The Freedom Of Information Act Trial, Margaret B. Kwoka Jan 2011

The Freedom Of Information Act Trial, Margaret B. Kwoka

American University Law Review

This Article examines the paucity of Freedom of Information Act (FOIA) cases that go to trial and courts’ preference for resolving these disputes at the summary judgment stage. Using traditional legal analysis and empirical evidence, this Article explores whether we should expect FOIA cases to go to trial and how the scarcity of FOIA trials compares to the trial rate in civil litigation generally. It concludes that the unusual use of summary judgment in FOIA cases has unjustifiably all but eliminated FOIA trials, which occur in less than 1% of FOIA cases. It further examines how conducting FOIA trials in …

Religiosity In Adolescence And Emerging Adulthood, Carolyn Mcnamara Barry, Larry J. Nelson Jan 2011

Religiosity In Adolescence And Emerging Adulthood, Carolyn Mcnamara Barry, Larry J. Nelson

Faculty Publications

According to IEA Civic Education Study, approximately half of American adolescents participate in religious groups (Torney-Purta et al. 2001) and half of American 18–24-year-olds report religious beliefs to be important (Inglehart et al. 2004). Thus, religious experiences are an important aspect of the lives of many adolescents and emerging adults (approximately ages 18 to the mid-20s) in the USA. Specifically, adolescents are fully immersed in identity exploration and ideally resolve this search in emerging adulthood. They embark on a quest to solidify their values and beliefs about countless issues, including religiosity. This essay will review the literature on religiosity among …

Drilling For Micro-Foundations Of Human Capital Based Competitive Advantages, Russell Coff, David Kryscynski Jan 2011

Drilling For Micro-Foundations Of Human Capital Based Competitive Advantages, Russell Coff, David Kryscynski

Faculty Publications

From the origins of the Resource Based View, scholars have emphasized the importance of human capital as a source of sustained competitive advantage and recently there has been great interest in gaining a better understanding of the micro-foundations of strategic capabilities. Along these lines, there is little doubt that heterogeneous human capital is often a critical underlying mechanism for capabilities. Here, we explore how individual level phenomena underpin isolating mechanisms that sustain human capital-based advantages but also create management dilemmas that must be resolved in order to create value. The solutions to these challenges cannot be found purely in generic …

Hired Guns And Moral Torpedoes: Balancing The Competing Moral Duties Of The Public Relations Professional, Kati Tusinski Berg, Kevin Gibson Jan 2011

Hired Guns And Moral Torpedoes: Balancing The Competing Moral Duties Of The Public Relations Professional, Kati Tusinski Berg, Kevin Gibson

College of Communication Faculty Research and Publications

Public relations helps an organisation and its publics adapt mutually to each other. However, this does not mean that the profession is value neutral or anything goes. There will be cases where professionals have to make discretionary ethical decisions and negotiate their roles and responsibilities, especially when faced with novel or difficult issues. In this conceptual paper, we describe how the notion of professional role morality not only shapes the individual struggles that practitioners endure but also highlights the organisational structures that foster or shun ethics in the decision-making process. Thus we provide a means of assessing professional action that …

The Specter Of Nature, Stephanie Clark Jan 2011

The Specter Of Nature, Stephanie Clark

Theses

The Specter of Nature is a photographic series that examines the tenuous boundaries between culture and Nature. Through this thesis, I address how, within culture, Nature is defined, distorted, fantasized and then realized through various forms of representation. To this end, Nature historically serves as a backdrop in culturally constructed fantasies and storytelling, as well as historically playing a role in the development of a female identity. The Specter of Nature, examines these concerns through staged photographs of settings created from fabrics and cutouts of decorative papers. By cutting along the patterns embedded in materials such as wrapping papers, wallpapers, scrapbooking …

We investigate the usability of MobiTOP (Mobile Tagging of Objects and People), a mobile location-based content sharing system. MobiTOP allows users to annotate real world locations with both multimedia and textual content and concurrently, share the annotations among its users. In addition, MobiTOP provides additional functionality such as clustering of annotations and advanced search and filtering options. A usability evaluation of the system was conducted in the context of a travel companion for tourists. The results suggested the potential of the system in terms of functionality for mobile content sharing. Participants agreed that the features in MobiTOP were generally usable …

Retention Elections 2.010, James Sample Jan 2011

Retention Elections 2.010, James Sample

Hofstra Law Faculty Scholarship

Counter-historically, the highest profile judicial election campaigns of the first judicial elections cycle following the Supreme Court's decision in Citizens United v. Federal Election Commission were retention and ballot measure, rather than contested elections. Retention elections, in which voters cast their ballots either in favor of returning the incumbent judge to office for another term or for her removal, were intended to balance the values of judicial impartiality and accountability to the public.

In Iowa, judicial retention elections-contests normally well beneath the radar even in Des Moines-became a national flashpoint for same sex marriage debates and, more to the point, …

Latino Students’ Perceptions Of The Academic Library, Dallas Long Jan 2011

Latino Students’ Perceptions Of The Academic Library, Dallas Long

Faculty and Staff Publications – Milner Library

Library use is strongly linked with student persistence in higher education, and Latino students have lower rates of academic library use and proficiency than other racial/ethnic groups of students. This study explores Latino undergraduate students’ perceptions of the academic library and library staff and identifies the conditions which impede or facilitate the students’ use of the library. Using a multiple case study design, this study describes the experiences and perceptions of undergraduate students who identify as Latino and attend a four-year public research-intensive university in the Midwest. The findings suggest that Latino students use the library through the influence of …

An Alternative To Chromates For Corrosion Protection For Aluminum Alloys, Melissa Williams Jan 2011

An Alternative To Chromates For Corrosion Protection For Aluminum Alloys, Melissa Williams

Open Access Master's Theses

Aluminum alloys, such as Al 6061-T6 and Al 7075-T6, are widely used in industry due to their high strength to weight ratio and good mechanical properties. The corrosion of these alloys, however, is an expensive and critical problem since the alloys are susceptible to pitting and crevice corrosion in marine environments. The most significant environmental factor, which contributes to the corrosion of these alloys, is the chloride ion found in marine environments or water condensed from humid air contaminated with soluble chloride salts.

Traditionally, chromate based conversion coatings have been used for many years for the protection of aluminum alloys. …

Weighing Status: Obesity, Class, And Health Reform, Janet L. Dolgin, Katherine R. Dieterich Jan 2011

Weighing Status: Obesity, Class, And Health Reform, Janet L. Dolgin, Katherine R. Dieterich

Hofstra Law Faculty Scholarship

The article explores the intersection between the nation’s presumptive “epidemic” of obesity and efforts to reform the health care system. It notes parallels between attitudes toward obesity and attitudes toward poverty and suggests that a set of social and legal responses about those deemed overweight or obese echoes a wider set of beliefs and values that lies beneath the national debate about health care reform. It suggests that these beliefs and values limited the reach of health reform in 2010 and continue to do so.

More specifically, the article examines America’s recent public focus on what has been labeled an …

The Puzzle Of Criminal Sanctions For Intellectual Property Infringement, Irina D. Manta Jan 2011

The Puzzle Of Criminal Sanctions For Intellectual Property Infringement, Irina D. Manta

Hofstra Law Faculty Scholarship

The article discusses the criminal sanctions for the infringement of intellectual property while emphasising on the patent infringements. It states that criminal punishments are imposed to the violators of copyright and trademark but not to the violators of patent and also discusses the reason for this disparity. Information on the impact of the international negotiations by the U.S. regarding the intellectual property arena on the criminal sanctions is also presented.

Fatigue Testing And Computational Analysis Of A Spinal Implant, Timothy Helton Jan 2011

Fatigue Testing And Computational Analysis Of A Spinal Implant, Timothy Helton

Electronic Theses and Dissertations

The following study investigates the fatigue behavior of a spinal implant developed by Synthes, Inc. to provide stability and off load pressure from the discs in the lumbar region. The installation process for the StenoFix design utilizes plastic deformations to customize the device to each individual patient, but also has potential to degrade fatigue behavior. Physical testing of two titanium alloys, Ti-6Al-7Nb and Ti-15Mo, was conducted on hydraulic test frames and compared to computational simulations which were carried out for the following scenarios: cyclic excitation following plastic deformation; variation of material property definition; variation of loading location; and three modifications …

European Integration: A Plan To Make The Grade, Megan Weinstein Jan 2011

European Integration: A Plan To Make The Grade, Megan Weinstein

Res Publica - Journal of Undergraduate Research

Since World War II, millions of immigrants have settled into European societies. While many of these ethnic minorities are entering their second and third generation within their host countries there is still a deep sense of disunity and alienation. Some researchers suggest that the best way to acculturate these migrants into society is through structural integration where migrants are exposed to and involved in institutions such as the educational system. To examine the importance of education's impact on socio-cultural integration, this article examines the effect of educational structures on the socio-cultural integration of Europe's ethnic minority populations, including foreign-born migrants. …

Perceptions Of A Deity And Corresponding Religious Group As Affected By Descriptions Of Gender And Personal Characteristics, Hannah R. Jones Jan 2011

Perceptions Of A Deity And Corresponding Religious Group As Affected By Descriptions Of Gender And Personal Characteristics, Hannah R. Jones

Honors Projects

Both personal and social identities are important to the self-concept, but the values of such identities can come into question when they conflict with one another. The religious group, one such identification, can exert a great deal of influence over one’s thoughts and beliefs. However, religion is often critiqued for being a reflection of the patriarchal context from which a religion often emerges, which potentially elicits and reinforces gender stereotypes and sexism within the religious group. This can be seen in the Abrahamic religions; they maintain that their God does not claim biological sex nor gender, but their texts include …

Capacity Rationalisation And Exit Barriers In The Irish Printing Industry, Kathleen Hughes Jan 2011

Capacity Rationalisation And Exit Barriers In The Irish Printing Industry, Kathleen Hughes

Conference papers

Decisions regarding capacity and capital investment are among the most critical for firms, as reflected in the extensive literature devoted to this subject. However, substantially less work has been carried out on the decision to disinvest. This is unfortunate as in some situations, such as recessionary times, the main competitive moves pertain to disinvestment, rather than investment. This study aims to contribute to this subject, in particular it aims to identify why industries with a concentrated structure can when proactively rationalise when required, while fragmented ones cannot. Research methodology a case study approach, comprising in-depth interviews with six industry experts …

Articles

The physical structure of a city frequently defines how people interact with each other and their environment. This paper examines the use of personas as a user-centred design tool for the re-engineering of a city to promote sustainable behaviour and social inclusion of its citizens (the Eight Eyes of Dublin Project). The research was carried out through the adoption of personas and collaboration with design partners to identify barriers to sustainability, and resulted in recommendations for the future development of Dublin city, Ireland. These recommendations are then compared with the draft Dublin development plan 2011–17 to determine the effectiveness of …

On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn Jan 2011

On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn

Conference papers

Cloud computing is expected to grow considerably in the future because it has so many advantages with regard to sale and cost, change management, next generation architectures, choice and agility. However, one of the principal concerns for users of the Cloud is lack of control and above all, data security. This paper considers an approach to encrypting information before it is ‘placed’ on the Cloud where each user has access to their own encryption algorithm, an algorithm that is based on a set of iterated function systems that outputs a chaotic number stream, designed to produce a cryptographically secure cipher. …
