Smartphone, Dumb Regulations: Mixed Signals In Mobile Privacy, Christian Levis
Smartphone, Dumb Regulations: Mixed Signals In Mobile Privacy, Christian Levis
Fordham Intellectual Property, Media and Entertainment Law Journal
The smartphone has turned a user’s location into valuable information. Users of smart devices can use location-based mobile services to get driving directions, check into social networks, or even see which of their friends are around. But the use of this technology, and the new type of data created by it, raises privacy concerns as to who has access to one's location-based information. Because the only legislation covering this technology, the Electronic Communications Privacy Act, is more than twenty-five years old, courts encounter problems when trying to use it to resolve these privacy issues, often reaching illogical results. The Alternative Appeal, Courtney Deroo
The Alternative Appeal, Courtney Deroo
Health Sciences Student Scholarship
For decades, Americans expressed dissatisfaction with conventional cancer treatments. I examine the appeal of biological alternatives to surgery, chemotherapy, and radiation therapy for patients with cancer. The limited effectiveness and side effects of many conventional cancer therapies led many patients to pursue a variety of unconventional therapies. To improve the quality of care for cancer patients, "mainstream" providers must better understand, and even collaborate with, alternative practitioners.

Celebrity Endorsements In Non-Traditional Advertising: How The Ftc Regulations Fail To Keep Up With The Kardashians, Leah W. Feinman
Celebrity Endorsements In Non-Traditional Advertising: How The Ftc Regulations Fail To Keep Up With The Kardashians, Leah W. Feinman
Fordham Intellectual Property, Media and Entertainment Law Journal
Advertisers have used the rise of reality television, social media, and the public's fascination with celebrities to connect with consumers in new and non-traditional ways. With these new techniques come new concerns over consumer protection. When an advertisement does not look like an advertisement, consumers can easily be misled. In 2009, the FTC implemented a set of Guides which were intended to clarify and interpret the regulations enforced by the FTC, and advise the public on how to conduct affairs regarding sponsorship disclosure, specifically in new media. As the note describes, the Guides are insufficient as applied to non-traditional advertising …

Multi-National Patent Litigation: Management Of Discovery And Settlement Issues And The Role Of The Judiciary, James Pooley, Vicki Huang
Fordham Intellectual Property, Media and Entertainment Law Journal
National patent laws protect intellectual property rights. However, these rights can only be enforced in the country that granted the patent. Therefore, a patent owner must pursue infringement or revocation proceedings in each country where his patent rights are challenged even if the defendant is the same party. Patent owners are forced to pursue duplicative litigation on a nation-by-nation basis, incurring significant costs and draining valuable judicial resources. Duplicative litigation may result in conflicting outcomes, the impact of which can be complex and costly.... This article will focus on Germany, Japan, the United Kingdom, and the United States. First, we will …

Better Speakers Make More Friends: Predictors Of Social Network Development Among Study-Abroad Students, J Wyatt Brockbank
Better Speakers Make More Friends: Predictors Of Social Network Development Among Study-Abroad Students, J Wyatt Brockbank
Theses and Dissertations
Social network development has been studied in the social sciences for the last several decades, but little work has applied social network theory to study-abroad research. This study seeks to quantitatively describe factors that predict social network formation among study-abroad students while in the host countries. Social networks were measured in terms of the number of friends the students made, the number of distinct social groups reported, and the number of friends within those groups. The Study Abroad Social Interaction Questionnaire was compared against these pre-trip factors: intercultural competence, target-language proficiency, prior missionary experience, gender, study-abroad program, neuroticism, extroversion, agreeableness, …
La Grande Arche Des Fugitifs?,/I> Huguenots In The Dutch Republic After 1685, Michael Joseph Walker
La Grande Arche Des Fugitifs?,/I> Huguenots In The Dutch Republic After 1685, Michael Joseph Walker
Theses and Dissertations
In the seventeenth century, many refugees saw the United Provinces of the Netherlands as a promised land—a gathering ark, or in French, arche. In fact, Pierre Bayle called it, "la grande arche des fugitifs." This thesis shows the reception of one particular group of Protestant refugees, the Huguenots, who migrated to the Netherlands because of Catholic confessionalization in France, especially after the Revocation of the Edict of Nantes in 1685. The thesis offers two case studies—one of the acceptance of Huguenot clergymen and one of the mixed reception of refugee radical and philosopher Pierre Bayle—in order to add nuance …

Framework To Secure Cloud-Based Medical Image Storage And Management System Communications, Timothy James Rostrom
Framework To Secure Cloud-Based Medical Image Storage And Management System Communications, Timothy James Rostrom
Theses and Dissertations
Picture Archiving and Communication Systems (PACS) have been traditionally constrained to the premises of the healthcare provider. This has limited the availability of these systems in many parts of the world and mandated major costs in infrastructure for those who employ them. Public cloud services could be a solution that eases the cost of ownership and provides greater flexibility for PACS implementations. This could make it possible to bring medical imaging services to places where it was previously unavailable and reduce the costs associated with these services for those who utilize them. Moving these systems to public cloud infrastructure requires …
Damage Tolerance Of Unidirectional Basalt/Epoxy Composites In Co-Cured Aramid Sleeves, Devin Nelson Allen
Damage Tolerance Of Unidirectional Basalt/Epoxy Composites In Co-Cured Aramid Sleeves, Devin Nelson Allen
Theses and Dissertations
Unidirectional basalt fiber rods consolidated with an aramid sleeve were measured for compression strength after impact at various energy levels and compared to undamaged control specimens. These structural elements represent local members of open three-dimensional composite lattice structures (e.g., based on isogrid or IsoTruss® technologies) that are continuously fabricated using advanced three-dimensional braiding techniques. The unidirectional core specimens, nominally 8 mm (5/16") and 11 mm (7/16") in diameter, were manufactured using bi-directional braided sleeves or unidirectional spiral sleeves with full or partial (approximately half) coverage of the core fibers. The 51 mm (2") specimens were shorter than the critical buckling …

Damage Tolerance Of Buckling-Critical Unidirectional Carbon, Glass,And Basalt Fiber Composites In Co-Cured Aramid Sleeves, Michael D. Embley
Theses and Dissertations
Compression strength after impact tests were conducted on unidirectional composite rods with sleeves. These elements represent local members of open three-dimensional composite lattice structures (e.g., based on isogrid or IsoTruss® technologies). The unidirectional cores composed of carbon, glass, or basalt fiber/epoxy composites were co-cured in aramid sleeves. Sleeve patterns included both bi-directional (unsymmetric) braids and unidirectional spiral wraps with sleeve coverage ranging from nominally half to full. The diameters were nominally 8 and 11 mm (5/16 and 7/16 in). The larger diameter had nominally twice the cross-sectional area, to quantify the effects of scaling. The specimens were long enough to …
Creativity And Innovation: A Comparative Analysis Of Assessment Measures For The Domains Of Technology, Engineering, And Business, Tyler Lewis
Theses and Dissertations
The purpose of this literature review is to investigate and discuss: (1) the characteristics measured by innovation assessments, and (2) the comparison of characteristics measured by creativity assessments with those of innovation assessments. This will be done by: (1) collecting creativity and innovation assessments, and (2) comparing and contrasting the characteristics measured by each assessment. This study reveals that innovation assessments do not measure the innovation process in its entirety. The findings show that creativity and innovation assessments lack in assessing the entire innovation process, assessing the innovation process on an individual level, and assessing an individual's change or growth …

Lilburn W. Boggs And The Case For Jacksonian Democracy, Robert John Walker
Theses and Dissertations
Lilburn W. Boggs and the Case for Jacksonian Democracy Robert John Walker Department of Religion, BYU Masters of Religious Education Lilburn W. Boggs was lieutenant governor of Missouri from 1832 to 1836. He was governor of Missouri from 1836 to 1840. Political upheaval was the order of the day as Jacksonian democrats overthrew, through the power of the ballot box, the establishment of the patrician leadership in the United States. Issues of equity, slavery, religion, settlement of the West, and divisive sectionalism threatened the Union of the states. President Andrew Jackson was the representation of the common man and the …

Model Decomposition And Constraints To Parametrically Partition Design Space In A Collaborative Cax Environment, Felicia Diane Marshall
Model Decomposition And Constraints To Parametrically Partition Design Space In A Collaborative Cax Environment, Felicia Diane Marshall
Theses and Dissertations
An industry survey was conducted to collect information on current collaboration methods and project management and communication structures. The results, along with other design collaboration philosophies, were used to develop a method of coordinating users in a multi-user design space. These thesis methods will regulate collaboration and avoid user collisions in the same model space, either by cooperative interaction or by spatial decomposition with regional blocking. The method partitions the design space by integrating a graphical user interface tool into the engineering application used to define and assign the necessary tasks of the project. A simple implementation of this method …

Theses and Dissertations
In this thesis, I discuss the function and use of decorated ceramic bowls at Fourmile Ruin, a Pueblo IV site located in east-central Arizona. My research focused on three wares dating to the Pueblo IV period of the American Southwest (AD 1275-1450): White Mountain Red Ware, Salado Polychrome, and Jeddito Yellow Ware. These wares represent the most abundant type of decorated ceramic bowls found at Fourmile Ruin. Ceramic wares and types are described, followed by a description of their physical and stylistic characteristics and functions, an analysis of how vessels were used, and, lastly, a discussion of the contexts within …
Macrobotanical Evidence Of Diet And Plant Use At Wolf Village (42ut273), Utah Valley, Utah., Wendy Dahle
Macrobotanical Evidence Of Diet And Plant Use At Wolf Village (42ut273), Utah Valley, Utah., Wendy Dahle
Theses and Dissertations
Farming played a role in the subsistence base for the Fremont culture, but there is no consensus as to how significant that role was. Maize is consistently found in Fremont sites, but evidence of wild plant use is also abundant. The use of both domesticates and foraged plants by the Fremont, combined with the diversity of the landscape and sites that were inhabited by the Fremont, contributes to the diversity of theories on Fremont subsistence. This thesis examines evidence for plant usage at Wolf Village, a Fremont site in Utah Valley. Wolf Village is ideally situated for a Fremont farming …
Security Cooperation Poorly Defined, Nathan L. Fenell
Security Cooperation Poorly Defined, Nathan L. Fenell
Master's Theses
Security cooperation is a vital component to the national security of the United States. Despite this fact, insufficient military or academic attention has been applied to the subject. The academic and professional void created by this inattention has led academic, journalistic, and military professionals to misuse the term security cooperation, and stray from its doctrinal description as defined by the Department of Defense Dictionary and Associated Military Terms. The academic rigor required to properly express the concept of security cooperation as a peace-time strategy has been absent from both the Department of Defense, and the Department of State, and …
