Part-Time Faculty In Higher Education: A Selected Annotated Bibliography, Robert Pankin, Carla Weiss Oct 2011

Part-Time Faculty In Higher Education: A Selected Annotated Bibliography, Robert Pankin, Carla Weiss

Sociology & Anthropology Faculty Publications

At this writing (Fall 2011), two-thirds of the faculty in higher education are contingent part-time or full-time. Only one-third of the faculty is tenured or on the tenure-track. This selected, annotated bibliography is organized by year of publication, from 1977 to 2010. (An earlier version was published in 2008.) It is the purpose of this publication to facilitate understanding of the meaning and implications of this major change in the structure of higher education. The annotations in the bibliography were written from the perspective of a part-time faculty member, unlike most of the literature, which is written from a management …

Saving Seaborn: Ownership Not Marriage As The Basis Of Family Taxation, Dennis J. Ventry Jr Oct 2011

Saving Seaborn: Ownership Not Marriage As The Basis Of Family Taxation, Dennis J. Ventry Jr

Indiana Law Journal

One of the most famous Supreme Court tax cases celebrated its eightieth birthday last year. In Poe v. Seaborn, the Court reified two principles of the federal income tax: ownership determines tax liability and state law determines ownership. This Article affirms that family taxation continues to follow ownership, not marriage, despite the federal government’s position that the “ownership equals taxability” rule applies almost exclusively to heterosexual spouses. Verifying the vitality of this principle carries significant implications for all families, particularly nontraditional families. Under the aegis of Seaborn, the principle authorizes certain members of state-recognized relationships—marriages, domestic partnerships, civil unions—to file …

The Financial Crisis: Irrational Exuberance Or Institutional Rationality?, Samuel E. Enajero Oct 2011

The Financial Crisis: Irrational Exuberance Or Institutional Rationality?, Samuel E. Enajero

Mountain Plains Journal of Business and Technology

"The last financial crisis could have been caused by rational and irrational exuberance. (That is, overreaction by agents to both good and poor signals in the financial markets). The problem is further exacerbated by institutional rationality. Rule following is one mode of behavior in dual-mode institutional rationality (Redmond 2004; Verstegen 2006). Rule-following behaviors hamper agents’ abilities to adapt to new circumstances. It is shown that management structures where both upper-level and field managers exhibit purpose-seeking behaviors is necessary for corporations to overcome any type of economic and financial volatility. Ltl Pricing: Looking Back To The Future, C. Clifford Defee, Joe B. Hanna, Robert Overstreet

Journal of Transportation Management

Numerous LTL carriers struggled during the recent recession as customers demanded lower prices. This study is designed to qualitatively evaluate the data gathered from three industry segments regarding LTL pricing. Researchers used semi-structured interviews to conduct an in-depth investigation with over two dozen industry experts who represented shippers, carriers, and 3PLs. Interview transcripts were analyzed using a grounded theory coding technique. Five major themes emerged from the interview transcripts. These themes are used to describe possible future adjustments to industry pricing structure.

Regional Differences In Fan Preferences For Minor League Hockey: The Ahl, Rodney Paul, Robert Chatt Oct 2011

Regional Differences In Fan Preferences For Minor League Hockey: The Ahl, Rodney Paul, Robert Chatt

Falk College Research Center

Regional differences in fan preferences for minor league hockey in the United States are explored using simple linear regression models. The top-level minor league for the NHL, the American Hockey League (AHL), was studied for the 2008-09 season. Key attributes with respect to attendance are studied for hockey including population, income per capita, promotions, scoring, and winning percentage. In addition, a key socio-economic variable, fighting is also investigated. Major differences are found for fan preferences across geographic regions in relation to population, income per capita, a variety of promotions, and team success. In addition, fan reaction to fighting tends to …

Hip-Hop And Housing: Revisiting Culture, Urban Space, Power, And Law, Lisa T. Alexander Oct 2011

Hip-Hop And Housing: Revisiting Culture, Urban Space, Power, And Law, Lisa T. Alexander

Faculty Scholarship

U.S. housing law is finally receiving its due attention. Scholars and practitioners are focused primarily on the subprime mortgage and foreclosure crises. Yet the current recession has also resurrected the debate about the efficacy of place-based lawmaking. Place-based laws direct economic resources to low-income neighborhoods to help existing residents remain in place and to improve those areas. Law-and-economists and staunch integrationists attack place-based lawmaking on economic and social grounds. This Article examines the efficacy of place-based lawmaking through the underutilized prism of culture. Using a sociolegal approach, it develops a theory of cultural collective efficacy as a justification for place-based …

Librarians On The Move: Embedded Librarians, Linda Masselink, Anne Merkle Msl, Rita Kohrman

Presentations

Years ago, in the late 90’s when we had an official reference desk and students ambled their way into the library to ask for research assistance I thought it would be a good proactive idea to take the reference desk to students on their home turf in their residence hall, dining area and socializing entities. I thought, “ What better way to burst the illusion bubble that academic librarians were unhelpful, grouchy and untouchable.”

Same-Sex Marriage, Second-Class Citizenship, And Law's Social Meanings, Michael C. Dorf Oct 2011

Same-Sex Marriage, Second-Class Citizenship, And Law's Social Meanings, Michael C. Dorf

Cornell Law Faculty Publications

Government acts, statements, and symbols that carry the social meaning of second-class citizenship may, as a consequence of that fact, violate the Establishment Clause or the constitutional requirement of equal protection. Yet social meaning is often contested. Do laws permitting same-sex couples to form civil unions but not to enter into marriage convey the social meaning that gays and lesbians are second-class citizens? Do official displays of the Confederate battle flag unconstitutionally convey support for slavery and white supremacy? When public schools teach evolution but not creationism, do they show disrespect for creationists? Different audiences reach different conclusions about the …

Negotiating Tensions Across Organizational Boundaries: Communication And Refugee Resettlement Organizations, Sarah Steimel Oct 2011

Negotiating Tensions Across Organizational Boundaries: Communication And Refugee Resettlement Organizations, Sarah Steimel

Department of Communication Studies: Dissertations, Theses, and Student Research

Voluntary non-profit organizations play a critical role in mediating the transition of refugees into their new host communities in the United States. Furthermore, mediation is fundamentally a communicative phenomenon, as social services are provided in through communication between nonprofit workers and clients. Critically, for voluntary mediating organizations to create empowering spaces for refugees, communication is central. In this study, I emphasize the tensional processes inherent to mediating interactions and explore how refugee resettlement organizational staff members and refugee-clients describe and manage the communicative tensions which emerge when they interact with one another.

I conducted eighteen in-depth interviews with fifteen organizational …

Citation Advantage Of Open Access Legal Scholarship, James M. Donovan, Carol A. Watson

Law Faculty Scholarly Articles

In this study focusing on the impact of open access on legal scholarship, the authors examine open access articles from three journals at the University of Georgia School of Law and confirm that legal scholarship freely available via open access improves an article’s research impact. Open access legal scholarship—which today appears to account for almost half of the output of law faculties—can expect to receive fifty-eight percent more citations than non–open access writings of similar age from the same venue.

A Theory Of Brand Ww2, Jonathan M. Bullinger, Andrew J. Salvati Oct 2011

A Theory Of Brand Ww2, Jonathan M. Bullinger, Andrew J. Salvati

Reconstruction: Studies in Contemporary Culture

Myths about the Second World War, grounded within stores of knowledge, often act as narrative templates to be drawn upon by collective memory. These myths and memories are transformed and commodified in a reductive manner into a brand encompassing simplistic narratives, easily recognized visual signifiers (including logo, colors, and associated symbols), and emotional cues that connect with the audience. This posits a theory that what most individuals today interact with is not a fragment of memory related to World War Two but rather a reductive representation sold as BrandWW2.

It’S Not All Zeroes And Ones: Constructing Online Identity Assembly Theory, Adam W. Tyma, Lynette G. Leonard Oct 2011

It’S Not All Zeroes And Ones: Constructing Online Identity Assembly Theory, Adam W. Tyma, Lynette G. Leonard

Communication Faculty Proceedings & Presentations

The construction of online identity, though examined in other disciplines, has not yet been approached theoretically in the communication scholarship. Online identities cannot be understood as linear or static as some identity theory presents. Online identities need to be understood as continually changing representations, never fixed in one position, and perpetually in a state of assembly. Identity research within the communication literature has focused on specific characteristics of the medium (e.g., anonymity) and the effects of those characteristics on the outcomes of the communicative act rather than focusing on the communicative process of identity construction itself. In other words, past …

The Effects Of Exposure To Intimate Partner Violence On Children’S Development, Courtney A. Crittenden, Emily M. Wright, Abigail A. Fagan Oct 2011

The Effects Of Exposure To Intimate Partner Violence On Children’S Development, Courtney A. Crittenden, Emily M. Wright, Abigail A. Fagan

Criminology and Criminal Justice Faculty Publications

Previous research indicates that intimate partner violence (IPV) increases the likelihood of negative outcomes for children exposed to it, including the use of violence, drug use, and poor mental health. Yet this work often overlooks potential complexities in how IPV exposure may affect children’s development. For example, the impact of IPV may be felt immediately or develop over time; its effects may vary for boys and girls; and other life experiences may affect the extent to which exposure to IPV influences children’s outcomes. This article summarizes the main findings of a research project examining the degree to which exposure to …

The Civilization Approach To Education In The 21st Century, Andrew Targowski Oct 2011

The Civilization Approach To Education In The 21st Century, Andrew Targowski

Comparative Civilizations Review

This investigation presents the Civilization Development Curriculum that should impact almost every kind of higher education and particularly should be practiced in educating leaders of world societies. The justification for this plan comes from an historic perspective of education, the state of education at the dawn of the 21st century, and is a synthesis of learning for work and life, both individually and socially. The civilization approach to education is defined and an example of the civilization development curriculum is offered as well as an octopus strategy for its implementation.

Interpretation's Contrapuntal Pathways: Addams And The Averbuch Affair, Marilyn Fischer Oct 2011

Interpretation's Contrapuntal Pathways: Addams And The Averbuch Affair, Marilyn Fischer

Philosophy Faculty Publications

In March 1908 the Chicago Police Chief shot Lazarus Averbuch, a young, Russian Jewish immigrant, claiming self-defense against an anarchist plot. Jane Addams refused to join the public's outcry of support for their chief, declaring that she had the obligation to interpret rather than denounce the incident. Her analysis of Averbuch's killing, given in her essay, ““The Chicago Settlements and Social Unrest,”” provides a focal point for seeing how interpretation functions as a unifying theoretical category for Addams, bringing together her activism, her style of writing, and her philosophy of social change. Addams's conception of interpretation is multi-faceted and dynamic; …

Regulation For The Sake Of Appearance, Adam M. Samaha Oct 2011

Regulation For The Sake Of Appearance, Adam M. Samaha

Public Law and Legal Theory Working Papers

Appearance is often given as a justification for decisions, including government decisions, but the logic of appearance arguments is not well theorized. This Article develops a framework for understanding and evaluating appearance-based justifications for government decisions. First, working definitions are offered to distinguish appearance from reality. Next, certain relationships between appearance and reality are singled out for attention. Sometimes reality is insulated from appearance, sometimes appearance helps drive reality over time, and sometimes appearance and reality collapse from the outset. Finally, sets of normative questions are suggested based on the supposed relationship between appearance and reality for a given situation. …

Beginning To End Racial Profiling: Definitive Solutions To An Elusive Problem, Kami Chavis Simmons Oct 2011

Beginning To End Racial Profiling: Definitive Solutions To An Elusive Problem, Kami Chavis Simmons

Faculty Publications

Remedying an elusive practice such as racial profiling remains a challenging issue for the judiciary and reformers must rely on other avenues for a solution. For example, even where evidence demonstrates that minorities are disproportionately stopped and searched, courts rarely recognize the victim's claim or provide relief. Thus, it is clear that courts will not be the catalysts of change. This Article argues that while courts may be reluctant to provide judicial remedies, police departments themselves should not ignore [minorities'] perceptions [of racial discrimination] and should take measures to reduce any possible profiling and increase partnerships with communities. An indication …

A Qualitative Study Of The Use Of Content-Related Comics To Promote Student Participation In Mathematical Discourse In A Math I Support Class, Jeni M. Halimun Oct 2011

A Qualitative Study Of The Use Of Content-Related Comics To Promote Student Participation In Mathematical Discourse In A Math I Support Class, Jeni M. Halimun

Dissertations, Theses and Capstone Projects (Full IR Collection)

The purpose of this study is to contribute to existing research on classroom discourse by investigating whether a content-related comic that is closely linked to the learning task can stimulate mathematical discourse in a real high school classroom. To build a math-talk learning community and to analyze the effectiveness of content-related comics in eliciting student participation, I employed the combined theoretical frameworks consisting of a Hufferd-Ackles’ et al. (2004) math-talk learning community and Nathan and Knuth’s (2003) social and analytical scaffolding. The combined frameworks provided a multilevel analytical tool for studying classroom interactions. The results suggested that the content-related comic …

Cultural Intersections: White Teachers And Their Racial Minority Students, Jason Pritchett Oct 2011

Cultural Intersections: White Teachers And Their Racial Minority Students, Jason Pritchett

Dissertations, Theses and Capstone Projects (Full IR Collection)

Racial minority students in American public schools learn in environments that are antithetical to their cultural and familial backgrounds. Because the majority of the teacher workforce is comprised of white teachers, the institution of school places racial minority students at risk. These students drop out or are labeled as failures at alarming rates. This qualitative study explored the teaching behaviors of white veteran teachers through a design that mixed both multicase study and autoethnography. The data sources for this study included interviews, focus groups, teacher journals, and teacher-authored documents. The data in this study was member checked and peer reviewed …
