This paper argues that the core principle of bioethics, autonomy, is rooted both in the 20th century history of the development of new medical technologies as in political liberalism transferred to medical practices, rendering the medical decision-making of patients a centerpiece of medical interventions. The paper shows how the ambiguity in the interpretation of autonomy reflects the ambivalence of bioethics towards making normative claims on the moral agents insofar as these go beyond the respect for a patient’s autonomy. A Catholic hospital in Phoenix “acted in accord with the Ethical and Religious Directives, Catholic moral tradition and universally valid moral precepts” in carrying out a controversial procedure on an ill pregnant woman that resulted in the death of the unborn child, theologian M. Therese Lysaught said in a moral analysis of the situation. Phoenix Bishop Thomas J. Olmsted determined that the November 2009 procedure constituted a direct abortion, and he subsequently stripped St. Joseph’s Hospital and Medical Center of its Catholic status. One of the questions I address in my scholarly work is this: What would Catholic theological ethics look like if it took the "Black Experience" seriously as a dialogue partner? To raise the question, however, is to signal the reality of absence, erasure, and "missing" voices. The question is necessary only because the "Black Experience"--the collective story of African American survival and achievement in a hostile, exploitative, and racist environment--and the bodies who are the subjects of this experience have been all too often rendered invisible and therefore "missing" in U.S. Catholic ethical reflection.

Obstetric ethics is sometimes represented by polarized views. One extreme asserts the rights of the fetus as the overwhelming ethical consideration. Both assertions are overly simplistic. Such oversimplification is called reductionism. This article explains the fallacy of rights-based reductionism and 2 models of obstetric ethics based on it and explains why the fetal rights reductionism model and the pregnant woman's rights reductionism model result in conceptual and clinical failure and therefore should be abandoned. Throughout the papers of this book, the CIT appears not to be an abstract concept but a dynamic reality, a powerful source of inspiration for imagining creative ways to face the challenges of life in today’s world. Critical voices question the reference to Catholicism, others to a tradition. While addressing these issues helps to prevent the CIT from becoming the victim from either unreligious or traditionalist misconceptions, a synthetic approach will try to reveal fundamental dynamisms of the CIT that allow to identify it without reducing its inherent complexity and historical diversity, including its expressions yet to come.

Liberal allowance of rescission followed by restitution has, for centuries, unsettled legal authorities who fear it as a threat to commercial order or other normative values. Responding to these fears, authorities have limited the ease with which rescission may be elected. Their responses, however, are often excessive and based on misunderstandings of the remedy’s effects. Rescission, followed by restitution, may in fact promote contracting by allowing parties to create efficient incentives. Concern about the stability of contracting is not entirely unfounded, but the problem is not primarily due to the ease of rescission following breach; rather, the problem concerns the …

The School of Engineering at the University of Dayton (UD), a Catholic and Marianist University, boasts large enrollments of 1,300 undergraduate and 350 graduate students out of a total of 7,000 undergraduates and 3,000 graduate students. It also boasts a faculty very active in research, which, under the umbrella of the University of Dayton Research Institute, is funded at a level of $100 million per year.

This dissertation explores the liturgical theology of the late Aidan Kavanagh, OSB. His particular approach to liturgy helped to shape the implementation of the liturgical changes instituted by the Second Vatican Council. His early published works were instrumental in explaining the goals of these liturgical changes, while his later works offered a not-so-subtle critique of how the changes had begun to impact the American Church. Fr. Kavanagh based the importance of liturgy on several unique and potentially controversial subjects. To Fr. Beauchamp and Childress' Principles of Biomedical Ethics is a well accepted approach to contemporary bioethics. Those principles are based on what Beauchamp and Childress call the common morality. This dissertation employs New Testament theological themes to enhance the meaning of contemporary principles of bioethics. Beginning with the incarnation in the New Testament, the invitation-response hermeneutic is developed as a hermeneutic to use in studying the New Testament. This paper suggests that judicial opinions often reflect ajudge's position on what is ethical and useful in the real world of constitutional values. It further suggests that an appreciation of legal philosophical theory assists one in understanding the ethical and public policy dimensions of a court's opinion. Do judges' opinions parallel philosophical theories constructed by philosophers or is any apparent relationship mere coincidence? This paper suggests the former-that a judge's belief system, education, and experiences 2 include the adoption of judicial philosophies, the expression of which can be found in his or her written opinions.
