Maryland Politics And Government, Herbert C. Smith, John T. Willis Oct 2011

Maryland Politics And Government, Herbert C. Smith, John T. Willis

University of Nebraska Press: Sample Books and Chapters

Tucked between the larger commonwealths of Pennsylvania and Virginia and overshadowed by the political maneuverings of its neighbor, Washington, D.C., Maryland has often been overlooked and neglected in studies of state governmental systems. With the publication of Maryland Politics and Government, the challenging demographic diversity, geographic variety, and dynamic Democratic pragmatism of Maryland finally get their due. Two longtime political analysts, Herbert C. Smith and John T. Willis, conduct a sustained inquiry into topics including the Maryland identity, political history, and interest groups; the three branches of state government; and policy areas such as taxation, spending, transportation, and the …

A Conflict Of Interests: Privacy, Truth, And Compulsory Dna Testing For Argentina’S Children Of The Disappeared, Elizabeth B. Ludwin King Oct 2011

A Conflict Of Interests: Privacy, Truth, And Compulsory Dna Testing For Argentina’S Children Of The Disappeared, Elizabeth B. Ludwin King

Cornell International Law Journal

From 1976 to 1983, Argentina was ruled by a military dictatorship that disappeared an estimated 30,000 suspected subversives, including parents of young children and pregnant women. Their children, either disappeared along with their parents or born in clandestine detention centers, were then taken from their parents and adopted, often by couples who were sympathetic with the government and knew of the children's origins. This Article addresses Argentina's newest effort to identify these now-adult children: compulsory DNA testing in cases where the raising parents are suspected of having knowingly adopted their children illegally. It argues that, although the mandatory testing permissibly …

Sharing The Green: Reformatting Wisconsin's Forgotten Green Space Grant With A Public-Private Partnership Design, Scott W. Brunner Oct 2011

Sharing The Green: Reformatting Wisconsin's Forgotten Green Space Grant With A Public-Private Partnership Design, Scott W. Brunner

Marquette Law Review

Despite the vast amount of legal research available on brownfields redevelopment generally, little has been done on the value of brownfieldto- greenspace conversions. Brownfield-to-greenspace conversions that incorporate public–private partnership elements may trigger private investment in brownfields when the market alone fails to induce development of contaminated lands. Brownfield-to-greenspace partnerships are a flexible way to redevelop brownfields and maintain complete stakeholder involvement in the cleanup and ownership process. Currently, an unfunded Wisconsin program is set up to provide grants to municipalities for brownfield-to-greenspace conversions. Wisconsin municipalities have used this grant successfully in the past to improve local economic prospects simply by …

The Garcetti Virus, Nancy M. Modesitt Oct 2011

The Garcetti Virus, Nancy M. Modesitt

All Faculty Scholarship

In an era where corporate malfeasance has imposed staggering costs on society, ranging from the largest oil spill in recorded history to the largest government bailout of Wall Street, one would think that those who uncover corporate wrongdoing before it causes significant harm should receive awards. Employees are particularly well-placed to uncover such wrongdoing within companies. However, rather than reward these employees, employers tend to fire or marginalize them. While there are statutory protections for whistleblowers, a disturbing new trend appears to be developing: courts are excluding from the protection of whistleblowing statutes employees who report wrongdoing as part of …

A Quantitative Study Of Robustness Characteristics In Steel Framed Structures, Christopher Herman Raebel Oct 2011

A Quantitative Study Of Robustness Characteristics In Steel Framed Structures, Christopher Herman Raebel

Dissertations (1934 -)

Robustness is a desirable property in any structural design. Robustness may be thought of as the building's inherent structural ability to resist loads other than those anticipated during design. Examples of unanticipated loads are damage to a column or beam due to impact; damage due to the concussion of a blast; strength reduction due to extreme heat during a fire; and localized accidental overload of a beam or column. Each of these events, although very different in their nature, has one major point in common; in each case the path of load resistance changes in a way that was not …

The People's Court, Kermit J. Lind Oct 2011

The People's Court, Kermit J. Lind

Law Faculty Articles and Essays

The Cleveland Housing Court adjudicates only one house and one owner at a time, while the investors and speculators in blighted properties operate in secret at high volume from a distance. However, the court's focus on housing code compliance and its (when needed) willingness to hand down strong measures is powerful. Even now, the City of Cleveland is implementing new strategic code compliance measures in partnership with neighborhood-based community development corporations, to the point where there is less profit in owning worthless houses in Cleveland, and the court is redirecting the disposal of low-value foreclosed houses to local land banks …
