Work, Caregiving, And Masculinities, Ann C. Mcginley Apr 2011

Work, Caregiving, And Masculinities, Ann C. Mcginley

Scholarly Works

In her book Reshaping the Work-Family Debate, Joan Williams demonstrates the vulnerability of parent workers in working class America. In Chapter 2, "One Sick Child Away from Being Fired," she examines the records of ninety-nine union arbitrations to analyze the problems of working class parents who struggle to juggle their working and parenting responsibilities. Because this chapter is a tour de force in an overall excellent book, and because it suggests an area that Professor McGinley's research has focused on over the past number of years, in this Essay, Professor McGinley limits her discussion almost exclusively to this chapter. …

Teens, Technology, And Cyberstalking: The Domestic Violence Wave Of The Future?, Andrew King-Ries Apr 2011

Teens, Technology, And Cyberstalking: The Domestic Violence Wave Of The Future?, Andrew King-Ries

Faculty Law Review Articles

The American criminal justice system, (therefore), is facing a future domestic violence crisis. Unfortunately, authorities-both parents and law enforcement-tend to minimize the seriousness of violence within adolescent relationships and to minimize the seriousness of stalking. In addition, given the prevalence and embrace of technology by teenagers, criminalizing "normal" teenage behavior seems counter-productive. While an effective criminal justice system response to this problem has yet to be developed, the first step will be for parents and law enforcement to recognize the risk and take it seriously. The second step will be to "renorm" unhealthy teenage relationship norms. It is possible that …

Burying Our Heads In The Sand: Lack Of Knowledge, Knowledge Avoidance And The Persistent Problem Of Campus Peer Sexual Violence, Nancy Chi Cantalupo Apr 2011

Burying Our Heads In The Sand: Lack Of Knowledge, Knowledge Avoidance And The Persistent Problem Of Campus Peer Sexual Violence, Nancy Chi Cantalupo

Georgetown Law Faculty Publications and Other Works

This article discusses why two laws that seek to prevent and end sexual violence between students on college campuses, Title IX of the Educational Amendments of 1972 ("Title IX") and the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act ("Clery Act"), are failing to fulfill that goal and how these legal regimes can be improved to reach this goal. It explicates how Title IX and the Clery Act ignore or exacerbate a series of "information problems" that create incentives for schools to "bury their heads in the sand" with regard to campus peer sexual violence. These …

From Victim To Abuser An Analysis Of Child Sex Offenders, Ava M. Adinolfi Apr 2011

From Victim To Abuser An Analysis Of Child Sex Offenders, Ava M. Adinolfi

Sociology & Criminal Justice Theses & Dissertations

The purpose of this study is to identify potential risk factors for becoming a child sex offender, more specifically for sexually offending against a girl versus a boy victim. The 2004 Survey of Inmates in State Correctional Facilities was used for this study. Data were drawn from 11,569 one-hour computer assisted interviews with male inmates.

The results from this study confirm one of the two hypotheses set out in this research. Compared to rapists and female object sex offenders, boy object sex offenders were more likely to report a history of sexual abuse prior to age 18. The etiological factors …

Predictors Of Pre-Dispositional Juvenile Detention: Race Gender And Intersectionality, Jennifer Lee Gebler Apr 2011

Predictors Of Pre-Dispositional Juvenile Detention: Race Gender And Intersectionality, Jennifer Lee Gebler

Sociology & Criminal Justice Theses & Dissertations

This research examines disproportionate minority contact (DMC) in a court service unit (CSU) in Virginia which has been implementing the Juvenile Detention Alternatives Initiative (JDAI) program since 2005. Using three years of intake data, the study also explores the impact of race and gender on the likelihood of receiving pre-dispositional secure detention. Finally, using intersectionality theory, the study analyzes the joint impact of being non-white and female on the pre-dispositional detention outcome. In this CSU, non-whites were found to be overrepresented in secure detention indicating the presence of DMC. In the multivariate model, race was not found to be a …

Purple Haze, Clare Huntington

Michigan Law Review

It takes only a glance at the headlines every political season-with battles over issues ranging from abortion and abstinence-only education to same-sex marriage and single parenthood-to see that the culture wars have become a fixed feature of the American political landscape. The real puzzle is why these divides continue to resonate so powerfully. In Red Families v. Blue Families: Legal Polarization and the Creation of Culture, Naomi Cahn and June Carbone offer an ambitious addition to our understanding of this puzzle, illustrating pointedly why it is so hard to talk across the political divide. In a telling anecdote in the …

Home Is Where The Crime Is, I. Bennett Capers Apr 2011

Home Is Where The Crime Is, I. Bennett Capers

Michigan Law Review

Think of home. Go on. Maybe not your parents' home, which for this reviewer would be enough to induce heavy breathing and general anxiety. Rather, think about the concept of home. Think about the idea of home. Think about Home with a capital letter. Think of home as in The Wizard of Oz and Dorothy's famous "There's no place like home." Think "home sweet home." Or "home is where the heart is." Go on. Of course, there may be other associations that come to mind when one thinks of home. There's security. Safety. Control. Home rule. After all, in the …

Intimate Partner Violence In Rural Areas, Amanda J. Dudgeon Apr 2011

Intimate Partner Violence In Rural Areas, Amanda J. Dudgeon

Theses and Dissertations

Intimate partner violence is a major health care issue in the United States, affecting millions of women annually. The incidence and prevalence of intimate partner violence is essentially the same in rural areas as compared to non-rural; however, rural survivors are faced with barriers in obtaining help and services that non-rural survivors are not. Multiple mental and physical health problems are associated with intimate partner violence and billions of health care dollars are spent annually due to abuse. Nurses need to understand the problem of intimate partner violence and routinely screen all women for abuse. This article describes the unique …

Conviction, Confrontation, And Crawford: Gang Expert Testimony As Testimonial Hearsay, Hon. Jack Nevin

Seattle University Law Review

This Article will discuss how gang expert reliance on testimonial hearsay violates Crawford. Both the spirit and letter of Crawford are violated when the information relied on by law enforcement has not passed the “crucible” of pretrial cross-examination mandated by Crawford to assure reliability. Moreover, this Article will offer a way to reconcile ER 703 with the requirements of Crawford.

Part II of this Article will discuss the history and application of Crawford and its expansion into virtually every area of testimonial hearsay. Part III will discuss the evolving and growing area of gang expert testimony as a …

Experience Of Supervision Scale: The Development Of An Instrument To Measure Child Welfare Workers' Experience Of Supervisory Behaviors, Mary Parente Mar 2011

Experience Of Supervision Scale: The Development Of An Instrument To Measure Child Welfare Workers' Experience Of Supervisory Behaviors, Mary Parente

Theses and Dissertations

The purpose of this study was to develop and test the Experience of Supervision Scale, which measures the experience of supervisory behaviors from the perspective of child welfare workers. Child welfare supervision is gaining increased attention as states struggle to improve performance measures of their child welfare systems. However, the lack of a standardized instrument which measures supervision through an analysis of supervisory behaviors from the supervisee’s perspective has hindered efforts in these areas. The Experience of Supervision Scale is based on Kadushin’s three function casework supervision model of supervision (administrative, educational, and supportive) which was chosen as the theoretical …
