The Justification Of Positive Law In Plato, Brenner M. Fissell Jan 2011

The Justification Of Positive Law In Plato, Brenner M. Fissell

Hofstra Law Faculty Scholarship

This article argues that Platonic legal philosophy views positive law as justified only because of the problems inherent in human nature, and not, contra natural law thinkers, because of its rationality.

From Brown To Bakke: Race Change And The Birmingham City Schools, 1963-1983, Johnmark Allen Edwards

All ETDs from UAB

When in 1954 the US Supreme Court declared that "separate but equal" was inherently not equal, every segregated school system in America was supposed to desegregate. This was easier said than done, and more successful in some systems than others. Here is a case study of that episode in American history focused on Birmingham, Alabama. This city's tumultuous road to educational desegregation unfolded in four phases: non-compliance (1954-1963), incremental desegregation (1963-1967), "freedom of choice" (1967-1970) and zoned integration (1970-1983). In this context, the thesis has three objectives: first, to explore how people of Birmingham - black and white, male and …

The Effect Of Optimism On The Relationship Between Religiosity And Spirituality Among Elderly Christians, Matthew West Jan 2011

The Effect Of Optimism On The Relationship Between Religiosity And Spirituality Among Elderly Christians, Matthew West

All ETDs from UAB

Older Americans represent one of the most devout groups of religious people in America, yet research is consistently scarce on how to use this characteristic in mental health interventions. This study uses Ordinary Least Squares regression of a 2004, national sample of older Christian Americans to assess the relationship between private prayer, church attendance, prayer group participation, religious meaning, optimism, and depressive symptomology. Previous work has found a strong positive relationship between religion and health outcomes. The present endeavor goes beyond examining the main effects of such relationships to look at a possible moderating mechanism--optimism. Controlling for demographic variables and …

Gender, Race, Power And Condom-Use: Understanding Relationship Power And Condom-Use Among Young Heterosexually-Active Adults, Tara L. Jones

All ETDs from UAB

GENDER, RACE, POWER AND CONDOM-USE: UNDERSTANDING RELATIONSHIP POWER AND CONDOM-USE AMONG YOUNG HETEROSEXUALLY-ACTIVE ADULTS HIV/AIDS continues to be a significant public health threat among heterosexual-ly-active females in the United States, particularly among Black females. Rates of HIV infection among heterosexually-active, non-injection drug using females have been in-creasing since the 1990s. Previous research recommends the need to consider the gen-dered and cultural context within which these infections are occurring. This research re-sponds to these recommendations by using Connell's (1987) theory of gender and power as a theoretical guide to test the following research questions: 1. Does relationship power differ by sex …

Explaining Racial Differences In Mci Classification In The Active Sample, Bridgett Hill Kennedy

All ETDs from UAB

Mild cognitive impairment (MCI) is 2 to 5 times more common than dementia and can be a predisposing marker for the development of dementia. African Americans are reported to be at an increased risk for developing MCI when compared to Caucasians. The purpose of the present study was to examine reasons for racial disparity in rates of MCI classification and, in particular, whether preservation of functional abilities over time occurs among African Americans so classified, suggesting possible misclassification. Level and quality of education and prevalence of vascular disease were examined as mediators of the racial disparity in MCI classification. Previously …

The present study aims to identify factors associated with physicians' prescribing of antiviral medications in the ambulatory care setting. The data utilized for this study were obtained from the National Ambulatory Medical Care Survey for each influenza season between the years of 2005-2008. …

The Graphic Novel: A Frontier Literary Form Edges Towards The English Classroom, Malgorzata Pflueger-Pieczynska Jan 2011

The Graphic Novel: A Frontier Literary Form Edges Towards The English Classroom, Malgorzata Pflueger-Pieczynska

All ETDs from UAB

Graphic novels, as not yet fully researched and examined forms under academia, suffer from their association in the public mind with the advertisement industry and cheap subject matter. This negative affiliation is especially popular in teachers' circles that use the graphic novel mostly as an instrument to improve reading skills rather than to present it as an extraordinary example of a frontier literary form. The graphic novel is one of many products that took off dynamically with the technological revolution using the visual as a communication's medium. Visual communication is not only one of the leading forms of passing information, …

Parental Influences On Late Adolescents' Autonomous Motivation And Sexual Risk Knowledge And Behavior, Bettina Hornbuckle Riley Jan 2011

Parental Influences On Late Adolescents' Autonomous Motivation And Sexual Risk Knowledge And Behavior, Bettina Hornbuckle Riley

All ETDs from UAB

Adolescent risky sexual behavior is associated with unprotected sex, unplanned pregnancy, abortion, and contraction of sexually transmitted diseases (STDs) such as chlamydia, syphilis, gonorrhea, and HIV/AIDS. During their time of transition to adulthood, late adolescents make decisions about their sexual health that may or may not be motivated by parental (mother and father) sexual risk communication and autonomy support. While the adolescent may be physically independent or semi-independent from his/her parents, parents continue to influence their adolescents through past and present endorsement of certain behaviors. This research examined how parent-sexual risk communication and parental autonomy support may individually and collectively …

Health Status And Health Behavior As Factors Predicting Online Health Seeking, Timothy Hale Jan 2011

Health Status And Health Behavior As Factors Predicting Online Health Seeking, Timothy Hale

All ETDs from UAB

The purpose of this dissertation is to examine why people use the Internet for health-related purposes and whether this usage is part of larger pattern of health-promoting behaviors, or health lifestyle. Pierre Bourdieu's concept of habitus provides the key theoretical concept that links health lifestyle theory and the digital inequality framework to explain how socioeconomic status and level of Internet access may contribute to status-specific attitudes and behaviors, or lifestyles. Two dependent variables are used to measure online health behavior: (1) online health information seeking, and (2) an index constructed from six types of online health-related activities. Path analysis is …

Rituals Of Resistance In Contemporary Latino Fiction: Queering Masculinity, Matrimony, And Motherhood In The Works Of Junot DãAz And Nicholasa Mohr, Ana Maria Santiago

All ETDs from UAB

This thesis examines the processes of gendering and sexing as seen in the short fiction of contemporary Latino authors Junot Díaz and Nicholasa Mohr, and focuses especially on how the ideological constructions of gender and sexuality, particularly those of machismo, maternity, and marriage, interact with notions of nationality, ethnicity, race, and class. The stories in Díaz's Drown and Mohr's Rituals of Survival and In Nueva York illuminate the mechanics of these ongoing, complex ideological processes, revealing the crucial role gendering and sexing play in forming and regulating a working-class, U.S. Latino body. The characters of these stories negotiate stark dichotomies …

Azerbaijan In The Eyes Of Polish Travellers And Exiles To The Caucasus, Ewa Siemieniec-Gołaś

Khazar Journal of Humanities and Social Sciences

In the mid nineteenth century quite a numerous group of Poles appeared in the Caucasus within its various regions, a territory which at that time was already almost totally within Russian possession. The reason for the appearance of Poles in the Caucasus was of a political nature, since at that time Poland did not exist as a country, but was divided between three empires – Austria, Russia and Prussia. Some young Polish patriots from the part of Poland that had been incorporated into Russia, in fighting for independence, used to organize plots and riots against the tsarist regime. The consequence …

Islamic And Western Political Thought: Does History/ Archaeology Have Any Lessons?, Anthony Black

Khazar Journal of Humanities and Social Sciences

Revealed religions may be interpreted in different ways. But their original texts influence people over the ages. The West was also greatly influenced by ancient Greece and Rome. Today, Muslims have mostly accepted democracy but not yet equal rights for unbelievers. This remains an area of dispute.

The Once And Future Equal Protection Doctrine?, Mario L. Barnes, Erwin Chemerinsky Jan 2011

The Once And Future Equal Protection Doctrine?, Mario L. Barnes, Erwin Chemerinsky

Articles

This Essay is the third in a series of pieces assessing Equal Protection Doctrine and jurisprudence. Here, we endeavor to do two things: (1) to utilize constitutional structure, text, and history to interrogate the concept of equality protected under the Fourteenth Amendment; and (2) to critique the Supreme Court's present approach to adjudicating constitutional discrimination claims. With regard to the meaning of equality, we assert that if the text of the Reconstruction Amendments and the stated goals of Reconstruction are used to inform constitutional analysis, then equality should be understood as a substantive rather than formalist concept. Reconstruction, however, was …

Best Practices For Hiring And Retaining A Diverse Law Faculty, Kellye Y, Testy Jan 2011

Best Practices For Hiring And Retaining A Diverse Law Faculty, Kellye Y, Testy

Articles

As with all institutions, the history, character, identity, and accomplishments of each law school are the direct result of its people and their acts. For that simple reason, diversity is critical; it goes to the very core of what the institution is and what it does. With legal institutions, in particular, diversity plays a critical role in shaping the perception of the institution held by persons outside of it. In order for our system of law to function as the bedrock of our democratic society that it aims to be, legal institutions must be perceived as fair and just. If …

Post-Racial Proxies: Resurgent State And Local Anti-"Alien" Laws And Unity-Rebuilding Frames For Antidiscrimination Values, Mary D. Fan Jan 2011

Post-Racial Proxies: Resurgent State And Local Anti-"Alien" Laws And Unity-Rebuilding Frames For Antidiscrimination Values, Mary D. Fan

Articles

Though unauthorized migration into the United States has diminished substantially since 2007, anti-“illegal alien” state and local laws and furor are flaring again. While one of the biggest worries regarding such “anti-alien” laws is the risk of racialized harm, courts invalidating overreaching statutes are relying on structural or procedural grounds, such as preemption and due process doctrines. [PARA] This Article examines how these political and legal trends point to how proxies are used in a post-racial era to dance around race, in constructive, national unity-rebuilding as well as divisive, inflammatory ways. Anti-alien legislation is a proxy way to vent resurgent …

Doctoral Dissertations and Projects

This study examined the effects of the NXT Robotics curriculum on high school students' attitudes about science. A quasi-experimental research design was employed in the evaluation of the NXT Robotics class. The program was evaluated by comparing the attitudes and interests of 57 students who participated in the elective NXT Robotics class and not a science class, and 57 students who participated in a science class and not the elective NXT Robotics class. While a treatment group and a control group were compared, the groups were intact groups chosen out of convenience rather than through random assignment into the treatment …

Community Fact Sheet: Counting Nwa’S Homeless: Preliminary Results From The 2011 Homeless Census, Kevin Fitzpatrick

Homelessness

The 2011 point-in-time (PIT) homeless census in Northwest Arkansas is completed and the news, as expected, is not good. In the midst of the most significant economic downturn since the Great Depression, the number of homeless in Northwest Arkansas increased from an estimated 1,287 in 2009 to 2,001 (36%) in 2011. The rise is alarming but not surprising as service providers throughout the region report record numbers of persons being served.

Homelessness

On any given night, it is estimated that over 2,000 adults and youth are without their own place in Washington and Benton Counties. Results from the 2011 Northwest Arkansas Homeless Census of interviewed adults (n=437), revealed that 58 percent were male, 81 percent were White/Caucasian, and 64 percent unmarried. The median age was 40 years. While this demographic profile mirrors much of what was reported in the 2009 Northwest Arkansas Homeless Census, there are some shifts that have taken place worth noting.
