Rulemaking 2.0, Cynthia R. Farina, Mary J. Newhart, Claire Cardie, Dan Cosley, Cornell Erulemaking Initiative
Cornell Law Faculty Publications
In response to President Obama's Memorandum on Transparency and Open Government, federal agencies are on the verge of a new generation in online rulemaking. However, unless we recognize the several barriers to making rulemaking a more broadly participatory process, and purposefully adapt Web 2.0 technologies and methods to lower those barriers, Rulemaking 2.0 is likely to disappoint agencies and open-government advocates alike.
This article describes the design, operation, and initial results of Regulation Room, a pilot public rulemaking participation platform created by a cross-disciplinary group of Cornell researchers in collaboration with the Department of Transportation. Regulation Room uses selected live …
The Predictability Of Juries, Valerie P. Hans, Theodore Eisenberg
The Predictability Of Juries, Valerie P. Hans, Theodore Eisenberg
Cornell Law Faculty Publications
This article discusses the meaning of jury “predictability” and whether jury research supports claims of unpredictability. It then analyzes the factors that are associated with perceptions of civil jury unpredictability using data from (1) surveys of corporate and insurance attorneys’ views of the civil justice system, and (2) the outcomes of civil jury trials in state courts. Perceptions of punitive damages dominate business and insurance industry attorneys’ jury predictability ratings. Punitive damages data are significantly and strongly related to attorneys’ judgments about jury predictability across states. This strong association occurs despite evidence of infrequent punitive damage award requests and less …
Religious And Customary Laws In Nigeria, Abdulmumini A. Oba
Religious And Customary Laws In Nigeria, Abdulmumini A. Oba
Emory International Law Review
This Essay discusses the 'religious law' and 'customary law' paradigms in the context of the Nigerian legal system. It also examines the pluralistic nature of Nigeria in terms of ethnicity, religion, and law, and argues that the religious law paradigm is problematic for the discussion of laws at the global level generally and within the Nigerian legal system in particular. Then this Essay identifies customary law, Islamic law, and English law (common law) as the three legal traditions in Nigeria, and then proceeds to discuss their status and scope, the conflicts between them, and the particular challenges facing the Islamic …
Protecting The Human Rights Of Lgbt People In Uganda In The Wake Of Uganda's "Anti Homosexuality Bill, 2009", Daniel Englander
Protecting The Human Rights Of Lgbt People In Uganda In The Wake Of Uganda's "Anti Homosexuality Bill, 2009", Daniel Englander
Emory International Law Review
A bill pending before the Ugandan Parliament from October 2009 to May 2011 sought to punish anyone who engages in 'homosexuality' with life imprisonment and prescribed the death penalty for a variety of activities deemed 'aggravated homosexuality.' Many commentators saw the 'Anti Homosexuality Bill, 2009' ('Bill' or 'Anti-homosexuality Bill') as the most pernicious legislative proposal aimed at gays and lesbians anywhere in the world and feared the death penalty provision could signal a 'looming gay genocide' in Uganda. This Comment seeks to begin the conversation on legal solutions to vindicate the rights of LGBT people in Uganda in the wake …
International Law, Religious Limitations, And Cultural Sensitivity: The Park51 Mosque At Ground Zero, Heather Greenfield
International Law, Religious Limitations, And Cultural Sensitivity: The Park51 Mosque At Ground Zero, Heather Greenfield
Emory International Law Review
In the summer of 2010, a controversy erupted after news surfaced of a planned mosque two blocks from New York City's Ground Zero. The proposed location of the mosque, now named Park51, inflamed the passions of many Americans who believed that the Muslim institution would threaten both the memories of September 11, 2001, and the respect for those killed by the terrorist attacks. The Park51 mosque quickly attracted international attention, and the question of whether the state could restrict the mosque became entangled in a web of legal and 'cultural sensitivity' arguments. This Comment advocates an international human rights framework …
The Burqa Ban: An Unreasonable Limitation On Religious Freedom Or A Justifiable Restriction?, Shaira Nanwani
The Burqa Ban: An Unreasonable Limitation On Religious Freedom Or A Justifiable Restriction?, Shaira Nanwani
Emory International Law Review
In the spring of 2011, France enacted a law banning the concealment of the face in public spaces (the 'burqa ban'). The burqa ban creates two new punishable offenses in France. First, wearing clothing designed to conceal one's face in a public space is punishable by either a maximum of a €150 fine or by being required to take a class on the meaning of citizenship, or both. Second, forcing a woman to wear a face-covering veil is punishable by one year of imprisonment or a €30,000 fine. The burqa ban, which was first introduced by the French National Assembly …
Try As They Might, Just Can't Get It Right: Shortcomings Of The International Megan's Law Of 2010, Danielle Viera
Try As They Might, Just Can't Get It Right: Shortcomings Of The International Megan's Law Of 2010, Danielle Viera
Emory International Law Review
This Comment argues that future legislation closely resembling House Bill 5138, the International Megan's Law of 2010, should not become law. Further, this Comment encourages future drafts of such a law to account for the inherent weaknesses of House Bill 5138. This Comment proposes two alternative solutions for Congress to consider in light of the problems discussed: Congress should either change the language in its next attempt or decline to pass any law until it can analyze the successes and failures of the British Parliament's similarly drafted Sarah's Law.

Ceo's Pay Differentials And The Location Of Ipos : An Empirical Study For Chinese A-Share And H-Share Companies, Yi Liu
Lingnan Theses
This thesis provides an empirical investigation on how different public listing locations affect the CEO (chief executive officer)’s pay of Chinese SOEs (State Owned Enterprises) and whether such a pay differential would in turn affect the listing location choice by those firms, which have not received much attention in the current literature. In particular, we focus on two stock markets, the mainland (including Shenzhen and Shanghai) A-share market and Hong Kong H-share market. Unlike what have been found in many other markets, where firms listed in the foreign markets can normally enjoy a price premium, Chinese firms listed in the …

Rmb Exchange Rate Reform And Cross Listed Stock Price Disparity, Yuqian Rong
Lingnan Theses
A growing number of Chinese corporations have been listing their shares on foreign stock markets. Hong Kong Stock Exchange (HKEX) and New York Stock Exchange (NYSE) are their major targets. Taking China’s exchange rate system reform as a unique event, I examine the price disparity between A-share and H-share (or ADR) using a sample of 28 Chinese companies listed in Shenzhen, Shanghai, Hong Kong, and New York. I conduct a panel-data investigation to examine the price disparity before and after the transition from the pegged to the managed floating exchange rate.
I have obtained several important findings in this study. …
Ownership Structure, Board Characteristics, And Tax Aggressiveness, Ying Zhou
Ownership Structure, Board Characteristics, And Tax Aggressiveness, Ying Zhou
Lingnan Theses
Tax aggressiveness, as commonly proxied by the effective tax rate (ETR), measures a firm’s effort spent on minimizing its tax payments. It is suggested that more tax aggressive firms have greater incentives to allocate resources to minimize taxes and thus have lower ETRs. Corporate governance has been continuously receiving attention in literature across different fields and can affect a firm’s tax strategy through its control mechanism. This thesis investigates how corporate governance influences a firm’s tax aggressiveness. The main hypothesis of this thesis is whether firms with good corporate governance will have less incentives and opportunities to manage tax aggressively. …

Genetic And Physiological Contribution Of Adrenergic Cells In Heart Development, Kingsley Osuala
Genetic And Physiological Contribution Of Adrenergic Cells In Heart Development, Kingsley Osuala
Electronic Theses and Dissertations
The adrenergic hormones norepinephrine (NE) and epinephrine (EPI) are essential for cardiovascular development as embryos lacking NE/EPI begin to die abruptly between embryonic days 10.5 and 11.5 due to apparent cardiac failure. The objective of this research aims to elucidate the mechanism of the embryonic fatality observed in the NE/EPI deficient mouse model. Here we utilized the dopamine β- hydroxylase knockout (Dbh-/-) mouse model, which lacks the gene and subsequent enzyme necessary for the conversion of dopamine to norepinephrine. Embryonic mouse hearts were extracted from Dbh+/+ (control) and Dbh-/- (experimental model) mice for mRNA transcript expression profiling. These studies were …
Low Noise And Low Repetition Rate Semiconductor-Based Mode-Locked Lasers, Dimitrios Mandridis
Low Noise And Low Repetition Rate Semiconductor-Based Mode-Locked Lasers, Dimitrios Mandridis
Electronic Theses and Dissertations
The topic of this dissertation is the development of low repetition rate and low noise semiconductor-based laser sources with a focus on linearly chirped pulse laser sources. In the past decade chirped optical pulses have found a plethora of applications such as photonic analogto-digital conversion, optical coherence tomography, laser ranging, etc. This dissertation analyzes the aforementioned applications of linearly chirped pulses and their technical requirements, as well as the performance of previously demonstrated chirped pulse laser sources. Moreover, the focus is shifted to a specific application of the linearly chirped pulses, timestretched photonic analog-to-digital conversion (TS ADC). The challenges of …
Dead, Imprisoned, Relapsed The Fate Of Homeless Substance Abusers Two Decades Later, Rachel L. Rayburn
Dead, Imprisoned, Relapsed The Fate Of Homeless Substance Abusers Two Decades Later, Rachel L. Rayburn
Electronic Theses and Dissertations
Guided and influenced by a famous follow-up study in criminology focused on desistance from crime, this dissertation studies desistance from crime, homelessness, and substance abuse. In the early 1990s, The New Orleans Homeless Substance Abusers Project (NOHSAP) was founded as an experiment funded by the National Institute on Alcohol Abuse and Alcoholism (NIAAA) to uncover optimal treatment strategies for homeless alcoholics and drug addicts. The program ran for three years (1991-1993) and in those years, 670 homeless New Orleans men and women were admitted into treatment. Some of the original clients were followed for as long as 18 months, but …
The Stigmatization Of Deathcare Workers, Shannon Rose Simone
The Stigmatization Of Deathcare Workers, Shannon Rose Simone
Electronic Theses and Dissertations
Research has indicated that Funeral Directors and Embalmers are stigmatized for their work. Studies have shown that, although the decay of dead bodies is a stigmatized process in American culture, these particular deathcare workers are able to shift the focus of their services from the dead to the living. However, there remains a lack of research regarding deathcare workers who are not employed as Funeral Directors or Embalmers— those whose positions are not as obvious to the general public. This research explores how, why, and to what degree stigma is placed on those individuals who spend the majority of their …
Student Perceptions Of Race And Gender Representations Within College Textbooks, Chastity Lynn Blankenship
Student Perceptions Of Race And Gender Representations Within College Textbooks, Chastity Lynn Blankenship
Electronic Theses and Dissertations
This study examines introductory textbooks images across a variety of disciplines, with particular focus on the ways in which race and gender are shown. This study goes beyond a basic analysis of textbooks, however, and also explores student perceptions of textbook images. My data show that compartmentalization of gender and race into certain themes still occurs within some textbooks. Specifically, white men were more likely to be depicted as hard workers and contributors to the field than any other race and gender. Despite these results, students seemed mixed on the importance of textbook images with many students focused on the …
Supporting Hispanic Mothers With Preschool Children With Speech And/ Or Language Delays Via Dialogic Reading And Coaching Within The Home, Natalie Elizabeth Dopson
Supporting Hispanic Mothers With Preschool Children With Speech And/ Or Language Delays Via Dialogic Reading And Coaching Within The Home, Natalie Elizabeth Dopson
Electronic Theses and Dissertations
Young children who are Hispanic, from low-income homes and have developmental delays are at a disadvantage for not having the basic early literacy foundation to become successful readers later in school (Ballantyne, Sanderman, D‘Emilio, & McLaughlin, 2008; Hammer, Farkas, & Maczuga, 2010; Ezell & Justice 2005; McCardle, Scarborough, & Catts, 2001). These challenges can be addressed in several ways. Early intervention including parent education and collaboration along with shared book reading are considered best practices and critical to improving child outcomes (NELP, 2008). In addition, children who have a solid foundation in early literacy skills including vocabulary development in their …
A Comparison Of Paper-Pencil Versus Video-Conferencing Administration Of A Neurobehavioral Screening Test, Tyler Cole Duffield
A Comparison Of Paper-Pencil Versus Video-Conferencing Administration Of A Neurobehavioral Screening Test, Tyler Cole Duffield
Electronic Theses and Dissertations
Regardless of the reason, many patients/clients do not have access to face-to-face medical, neuropsychological, or mental health consultation, assessment, or treatment (Cowain, 2001). The term Remote Neuropsychological Assessment (RNA) has been proposed by Browndyke to denote the general use of telecommunication and Internet-based technologies in neuropsychological assessment and practice (as cited in Schatz & Browndyke, 2002). RNA (Telemedicine) offers a plausible, potentially cost-effective solution to individuals in need of medical, neuropsychological, or mental health consultation, assessment, or treatment that are located in geographical areas away from the specialist (Armstrong, 2006; Berman, 2005; Cowain, 2001; Jacobsen, Sprenger, Andersson, & Krogstad, 2003). …
Genetically Modified Es Cells Enhance Cardiac Repair And Regeneration In The Infarcted Heart, Carley E. Glass
Genetically Modified Es Cells Enhance Cardiac Repair And Regeneration In The Infarcted Heart, Carley E. Glass
Electronic Theses and Dissertations
Transplanted embryonic stem (ES) cells following myocardial infarction (MI) contribute to limited cardiac repair and regeneration with improved function. Therefore novel strategies are still needed to enhance the efficacy by which ES cells differentiate into cardiac cell types and inhibit adverse remodeling in the infarcted myocardium. Our studies evaluate whether genetic manipulation of transplanted ES cells employing miR- 1, a pro-cardiac microRNA, and TIMP-1, an anti-apoptotic and anti-fibrotic protein, will enhance cardiac myocyte differentiation, inhibit native cardiac apoptosis, and reduce fibrosis in the infarcted myocardium. Furthermore, we assess levels of associated pro- (caspase-3, PTEN) and anti-(Akt) apoptotic proteins as well …
Out A Sociological Analysis Of Coming Out, Nicholas A. Guittar
Out A Sociological Analysis Of Coming Out, Nicholas A. Guittar
Electronic Theses and Dissertations
This study uses a constructivist grounded theory approach to investigate the meaning of “coming out” for LGBQ individuals. Analysis of open-ended interviews with 30 LGBQ persons revealed three main themes. First, coming out does not have a universal meaning among LGBQ persons; rather, it varies on the basis of an individual’s experiences, social environment, and personal beliefs and values. Coming out is a transformative process, and an important element in identity formation and maintenance. Second, despite being attracted only to members of the same sex, ten interviewees engaged in a queer apologetic, a kind of identity compromise whereby individuals disclose …
Emotional Regulation At Walt Disney World Deep Acting Vs. Surface Acting, Anne Reyers
Emotional Regulation At Walt Disney World Deep Acting Vs. Surface Acting, Anne Reyers
Electronic Theses and Dissertations
The objective of this study is to examine the emotional regulation strategies used by Walt Disney World on-stage employees as a way to fulfill requirements set forth by the company. Ten Disney on-stage employees were interviewed off-property in Orlando. The emotional regulation framework was divided into several categories: (1) a distinction between deep acting and surface acting, (2) emotional deviance, and (3) emotional exhaustion. “Surface acting” is a strategy by which employees display company-imposed emotions not genuinely felt, whereas “deep acting” occurs when employees do feel the emotions that they are required to express (Hochschild, 1983). Throughout the data reduction …
Homicide In The Headlines An Analysis Of The Newspaper Reporting Of Baltimore Homicides Of 2010, Jaclyn V. Schildkraut
Homicide In The Headlines An Analysis Of The Newspaper Reporting Of Baltimore Homicides Of 2010, Jaclyn V. Schildkraut
Electronic Theses and Dissertations
Baltimore is notorious for its recent and storied history of crime. The current study examines the treatment of homicide victims in Baltimore newspapers. In 2010, 222 homicides occurred in Baltimore, according to the city‟s homicide map. One hundred and sixty-five were discussed in The Baltimore Sun, the city‟s most-circulated paper. Based on the inclusion or exclusion of particular cases and the manner in which cases were discussed, conclusions can be drawn about the media‟s perception of a case‟s newsworthiness. Specifically, cases with particular details that varied significantly from a “normal” homicide were found to be most newsworthy, determined in part …
Evaluation Of The Expectancy Challenge Alcohol Literacy Curriculum (Ecalc) For Reducing Alcohol Use Among High School Students, Janani Sivasithamparam
Evaluation Of The Expectancy Challenge Alcohol Literacy Curriculum (Ecalc) For Reducing Alcohol Use Among High School Students, Janani Sivasithamparam
Electronic Theses and Dissertations
Alcohol use is the single most alarming behavior among youth in the United States. Adolescents especially are at risk for increases in heavy episodic drinking and drunkenness leading to alcohol-related problems such as academic failure, interpersonal violence, risky sexual behavior and death. In an effort to address this endemic issue, a number of alcohol use prevention programs have been developed and are currently implemented in the high school setting. Many of these programs, however, lack an empirical basis and have been unable to demonstrate significant reductions in alcohol use over time. The need for the development and dissemination of effective …
Translocation Of The Cholera Toxin A1 Subunit From The Endoplasmic Reticulum To The Cytosol, Michael Prentice Taylor
Translocation Of The Cholera Toxin A1 Subunit From The Endoplasmic Reticulum To The Cytosol, Michael Prentice Taylor
Electronic Theses and Dissertations
AB-type protein toxins such as cholera toxin (CT) consist of a catalytic A subunit and a cell-binding B subunit. CT proceeds through the secretory pathway in reverse, termed retrograde trafficking, and is delivered to the endoplasmic reticulum (ER). In order for the catalytic A1 subunit to become active it must separate from the rest of the holotoxin, and this dissociation event occurs in the ER lumen. CTA1 assumes an unfolded conformation upon dissociation from the holotoxin and is recognized by ERassociated degradation (ERAD), a quality control system that recognizes and exports misfolded proteins to the cytosol for degradation by the …
Investigating The Optimal Presentation Of Feedback In Simulation-Based Training An Application Of The Cognitive Theory Of Multimedia Learning, Wendi Van Buskirk
Investigating The Optimal Presentation Of Feedback In Simulation-Based Training An Application Of The Cognitive Theory Of Multimedia Learning, Wendi Van Buskirk
Electronic Theses and Dissertations
There are many different training interventions that can be used in simulation based training systems (e.g., cueing, hinting, highlighting, deliberate practice, etc.). However, the most widely used training intervention in the military is feedback, most often presented in the form of a debrief. With advances in technology, it is possible to measure and diagnose performance in real-time. Thus it is possible to provide immediate feedback during scenarios. However, training systems designers should not consider the timing of feedback in isolation. There are other parameters of feedback that must also be considered which may have an impact on performance. Specifically, feedback …
Understanding The Subjectivities Of Pastors And Beliefs About The Current American Church Culture, Michael Ellis Anderson
Understanding The Subjectivities Of Pastors And Beliefs About The Current American Church Culture, Michael Ellis Anderson
Electronic Theses and Dissertations
This study investigates the spiritual subjectivities of pastors in the Mainstream White Middle Class Evangelical Church in the context of American capitalism. The Evangelical church carries extreme amounts of power and influence in shaping the beliefs of individuals in American society. However, very little pointed research of pastors' spiritual subjectivities that guide their teachings and views in this sub-sect of church culture is present in academia. Anthropology, along with other disciplines, often focuses on dominant churches from an etic perspective of politics and power relations without fully considering the spiritual beliefs of pastors. This etic perspective can miss the deeply …
The Study Of Three Different Layered Structures As Model Systems For Hydrogen Storage Materials, Muzaffer Tonguç Öztek
The Study Of Three Different Layered Structures As Model Systems For Hydrogen Storage Materials, Muzaffer Tonguç Öztek
Electronic Theses and Dissertations
The strength and success of the hydrogen economy relies heavily on the storage of hydrogen. Storage systems in which hydrogen is sequestered in a solid material have been shown to be advantageous over storage of hydrogen as a liquid or compressed gas. Many different types of materials have been investigated, yet the desired capacity and uptake/release characteristics required for implementation have not been reached. In this work, porphyrin aggregates were investigated as a new type of material for hydrogen storage. The building blocks of the aggregates are porphyrin molecules that are planar and can assume a face to face arrangement …
Mixed Signals At The Intersection The Effect Of Organizational Composition On Ratings Of Black Women's Management Suitability, Laticia D. Bowens
Mixed Signals At The Intersection The Effect Of Organizational Composition On Ratings Of Black Women's Management Suitability, Laticia D. Bowens
Electronic Theses and Dissertations
Historically, Black women‘s workplace experiences have been understudied, partially due to an implicit assumption that their experiences are subsumed by research on Black men and/or White women. This oversight is even more evident in the field of management. However, considerable attention has been given to the debate about whether Black women are at a double advantage (i.e., as supposed affirmative action ―two-for-one bargains‖) or at a double disadvantage due to their double marginalizing characteristics. Empirical research in the area has found support for each side, furthering the debate, but also advancing an overly simplistic explanation for a set of experiences …
