When Men Are Harmed: Feminism, Queer Theory, And Torture At Abu Ghraib, Aziza Ahmed
When Men Are Harmed: Feminism, Queer Theory, And Torture At Abu Ghraib, Aziza Ahmed
Faculty Scholarship
In this Article I explore the assertions of "anti-imperialist" feminist scholars who critique "imperial feminism" for its support of the war on terror (WOT). I bring into this analysis the proposition by queer theorists that feminist reliance on male/ female subordination has the potential to not only obscure harm in times of war but also to perpetuate it. As a case study, I focus on the Abu Ghraib prison photos that depict, in part, female soldiers torturing male Iraqi prisoners. In conducting this analysis, I reveal the analytical limitations of dominance and cultural feminists, particularly with regard to male harm …

Website Design As Contract, Woodrow Hartzog
Website Design As Contract, Woodrow Hartzog

Few website users actually read or rely upon terms of use or privacy policies. Yet users regularly take advantage of and rely upon website design features like privacy settings. To reconcile the disparity between boilerplate legalese and website design, this article develops a theory of website design as contract. The ability to choose privacy settings, un-tag photos, and delete information is part of the negotiation between websites and users regarding their privacy. Yet courts invariably recognize only the boilerplate terms when analyzing online agreements. In this article, I propose that if significant website features are incorporated into the terms of …

Creditor Claims In Arbitration And In Court, Christopher R. Drahozal, Samantha Zyontz
Faculty Scholarship
This article is based on the Interim Report, Creditor Claims in Arbitration and in Court, issued in November 2009 by the Searle Civil Justice Institute's Consumer Arbitration Task Force. It seeks to compare the outcomes of debt collection arbitrations to the outcomes of debt collection cases in court to help in evaluating arbitration as a means of resolving consumer disputes. The arbitration cases examined are debt collection cases administered by the American Arbitration Association (AAA) as part of its consumer arbitration docket, supplemented by cases brought by a single debt buyer as part of a consumer debt collection program administered …
Network Accountability For The Domestic Intelligence Apparatus, Danielle K. Citron, Frank Pasquale
Network Accountability For The Domestic Intelligence Apparatus, Danielle K. Citron, Frank Pasquale
Faculty Scholarship
A new domestic intelligence network has made vast amounts of data available to federal and state agencies and law enforcement officials. The network is anchored by “fusion centers,” novel sites of intergovernmental collaboration that generate and share intelligence and information. Several fusion centers have generated controversy for engaging in extraordinary measures that place citizens on watch lists, invade citizens’ privacy, and chill free expression. In addition to eroding civil liberties, fusion center overreach has resulted in wasted resources without concomitant gains in security.
While many scholars have assumed that this network represents a trade-off between security and civil liberties, our …
Suitable For Framing: Business Deductions In A Net Income Tax System, David I. Walker
Suitable For Framing: Business Deductions In A Net Income Tax System, David I. Walker
Faculty Scholarship
The federal income tax code includes numerous provisions disallowing or curtailing income tax deductions related to such disparate activities as providing non-performance based compensation to senior corporate executives and business lobbying. The primary claim of this article is that a tendency to mentally frame business deductions as subsidies, often reinforced by rhetoric explicitly framing deductions as subsidies, helps explain these provisions. The traditional “public policy” disallowances directed at lobbying, fines and penalties paid by businesses, and antitrust treble damages respond to an appearance of a taxpayer subsidy that would follow from deduction, despite the fact that it is far from …
"We Know It When We See It": Intermediary Trademark Liability And The Internet, Stacey Dogan
"We Know It When We See It": Intermediary Trademark Liability And The Internet, Stacey Dogan
Faculty Scholarship
The recent history of intermediary liability decisions in copyright and trademark law reflects a notable resistance to rules that might constrain judicial discretion to ferret out bad guys. Indeed, a dichotomy appears to be emerging between two types of defendants: those who want infringement to happen and those who do not. In both copyright and trademark cases, courts are developing two distinct sets of rules to deal with two different classes of intermediaries. Good-faith intermediaries — those with a core business model unrelated to infringement — have an obligation to address infringement upon notice, but need not go out of …

This article discusses three models of law school engagement that have been used to respond to natural disasters. The three models discussed are a disaster law clinic, a course on disaster law, and a student-led initiative featuring non-credit, pro bono placements. Each model offers a conceptual approach for integrating community-based, justice-oriented initiatives into academic and clinical teaching. Taken as templates for a more permanent model of engagement in the area of post-disaster law and social justice, these models demonstrate that the legal academy can meet its service obligation to the community while training lawyers to better appreciate the central tenets …
Have Truth And Reconciliation Commissions Helped Remediate Human Rights Violations Against Women? An Analysis Of The Past And Formula For The Future, Peggy Maisel
Faculty Scholarship
Truth and Reconciliation Commissions (TRCs) have investigated human rights violations and abuses in a wide range of countries and communities over the last thirty-five years. Created by people who believe finding truth through an examination of the past is necessary to build social and political trust, the goal of these processes has been to make findings and recommendations in order to strengthen or aid the transition to democracy, reduce conflict and create a basis for long term reconciliation, facilitate some form of transitional or restorative justice, and begin the process of change needed to avoid similar human rights violations in …
Pay For Banker Performance: Structuring Executive Compensation For Risk Regulation, Frederick Tung
Pay For Banker Performance: Structuring Executive Compensation For Risk Regulation, Frederick Tung
Faculty Scholarship
Excessive risk taking by firm managers did not originate with the Financial Crisis of 2007-08. Though bankers had special incentives to take big risks in the period before the Crisis, the incentive effects of equity-based compensation have been understood for some time. Among other things, equity compensation tends to induce greater risk taking by aligning managers’ risk preferences with those of equity holders. Longstanding government guaranties of bank liabilities additionally served to intensify bankers’ risk taking incentives.
I propose to ameliorate this gambler’s incentive with a new approach to compensation at the largest banks, one that explicitly accounts for the …

Mesmerized, Katherine Knoeringer
LSU Master's Theses
This body of work is about looking and contemplating. Intense concentration requires solitude, which is why the figures that appear in the work are either literally isolated or seem detached from others around them. Sometimes the events the figures witness are ordinary, but more often their environments have mysterious or whimsical qualities. The whimsy comes from two places; fictional literature and childhood fantasies. Reading connects me to things and ideas outside of myself and allows the work to vacillate between the reality of normal daily observation and the mental escape of daydreaming. I want to make a place where everything …
Playing Class: A Case Study Of Ludic Pedagogy, Jessica Broussard
Playing Class: A Case Study Of Ludic Pedagogy, Jessica Broussard
LSU Doctoral Dissertations
The purpose of this study was to examine the efficacy of transforming traditional classroom content and teaching strategy into a "gamified" version through the use of popular gaming strategy, or, in other words, how a college course can be designed or redesigned to mimic ludic pedagogy, as well as the influence of this pedagogy on student performance in understanding course content and course assessments. The researcher acted as a participant observer and used Constant Comparative Method as data driven teaching focused on student created documents. This research provides an exploration on the use of ludicly styled teaching methodology which includes …

Corporate Governance Reform For The 21st Century: A Critical Reassessment Of The Shareholder Primacy Model, Carol Liao
Corporate Governance Reform For The 21st Century: A Critical Reassessment Of The Shareholder Primacy Model, Carol Liao
All Faculty Publications
This article questions the efficiency of the shareholder primacy model of corporate governance in light of the financial calamities that have plagued the first decade of the 21st century. Reform efforts following the global financial crisis have focused on failures in securities regulation, but that is only part of the story. Effective reform measures must also address the legal and normative prescriptions found within existing governance structures, and the collateral effect those prescriptions have on political and regulatory inaction.
There was strong ideological support for the shareholder primacy model at the start of the century. Following the corporate and accounting …
Indonesia's Law On Public Services: Changing State-Society Relations Or Continuing Politics As Usual?, Michael Buehler
Indonesia's Law On Public Services: Changing State-Society Relations Or Continuing Politics As Usual?, Michael Buehler
Faculty Articles, Papers, and Other Scholarship
Institutional reforms introduced after the collapse of the New Order regime have brought state–society relations in Indonesia under increased scrutiny. This paper uses an evaluation of Law 25/2009 on Public Services as a means to assess whether the new political setting has increased the leverage of the citizenry over the state. Adopted in July 2009, the law introduced a range of regulations for public service providers. It also expanded the responsibilities of the Ombudsman's office and called for the establishment of citizen committees to monitor public service delivery. However, the legal quality of the law is poor and the broader …

Introduction: Little research exists on the prevalence of evidence-based tobacco cessation practices in workplaces, employer promotion of state-sponsored quitlines and predictors of these practices.
Methods: Cross-sectional analysis of the 2008 Healthy Worksite Survey, a telephone survey administered to Washington employers with 50 or more employees (n¼693). The objectives were to describe workplaces’ implementation of evidence-based tobacco cessation practices and identify key predictors of implementation in order to highlight opportunities for interventions.
Results: Among these employers, 38.6% promoted quitting tobacco, and 33.8% offered insurance coverage for cessation medications and counselling, 27.5% referred no-smoking violators to cessation services, and 5.7% included the …
Appalachian Bridges To The Baccalaureate: Institutional Perceptions Of Community College Transfer Success, Christopher M. Phillips
Appalachian Bridges To The Baccalaureate: Institutional Perceptions Of Community College Transfer Success, Christopher M. Phillips
University of Kentucky Doctoral Dissertations
Statement of the problem. Appalachian community colleges are dealing with a dynamic transfer policy environment and implementing practices that either foster or impede transfer student success. The problem in this dissertation is to discern how Appalachian community colleges are making sense of transfer policy changes and conducting practices to address student transfer success. Although individual factors must be considered by community colleges, they often are out of the control of the institution. This study focused on the institutional factors, including the ways that organizational structures and transfer policies contribute to the success of a community college’s transfer program.

Factors Associated With Tobacco Use Among Rural And Urban Pregnant Women, Whitney Jeanne Katirai
Factors Associated With Tobacco Use Among Rural And Urban Pregnant Women, Whitney Jeanne Katirai
University of Kentucky Doctoral Dissertations
The purpose of this study was to investigate the influences of smoking on rural and urban pregnant women. More specifically, the variables of the knowledge of health effects, health provider recommendations, subscores from the Health Belief Model (HBM), and social support were explored in relation to the smoking behavior of pregnant women. A secondary purpose was to investigate the accuracy of self-reported smoking during pregnancy using biochemical validation. Pregnant women (N=71) completed an anonymous questionnaire, designed by the researcher, to identify variables that predicted smoking for urban and rural women. Participants also gave a saliva sample for cotinine testing.

Do They Get The Picture?: Visual Literacy And Low-Literacy Adult Esl Learners, Daniel J Bruski
School of Education and Leadership Student Capstone Theses and Dissertations
Teachers of low-literate adult English language learners often use visual materials to teach content, but little research has been conducted on how these visuals are interpreted. This research explores the relationship between first language (L1) literacy and visual literacy, specifically the ability of adult ESL learners to identify the functions of graphic devices used in educational materials. The literature review examines how literacy and visual literacy are defined and discusses visual communication using the framework of semiotics. Through think-aloud interview sessions, Somali participants of varying L1 literacy levels interpreted illustrations from ESL materials. Results show lower than expected ability to …

Appalachian Bridges To The Baccalaureate: The Influence Of Multiple Roles And Cultural Norms On The Baccalaureate Persistence Of Location-Bound Appalachian Women, Nancy Coldiron Preston
University of Kentucky Doctoral Dissertations
Too few Kentucky community college students transfer and persist to earn baccalaureate degrees. This is particularly true in Appalachia Kentucky which has a high rate of poverty and a low rate of baccalaureate attainment. Scholars and economists agree that the fastest way to decrease poverty within a geographical region is to increase the educational level of the citizens. Policy makers in the Commonwealth have established a goal of doubling the number of baccalaureate holders within the state by 2020.
This study is framed by a collaborative study which examined the ways in which institutional and student characteristics impact the pathway …
Pornography Addiction: A Cognitive Approach In Combating The Lies Christian Males Believe, Farid Awad
Pornography Addiction: A Cognitive Approach In Combating The Lies Christian Males Believe, Farid Awad
Doctoral Dissertations and Projects
Pornography addiction has grown in epidemic numbers. Its bondage is evident within and outside the church walls. While sex and sexually explicit images saturate our daily lives, God continues to call His people to be holy as He is holy. Freedom from pornography addiction can be achieved only through intimate relationship with Jesus Christ and by accepting the atoning work of His cross for all believers. This thesis will redefine pornography through the lens of the Scripture and primarily focus on cognitive lies regarding oneself and others, which are crippling and ensnaring men into the trap of pornography. This study …
Threat, Violence, And Voters: Race And Context In The 2008 Presidential Election, Matthew Fowler
Threat, Violence, And Voters: Race And Context In The 2008 Presidential Election, Matthew Fowler
LSU Master's Theses
The 2008 Presidential Election brought into office the first African-American president in U.S. history. This paper analyzes variations in White support for Barack Obama based on a number of county-level contextual factors, which are hypothesized to influence aggregate White voter support for the Democratic candidate. Based on the well-known racial threat theory, this paper will explore how racial composition and income inequality effect White support for Barack Obama. Another key explanatory variable, violence, is thought to influence White voter support because of the preconceptions some of these voters hold about African-Americans. Violence helps shape the stereotypes White voters hold, and …
Evaluation Of Simultaneous Water And Gas Injection Using Co2, Shrinidhi Shetty
Evaluation Of Simultaneous Water And Gas Injection Using Co2, Shrinidhi Shetty
LSU Master's Theses
Miscible CO2 injection is the second largest contributor to global enhanced oil recovery, as it has successfully undergone extensive laboratory tests and field applications for recovering residual oil left behind after waterflooding. Prolific incremental recoveries have been obtained for some fields. Although miscible CO2 injections generally have excellent microscopic displacement efficiency they often result in poor sweep efficiency. In order to address sweep problems and maximize recoveries, other schemes of gas injection have been developed. Two such processes are water-alternating-gas (WAG) and simultaneous water-and-gas (SWAG) injection. WAG and SWAG have been successfully used to minimize poor sweep. Improved gas utilization …
Characterization Of Spiroplasma Mirum And Its Role In Transmissible Spongiform Encephalopathies, Hilari Maree French
Characterization Of Spiroplasma Mirum And Its Role In Transmissible Spongiform Encephalopathies, Hilari Maree French
LSU Doctoral Dissertations
There are many contradictory reports in the literature involving the culture of Spiroplasma mirum, its resistance to disinfectants and antibiotics, and its potential role in Transmissible Spongiform Encephalopathies (TSEs). These contradictions led to an interest in a possible link between spiroplasma and TSEs and the development of a research plan to elucidate this connection. It was hypothesized that Spiroplasma was associated with a neurodegenerative disease such as TSE. In this work we further characterized S. mirum laboratory strains and continued to evaluate the possible correlations they have with TSE infections and the prion. To optimize recovery of S. mirum from …

Chemistry Faculty Publications and Presentations
The extracellular pH (pH(e) ) of solid tumors is acidic, and there is evidence that an acidic pH(e) is related to invasiveness. Herein, we describe an MRI single-infusion method to measure pH(e) in gliomas using a cocktail of contrast agents (CAs). The cocktail contained gadolinium-1,4,7,10-tetraazacyclododecane-1,4,7,10-tetraaminophosphonate (GdDOTA-4AmP) and dysprosium-1,4,7,10-tetraazacyclododecane-N,N',N'',N'''-tetrakis(methylenephosphonic acid) (DyDOTP), whose effects on relaxation are sensitive and insensitive to pH, respectively. The Gd-CA dominated the spin-lattice relaxivity ΔR(1) , whereas the Dy-CA dominated the spin-spin relaxivity ΔR(2)*. The ΔR(2)* effects were used to determine the pixel-wise concentration of [Dy] which, in turn, was used to calculate a value for [Gd] …

(Im)Possibilities Of Theatre And Transgression: The Critical Impact Of Transgressive Theatrical Practices, Christopher J. Krejci
LSU Doctoral Dissertations
While performance practitioners often rely on socially, aesthetically, and politically transgressive practices to critically impact the socio-political climate outside the theater walls, transgression is fraught with contradiction. Historically, acts of transgression have led to both the expansion and suppression of democratic rights. (Im)possibilites of Theatre and Transgression employs a critical lens that takes into account the historical and ideological specificities of individual productions in Austin, TX and Baton Rouge, LA to argue that transgressive theatrical practices both counter and reproduce normalizing discourses and discourses of domination in local and regional culture. This study focuses on the types of aesthetically, socially, …

Comorbid Psychopathology In Children With Autism Spectrum Disorders - Cut-Off Scores For The Autism Specturm Disorders-Comorbidity For Children (Asd-Cc), Ryan Thomas Thorson
LSU Doctoral Dissertations
Once considered rare, Autism Spectrum Disorders (ASD) are increasingly becoming viewed as common disorders. Prevalence rates of ASD have increased drastically in recent years. Recent studies suggest comorbid psychopathology within ASD to be more common than previously thought. Though these deficits exist, specific instruments to diagnose psychopathology in this population do not yet exist. This highlights the underlying need for instruments to identify psychopathology in individuals with ASD. The aim of this study was to establish cut-off scores for the Autism Spectrum Disorder – Comorbidity for Children, an instrument designed to assess for comorbid psychopathology within individuals with ASD.
