Sexting: A Typology., Janis Wolak, David Finkelhor
Crimes Against Children Research Center
This bulletin presents a typology of sexting episodes based on a review of over 550 cases obtained from a national sur‐ vey of law enforcement agencies. The cases all involved “youth‐produced sexual images,” defined as images of minors created by minors that could qualify as child pornography under applicable criminal statutes. The episodes could be broadly divided into two categories, which we termed ‘Aggravated’ and ‘Experimental’. Aggravated incidents involved criminal or abusive elements beyond the creation, sending or possession of youth‐produced sexual images. These addi‐ tional elements included 1) adult involvement; or 2) criminal or abusive behavior by minors such …

Representational Competence: Defining The Limits Of The Right To Self-Representation At Trial, E. Lea Johnston
Representational Competence: Defining The Limits Of The Right To Self-Representation At Trial, E. Lea Johnston
Notre Dame Law Review
In 2008, the Supreme Court held that the Sixth Amendment permits a trial court to impose a higher competence standard for self-representation than to stand trial. The Court declined to delineate a permissible representational competence standard but indicated that findings of incompetence based on a lack of decisionmaking ability would withstand constitutional scrutiny. To date, no court or commentator has suggested a comprehensive competence standard to address the particular decisional context of self-representation at trial. Conceptualizing self-representation as an exercise in problem solving, this Article draws upon social problem-solving theory to identify abilities necessary for autonomous decisionmaking. The Article develops …

Military Commissions Revived: Persisting Problems Of Perception, Devon Chaffee
Military Commissions Revived: Persisting Problems Of Perception, Devon Chaffee
The University of New Hampshire Law Review
[Excerpt] “When the first military commission proceedings began in July 2004, the Bush Administration identified fifteen Guantanamo Bay detainees subject to the military commissions. Subsequently, Bush Administration officials asserted that they had evidence to move forward with between sixty and eighty cases within the commission system. But, by the time President George W. Bush left office in early 2009, the commissions had resolved only three cases.
Upon taking office, President Barack Obama initially suspended the military commission proceedings in the thirteen cases in which charges were pending, but, in May 2009, he announced his intention to move forward with some …
Introducing The China Jurist Series, Timothy Webster
Introducing The China Jurist Series, Timothy Webster
Washington International Law Journal
The China Jurist Series aims to ease part of this inequity by introducing leading law scholars from China to an Anglophone audience. Each year, in consultation with the editors of the Pacific Rim Law & Policy Journal, I will translate an article or a book chapter from a leading Chinese law scholar. In particular, the translated piece will highlight major breakthroughs, concerns, developments, setbacks or otherwise notable features of contemporary Chinese law.
The Defense Of Marriage Act And Uncategorical Federalism, David B. Cruz
The Defense Of Marriage Act And Uncategorical Federalism, David B. Cruz
William & Mary Bill of Rights Journal
This Essay addresses federalism objections to section 3 of the Defense of Marriage Act (DOMA). Ordinarily, the federal government accepts states’ determinations of what couples are validly married. Section 3 of DOMA, however, fashions a broad exception for same-sex couples, who are definitionally deemed not to be in “marriages.” In addition to equal protection and full faith and credit challenges to DOMA, litigants have made constitutional federalism arguments. In Massachusetts v. United
States Department of Health and Human Services, the federal trial court accepted one such argument, though in a form that might be read to categorically deny the federal …

The Socioeconomic Achievement Gap In Mathematics, Adam Meador
The Socioeconomic Achievement Gap In Mathematics, Adam Meador
Dissertations
Currently in the United States a gap exists in the education of high and low socio-economic students. There is an education available for the socioeconomically challenged and a different system of education for those who live in a higher socioeconomic status. The purpose of this study was to explore the achievement gap in mathematics for elementary students. Specifically, the gap between the students’ scores who attended a school with a free and reduced price meal percentage below 25% and students’ scores who attended a school with a free and reduced price meal percentage above 75% was explored. Additionally, the focus …
Guantanamo And Beyond: Reflections On The Past, Present, And Future Of Preventive Detention, Kristine A. Huskey
Guantanamo And Beyond: Reflections On The Past, Present, And Future Of Preventive Detention, Kristine A. Huskey
The University of New Hampshire Law Review
[Excerpt] “January 11, 2011 began the tenth year of existence of the detention center at the U.S. Naval Base at Guantanamo Bay, Cuba (“Guantanamo” or “GTMO”). In human-being terms, what this means is that large numbers of men have been detained by the U.S. military for almost a decade, in prison-like conditions, without trial. In a pre-9/11 world, a “Guantanamo” and the idea of “detention without trial” would have been seen as decidedly un-American and a violation of our democratic values. Over the last decade, however, Guantanamo” and the practice of long-term detention without trial for terrorism suspects (or, “preventive …

Race And The Local Politics Of Punishment In The New World Of Welfare, Richard C. Fording, Joe Soss, Sanford F. Schram
Race And The Local Politics Of Punishment In The New World Of Welfare, Richard C. Fording, Joe Soss, Sanford F. Schram
Graduate School of Social Work and Social Research Faculty Research and Scholarship
To illuminate how race affects the usage of punitive tools in policy implementation settings, we analyze sanctions imposed for noncompliant client behavior under welfare reform. Drawing on a model of racial classification and policy choice, we test four hypotheses regarding client race, local context, and sanctioning. Based on longitudinal and cross-sectional multilevel analyses of individual-level administrative data, we find that race plays a significant role in shaping sanction implementation. Its effects, however, are highly contingent on client characteristics, local political contexts, and the degree to which state governments devolve policy control to local officials.
