Guardianship For Persons With Mental Illness - A Legal And Appropriate Alternative?, Leslie Salzman Jan 2011

Guardianship For Persons With Mental Illness - A Legal And Appropriate Alternative?, Leslie Salzman

Articles

The article critiques the U.S. guardianship system for individuals with psychosocial disabilities, arguing that it often unnecessarily restricts their autonomy by removing their legal right to make decisions. It advocates for supported decision-making models as a less restrictive alternative, aligning with the Americans with Disabilities Act (ADA) and the United Nations Convention on the Rights of Persons with Disabilities (CRPD). The analysis emphasizes the importance of maximizing integration and participation in social, economic, and civic life, while highlighting the need for safeguards to ensure effective support without undue bureaucratic complexity.

The Inauthentic Claim, Anthony J. Sebok Jan 2011

The Inauthentic Claim, Anthony J. Sebok

Articles

This Article takes a critical look at the persistence of legal doctrines that prohibit or limit property rights in litigation. The Article focuses on prohibitions on assignment and maintenance. Assignment of personal injury tort claims is prohibited throughout the United States, while the assignment of other claims, such as fraud and professional malpractice, is prohibited in a large number of states. Maintenance, in which a stranger provides something of value to a litigant in order to support or promote the litigation, is prohibited in varying degrees in the United States.

These doctrines might seem quite independent of each other at …

Identity And Behavior: Exploring An Understanding Of “Being” And “Doing” For Catholic Priests Accused Of The Sexual Abuse Of Minors In The United States, Brenda K. Vollman Jan 2011

Identity And Behavior: Exploring An Understanding Of “Being” And “Doing” For Catholic Priests Accused Of The Sexual Abuse Of Minors In The United States, Brenda K. Vollman

Dissertations, Theses, and Capstone Projects

The problem of the sexual abuse of minors by Catholic priests in the United States has been problematized as a phenomenon that is, in part, a distinction of the priesthood. Although it is known that there are sex offenders in the world who are not, nor were they ever, priests, this study sets forth to uncover whether or not the priests in the sample are, in fact, different on typical psychological risk factors than the at-large sex offender. More importantly, in the absence of notable differences on risk factor characteristics, this study explores the ways in which narrative structures are …

Teacher Expectations Of Children With Mental Illness In The Schools, Jamie Lee Satterly Roig Jan 2011

Within an experimental vignette design, 224 certified teachers participated in this online study by completing a researcher created rating scale that assessed expectations for a child described in a randomly assigned vignette; a child without mental illness, a child identified with an emotional behavioral disorder, and a child identified as returning from acute psychiatric care. Results from the current study revealed reliable scales; learning, cooperation, self-control, and teacher self-efficacy. Findings indicated teachers reported significantly different expectations for children identified with mental illness in comparison to typical children in the areas of self-control and cooperation; specifically, teachers reported lower expectations for …

Functional Connectivity For Configural And Featural Face Processing In The Broad Autism Phenotype, Jonathan Darrell Clark Jan 2011

Functional Connectivity For Configural And Featural Face Processing In The Broad Autism Phenotype, Jonathan Darrell Clark

University of Kentucky Doctoral Dissertations

During normal development, face processing involves a gradual shift from a featurally oriented style to a mature configural style by adolescence. This shift may coincide with increased right hemispheric dominance for faces supporting configural processing. Previous studies suggest that individuals diagnosed with ASD continue to process faces using individual parts and features into adulthood. This continued bias may be due to deficits in configural processing abilities. The current study investigated measures of functional connectivity during featural and configural processing of faces in broad autism phenotype sibling (ASD-sibs) children compared to age, sex, and handedness matched normal developing (ND) controls and …

Education Policy And The Mathematics Curriculum In New York City Middle Schools, 1958 To 2002, Joseph Valley Jan 2011

Education Policy And The Mathematics Curriculum In New York City Middle Schools, 1958 To 2002, Joseph Valley

Dissertations, Theses, and Capstone Projects

This study investigates how mathematics education policy and curriculum in New York City changed over the period from 1958 through 2002. It looks at the events leading up to the "new math" era, the "back to basics" movement, and the Standards movement initiated by the National Council of Teachers of Mathematics (NCTM) in 1989. Since this period is bounded by two important pieces of legislation, the National Defense Education Act (NDEA), 1958, and the No Child Left Behind Act (NCLB) 2001 an assessment of the arguments for and against the federal intervention in education is essential.

The research methodology used …

Design Of Multi Agent Based Crowd Injury Model, Emin Kugu Jan 2011

Design Of Multi Agent Based Crowd Injury Model, Emin Kugu

Electrical & Computer Engineering Theses & Dissertations

A major concern of many government agencies is to predict and control the behavior of crowds in different situations. Many times such gatherings are legal, legitimate, and peaceful. But there are times when they can turn violent, run out of control, result in material damages and even casualties. It then becomes the duty of governments to bring them under control using a variety of techniques, including non-lethal and lethal weapons, if necessary.

In order to aid decision makers on the course of action in crowd control, there are modeling and simulation tools that can provide guidelines by giving programmed rules …

Choosing To Serve: Modeling Antecedents Of Public Service Motivation In Undergraduate Students, Vivian Walker Greentree

School of Public Service Theses & Dissertations

This research builds upon the public service literature to better understand the distinctive nature of motivations associated with pursuing careers in the public sector. Previous research has shown that a wide variety of socialization experiences help to develop one's public service motivation (PSM). However, the research has fallen short of providing a comprehensive explanation. Additionally, a majority of the research focuses on those already employed in the public sector, with a dearth of exploration into students' preferences. This study utilized Perry's (1996) original survey instrument to measure PSM scores (both composite and dimensions) in college students, those who we must …

Negotiating Federalism, Erin Ryan Jan 2011

Negotiating Federalism, Erin Ryan

Faculty Publications

Bridging the fields of federalism and negotiation theory, Negotiating Federalism analyzes how public actors navigate difficult federalism terrain by negotiating directly with counterparts across state-federal lines. In contrast to the stylized, zero-sum model of federalism that pervades political discourse and judicial doctrine, the Article demonstrates that the boundary between state and federal power is negotiated on scales large and small, and on an ongoing basis. It is also the first to recognize the procedural tools that bilateral federalism bargaining offers to supplement unilateral federalism interpretation in contexts of jurisdictional overlap.

The Article begins by situating its inquiry within the age-old …

Dynamic Ergonomic Analysis And Simulation Of Fastening Operation, Akul Joshi Jan 2011

Dynamic Ergonomic Analysis And Simulation Of Fastening Operation, Akul Joshi

Doctoral Dissertations

"Operator performing fastening operation with powered hand-tools at awkward postures is subjected to external forces that may pose a risk of developing ergonomic injuries. For design of safe workplaces and selection of tools it is necessary to identify the probable causes of discomfort by simulating the work conditions and quantifying the risk factors. An ergonomic simulator is developed to simulate the fastening operation and quantify the effects of posture and force in fastening operation. The effect of dynamic forces is analyzed using two approaches. The first approach analyzes the effect of tool vibration while the second analyzes the hand-arm system …

Lying In The Scanner: Covert Countermeasures Disrupt Deception Detection By Functional Magnetic Resonance Imaging, Giorgio Ganis, J. Peter Rosenfeld, John B. Meixner Jr., Rogier Kievit, Haline Schendan

Scholarly Works

Functional magnetic resonance imaging (fMRI) studies have documented differences between deceptive and honest responses. Capitalizing on this research, companies marketing fMRI-based lie detection services have been founded, generating methodological and ethical concerns in scientific and legal communities. Critically, no fMRI study has examined directly the effect of countermeasures, methods used by prevaricators to defeat deception detection procedures. An fMRI study was conducted to fill this research gap using a concealed information paradigm in which participants were trained to use countermeasures. Robust group fMRI differences between deceptive and honest responses were found without, but not with countermeasures. Furthermore, in single participants, …

Damage Anchors On Real Juries, Shari Seidman Diamond, Mary R. Rose, Beth Murphy, John B. Meixner Jr. Jan 2011

Damage Anchors On Real Juries, Shari Seidman Diamond, Mary R. Rose, Beth Murphy, John B. Meixner Jr.

Scholarly Works

Experiments reveal anchoring as a powerful force, even when participants see the anchor as irrelevant. Here, we examine the reactions of real deliberating jurors to attorney damage requests and concessions in 31 cases involving 33 plaintiffs in which the jury awarded damages. Jurors were critical consumers of attorney suggestions. They reacted more negatively to, and were less influenced by, plaintiff ad damnums for pain and suffering than to damage requests in categories grounded in more objective evidence. Deliberations revealed that jurors often perceive plaintiff ad damnums not only as irrelevant, but also as outrageous, impressions reflected in their verdicts. These …

Can You Really Keep Your Health Care Plan? The Limits Of Grandfathering Under The Affordable Care Act, Elizabeth Weeks Leonard Jan 2011

Can You Really Keep Your Health Care Plan? The Limits Of Grandfathering Under The Affordable Care Act, Elizabeth Weeks Leonard

Scholarly Works

This article examines the rhetoric and reality of President Obama's repeated hallmark promise during federal health reform that "you can keep your health plan," as one example of the Administration's equivocal stance toward deregulation. Although rhetorically supporting the popular preference for decreased government involvement in health care, the Obama Administration, in several instances, has achieved significant re-regulation through the intricacies of executive branch rule-making. The Affordable Care Act's "grandfather rule" (Section 1251, "Preservation of Right to Maintain Existing Coverage") purports to uphold the "you can keep your health plan" promise. But the regulatory requirements for plans to retain grandfathered status …

Finding The Heart Of Medical Family Therapy: A Content Analysis Of Medical Family Therapy Casebook Articles, Richard Bischoff, Paul R. Springer, Daniel S. Felix, Cody S. Hollist

Department of Child, Youth, and Family Studies: Faculty Publications

In an effort to identify the essential ingredients of medical family therapy, a content analysis of 15 peer-reviewed case studies in medical family therapy was conducted. The case studies were published from 1996 to 2007 in Families, Systems, & Health. Through a qualitative content analysis, three main themes emerged that describe the essence of the practice of medical family therapy: (1) The patient’s multisystemic experience of disease, (2) treatment is about caring, not just caregiving, and (3) elevating the patient as collaborator in the care team.

Psychometric Evaluation Of A Proposed, Alzheimer's Aggression Scale, Kristina Little

LSU Master's Theses

Aggressive behavior is a common symptom of mid- to late-stage Alzheimer’s disease, causing unique challenges for caregivers and healthcare professionals. In previous research, aggressive behavior related to dementia was linked to higher caregiver distress and burden. The purpose of this study was to examine the psychometric properties of an aggressive behavior subscale of the Revised Memory and Behavior Problem Checklist (RMBPC) among Alzheimer’s disease caregivers. The subscale measures the frequency of aggressive behavior and the caregiver’s reaction. The sample consisted of 419 caregivers reporting some frequency of aggressive behavior by the care recipient. Exploratory factor analysis was favorable. Convergent validity …

An Historical Analysis Of Character Education, Michael Watz

Journal of Inquiry and Action in Education

What is termed character education in today’s world has been called many things throughout the history of education in this country. Character education has been both a formal and informal part of schools. At times it has been integrated in small ways into many other pieces of the curriculum. At other times it has been a unique piece of the curriculum as highlighted by the variety of standalone character education programs that are currently running in schools today. Much of character education in the United States can be closely tied in its roots to the education of character in Europe, …
