Dueling Nationalities: Dual Citizenship, Dominant And Effective Nationality, And The Case Of Anwar Al-Aulaqi, Abraham U. Kannof Jan 2011

Dueling Nationalities: Dual Citizenship, Dominant And Effective Nationality, And The Case Of Anwar Al-Aulaqi, Abraham U. Kannof

Emory International Law Review

This Comment argues that when hearing a case involving a suspected terrorist who holds dual citizenship, a domestic court should first determine, as a threshold matter, the dominant and effective nationality of the accused. This determination is significant because a dominant foreign national can essentially be treated as a non-citizen, for the purposes of adjudication, and may not be entitled to the full rights and protections of domestic citizenship.

Assessing The Perceptions Of Environmental Pollutants, Health And Nutrition Behavior To Improve Risk Communications In Kentucky, Elizabeth Virginia Willett

University of Kentucky Master's Theses

Nutrition interventions are an effective way to improve the dietary habits and lifestyle choices and reduce the risk of chronic disease. The Researchers in the UK-SRP Community Engagement Core develop nutrition programs for communities affected by environmental pollutants. Risk communication is a discipline that can be used to develop targeted nutrition interventions that will yield positive behavior change. The purpose of this study was to examine knowledge, risk perception, and actions concerning environmental pollutants and nutrition behavior. Data was collected using a modified survey instrument based on the validated Environmental Health Engagement Profile (EHEP). Survey participants from diverse regions of …

The Effects Of New Media On Alumni Engagement Among Millennials: A Case Study Of The University Of Kentucky College Of Health Sciences Alumni, Allison M. Horseman

University of Kentucky Master's Theses

This thesis explores the effects of new media, specifically the Internet and the popular social networking site Facebook, on alumni engagement among Millennials in the University of Kentucky College of Health Sciences. Millennials are defined as those born in or after 1982. Alumni engagement is defined as part of the larger social science term of social capital and is defined here as consisting of volunteerism and financial giving. To explore this topic, a survey was constructed and sent electronically to all Millennial alumni from the UK College of Health Sciences. Data reveal Millennial alumni from the College of Health Sciences …

Influence Of Tissue Absorption And Scattering On Diffuse Correlation Spectroscopy Blood Flow Measurements, Daniel Irwin Jan 2011

Influence Of Tissue Absorption And Scattering On Diffuse Correlation Spectroscopy Blood Flow Measurements, Daniel Irwin

University of Kentucky Master's Theses

This investigation evaluates the influences of optical property assumptions on nearinfrared diffuse correlation spectroscopy (DCS) flow index measurements. Independent variation is induced in optical properties, absorption coefficient (μa) and reduced scattering coefficient (μs’), of liquid phantoms with concurrent measurements of flow indices. A hybrid instrument is incorporated consisting of a dual-wavelength (785 and 830 nm) DCS flow device to obtain flow indices and a frequency-domain tissue-oximeter for optical properties. Flow indices are calculated with measured μa and μs’ or assumed constant μa and μs’. Inaccurate μs’ assumptions produced …

The Improper Dismissal Of Title Vii Claims On "Jurisdictional" Exhaustion Grounds: How Federal Courts Require That Allegations Be Presented To An Agency Without The Resources To Consider Them, Katherine Macfarlane Jan 2011

The Improper Dismissal Of Title Vii Claims On "Jurisdictional" Exhaustion Grounds: How Federal Courts Require That Allegations Be Presented To An Agency Without The Resources To Consider Them, Katherine Macfarlane

Journal Articles

Title VII of the Civil Rights Act of 1964 represents a watershed moment in American history. With Title VII's passage, Congress acknowledged the need to “back” the civil rights movement with “federal legislative power.” Title VII was meant to eliminate practices that inhibit employment opportunity equality. Beyond eliminating those practices, Title VII was also designed to assure equality of employment opportunities and to eliminate conduct that “fostered racially stratified job environments to the disadvantage of minority citizens.” This Title renders unlawful the refusal or failure to hire or “otherwise to discriminate against any individual with respect to his compensation, terms, …

Design And Analysis Of Macro Switched Impedance Motors, Weston C. Johnson Jan 2011

Design And Analysis Of Macro Switched Impedance Motors, Weston C. Johnson

Theses and Dissertations--Electrical and Computer Engineering

For present day global economies energy use is the single most important criteria determining a nation’s wealth and sustainability. The global energy needs are met primarily by fossil fuels which are of finite supply. One means to extend the life span of the fossil fuel reserves has been to improve the efficiency of existing systems including generation, storage, usage etc., as a means of conservation. This dissertation investigates a motor technology that promises to complement existing conservation techniques.

Given advances in high voltage power semiconductors, manufacturing techniques and materials research this dissertation evaluates the potential of the switched impedance motor …

Open Access And Liberal Education: A Look At Armenia, Azerbaijan And Georgia, D. Aram Donabedian, John Carey Jan 2011

Open Access And Liberal Education: A Look At Armenia, Azerbaijan And Georgia, D. Aram Donabedian, John Carey

Publications and Research

In the post-Soviet era, libraries in Armenia, Azerbaijan and Georgia have faced increasing budgetary challenges. In response to socioeconomic restructuring and the introduction of private enterprise, libraries have been forced to seek alternatives to commercial publishing and licensing models. This paper will assess the status of the open access movement and of Internet filtering controls in the countries of the South Caucasus. It will also argue that developing open models for scholarly communications is crucial to the strengthening of liberal education and civic participation in these aspiring democracies. Libraries, in their role as providers of and advocates for shared information, …

Scaling Lightness Perception And Differences Above And Below Diffuse White And Modifying Color Spaces For High-Dynamic-Range Scenes And Images, Ping-Hsu Chen Jan 2011

Scaling Lightness Perception And Differences Above And Below Diffuse White And Modifying Color Spaces For High-Dynamic-Range Scenes And Images, Ping-Hsu Chen

Theses

The first purpose of this thesis was to design and complete psychophysical experiments for scaling lightness and lightness differences for achromatic percepts above and below the lightness of diffuse white (L*=100). Below diffuse white experiments were conducted under reference conditions recommended by CIE for color difference research. Overall a range of CIELAB lightness values from 7 to 183 was investigated. Psychophysical techniques of partition scaling and constant stimuli were applied for scaling lightness perception and differences, respectively. The results indicate that the existing L* and CIEDE2000-weighting functions approximately predict the trends, but don't well fit the visual data. Hence, three …

The Conflicts In Yemen And U.S. National Security, W. Andrew Terrill Dr. Jan 2011

The Conflicts In Yemen And U.S. National Security, W. Andrew Terrill Dr.

Books, Monographs & Collaborative Studies

Yemen is not currently a failed state, but it is experiencing huge political and economic problems that can have a direct impact on U.S. interests in the region. It has a rapidly expanding population with a resource base that is limited and already leaves much of the current population in poverty. The government obtains around a third of its budget revenue from sales of its limited and declining oil stocks, which most economists state will be exhausted by 2017. Yemen also has critical water shortages and a variety of interrelated security problems. In Sa’ada province in Yemen’s northern mountainous region, …

Civil-Military Relations In Medvedev's Russia, Stephen J. Blank Dr. Jan 2011

Civil-Military Relations In Medvedev's Russia, Stephen J. Blank Dr.

Books, Monographs & Collaborative Studies

The best recent scholarship on Russian civil-military relations explicitly addresses this issue’s importance for both domestic and external security. An inquiry into the present state of those relations under conditions of defense reform and the current international situation is of immense analytical and policy relevance for both domestic and external security in Russia. While the Russian regime is serious about military reform, it is encountering severe objections from the uniformed military, and the military has successfully persuaded the government to accept its expansive concept of the threats to Russia, i.e., its threat assessment. Therefore, we must closely follow those developments …

The Law And Politics Of Embryo Research In America, O. Carter Snead Jan 2011

The Law And Politics Of Embryo Research In America, O. Carter Snead

Journal Articles

The moral, legal, and public policy dispute over embryonic stem cell research (and related matters, such as human cloning) is the most prominent issue in American public bioethics of the past decade. The primary moral question raised by the practice of embryonic stem cell research is whether it is defensible to disaggregate (and thus destroy) living human embryos in order to derive pluripotent cells (stem cells) for purposes of basic research that may someday yield regenerative therapies. This essay will explain the legal and political dimensions of the embryonic stem cell debate as it has unfolded at the national level …
