The Origins Of Back-End Sentencing In California: A Dispatch From The Archives, Sara Mayeux
The Origins Of Back-End Sentencing In California: A Dispatch From The Archives, Sara Mayeux
Vanderbilt Law School Faculty Publications
In recent years, policy analysts have generated a small body of literature about the practice of "back-end sentencing," observing that California uses parole revocation in lieu of criminal prosecution for a surprisingly high number of cases, including many that would otherwise be considered serious crimes. Some of these offenders may be getting away with far shorter sentences than if their conduct were prosecuted criminally. Surely others are being railroaded into serving time for charges of which they could never be convicted beyond a reasonable doubt. And many are being cycled in and out of prison on fairly minor violations for …

The Police Gamesmanship Dilemma, Mary D. Fan
The Police Gamesmanship Dilemma, Mary D. Fan
Articles
Police gamesmanship poses a recurring regulatory challenge for constitutional criminal procedure, leading to zigzags and murky zones in the law such as the recent rule shifts regarding searches incident to arrest and interrogation. Police gamesmanship in the “competitive enterprise of ferreting out crime” involves tactics that press on blind spots, blurry regions or gaps in rules and remedies, undermining the purpose of the protections. Currently, courts generally avoid peering into the Pandora’s Box of police stratagems unless the circumvention of a protection becomes too obvious to ignore and requires a stopgap rule-patch that further complicates the maze of criminal procedure. …

The Mirror Of Laughter: Mediation, Self-Reflection, And Healing In E.T.A. Hoffmann's Princess Brambilla, Alexander M. Schlutz
The Mirror Of Laughter: Mediation, Self-Reflection, And Healing In E.T.A. Hoffmann's Princess Brambilla, Alexander M. Schlutz
Publications and Research
E.T.A. Hoffmann’s capriccio Princess Brambilla explores a narrative realm of liminality and metamorphosis that reveals the fundamental instability of our most basic epistemological distinctions. Set during the irreverent days of the Roman carnival, Brambilla delights in a disorienting chaos of masks, costumes, dream images and hallucinations as Hoffmann pulls all the stops in a fantastical narrative of extraordinary complexity. The text unfolds a carnivalesque universe that – in the spirit of Early German Romantic irony – plays with the inescapable mediatory “distortions” brought about by the structures of human consciousness itself. Just as the carnival is a ritual of life-affirming …

In July 2008, the State of Oregon implemented SB 1080, legislation that required all applicants for an Oregon Driver License or ID card to present proof of legal presence in the United States. In 2007, some 140,000 unauthorized immigrants were estimated to be living in Oregon, more than two-thirds of whom were estimated to be members of the labor force. Approximately 97% of Oregon’s unauthorized immigrants are thought to be Latino, nearly all of Mexican origin. This report includes a discussion of the social science findings on the situation of undocumented workers in the U.S and what is known about …
Legal Experiences Of Women Survivors Of Domestic Violence: A Need For Policies That Address The Justice Gap, Kimberly Ann Puhala
Legal Experiences Of Women Survivors Of Domestic Violence: A Need For Policies That Address The Justice Gap, Kimberly Ann Puhala
Graduate Doctoral Dissertations
The problems associated with the civil legal system for women who have experienced domestic violence have been persistent over time and still exist today. The current sociopolitical context in this state frames access to civil legal services either through a means-tested (and underfunded) program (Civil Legal Assistance) or as a privately purchased market service. This leaves a limited amount of low- or no-cost alternatives, which creates a gap in services for those women whose income is too high to qualify for Civil Legal Assistance programs, yet too low to afford to hire a private attorney. This study examines this two-tiered …
Deportation Is Different, Peter L. Markowitz
Deportation Is Different, Peter L. Markowitz
Articles
Over one hundred years ago, the Supreme Court emphatically declared that deportation proceedings are civil, not criminal, in nature. As a result, none of the nearly 400,000 individuals who were deported last year enjoyed any of the constitutional protections afforded to criminal defendants under the Sixth or Eighth Amendments. Among those 400,000 were numerous detained juveniles and mentally ill individuals who, as a result of the civil designation, were forced to navigate the labyrinth of immigration law alone, without appointed counsel. Others were lawul permanent residents who had pled guilty to minor offenses upon the correct advice of counsel that …

Understanding Issues In Cloud Forensics: Two Hypothetical Case Studies, Josiah Dykstra, Alan T. Sherman
Understanding Issues In Cloud Forensics: Two Hypothetical Case Studies, Josiah Dykstra, Alan T. Sherman
Annual ADFSL Conference on Digital Forensics, Security and Law
The inevitable vulnerabilities and criminal targeting of cloud environments demand an understanding of how digital forensic investigations of the cloud can be accomplished. We present two hypothetical case studies of cloud crimes; child pornography being hosted in the cloud, and a compromised cloudbased website. Our cases highlight shortcomings of current forensic practices and laws. We describe significant challenges with cloud forensics, including forensic acquisition, evidence preservation and chain of custody, and open problems for continued research.

A Practitioners Guide To The Forensic Investigation Of Xbox 360 Gaming Consoles, Ashley L. Podhradsky, Rob D’Ovidio, Cindy Casey
Annual ADFSL Conference on Digital Forensics, Security and Law
Given the ubiquitous nature of computing, individuals now have nearly 24-7 access to the internet. People are not just going online through traditional means with a PC anymore, they are now frequently using nontraditional devices such as cell phones, smart phones, and gaming consoles. Given the increased use of gaming consoles for online access, there is also an increased use of gaming consoles to commit criminal activity. The digital forensic community has been tasked with creating new approaches for forensically analyzing gaming consoles. In this research paper the authors demonstrate different tools, both commercial and open source, available to forensically …

Digital Forensics And The Law, Karon N. Murff, Hugh E. Gardenier, Martha L. Gardenier
Annual ADFSL Conference on Digital Forensics, Security and Law
As computers and digital devices become more entrenched in our way of life, they become tools for both good and nefarious purposes. When the digital world collides with the legal world, a vast chasm is created. This paper will reflect how the legal community is failing to meet its obligation to provide adequate representation due to a lack of education about digital (computer) forensics. Whether in a civil litigation setting or a criminal setting, attorneys, prosecutors and judges have inadequate knowledge when it comes to the important questions they need to ask regarding digital evidence. Reliance on expert witnesses is …

The Fight For Public Higher Education In Staten Island: The Saga Of The College Of Staten Island, Mark Rivera
Publications and Research
The College of Staten Island has a unique history as part of the City University of New York (CUNY). The formation of the College of Staten Island coincides in many ways with the development of the borough of Staten Island and its struggle for acknowledge in the greater New York City. The article discusses how the institution was an outcome of compromise, conflict, politics, and desperation. The story begins with the development of the Richmond County/the Borough of Staten Island, the fight for New York City's first public community college, the establishment of New York City's first Upper Division Undergraduate …

Are All Immigrants Criminals? Societal Perceptions Across Select Social Groups, Catherine F. Tindall
Are All Immigrants Criminals? Societal Perceptions Across Select Social Groups, Catherine F. Tindall
Theses and Dissertations
This study explores the perceptions toward immigrant criminality in Utah of four distinct social groups: state legislators, immigrants, law enforcement personnel, and incarcerated immigrants. Each group was examined separately and found to have a variety of perceptions among their members. Themes emerged that provided insight into the overlap and complexity of these differences across social groups. Legislators appeared the most dichotomous: some believed immigration and crime to be positively correlated, especially for undocumented immigrants, while others perceived no such connection. Among immigrants, perceptions were extremely diverse, but generally represented by reference to an unsubstantiated stereotype that immigrants committed crime at …
