Family Law Scholarship Goes To Court: Functional Parenthood And The Case Of Debra H. V. Janice R., Suzanne B. Goldberg, Harriet Antczak, Mark Musico Jan 2011

Family Law Scholarship Goes To Court: Functional Parenthood And The Case Of Debra H. V. Janice R., Suzanne B. Goldberg, Harriet Antczak, Mark Musico

Faculty Scholarship

Family law literature, while diverse in its exploration of contemporary families, also offers important threads of consensus. These strong points of coherence, when brought together with relevant case law, can be a useful means of advancing the academic conversation as well as engaging directly with courts to shape the law's development.

In a field as complex as family law, myriad academic viewpoints on any given issue often make it difficult to imagine scholarly discussion having utility for courts. As we aim to show here, however, amicus briefs can be important vehicles for synthesizing the literature, highlighting basic points of consensus …

A Qualitative Investigation Of The Use Of An Art-Based Technique In Counselor Group Supervision, Cheryl Shiflett Jan 2011

A Qualitative Investigation Of The Use Of An Art-Based Technique In Counselor Group Supervision, Cheryl Shiflett

Counseling & Human Services Theses & Dissertations

While the counseling community embraces the use of creative approaches in counseling and supervision, few researchers have attempted to empirically describe the process of including an art-based technique into counselor group supervision. A grounded theory design guided the exploration of the factors and processes of including one art-based technique into six counselor supervision groups. Six doctoral-level supervisors who were trained in an art-based technique known as the visual case processing method introduced the method to their group supervisees who were completing a semester-long practicum or internship. Data collection methods included individual and focus group interviews, observations of visual case presentations, …

Deterring Serious And Chronic Offenders, Thomas A. Loughran, Alex R. Piquero, Jeffrey A. Fagan, Edward P. Mulvey Jan 2011

Deterring Serious And Chronic Offenders, Thomas A. Loughran, Alex R. Piquero, Jeffrey A. Fagan, Edward P. Mulvey

Faculty Scholarship

This chapter examines ways of deterring serious and chronic offenders based on evidence from the Pathways to Desistance Study, which addresses the issue of perceptions of deterrence and looks into the mechanisms of deterrence for serious offenders. After a brief overview of the Pathways study, the chapter reviews empirical evidence that demonstrates the rationality of high-risk adolescents regarding involvement in crime. It argues that offenders take into account rational-choice perceptions in their offending decisions and goes on to discuss the elasticity and malleability of these perceptions, and whether adolescent offenders act differently when they change risk and cost perceptions. It …

A Populist Threat To China's Courts?, Benjamin L. Liebman Jan 2011

A Populist Threat To China's Courts?, Benjamin L. Liebman

Faculty Scholarship

Is the Chinese party-state too responsive to public opinion? In the case of the courts, this may be the case. Western literature has devoted extensive attention to the problems in the Chinese legal system, in particular in the courts, describing a system that continues to be undermined by a range of problems, from corruption to lack of competence to continued Communist Party intervention. Likewise, existing literature describes a legal system that often is unresponsive to individual demands for justice. In this chapter, I examine another possibility: that one impediment to the development of courts that are able to protect individual …

The Challenges Of Developing Cross-Cultural Legal Ethics Education, Professional Development, And Guidance For The Legal Professions, Philip Genty Jan 2011

The Challenges Of Developing Cross-Cultural Legal Ethics Education, Professional Development, And Guidance For The Legal Professions, Philip Genty

Faculty Scholarship

The broad goal of this paper is to describe the need, and provide a framework, for engaging in cross-cultural conversations among lawyers, law teachers, and others, who are using legal ethics as a vehicle for improving the legal professions and the delivery of legal services. All legal cultures struggle with the question of how to educate students and lawyers to be ethical professionals and how to regulate the legal profession effectively. The purpose of the cross-cultural conversations discussed in this paper would be to develop principles of legal ethics education, professional development, and regulation of the legal professions that can …

Kiobel And Corporate Immunity Under The Alien Tort Statute: The Struggle For Clarity Post-Sosa, Dorothy S. Lund Jan 2011

Kiobel And Corporate Immunity Under The Alien Tort Statute: The Struggle For Clarity Post-Sosa, Dorothy S. Lund

Faculty Scholarship

In September 2010, a two-judge Second Circuit majority ruled that corporations are immune from liability under the Alien Tort Statute (“ATS”). This statute, which grants aliens access to federal district courts, has emerged as a controversial tool for international norm enforcement in the last thirty years. The unexpected decision to foreclose corporate liability has generated a wave of criticism from human rights activists and international law scholars who claim that the decision is grounded in a fundamental misunderstanding of international law.

This commentary examines the Kiobel decision against other recent interpretations of the ATS, especially those following the Supreme Court’s …

Children's And Parents' Depression In Relation To Family-Based Behavioral Weight Loss Treatment Outcome, Rachel Kolko Jan 2011

Children's And Parents' Depression In Relation To Family-Based Behavioral Weight Loss Treatment Outcome, Rachel Kolko

All Theses and Dissertations (ETDs)

Baseline parent-report of child depression and parent self-reported depression have been found to predict childrenΓÇÖs outcome in family-based behavioral weight loss treatment: FBT), although less is known about how child self-reported depression, changes in depression over time, and depression assessed via multiple informants is associated with FBT outcome. Two hundred and forty-one overweight children and their parents entered FBT, and 178 completed the pre- and post-FBT assessments. Depression was assessed via child and parent self-report, and parent-report on child. Linear regression examined child and parent depression: both baseline and change from baseline to post-FBT) as predictors of child FBT outcome: …

Examining The Effectiveness Of Multiple Imputation: A Case Study On Hiv Risk Behaviors In Women Receiving Treatment For Substance Use Disorders, Raphiel Murden

All Theses and Dissertations (ETDs)

Women in the United States are becoming infected with HIV more quickly now than ever before; many of whom are at higher risk because of their substance use habits or that of their partners.: CDC, 2010) This study analyzes cross sectional data regarding the risk behaviors and addiction severity of a sample of women receiving treatment for substance use disorders: SUDs). The data was gathered between 2006 and 2010 at a women's substance use treatment center in St. Louis, Missouri: MO), the name of which cannot be disclosed. We develop a scale, the HIV Risk Scale: HRS), to quantify a …

The Impact Of Cultural And Environmental Factors On The Experiences Of Survivors Of Gendered Violence In The African American Community, Alana Fields Jan 2011

The Impact Of Cultural And Environmental Factors On The Experiences Of Survivors Of Gendered Violence In The African American Community, Alana Fields

All Theses and Dissertations (ETDs)

I propose to examine cultural factors mediating silence surrounding “gendered violence” in the African American community, utilizing St. Louis as a case study. I hypothesize that two phenomenon are in play, “Black Male Privilege” in conjunction with “collectivism”. I expect to demonstrate that - using an ethnographic methodology - these phenomena work to create and normalize a climate of silence relating to gendered violence. I suggest that these phenomena also work to perpetuate a culture of acceptability about gendered violence and preclude the understanding of the dynamic intersection of race, gender and class which cause insufficient access to culturally sensitive …

Processing Speed And Executive Abilities In Children With Phenylketonuria, Alicia Janos Jan 2011

Processing Speed And Executive Abilities In Children With Phenylketonuria, Alicia Janos

All Theses and Dissertations (ETDs)

Objective: Phenylketonuria: PKU) is a hereditary metabolic disorder that often results in neuropsychological impairment, even in individuals treated early and continuously. This study was conducted to examine processing speed, variability in processing speed, and the relationship between processing speed variables and executive abilities in children with early- and continuously-treated PKU. Method: Participants were 42 children with PKU and 81 typically-developing children ranging from 7 to 18 years of age. Children completed three computerized reaction time: RT) tasks: simple reaction time, go/no-go, stimulus-response compatibility) and seven tasks assessing various aspects of executive abilities: working memory, inhibitory control, strategic processing). Results: The …

Likely Old Or Likely New? Taking Memory Advice During Recognition Decisions, Diana Selmeczy Jan 2011

Likely Old Or Likely New? Taking Memory Advice During Recognition Decisions, Diana Selmeczy

All Theses and Dissertations (ETDs)

We examined the influence of external recommendations on recognition memory decisions. In contrast to prior literature that primarily focuses on the negative impacts of external influences during memory judgments, we investigated whether participants can capitalize on explicit reliable recommendations in order to improve their performance. In the first experiment, participants were given explicit external recommendations: “Likely Old” or “Likely New”) that were 75% accurate for deeply and shallowly encoded test items. In the second experiment, participants were given varying levels of recommendations: 65% and 85% accurate). Across both experiments we found that participants improved their performance when given external recommendations …

Often Wrong But Never In Doubt: Categorized Lists Produce Confident False Memories, Kurt Desoto Jan 2011

Often Wrong But Never In Doubt: Categorized Lists Produce Confident False Memories, Kurt Desoto

All Theses and Dissertations (ETDs)

In the categorized list procedure, subjects study words from semantic categories, then take a recognition test on those items. Subjects are likely to recognize common: high output dominance) category members even when they are not studied. Across three experiments, we sought to extend the categorized list procedure, further develop an explanation of why false recognition of category members occurs in this procedure, and modulate false recognition of category members by manipulating encoding and retrieval phases. Experiment 1 extended previous categorized list research, showing that subjects are likely to false alarm with high confidence to high output dominance category members that …

Speling "Successful" Sucesfuly: Statistical Learning In Spelling, Siti Syuhada Binte Faizal

All Theses and Dissertations (ETDs)

Many spelling errors in English are doubling errors, as when people are stumped by the double ‹l› in ‹trellis›. In Study 1, we tabulated statistical patterns with regards to doubling in English. In Study 2, we collected behavioral data to see if people were sensitive to these statistical patterns in doubling and to explore other factors that might influence doubling such as context, individual differences: language background and spelling ability), and task. We gave two nonword spelling tasks to US college students: N=68) and bilingual Singaporean college students from an English-based education system but with diverse language backgrounds: Mandarin: N=54), …
