Temporary Insanity: The Strange Life And Times Of The Perfect Defense, Russell D. Covey Jan 2011

Temporary Insanity: The Strange Life And Times Of The Perfect Defense, Russell D. Covey

Faculty Publications By Year

The temporary insanity defense has a prominent place in the mythology of criminal law. Because it seems to permit factually guilty defendants to escape both punishment and institutionalization, some imagine it as the “perfect defense.” In fact, the defense has been invoked in a dizzying variety of contexts and, at times, has proven highly successful. Successful or not, the temporary insanity defense has always been accompanied by a storm of controversy, in part because it is often most successful in cases where the defendant’s basic claim is that honor, revenge, or tragic circumstance – not mental illness in its more …

Becoming Normal: The Social Construction Of Buprenorphine And New Attempts To Medicalize Addiction, Julie C. Netherland Jan 2011

Becoming Normal: The Social Construction Of Buprenorphine And New Attempts To Medicalize Addiction, Julie C. Netherland

Dissertations, Theses, and Capstone Projects

Drawing on theories about the social construction of knowledge and the sociology of the body, this dissertation analyzes the social construction of buprenorphine, a medication being used to treat addiction to opioids, to better understand the processes of medicalization. Buprenorphine was central the passage of the Drug Addiction Treatment Act of 2000, a law which overturned an almost one hundred year prohibition preventing physicians from prescribing narcotics for the treatment of addiction in an office-based setting. Buprenorphine is seen by many as central to moving addiction treatment into the medical mainstream. Using documents from government regulators, industry, and addiction researchers, …

Tiebout Sorting And Jurisdictional Homogeneity: Empirical Validity And Ethical Implications, Lee Hachadoorian Jan 2011

Tiebout Sorting And Jurisdictional Homogeneity: Empirical Validity And Ethical Implications, Lee Hachadoorian

Dissertations, Theses, and Capstone Projects

In a seminal paper, Tiebout (1956) argues that a large number of small local governments will function as a market in local services, leading to efficient allocation of local public goods. This result only obtains if households actually move in response to local fiscal differences. Spatial dependence of socioeconomic variables confounds attempts to infer Tiebout-motivated residential choice from observed socioeconomic homogeneity. I correct for this by focusing on socioeconomic difference across local government borders. In an investigation of socioeconomic sorting in Queens and Nassau Counties, NY, I find strong evidence of income sorting at the level of small suburban municipalities …

The Impact Of Trial Consultants On Perceptions Of Procedural Justice And Juror Verdicts: An Empirical Investigation, Jennifer Burke Katz Jan 2011

The Impact Of Trial Consultants On Perceptions Of Procedural Justice And Juror Verdicts: An Empirical Investigation, Jennifer Burke Katz

Dissertations, Theses, and Capstone Projects

Despite the proliferation of the trial consulting industry in recent years, we know virtually nothing about the impact that the use of a trial consultant may have on a jury. This laboratory study seeks to fill some of the gaps in the trial consulting literature by using the principles of procedural justice to explore what, if any, impact the use of a trial consultant can have on the outcome of a criminal jury trial, as well as the possibility that perceptions of fairness mediate the relationship between the balance of trial consultants and juror verdicts in cases where the evidence …

Personal Narratives Of Women's Leadership And Community Activism In Cherkasy Oblast, Martha Kichorowska Kebalo Jan 2011

Personal Narratives Of Women's Leadership And Community Activism In Cherkasy Oblast, Martha Kichorowska Kebalo

Dissertations, Theses, and Capstone Projects

Ukraine's women's movement is part of a complex social field characteristic of formerly Soviet countries, but it also emerges from its own specific political history. Post-Soviet period, (neo-) nationalism, feminism and (neo-) socialism are significant forces shaping women's collective behavior. Their activism resonates with the pre-Soviet liberation struggle while it is shaped also by practices from the recent Soviet past. It also is sensitive to external pressures, including the agendas of Western aid and the Ukrainian diaspora.

This study accepts the emergence of non-state women's organizations as indicative of an incipient movement and examines this field of social activism in …

Phenolic Constituents From Garcinia Intermedia And Related Species, Ulyana Muñoz Acuña Jan 2011

Phenolic Constituents From Garcinia Intermedia And Related Species, Ulyana Muñoz Acuña

Dissertations, Theses, and Capstone Projects

Antioxidants from plants scavenge free radicals and prevent reactive oxygen species from having damaging effects in common ailments such as inflammation, atherosclerosis, and Alzheimer’s disease. As part of our ongoing studies of antioxidants from tropical edible fruits, we have studied Garcinia intermedia (Pittier) Hammel [synonym: Rheedia edulis (Seem.) Planch. & Triana], native to Central America. In the fruits the following compounds were identified: guttiferone A, guttiferone E, xanthochymol, fukugetin, volkensiflavone and fukugeside. A new compound was tentatively identified in the fruits of this species. The antioxidant activity of guttiferone A in the 1,1-diphenyl-2-picrylhydrazyl (DPPH) assay was IC50 = 46 μM. …

The Interpersonal Foundations Of Anti-Atheist Prejudice, Michael W. Magee Jan 2011

The Interpersonal Foundations Of Anti-Atheist Prejudice, Michael W. Magee

Dissertations, Theses, and Capstone Projects

Anti-atheist prejudice in the U.S. is socially accepted and rife—and not just because most Americans are religious. This research suggests that hostility toward atheists is related in part to protecting parental relationships. To the extent that they are established within parental relationships, shared reality theory implies that religious beliefs and associated attitudes will be psychologically defended to the extent that the parental relationships engaged are strong, healthy, and vital (Magee & Hardin, 2010; see also Hardin & Higgins, 1996). Three experiments examined the regulation of anti-atheist prejudice in the defense and protection of religious shared realities with parents, as implied …

Influenza A And Flavivirus Manipulation Of Cell Death, Jeffrey E. Mclean Jan 2011

Influenza A And Flavivirus Manipulation Of Cell Death, Jeffrey E. Mclean

Dissertations, Theses, and Capstone Projects

Viruses employ a variety of strategies to manipulate cell fate and maximize their replication potential during infection. Interacting specifically with cell death pathways allows viruses direct control over the cellular decision to survive or die during infection.

Influenza A virus, of the family Orthomyxoviridae, encodes proteins that interact with the cell at several points along the apoptosis pathway to induce apoptosis. We demonstrate that caspase activation through pro-apoptotic Bax, a downstream target of Bcl-2, is a critical determinant of the nature of cell death induced by Influenza A infection. Influenza A virus cannot establish an apoptotic response without functional Bax, …

Diversity And Job Satisfaction: Reconciling Conflicting Theories And Findings, Douglas Campbell Jan 2011

Diversity And Job Satisfaction: Reconciling Conflicting Theories And Findings, Douglas Campbell

International Journal of Applied Management and Technology

This is a multidisciplinary study on reconciling the conflicting theories and research concerning whether a person’s gender, race, or ethnicity affects his or her overall job satisfaction or degree of satisfaction with any element of the job. A disciplined baseline survey was performed. Statistical techniques, including a stepwise regression, were used to identify significant relationships. The findings and observations resolve what had appeared to be conflicting theories and research findings. The author concludes that in some instances, a legitimate correlation between gender, race, or ethnicity and job satisfaction or the degree of satisfaction with a particular job element may be …

Traffic incidents are a major source of congestion in Virginia. Secondary incidents comprise a relatively small but important portion of all incidents, and relatively little is known about their occurrence, characteristics, and associated delays. The main objectives of this study were to define secondary incidents, understand and analyze the occurrence and nature of such incidents, and develop tools that can comprehensively and continuously analyze primary and secondary incidents at the planning and operational levels, ultimately contributing to congestion management. The scope of the study is limited to freeway incidents in the Hampton Roads (HR) area. The study found that secondary …

Flawed Assumptions: A Corporate Law Analysis Of Free Speech And Corporate Personhood In Citizens United, Anne M. Tucker Jan 2011

Flawed Assumptions: A Corporate Law Analysis Of Free Speech And Corporate Personhood In Citizens United, Anne M. Tucker

Faculty Publications By Year

In the wake of the January, 2010 Supreme Court decision in Citizens United, special interest groups, citizens, and politicians alike have engaged in a rigorous debate about the role of corporate speech within our democratic process. The First Amendment issues raised in Citizens United - to that extent do corporations have a constitutionally protected right to participate in and influence our elections through expenditures - evoke larger questions about the roles, rights, and responsibilities of corporations within our society. This article concludes that the Supreme Court did not reference corporate law principles when analyzing the fundamental First Amendment debate in …

There has been compelling signs of the great potential of building further synergy with academics, researchers, and industry practitioners from the areas of Modeling and Simulation (M&S) managing risk events. This paper provides an introduction to risk management and how M&S has permeated the risk management process. The trend has been to harness the advantages of M&S tools and techniques in terms of efficiency and effectiveness in managing risks. However, the more important contribution of M&S may be in how it provides a way for specialists in various disciplines or industries interact to manage risks that require multi-disciplinary approach. This …

Towards Reducing Traffic Congestion Using Cooperative Adaptive Cruise Control On A Freeway With A Ramp, George Arnaout, Shannon Bowling Jan 2011

Towards Reducing Traffic Congestion Using Cooperative Adaptive Cruise Control On A Freeway With A Ramp, George Arnaout, Shannon Bowling

Engineering Management & Systems Engineering Faculty Publications

Purpose: In this paper, the impact of Cooperative Adaptive Cruise Control (CACC) systems on traffic performance is examined using microscopic agent-based simulation. Using a developed traffic simulation model of a freeway with an on-ramp - created to induce perturbations and to trigger stop-and-go traffic, the CACC system’s effect on the traffic performance is studied. The previously proposed traffic simulation model is extended and validated. By embedding CACC vehicles in different penetration levels, the results show significance and indicate the potential of CACC systems to improve traffic characteristics and therefore can be used to reduce traffic congestion. The study shows that …

The Justification Of Positve Law In Plato, Brenner M. Fissell Jan 2011

The Justification Of Positve Law In Plato, Brenner M. Fissell

This article argues that Platonic legal philosophy views positive law as justified only because of the problems inherent in human nature, and not, contra natural law thinkers, because of its rationality.

Plato's Theory Of Democratic Decline, Brenner M. Fissell Jan 2011

Plato's Theory Of Democratic Decline, Brenner M. Fissell

Faculty Publications

While democracy is derided for a variety of reasons in Plato’s thought, his most damning critique of that regime type does not involve an observation about democracy qua democracy, but of the transition that it so easily engenders: the decline to tyranny. Regimes are composed of individuals and groups, though, and Plato is anxious to ascribe culpability for the degradation. Two actors are the primary focus of his analysis — the political leaders and the demos. At times he emphasizes the puissance of the demos, but in other passages he suggests it is the leaders who are most authoritative. This …

The role that input factors from project planning processes play on conflict emergence and conflict resolution in virtual teams is not well understood. Of particular interest for this paper is the role that factors during planning stages play in preventing interpersonal conflict, supporting conflict resolution and ultimately enhancing team outcomes in virtual team settings. This study examines the relationships among commitment to team goals, conflict management and team outcomes in virtual teams. First we provide an in depth review of relevant empirical findings. Next, we describe a study examining the relationships between three sets of variables: 1) goal commitment, 2) …

Reviving Slander, Cristina Carmody Tilley Jan 2011

Reviving Slander, Cristina Carmody Tilley

Faculty Publications

Roman law treated differently speech restricted to small, closed communities and speech within or among large, permeable communities. Intracommunity speech was subject to unlimited tort consequences, while intercommunity speech was subject to central government regulation. As English speech law evolved, slander rules governing spoken speech became a convenient proxy for intracommunity speech regulation, while libel rules governing written speech became a convenient proxy for intercommunity speech. In American law, the conceptual collapse of slander and libel meant that constitutional limits designed to lift central government regulation of intercommunity speech perhaps inadvertently vitiated tort consequences for intracommunity speech. The Supreme Court's …

Domain Independent Sentiment Classification With Many Lexicons, Bruno Ohana, Brendan Tierney, Sarah Jane Delany Jan 2011

Domain Independent Sentiment Classification With Many Lexicons, Bruno Ohana, Brendan Tierney, Sarah Jane Delany

Conference papers

Sentiment lexicons are language resources widely used in opinion mining and important tools in unsupervised sentiment classification. We present a comparative study of sentiment classification of reviews on six different domains using sentiment lexicons from different sources. Our results highlight the tendency of a lexicon’s performance to be imbalanced towards one class, and indicate lexicon accuracy varies with the target domain. We propose an approach that combines information from different lexicons to make classification decisions and achieve more robust results that consistently improve our baseline across all domains tested. These are further refined by a domain independent score adjustment that …

Organizations As Consumers Of Human Capital Via Technology: A Policy Study Of Information And Communication Technologies, Colrain M. Zuppo

All-Inclusive List of Electronic Theses and Dissertations

Organizations are consumers of human capital through technological means. Flexibility in work hours and locations can assist employee productivity; however, it can also foster a blurred distinction between work time and personal time (Robbins & Judge, 2007). Employees are given the tools to stay connected outside of a straightforward 40 hour work week in the name of enhanced productivity and/or flexibility with regard to their work arrangements. Organizational policies regarding ICTs have been limited to proscriptive measures (e.g. prohibiting installation of specific applications or downloads) as opposed to providing managerial parameters in the form of formal or informal policies. The purpose …
