Preservation Without Restoration: The Case For Ruins, Sydney Schoof
Historic Preservation Theses
The ruins are often an overlooked topic in historic preservation. The typical method of treatment is either full restoration or demolition. However, some ruins have gained significance in their own right and this thesis explores appropriate treatment and recognition for these structures. Ruins typically represent a historical trend toward downsizing that would not be otherwise visible and are therefore eligible for listing on the National Register of Historic Places under criterion A, though criterion C may also be applicable as the aesthetics of ruins are often much admired and become the primary reason for local and even national interest in …

In the United States the presence of gangs and gang activity is a common occurrence in lower socio-economic communities; however, local law enforcement agencies often have little information about the racial and ethnic composition of gang activity in their areas. As a result, gangs are often categorized without respect to important demographic differences between them. The purpose of this paper is to examine the New Jersey State Police Gang Survey 2007, which is a statewide assessment of gang composition and activity. I use the data from this survey along with conflict theory to analyze differences between African American and Hispanic …

The Clean Water Act was implemented to restore and maintain the Nation’s waters. The National Pollutant Discharge Elimination System is the principal permitting scheme under the Clean Water Act that is designated to achieve that objective. In the wake of ambiguous regulations on fill material, a loophole in the Clean Water Act has arisen. Currently, an entity can apply for a fill permit to discharge waste normally regulated under the Nation Pollutant Discharge Elimination System if the discharge is composed of a sufficiently high concentration of solids. This Comment discusses the regulations on fill permitting and the cases interpreting them. …

The 1996 Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA, P. L. 104-93) called primarily on women to achieve two goals: work and/or marriage. For low income single mothers with limited access to capital, the PRWORA presents a quagmire in that the public safety nets previously guaranteed by the policies of the New Deal were abruptly supplanted by policies with obligations that require various forms of capital. Using longitudinal data from the Fragile Families and Child Wellbeing dataset, we examine the impact of social capital on the chances of marriage and employment among single, unemployed mothers. This thesis will explore different water conservation strategies and systems in the residential home, using the city of Irvine as a basis. The thesis will compare the financial implications between the different systems and as a return on investment. The analysis will also account for ecological and social implications on the occupants, in particular their standard of living and lifestyle changes. The thesis will explore the ability to conserve water in new residential construction and will provide a sustainable and conscientious schematic water design for the particular area of concern.

Reforming Attempt Liability Under 18 U.S.C. § 2422(B): An Insubstantial Step Back From United States V. Rothenberg , Korey J. Christensen

The statute under which Internet sex predators are prosecuted for illicit online communications prohibits attempts to “knowingly persuade[], induce[], entice[], or coerce[]” minors to engage in “any sexual activity for which any person” can be criminally charged. This broad language has allowed courts to gradually expand the statute’s reach by reducing the level of conduct considered sufficient to constitute a substantial step toward commission of the crime. The Eleventh Circuit’s decision in United States v. Rothenberg is especially illustrative of this problematic expansion, as the court held that a conversation between consenting adults, without more, was sufficient to support a …

After losing sovereign immunity in 1985, SCDOT employees now focus a significant amount of time in processing tort claims and lawsuits filed against the agency. This is an important issue for transportation agencies considering the fact that money spent defending tort claims and lawsuits, is no longer available for safety and mobility improvements on the state highway system.
The South Carolina Department of Transportation (SCDOT) processes approximately one thousand claims per year and is engaged in nearly one hundred lawsuits per year. SCDOT has paid just over a half million ($523,607) to settle on 1007 claims - approximately 1/3 of …

With the deregulation of the electric power industry and the advancement of new technologies, the attention of the utilities has been drawn towards adopting Distributed Generation (DG) into their existing infrastructure. The deployment of DG brings ample technological and environmental benefits to the traditional distribution networks. The National Center on Addiction and Substance Abuse reported that 35 percent of middle school students and 45 percent of high school students say that there are students who are affiliated with gangs or who consider themselves to be affiliated with gangs in their schools (Arciaga, Sakamoto, & Jones, 2010). Gangs are increasingly violent and criminally involved and their impact on the school environment negatively influences student performance (National Gang Center, 2010a). This Article begins by describing the positive law of preventive detention, which I term "desert/disease jurisprudence." Then it provides a brief excursus about risk prediction (estimation), which is at the heart of all preventive detention practices. Part IV considers whether proposed expansions of desert jurisprudence are consistent with retributive theories of justice, which ground desert jurisprudence. I conclude that this is a circle that cannot be squared. The following Part canvasses expansions of disease jurisprudence, especially the involuntary civil commitment of mentally abnormal, sexually violent predators, and the use of post-insanity acquittal involuntary commitment. Prevention As The Primary Goal Of Sentencing: The Modern Case For Indeterminate Dispositions In Criminal Cases, Christopher Slobogin

This Article contends that properly constituted, indeterminate sentencing is both a morally defensible method of preventing crime and the optimal regime for doing so, at least for crimes against person and most other street crimes.
More specifically, the position defended in this Article is that, once a person is convicted of an offense, the duration and nature of sentence should be based on a back-end decision made by experts in recidivism reduction, within broad ranges set by the legislature. Compared to determinate sentencing, the sentencing regime advanced in this Article relies on wider sentence ranges and explicit assessments of risk, …

A Punitive Precondition For Preventive Detention: Lost Status As A Foundation For A Lost Immunity, Alec Walen

This Article argues that the presumption that an actor will be law-abiding, like the right to liberty itself, can be forfeited by criminal actions. In other words, the point is to argue that a just punishment could involve loss of the status of being a beneficiary of this presumption just as much as it could involve the loss of liberty.
In Part II, I introduce a basic framework for detention consistent with respect for autonomy and locate the lost status view within that framework. In Part III, I spell out the lost status view in more detail and contrast it …

How should we judge psychopaths, both morally and in the criminal justice system? This Article will argue that psychopaths are often not morally responsible for their bad acts simply because they cannot understand, and therefore be guided by, moral reasons.
Scholars and lawyers who endorse the same conclusion automatically tend to infer from this premise that psychopaths should not be held criminally punishable for their criminal acts. These scholars and lawyers are making this assumption (that just criminal punishment requires moral responsibility) on the basis of one of two deeper assumptions: that either criminal punishment directly requires moral responsibility or …

Crime-mapping technology has the potential to reshape Fourth Amendment protections in designated “high-crime areas.” In Illinois v. Wardlow the Supreme Court held that presence in a high-crime area is one of only two factors necessary for creating reasonable suspicion to stop an individual. Since Wardlow, thousands of federal and state cases have used the term “high-crime area,” yet only a handful of courts have considered how to define it. New crime-mapping technologies can now address that definitional problem. Crime-mapping technologies can collect and analyze crime statistics so that police districts can produce almost perfect information about the level, rate, and …
