Cftc V. Gibraltar Monetary Corp. And Vicarious Liability Under The Commodity Exchange Act, Jason E. Friedman

This Comment analyzes CFTC v. Gibraltar Monetary Corp., a 2009 decision in which the U.S. Court of Appeals for the Eleventh Circuit introduced a control requirement into the Commodity Exchange Act's vicarious liability provision. In so doing, the court rejected the U.S. Commodity Futures Trading Commission's long-held totality of the circumstances approach, in which any one factor, including control, is not dispositive of an agency relationship. This decision has created an undesirable situation in which retail foreign exchange dealers and futures commission merchants need not investigate the character of their introducing entities before retaining them, allowing them to easily avoid …

A Computational Flow Model Of Oxygen And Nitric Oxide Transport & Reactions And The Relation With Glaucoma, Lukas Holsen

The purpose of this project is to create a computational model of a precapillary arteriole network near the optic nerve head (ONH) using computational fluid dynamics modeling (CFD, Fluent, ANSYS, Inc.). The CFD analysis will contain a blood flow model coupled with oxygen (O2) and nitric oxide (NO) transport and reactions. Until recently it was believed that elevated intraocular pressure (IOP) was causal in glaucoma, however recent studies demonstrate that glaucoma is associated with sensitivity to IOP itself. Because of this insight, other mechanisms besides mechanical damage that could cause glaucomatous neurodegeneration need to be explored, such as alterations in …

A growing body of research in higher education suggests that teachers should move away from traditional lecturing towards more active and student-focus education approaches. Several classroom techniques are available to engage students and achieve more effective teaching and better learning experiences. The purpose of this paper is to share an example of how two of them – case-based teaching, and the use of response technologies – were implemented into a graduate-level food science course. Batik is one of popular arts of Indonesia. The batik industries in Sragen, Central Java, are prepared to compete in global market. In order to realize that objective, batik products should fulfill some qualifications, one of which is “environmental friendliness”. Nitrogen is one of the most important minerals for living organisms. Azolla is known as a small water fern which can fix nitrogen through the symbiotic association with the blue green algae Anabaena. Experimental studies were carried out in the glass house, investigating the growth of Azolla using different levels of nitrogen and phosphorus in the media. The experiment used 12 treatments with 3 levels of nitrogen (0, 5, and 10 mg atom/L) and 4 levels of phosphorus (0, 10, 20, and 30 mg atom/l) in a factorial design with 3 replicates. Cassava pulp, a low cost solid byproduct of cassava starch industry, has been proposed as a high potential ethanolic fermentation substrate due to its high residual starch level, low ash content and small particle size of the lignocellulosic fibers. As the economic feasibility depends on complete degradation of the polysaccharides to fermentable glucose, the comparative hydrolytic potential of cassava pulp by six commercial enzymes were studied. Raw cassava pulp (12% w/v, particle sizeμm) hydrolyzed by both commercial pectinolytic (1) and amylolytic (2) enzymes cocktail, yielded 70.06% DE. Maternal, Neonatal And Feeding Type Factors Associated With Severity Of Necrotizing Enterocolitis, Cheryl Ann Miner

Objective: To identify statistical associations with necrotizing enterocolitis (NEC) severity as dichotomized into cases with Bell stage II and III disease.
Study Design: We conducted a retrospective study using eight consecutive years of data from a multihospital healthcare system analyzed NEC severity (Bell stage II vs. III).
Results: We identified 220 neonates with stage ≥ II who had 225 separate episodes of NEC (157 stage II and 68 stage III). Those with stage III were born at earlier gestational age (P<0.0001) and lower birth weight (P<0.0001). Diagnosis of NEC occurred on about the same day of life in stage II and stage III cases. Those who developed stage III had significantly higher C-reactive protein (P<0.0001), I/T ratio (P= 0.0005), mean platelet volume (MPV) (P= 0.0001) and lower pH (P<0.0001) and platelet counts (P<0.0001). Transfusions were more common to those who progressed to stage III (P<0.0001). Regression analysis indicated higher odds of stage III in relationship to the volume of RBC transfusions (OR 2.41, {CI 1.85 to 3.11}, P<0.0001) and pasteurized human milk (PHM) (OR 1.32, {CI 1.07 to 1.62}, P = 0.0089). In contrast, feeding early mother's own milk (colostrum) for five days reduced the odds for stage III (OR 0.802, {CI 0.67 to 0.96}, P=0.0170). Those with small bowel resection were less likely to have received mother's own milk before NEC (OR 0.94, {CI 0.89 to 0.99}, P = 0.019) and factors predicting death from NEC were a low pH (OR 2.21, {CI 1.27 to 3.85}, P = 0.0005) and less colostrum (OR 0.96, {CI 0.94 to 0.99}, P = 0.003).

Levels of exposure to ionizing radiation are increasing for women worldwide due to the widespread use of CT and other radiologic diagnostic modalities. Exposure to ionizing radiation as well as increased levels of estradiol and other sex hormones are acknowledged breast cancer risk factors, but the effects of whole-body radiation on serum hormone levels in cancer-free women are unknown. This study examined whether ionizing radiation exposure is associated with levels of serum hormones and other markers that may mediate radiation-associated breast cancer risk.
