Dead Again: The Latest Demise Of The Confrontation Clause, Michael D. Cicchini

In Crawford v. Washington, the Supreme Court abandoned its Roberts “reliability” approach to the right of confrontation. The Court conceded that the Roberts decision had killed the Confrontation Clause by: (1) impermissibly tying the right of confrontation to the rule against hearsay; (2) inappropriately allowing pretrial determinations of reliability to replace actual cross-examination at trial; (3) relying too heavily on malleable, multi-factor balancing tests; and (4) completely failing to constrain judicial discretion. Since Crawford, however, the Court has decided Davis v. Washington and Michigan v. Bryant. Unfortunately, in the course of deciding those cases the Court has once again killed …

This intersectional and interdisciplinary social science qualitative dissertation in six chapters is grounded in critical research and theory for the purpose of engaged public service. This project is grounded in three formal disciplines: education, criminology, and peace and conflict studies. Within those three disciplines, this project interweaves newly emerging fields of study together, including critical animal studies, eco-ability, disability studies, environmental justice, transformative justice, green criminology, anarchist studies, and critical criminology, This dissertation adopts three qualitative methodologies; autoethnography, case study, and critical pedagogy. Assessing The Efficacy Of A Modified Therapeutic Community On The Reduction Of Institutional Write-Ups In A Medium Security Prison, Lee Maglinger

This study explored the impact a modified Therapeutic Community (TC) had on reducing institutional disorder as documented by institutional write-ups. Substance abuse treatment programs are typically evaluated in terms of their ability to prevent relapse and reduce recidivism. The current study examined the efficacy of a modified TC in relation to these parameters but also explored its overall impact on prison safety and security for both the inmates and staff of a medium security prison located in Kentucky. Fatal automobile crashes have claimed the lives of over 33,000 people each year in the United States since 1995. As in any point event, fatal crash events do not occur randomly in time or space. The objectives of this study were to identify spatial patterns and hot spots in FARS (Fatal Analysis Reporting System) fatal crash events based on temporal and demographic characteristics. The methods employed included 1) rate calculation using FARS points and average daily traffic flow; 2) planar kernel density estimation of FARS crash events based on temporal and demographic attributes within the data; and 3) two case …

From Nixon’S War On Drugs To Obama’S Drug Policies Today: Presidential Progress In Addressing Racial Injustices And Disparities, Cigdem Sirin

This study investigates presidential progress in addressing racial injustices and disparities within the context of the war on drugs. I argue that racial inequalities emanating from the war on drugs have been largely overlooked and at times aggravated by previous administrations. Although there have been some improvements in this regard since President Obama took office, more extensive policy reforms are needed to better remedy such inequalities. The trucking industry is the largest freight sector, making up about 70 percent of all domestic shipment in the United States and contributes greatly the American economy. About 10 billion tons of goods are shipped annually and of that, about 800,000 shipments of hazardous materials are transported in the United States each day by trucks, resulting in 300 million annual shipments (Federal Motor Carrier Security Administration). Although private parties have performed government functions throughout most of Western history, mainstream administrative law scholarship is dotted with concerns over the extent to which modern federal government activities are outsourced to private contractors. Federal contractors routinely exercise authority that is classically “executive” in nature. They write regulations, interpret laws, administer foreign aid, manage nuclear weapons sites and intelligence operations, interrogate detainees, control borders, design surveillance systems, and provide military support in combat zones. America’s surface transportation system features long and inter-connected routes and open access to stations and vehicles, making the system vulnerable to terrorist attack. While a variety of security-related training products exist for the transportation sector, government and other reports have called for improvements in the transportation security training curriculum in terms of quality and consistency. At the same time, tight economic times have left few extra financial resources available for systems to deliver adequate training to employees. The origin of the proliferation of private security companies (guards) in Nigeria can be traced to the systemic failure and inefficiency that adorn the public security sector, which exhibits blatant inability to meet the security needs of the people resulting from her agelong anti-people posture, inadequate training, official corruption, nepotism among other negativities. Indeed, the complementary roles being played by private security guards in mitigating the security challenges confronting the nation have been seen by many as a welcome development.
