Yoga As Counternarrative: American Higher Education Rethinks Difference And Interdependency, Laura Douglass Jan 2011

Yoga As Counternarrative: American Higher Education Rethinks Difference And Interdependency, Laura Douglass

Journal of Pedagogy, Pluralism, and Practice

This article explores how the subject and practice of Yoga is emerging in American higher education as a counter-narrative, or alternative, to mainstream opinions and views. In democratic education, alternative views are important to fueling academic debate, but new views are also resisted. This article will explore the way in which Yoga is simultaneously embraced and resisted to show how counternarratives challenge a deeply pluralistic society. Examining the inclusion of Yoga in America’s higher education system asks us to critically question our assumptions of homogeneity and refashion knowledge in terms of interdependency and co-construction.

Whose Constitution Is It Anyway - The Executives' Discretion To Defend Initiatives Amending The California Constitution, Jeremy Zeitlin Jan 2011

Whose Constitution Is It Anyway - The Executives' Discretion To Defend Initiatives Amending The California Constitution, Jeremy Zeitlin

UC Law Constitutional Quarterly

The decision of then Governor Arnold Schwarzenegger and Attorney General Jerry Brown to refuse to appeal the United States District Court's findings in Perry v. Schwarzenegger, striking down Proposition 8 as unconsitutional, was a bare assertion of executive power. Although plainly contrary to the will of the majority of the electorate who implemented Proposition 8, the Governor and Attorney General's decision was lawful because it stemmed from the wide discretionary powers that the California Constitution and the Government Code grant to the state's executive officers. Instead, the only check to the particular manner executives wield their discretionary authority is the …

Father Andrew White, The Jesuit Order, And The Marketing Of Colonial Maryland, Angela Feres Jan 2011

Father Andrew White, The Jesuit Order, And The Marketing Of Colonial Maryland, Angela Feres

CGU Theses & Dissertations

Father Andrew White, a leading Jesuit and esteemed promoter of the Maryland colony, kept a journal of his voyage to Maryland, which was subsequently published as Relatio Iteneris in Marylandiam. White also composed Declaratio Coloniae Domini Baronis de Balltimore, a document that masterfully marketed the colonial venture to lay English Catholics. The Relatio is an engaging account of the voyage to and initial settlement of Maryland; the Declaratio is a promotional tract written to ensure the successful creation of the new colony. Together the documents promoted the enterprise to the Jesuit Order, but also provide valuable …

Spirituality And Expectations Of Care Providers Of Older Patients With Chronic Illnes In North Central Florida, Myra Sherman

Electronic Theses and Dissertations

A qualitative design was used to explore the use of spirituality and prayer by older adults who have chronic illness and reside in a rural community. Thirteen individuals responded to a flyer soliciting participation in a study of the use of spirituality as part of health care. Participants were at least 60 years of age, had at least one chronic illness and resided in North Central Florida. Twelve participants then responded to six open-ended questions based on an adaption of an instrument used by Dr. Shevon Harvey in her doctoral dissertation. The data was analyzed to identify themes and answer …

Regulating Religious Freedom In Africa, Rosalind I.J. Hackett Jan 2011

Regulating Religious Freedom In Africa, Rosalind I.J. Hackett

Emory International Law Review

In this Essay, using a wide-ranging set of examples, I wish to provide some background on the emergent discussion on limitations on religious freedom in Africa, especially how these relate to the current debates on family law that are the subject of this Symposium. My general objectives are (1) to consider the legitimate and illegitimate ways in which African state and non-state actors seek to regulate religious practice; (2) to examine how particular religious groups may be disproportionately affected by these measures; (3) to demonstrate how interference with manifestations of religion often leads to abuses of related rights and freedoms …

Religion, Family Law, And Recognition Of Identity In Nigeria, M. Christian Green Jan 2011

Religion, Family Law, And Recognition Of Identity In Nigeria, M. Christian Green

Emory International Law Review

In this Essay, I discuss some of the key features of Muslim-Christian contestation in Nigeria as revealed in a recent survey conducted by the Pew Forum on Religious Life, titled Tolerance and Tension: Islam and Christianity in Sub-Saharan Africa. I then discuss some of the Pew statistics that bear on the family and gender issues at the heart of the Sharia controversy. Finally, I offer some concluding reflections on whether Muslim-Christian contestation in Nigeria should be construed as a matter of religion qua religion or of 'religion by proxy,' on the prospects for moderate Sharia and juridical pluralism in Nigeria, …

Transforming The Religious Paradigm: A Study Of Female Opportunism And Empowerment Through Latin American Evangelicalism, Melissa Irvine Jan 2011

Transforming The Religious Paradigm: A Study Of Female Opportunism And Empowerment Through Latin American Evangelicalism, Melissa Irvine

CMC Senior Theses

From a contemporary international perspective, there are two truly global religious movements of enormous vitality. One is a resurgent Islam, the other Pentecostal Protestantism. What makes the growth of Pentecostal Protestantism so fascinating is the fact that it’s transforming a region where the Catholic Church has for five centuries reigned supreme in its religious monopoly. While the first century of proselytizing in Latin America was relatively minute (constituting only 1 percent of the overall population in 1950), Pentecostalism began to show signs of its potential vitality in the 1960s and 1970s.2 Evangelical conversion became more pervasive in 1980s, and by …

How To Judge Shari’A Contracts: A Guide To Islamic Marriage Agreements In American Courts, Nathan B. Oman Jan 2011

How To Judge Shari’A Contracts: A Guide To Islamic Marriage Agreements In American Courts, Nathan B. Oman

Utah Law Review

The dominant paradigms for thinking about the relationship between law and religion in American jurisprudence are drawn from the Christian tradition. Increasingly, however, America is home to Muslim immigrants and citizens. As they bring their religious practices to American courts, judges will struggle to understand their meaning and police their possible abuse. Islamic mahr contracts present perhaps the most common issue of Islamic law and practice with which American courts have struggled. Islamic marriage contracts should be understood on their own terms, rather than as an idiosyncratic version of the more familiar premarital agreement. The move to conceptualize mahr contracts …

Key Theoretical Issues In The Interaction Of Law And Religion: A Guide For The Perplexed, Benjamin Berger Jan 2011

Key Theoretical Issues In The Interaction Of Law And Religion: A Guide For The Perplexed, Benjamin Berger

Articles & Book Chapters

There is perhaps no more important access point into the key issues of modern political and legal theory than the questions raised by the interaction of law and religion in contemporary constitutional democracies. Of course, much classical political and moral theory was forged on the issue of the relationship between religious difference and state authority. John Locke’s work was directly influenced by this issue, writing as he did about the just configuration of state authority and moral difference in the wake of the Thirty Years’ War. Yet debates about the appropriate role of religion in public life and the challenges …

Citizens United And The Balance Between Individual And Corporate Political Speech, Eric John Berken Jan 2011

Citizens United And The Balance Between Individual And Corporate Political Speech, Eric John Berken

LSU Master's Theses

In an attempt to create stronger protection for free speech rights, the Supreme Court, in its ruling on Citizens United v. Federal Election Commission (FEC), has issued a determination that limits the rights of citizens in favor of artificial industrial entities. The majority’s stated position, that corporations cannot be regulated differently from real human beings, cannot be justified according to values enshrined in the Constitution. They further claim that large sums of unregulated money accrued for capital investment cannot be demonstrated to cause corruption, which is an obvious mischaracterization of financial influence in the current political process. By ignoring the …

Highway Religion: Truckstop Chapels, Evangelism, And Lived Religion On The Road, David Brett Greenberg Jan 2011

Highway Religion: Truckstop Chapels, Evangelism, And Lived Religion On The Road, David Brett Greenberg

Honors Papers

This study examines manifestations of Christian faith found along the highways of the United States, particularly in the form of truckstop chapels. Through ethnographic research and social-historical/theoretical analysis, this study seeks to explore the ways in which Evangelical Christianity, when combined with certain cultural and social particulars of the trucking profession, may be markedly re-contextualized, giving rise to distinctive approaches to ministry, worship, and religious life.

By identifying widespread and often codified specializations among trucking ministries and examining the ways in which the trucking-specific evangelism of such ministries may be applied and lived out by individual drivers of faith, this …
