Beyond Individualism In Law And Economics, Robert B. Ahdieh Jan 2011

Beyond Individualism In Law And Economics, Robert B. Ahdieh

Faculty Scholarship

The study of law and economics was built upon two pillars. The first is the familiar assumption of individual rationality. The second, less familiar, is the principle of methodological individualism. Over the last twenty years, law and economics has largely internalized behavioral critiques of the rationality assumption. By contrast, the field has failed to appreciate the implications of growing challenges to its methodological individualism. Where social norms shape individual choices, network externalities are strong, coordination is the operative goal, or information is a substantial determinant of value, a methodology strongly oriented to the analysis of individuals overlooks at least as …

The Law And Economics Of Legal Parochialism, Nuno Garoupa Jan 2011

The Law And Economics Of Legal Parochialism, Nuno Garoupa

Faculty Scholarship

Law and economics is influential in U.S. legal scholarship, but not as much elsewhere. Different explanations have been suggested for this. In this Article, I argue that the problems faced by law and economics outside of the United States are neither particular to the field nor to the local context. I offer an interpretation based on the similarities between legal parochialism and trade protectionism. A tentative prediction is that globalization in legal markets might change the current patterns.

Republicanism And The Foundations Of Criminal Law, Richard Dagger Jan 2011

Republicanism And The Foundations Of Criminal Law, Richard Dagger

Political Science Faculty Publications

This chapter makes a case for the republican tradition in political philosophy as a theory that can provide a rational reconstruction of criminal law. It argues that republicanism offers a reconstruction of criminal law that is both rational and plausible. In particular, it shows that republicanism can help us to make sense of three important features of criminal law: first, the conviction that crime is a public wrong; second, the general pattern of development of criminal law historically; and third, the public nature of criminal law as a cooperative enterprise. To begin, however, it explains what republicanism is and why …

Beyond Belief: Prayer As Communication In Religious Information Seeking, David H. Michels Jan 2011

Beyond Belief: Prayer As Communication In Religious Information Seeking, David H. Michels

Articles, Book Chapters, & Popular Press

Prayer role in information seeking has been largely neglected in LIS research. I propose that respondents understood prayer as communication with God. I compared their descriptions of prayer to God with research on interpersonal communication for information seeking. Prayer, for these respondents, met both cognitive and affective information needs.

Race, Body, And Sexuality In Music Videos, Erika Vandyke Jan 2011

Race, Body, And Sexuality In Music Videos, Erika Vandyke

Honors Projects

Previous research has demonstrated that women are objectified and sexualized in music videos, and that Black characters are underrepresented in most genres. This content analysis addressed the question of whether the bodies and sexuality of women in music videos were portrayed differently based on their race. Music videos (n=47) were coded for women’s character roles, body size, and visual performances of sexuality, and for Black women’s Afrocentricity. Videos were also coded for specific ways women’s bodies were objectified or sexualized through camera shots and angles. Implications include the idea that Black women may internalize video messages about beauty …

The Effect Of Discrimination On Wage Differentials Between Asians And Whites In The United States: An Empirical Approach, Doug Dang Jan 2011

The Effect Of Discrimination On Wage Differentials Between Asians And Whites In The United States: An Empirical Approach, Doug Dang

Honors Projects

Econometric analysis of person-level data from the American Community Survey collected over a 5-year period from 2005-2009 so as to provide empirical evidence and measurable effect of race discrimination on wage differentials between Asian Americans and White Americans. Brief Methodology of research employed in the study involving analysis of explanatory variables to construct earnings models to gather estimates and draw implicative inferences. Utilization of decomposition of wage differentials of differences in education and experience with respect to annual income to identify proportion of effects attributable to endowments and estimated coefficients; as well as proportion of effect as a result of …

The Next Generation Of Greenwash: Diminishing Consumer Confusion Through A National Eco-Labeling Program , Jessica E. Fliegelman Jan 2011

The Next Generation Of Greenwash: Diminishing Consumer Confusion Through A National Eco-Labeling Program , Jessica E. Fliegelman

Fordham Urban Law Journal

Since the 1990's there has been a continuously growing movement among advertisers to appeal to consumers by touting how environmentally friendly their products are. This note addresses the prominence of misleading and deceptive environmental claims that have prompted appeals for improved federal regulation. Specifically, the Note focuses on the emerging trend of carbon advertising and national and international models that provide guidance on preventing deception. Part I conveys the current status of environmental advertising and the necessary background principles for establishing regulations. Part II details major criticisms of the current environmental advertising guidelines and proposed models for restructuring environmental advertising …

Review Of Organizing Schools For Improvement, Martin Scanlan Jan 2011

Review Of Organizing Schools For Improvement, Martin Scanlan

College of Education Faculty Research and Publications

What are the necessary and sufficient ingredients that lead to substantial improvement in student learning in urban schools? How do they work together? What happens if one of these necessary components is missing? Organizing Schools for Improvement (Bryk, Sebring, Allensworth, Luppescu, & Easton, 2009) is an ambitious work that both raises these big questions and addresses them with aplomb. As inequities in educational opportunities persist (Borman & Dowling, 2010), transforming education, particular public urban schooling, remains a vexing and urgent problem. In recent decades public discourse regarding addressing this has swelled, but policies promising transformation have proven ineffectual (Ravitch, 2010a, …

Treatment Effects For Common Outcomes Of Child Sexual Abuse: A Current Meta-Analysis, Emily Trask, Kate Walsh, David K. Dilillo Jan 2011

Treatment Effects For Common Outcomes Of Child Sexual Abuse: A Current Meta-Analysis, Emily Trask, Kate Walsh, David K. Dilillo

Department of Psychology: Faculty Publications

The present meta-analysis examined the effects of psychosocial treatments at reducing deleterious outcomes of sexual abuse. The meta-analysis included a total of 35 published and unpublished studies written in English, focusing on youth under the age of 18, and evaluating the effectiveness of treatments for the most common negative outcomes of sexual abuse: PTSD symptoms, externalizing problems, and internalizing problems. Results revealed medium effect sizes for PTSD symptoms, externalizing problems, and internalizing problems following treatment for sexual abuse. This study also examined the potential moderating effects of treatment (e.g., modality, duration, and inclusion of caregiver) and participant (e.g., age, gender, …

Prospective Changes In Attributions Of Self-Blame And Social Reactions To Women’S Disclosures Of Adult Sexual Assault, Cynthia J. Najdowski, Sarah E. Ullman Jan 2011

Prospective Changes In Attributions Of Self-Blame And Social Reactions To Women’S Disclosures Of Adult Sexual Assault, Cynthia J. Najdowski, Sarah E. Ullman

Psychology Faculty Scholarship

The present longitudinal study examined relations between self-blame attributions and social reactions to disclosure in a community sample of adult sexual assault victims (N = 555). Cross-lagged panel analyses showed that neither characterological self-blame nor behavioral self-blame related to negative social reactions over the 1-year follow-up period. In contrast, characterological but not behavioral self-blame predicted fewer positive reactions over time. Although positive reactions did not reduce self-blame, negative reactions led to greater characterological, but not behavioral, self-blame during the course of the study. Thus, relations between self-blame and social reactions were not reciprocal but rather quite complex. The effects …

The Nation And Its Heretics: ‘Muslim Citizenship’, State Power And Minority Rights In Pakistan, Sadia Saeed Jan 2011

The Nation And Its Heretics: ‘Muslim Citizenship’, State Power And Minority Rights In Pakistan, Sadia Saeed

Studio for Law and Culture

In 1984, Pakistan’s military ruler General Zia-ul-Haq passed an executive Ordinance that made it a criminal offence for members of the heterodox Ahmadiyya community, a self-defined minority sect of Islam, to refer to themselves as Muslims and practice Islam in public. Ahmadis challenged the 1984 Ordinance in both the Supreme Court and the Federal Shariat Court in Pakistan – in the former on that grounds that the Ordinance violated their constitutionally guaranteed right to freedom of religion and in the latter on the grounds that it violated shari’a. In a clear departure from the Pakistani courts’ earlier rulings on the …

“Corporation Law Is Dead”: The Mystery Of Corporation Law At The Height Of The American Century, Harwell Wells Jan 2011

“Corporation Law Is Dead”: The Mystery Of Corporation Law At The Height Of The American Century, Harwell Wells

Studio for Law and Culture

In 1962, the corporation law scholar Bayless Manning famously wrote that “[C]orporation law, as a field of intellectual effort, is dead in the United States.” Looking back, most scholars have agreed with Manning, concluding that corporation law from the 1940s to the 1970s was stagnant, only rescued from its doldrums by the triumph of the theory of the firm and modern finance in the 1980s. This paper takes a new look at American corporate law during this time, asking why scholars believed corporation law was “dead” at the same time that the American corporation had seized the commanding heights of …

The Bottom Line: Accounting For Revenues And Expenditures In Intercollegiate Athletics, Victor Matheson, Debra J. O'Connor, Joseph H. Herberger Jan 2011

The Bottom Line: Accounting For Revenues And Expenditures In Intercollegiate Athletics, Victor Matheson, Debra J. O'Connor, Joseph H. Herberger

Economics Department Working Papers

This paper examines the profitability of Division I athletic programs at colleges and universities in the United States under a variety of accounting definitions of profit. The data identify several broad themes. First, a majority of athletic departments rely heavily on direct and indirect subsidization of their programs by the student body, the institution itself, and state governments in order to balance their books. Without such funding, less than a third of BCS athletic departments and no non-BCS departments are in the black. Second, athletic programs rely heavily on contributions to balance their books. Donations to athletic departments may serve …

Feminism, Neoliberalism, And Social Studies, Mardi Schmeichel Jan 2011

Feminism, Neoliberalism, And Social Studies, Mardi Schmeichel

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The purpose of this article is to analyze the sparse presence of women in social studies education and to consider the possibility of a confluence of feminism and neoliberalism within the most widely distributed National Council for the Social Studies (NCSS) publication, Social Education. Using poststructural conceptions of discourse, the author applies second-wave feminist theory and Fraser’s (2009) work on neoliberalism as lenses to illuminate the limited attention to women and feminism in this text during the 1980s in order to better understand how women have been marginalized in social studies education and to consider the possibility that the …

Schooling And The Everyday Ruptures Transnational Children Encounter In The United States And Mexico, Edmund T. Hamann, Víctor Zúñiga Jan 2011

Schooling And The Everyday Ruptures Transnational Children Encounter In The United States And Mexico, Edmund T. Hamann, Víctor Zúñiga

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Using examples of students in Mexico who used to attend US schools and examples from Georgia of students who used to and might again attend Mexican schools, this chapter considers how an unremarkable, quotidian activity—the act of attending school—can become means for transnationally mobile children to experience shock, disconnection, and a reiterated sense of dislocation if schools are incompletely responsive to learners' biographies.

Gaps And Strengths In Us Policies On Infant And Young Child Feeding: An Analysis Based On The Global Strategy On Infant And Young Child Feeding, Linda J. Smith

Master of Public Health Program Student Publications

This research project reviews the evidence on the significance of infant and young child feeding to public health goals, analyzes US policy documents in relationship to the Global Strategy using the World Breastfeeding Trends Initiative (WBTi) to quantify the findings into a national score, and then summarizes the gaps and strengths in US policies and makes recommendations. Using the WBTi scoring system, strengths for the US exist in national policy, Baby-Friendly Hospital Initiative, monitoring and evaluation, and complementary feeding. Mother support and community outreach, information and support were moderate. Gaps exist in policies on infant feeding in emergencies and for …
