Due Process In Civil Commitments, Alexander Tsesis Jan 2011

Due Process In Civil Commitments, Alexander Tsesis

Washington and Lee Law Review

In one of its most controversial decisions to date, United States v. Comstock, the Roberts Court upheld a federal civil commitment statute requiring only an intermediate burden of proof. The statute provided for the postsentencing confinement of anyone proven by "clear and convincing evidence" to be mentally ill and dangerous. The law relied on a judicial standard established more than thirty years before. The majority in Comstock missed the opportunity to reassess the precedent in light of recent psychiatric studies indicating that the ambiguity of available diagnostic tools can lead to erroneous insanity assessments and mistaken evaluations about patients’ likelihood …

Contextual Influences On Faith Development In Adolescents And Emerging Adults, Katheryn A. Barker Jan 2011

Contextual Influences On Faith Development In Adolescents And Emerging Adults, Katheryn A. Barker

LSU Master's Theses

Recent research has revealed that high religiosity is associated with positive life outcomes in adolescents and emerging adults. However, the mechanisms and processes that underscore faith development, which is crucial to experiencing these outcomes, are not well understood. Furthermore, most research on faith development in adolescents and emerging adults is based on quantitative data and fails to examine the influence of developmental contexts on faith development. To address this, a racially diverse New England sample of 30 highly religious Christian, Jewish, New World faiths, and Muslim families were interviewed regarding their faith and family life. Focusing specifically on the faith …

Building Healthy Relationships In A Multi-Ethnic Congregation With No Ethnic Majority: A Case Study Of Sunrise Church, Arturo Lucero, Robert Weaver Jan 2011

Building Healthy Relationships In A Multi-Ethnic Congregation With No Ethnic Majority: A Case Study Of Sunrise Church, Arturo Lucero, Robert Weaver

Great Commission Research Journal

Friendship development is the key to the integration of members in multiethnic churches. Research has shown that in small congregations with an ethnic majority, those belonging to minorities experience high personal costs, thereby increasing the rate of turnover of fringe minorities. Our study focuses on the friendship development between ethnic groups in a mega-church with no ethnic majority. The conclusion is that the same social dynamics that produce homogeneity in non-religious volunteer organizations occur in a local church with no ethnic majority. In other words, people demonstrated a tendency of being with their own kind.

An Exploration Of The Accreditation Self-Study Process From The Perspectives Of Organizational Effectiveness, Troy Lee Roland Jan 2011

An Exploration Of The Accreditation Self-Study Process From The Perspectives Of Organizational Effectiveness, Troy Lee Roland

Theses and Dissertations

A total of 22 sanctions were issued in 2009 for noncompliance of the accreditation standards by the Junior College Division of the Western Association of Schools and Colleges (WASC). The most common reason for these sanctions is not conducting program reviews. Another major cause is for not integrating organizational planning or using assessment results, and not correcting institutional deficiencies with governing boards. Yet, despite these warnings, many institutions continue to receive such sanctions. Models for organizational effectiveness could help institutions of higher education prepare for and become compliant with accreditation standards. This case study involved the development of an assessment …

Enhancing Cognitive Behavioral Therapy For Childhood Anxiety Disorders: A Parent Manual, Anna L. Lock Jan 2011

Enhancing Cognitive Behavioral Therapy For Childhood Anxiety Disorders: A Parent Manual, Anna L. Lock

Theses and Dissertations

Anxiety disorders are among the most common psychiatric disorders affecting children and adolescents. In the past several decades, great advances have been made in the treatment of these disorders. While many psychopharmacological and psychotherapeutic treatments exist, Cognitive Behavioral Therapy (CBT) is currently the treatment approach with the most empirical support. Based on a large evidence-base, several CBT manuals have been developed for the treatment of anxiety disorders in children. While research on incorporating parents into these treatments is mixed, parent involvement is widely recommended in these treatments as well as in unmanualized CBT treatment. Although some self-help books and manual-specific …

A Systemic Perspective Of Stress In Emergency Medical Personnel: Emergency Medical Technicians And Firefighters, Rob W. Wennerberg Jan 2011

A Systemic Perspective Of Stress In Emergency Medical Personnel: Emergency Medical Technicians And Firefighters, Rob W. Wennerberg

Theses and Dissertations

Emergency medical personnel (firefighters and ambulance personnel) have higher levels of lifetime PTSD symptoms than the general population. Historically this has been attributed to the number of exposures to traumatic incidents, called the dose effect, but recent literature has suggested that there is a complex web of variables that affect an individual's experience of trauma. Through an interpretive review of the literature this dissertation takes the concepts supported by empirical research and organizes them into an integrated theoretical structure. With ecological psychology at the core, the integration uses Living Systems theory as a structure with which to organize and explore …

Partnerships between federal land management agencies and non-profit organizations have existed in various forms for decades, benefiting public lands in myriad ways. However, the consistent decline in agency budgets and available staffing dedicated to Wilderness stewardship have created a need for and subsequent boom of Wilderness stewardship -focused nonprofit organizations across the country. Previous literature addresses the elements of a successful partnership in a more generalized fashion, leaving a need for more empirical examination of the key components of a successful Wilderness stewardship partnership. Thirty semi-structured interviews were conducted with Wilderness stewardship nonprofit staff and staff from the Forest Service, …

Deconstructing Corporate Governance: Director Primacy Without Principle?, René Reich-Graefe Jan 2011

Deconstructing Corporate Governance: Director Primacy Without Principle?, René Reich-Graefe

Faculty Scholarship

If profit-maximizing is not enforced by corporate law, why does it nonetheless happen as a matter of almost overwhelming routine in today’s corporate reality? If indeed, director primacy is absolute and our theoretical models are all reliant on protolegal variables to explain general investor confidence ex-ante-investment despite the lack of director accountability ex-post-investment, then how can director primacy be understood and explained as a principled and, thus, just cor-porate governance structure in the first place? Or is director primacy not only absolute, but also without principle?

This Article provides a roadmap for purposes of answering this inquiry. Part II …

Young Consumer Protection In The “Millennial” Age, Eboni S. Nelson Jan 2011

Young Consumer Protection In The “Millennial” Age, Eboni S. Nelson

Utah Law Review

While many college-aged consumers may not be experiencing the detrimental consequences that can be associated with credit card debt, a significant number of them are. Several psychological and social factors may influence the thoughts and behaviors of those young consumers who find themselves at risk of experiencing indebtedness problems. Lawmakers did not fully consider and account for the possible influence of such factors when crafting the Act’s young consumer provisions. As the current CARD Act is not likely to significantly decrease the number of financially at risk college-aged cardholders or the amount of debt they incur, lawmakers should endeavor to …

The Procedure Of Election Law In Federal Courts, Joshua A. Douglas Jan 2011

The Procedure Of Election Law In Federal Courts, Joshua A. Douglas

Utah Law Review

The public is immensely interested in elections, never more so than when the race is close. Campaigns routinely ask the courts to construe the rules to each candidate’s advantage. Even outside the context of an actual election, federal courts decide numerous election law cases that have a profound influence on how elections are run, thus impacting the scope of our representative democracy. Whenever judges decide the constitutionality of an election provision or the reach of campaign finance limitations, the courts are shaping the meaning of political participation. But there has been little thought given to the processes by which courts …

Removing The Umpire’S Mask: The Propriety And Impact Of Judicial Apologies, Maxine D. Goodman Jan 2011

Removing The Umpire’S Mask: The Propriety And Impact Of Judicial Apologies, Maxine D. Goodman

Utah Law Review

One additional question this Article raises is why judicial conduct often warrants an apology. In other words, why do judges behave so badly? Researching judicial apologies for this Article presented a distressing view of judicial behavior—the degree and amount of rude and offensive behavior, illustrated by the examples shared previously, was both surprising and disheartening. Ideally, other commentators may take this Article and build on the ideas regarding the role of emotions in judging, which would include the emotions that motivate apologies.
