juror Perceptions Of Juveniles Transferred To Criminal Court: The Role Of Generic Prejudice And Emotion In Determinations Of Guilt, Megan Beringer Jones

Department of Psychology: Dissertations, Theses, and Student Research

Research examining juror perceptions of juveniles tried as adults has provided mixed results, with some studies providing evidence of bias against juveniles tried as adults, and others finding no evidence of this bias.  The present research aimed to clarify this issue by examining the roles of generic prejudice and emotion in jurors’ judgments of juveniles tried as adults.  Study 1 assessed which stereotypes people associate with juveniles tried as adults compared to juveniles tried in juvenile court and adults tried in criminal court.  Study 2 examined to what extent angry, fearful, sad, and neutral mock jurors used these stereotypes to …
