Though the Great Recession may be officially over, economic recovery is slow and tentative, particularly in California and much of the Intermountain West. Among other challenges, the protracted downturn in these states has exposed and aggravated a huge public-sector fiscal crisis—with disconcerting implications for citizens and states’ long-term economic health. This brief takes a careful look at the fiscal situation in Arizona, California, Colorado, and Nevada, examining both their serious cyclical budget shortfalls—those resulting from the recession and its aftermath—as well as the critical longer-term structural imbalances between revenues and expenditures that have developed in Arizona, California, and, to a …

Ten years after the attacks of September 11, 2001, it almost goes without saying that the acts of grotesque violence committed on that day have had enormous effects on national security law and policy worldwide. To be labeled a terrorist, or to be accused of involvement in an act of terrorism, carries far more severe repercussions now than it did ten years ago. This is true under international law and under domestic law in nations that have dealt with serious national security concerns for many years.

Current evidence suggests that persons with co-occurring disorders (COD) are at risk for poorer treatment outcomes in terms of substance use and recidivism. Studies have examined this trend in incarcerated individuals, but few have examined COD offenders under community supervision. The purpose of this study was to develop a predictive model to identify offenders under community corrections supervision with substance use diagnoses who were actively taking psychotropic medications (SUPM) as an index of COD and to compare demographics, social histories, and sexual risk behaviors for SUPM offenders to offenders with a substance use disorder (SUD) only and those who met …

Much research had shown that men volunteer at a lesser rate than women do. Additionally, research had shown that the motivations to volunteer differ for each gender. Two samples of college students who participated in single day service projects were surveyed using the Volunteer Functions Inventory-an instrument that assesses the importance of six possible motivations that range from a focus on others to a focus on gains for one's self-by the Student Community Service office. Recent disasters demonstrate that the needs of people with disabilities are not being met when disaster strikes. At the root of the problem is a widespread failure to include people with disabilities in preparing for emergencies before they occur. This study used a 2-round Delphi methodology with a panel of experts, consisting of people with disabilities and key players in emergency planning and response. The study instrument consisted of questionnaires containing items presented in Likert, yes-no, and open-ended formats. In the summer of 2010, a controversy erupted after news surfaced of a planned mosque two blocks from New York City's Ground Zero. The proposed location of the mosque, now named Park51, inflamed the passions of many Americans who believed that the Muslim institution would threaten both the memories of September 11, 2001, and the respect for those killed by the terrorist attacks. The Park51 mosque quickly attracted international attention, and the question of whether the state could restrict the mosque became entangled in a web of legal and 'cultural sensitivity' arguments. The Burqa Ban: An Unreasonable Limitation On Religious Freedom Or A Justifiable Restriction?, Shaira Nanwani

In the spring of 2011, France enacted a law banning the concealment of the face in public spaces (the 'burqa ban'). The burqa ban creates two new punishable offenses in France. First, wearing clothing designed to conceal one's face in a public space is punishable by either a maximum of a €150 fine or by being required to take a class on the meaning of citizenship, or both. Second, forcing a woman to wear a face-covering veil is punishable by one year of imprisonment or a €30,000 fine. The burqa ban, which was first introduced by the French National Assembly …

Try As They Might, Just Can't Get It Right: Shortcomings Of The International Megan's Law Of 2010, Danielle Viera

This Comment argues that future legislation closely resembling House Bill 5138, the International Megan's Law of 2010, should not become law. Further, this Comment encourages future drafts of such a law to account for the inherent weaknesses of House Bill 5138. This Comment proposes two alternative solutions for Congress to consider in light of the problems discussed: Congress should either change the language in its next attempt or decline to pass any law until it can analyze the successes and failures of the British Parliament's similarly drafted Sarah's Law.

Selective Serotonin Reuptake Inhibitors (SSRIs) are a class of antidepressant medications that came on the market in the late eighties and early nineties. SSRIs were found to be clinically effective in treating clinical depression, and anxiety disorders in adults and had less cumbersome side effects compared to the older Tricyclic antidepressants. The first drug in this class introduced was fluoxetine (Prozac), which was soon followed by paroxetine (Paxil), sertraline (Zoloft), citalopram (Celexa), fluvoxamine (Luvox), and escitalopram (Lexapro). Today the uses of SSRIs have broadened to include treatment for “Post-Traumatic Stress Disorder, pre-menstrual dysphoric disorder, urinary incontinence” and many other seemingly …

This qualitative case study identified shared leadership as a necessary component in the sustenance of restorative justice, a reform justice model used at Ada County Juvenile Court Services located in Boise, Idaho. Within each of its divisions, ACJCS utilizes this shared leadership model. At this court, leadership capacity was built though encouraging team members to take initiative and show innovation. Community capacity was built by the creation of networks with other private and county agencies, providing both leadership opportunities and community service hours for offending youth. The Missing Miranda Warning: Why What You Don’T Know Really Can Hurt You, Geoffrey S. Corn

When the Supreme Court issued its ruling in the consolidated case of Miranda v. Arizona, it registered as a seismic shock through the law enforcement community. This “shock effect” was the result of the broad implications created by the plain language of the ruling and the assumption that it permanently hobbled the efficacy of law enforcement interrogations. According to the Court, protecting the criminal suspect’s Fifth Amendment privilege against compelled self-incrimination required “something more” than the mere availability of the privilege during trial; something to offset the inherent coercion associated with police interrogation. To Tow Or Not To Tow: The Deterrence Effect Of A Municipal Ordinance, Alexia Brunet Marks, Ronald J. Allen

We examine the natural experiment caused by amendments to the City of Waukegan vehicular code adding mandatory impoundment and towing of vehicles for certain ticketed behavior. Multivariable negative binomial regression models were used to evaluate the relationship between tickets and accidents and implementation of the legislation while adjusting for the number of registered drivers and time. The legislation led to a 39% reduction in the total number of tickets, 55% reduction in the number of tickets for the four towable offenses, and a 37% reduction in accidents. Accidents to property decreased 39%, tickets decreased 39% for driving with a suspended/revoked …
