A Novel Gene Silencing Vector For Plant Genomics And Biotechnology, Dustin Hoover, Scott Nicholson, Vibha Srivastava Jan 2011

A Novel Gene Silencing Vector For Plant Genomics And Biotechnology, Dustin Hoover, Scott Nicholson, Vibha Srivastava

Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences

Gene silencing is a process of suppressing activity of specific genes by producing “interfering” RNA encoded by foreign genes. This process serves as the principle of genetic modification in plants and animals, which is an important tool in genomics and biotechnology, allowing scientists to manipulate organisms to better meet human demands. New approaches of gene silencing may enable improvements on current practices of genetic modification, and broaden the application and impact of gene silencing in biotechnology. Recently, a novel vector design consisting of the transcription of short gene fragments lacking transcription termination signals was demonstrated to be effective in partial …

Plant Growth In Soil Amended With Drilling Mud, Satoshi Takaki, Duane C. Wolf

Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences

Extraction of natural gas generates drilling fluid and drilling mud that contain high concentrations of salts. Land application of the fluid and mud can have negative impacts on plant growth and soil properties. The objective of this study was to determine the effects of drilling mud on plant growth, plant chemical concentrations, and soil chemical properties. Sudangrass (Sorghum sudanense [Piper] Stapf [Piper]) and bermudagrass (Cynodon dactylon L.) were grown in a Roxana loam soil amended with 0%, 5%, or 10% (w/w) drilling mud in a 6-wk greenhouse study. Plant biomass production and concentrations of elements in biomass were determined. Electrical …

Credit-Monitoring Damages In Cybersecurity Tort Litigation, Vincent R. Johnson Jan 2011

Credit-Monitoring Damages In Cybersecurity Tort Litigation, Vincent R. Johnson

Faculty Articles

When someone improperly accesses or discloses an individual’s personal information, the subject of that data breach is often at an increased risk of identity theft. One way for an affected data subject to guard against this risk is to subscribe to a credit-monitoring service. Recently, potential cybersecurity defendants have provided credit-monitoring services to affected data subjects voluntarily, and courts have approved credit-monitoring compensation as part of class-action settlements. These developments demonstrate that credit-monitoring expenditures are both reasonable and necessary when a serious breach of data security occurs. Furthermore, the economic loss rule should not bar recovery of credit-monitoring damages because …

A sample of twelve men and eight women ages 18 to 62 participated in a usability study of the vest. The activity chosen for this study was a typing test during which users would control a media player remotely with the vest. The usability measures included ease of use, performance of the interface as determined by accuracy rates and time to task completion for both …

The Relationship Of Preschool Children's Television Viewing, Food/Brand Recognition/Recall, Weight Classification, And Parent's Knowledge Of American Academy Of Pediatrics' Recommendations Of Daily Television Viewing, Patricia Marley Howell Jan 2011

The Relationship Of Preschool Children's Television Viewing, Food/Brand Recognition/Recall, Weight Classification, And Parent's Knowledge Of American Academy Of Pediatrics' Recommendations Of Daily Television Viewing, Patricia Marley Howell

UNF Graduate Theses and Dissertations

The prevention of childhood obesity during the formative years is necessary because dietary patterns influenced by parents are developed early. A major obstacle to healthy feeding patterns in children is television advertising. The study tested three hypotheses. 1) Preschool children ages two to five years who watch more television are able to recognize/recall more food brands than those who view less television. 2) An increase in food brand recognition/recall in preschool children is associated with an overweight classification based on calculated Body Mass Index. 3) Children of parents who are unaware of the American Academy of Pediatrics (AAP) recommendations for …

Re-Mapping Privacy Law: How The Google Maps Scandal Requires Tort Law Reform, Lindsey A. Strachan Jan 2011

Re-Mapping Privacy Law: How The Google Maps Scandal Requires Tort Law Reform, Lindsey A. Strachan

Richmond Journal of Law & Technology

In the Internet savvy and technology dependent world of today, it is difficult to imagine life without Google Maps. The pioneer web- mapping platform provides users with a number of free services, ranging from simple directions to high-resolution imagery of terrain. The service has revolutionized travel, providing guidance and resources to more than just the directionally challenged. Contributing to this notoriety was Google’s addition of “Street View” to the array of mapping functions in May of 2007. As its name implies, the Street View function allows users to view enhanced, 360-degree snapshots of homes, streets and other public property. According …

Rethinking Reasonable Expectations Of Privacy In Online Social Networks, Bryce Clayton Newell Jan 2011

Rethinking Reasonable Expectations Of Privacy In Online Social Networks, Bryce Clayton Newell

Richmond Journal of Law & Technology

In 1890, Warren and Brandeis “invented” the common law right to privacy in the United States. They declared the need for a right to privacy – “to be let alone” – because technological advancements (photography) and business methods (yellow journalism) enabled the media to bring previously private details to the attention of a much larger audience. Warren and Brandeis declared, “[i]nstantaneous photographs and newspaper enterprise have invaded the sacred precincts of private and domestic life; and numerous mechanical devices threaten to make good the prediction that ‘what is whispered in the closet shall be proclaimed from the house-tops.’” Because of …

A Critical Look At The Anti-Counterfeiting Trade Agreement, David M. Quinn

Richmond Journal of Law & Technology

On October 23, 2007, the United States announced an initiative to strengthen intellectual property enforcement measures within the international community via the Anti-Counterfeiting Trade Agreement (“ACTA”). During the following years, eleven rounds of negotiations among as many parties culminated in a finalized text released on December 3, 2010. The dialogue occurred outside the purview of existing bodies such as the WIPO and WTO. The ACTA now awaits acceptance following the March 31, 2011 commencement of the ratification period. It will enter into force thirty days following the sixth formal approval.

Do Not Track: Revising The Eu’S Data Protection Framework To Require Meaningful Consent For Behavioral Advertising, Matthew S. Kirsch

Richmond Journal of Law & Technology

The advertisements you see while browsing the Internet are rarely accidental. For instance, Alliance Data, one of many new companies in the booming data-marketing industry, can instantaneously recognize that a user visiting their client’s website is Joel Stein, a thirty-nine year-old, college educated male, who makes over $125,000 a year. Alliance Data also knows that Joel is likely to make purchases online, but only spends about $25 dollars a purchase. Using this information, and the specifics of over 100 of Joel’s past online purchases, Alliance Data creates advertisements specifically tailored to Joel and displays them as he continues to browse …

Anything But Academic: How Copyright’S Work-For-Hire Doctrine Affects Professors, Graduate Students, And K-12 Teachers In The Information Age, Nathaniel S. Strauss

Richmond Journal of Law & Technology

In 1938, the original designers of the Superman comic book figure assigned their ownership rights to DC Comics for $130. On January 1, 2013, their heirs plan to reclaim those rights in court. The impending Superman litigation will herald a wave of a new type of action, known as copyright termination. The Copyright Act of 1976 (“Copyright Act”) granted the original authors of creative works the right to recover rights assigned to publishers, media companies, and other parties, after a period of thirty-five years. Since the Copyright Act became effective on January 1, 1978, the original authors may first assert …

Reviving Slander, Cristina Carmody Tilley Jan 2011

Reviving Slander, Cristina Carmody Tilley

Faculty Publications

Roman law treated differently speech restricted to small, closed communities and speech within or among large, permeable communities. Intracommunity speech was subject to unlimited tort consequences, while intercommunity speech was subject to central government regulation. As English speech law evolved, slander rules governing spoken speech became a convenient proxy for intracommunity speech regulation, while libel rules governing written speech became a convenient proxy for intercommunity speech. In American law, the conceptual collapse of slander and libel meant that constitutional limits designed to lift central government regulation of intercommunity speech perhaps inadvertently vitiated tort consequences for intracommunity speech. The Supreme Court's …

Transcending Borders: The Experience Of Six Undocumented Immigrant Mothers In The United States, Patricia Derobles

Doctoral Dissertations

The purpose of this study was to gain meaningful insights into the experiences of six undocumented immigrant mothers as they settled in the United States while they raise and participate in the educational life of their children. Currently 10 % of California's 6 million students originate from homes where one or two parents are undocumented, poor and have limited English skills. Undocumented immigrants live in constant fear of deportation, live and work in the shadows of mainstream society, are stigmatized by the media, are criminalized by immigration law and exploited by their employers. Historically, children originating from immigrant homes have …

Predictors Of High School Graduation In Foster Youth, Clifford A. Stewart Jan 2011

Predictors Of High School Graduation In Foster Youth, Clifford A. Stewart

Doctoral Dissertations

Academic achievement in foster youth can be influenced by factors related to the foster care experience. The purpose of this study was to determine if gender, ethnicity, time in placement, type of placement, number of placements, and special education status could predict high school graduation in foster youth. To conduct the study a group of foster youth that graduated from high school (n=390) was compared to a group of foster youth that did not graduate from high school (n-400). Sample data were fit to a logistic regression prediction model on the independent variables of gender, ethnicity, time in placement, type …

Filipino American Educational Leaders In Northern California K-12 Public Schools: Challenges And Opportunities, Cynthia Manalo Rapaido Jan 2011

Filipino American Educational Leaders In Northern California K-12 Public Schools: Challenges And Opportunities, Cynthia Manalo Rapaido

Doctoral Dissertations

The assumption that all Asians are model minorities is incorrect. The largest group of Asian American people is comprised of Filipino people followed closely by Chinese people; although Filipino people comprise the largest population, they lag behind Chinese and other Asian American groups with respect to academic achievement. Hence, Filipino American people are underrepresented as educational leaders in K–12 public schools in California.

Compared to other Asian ethnic groups, Filipino American people have (a) a lower achievement level for academic success, (b) a lower percentage enrolled in college in the United States, (c) a lower percentage 25–29 years of age …

Academic Language Teaching And Learning In The Third Space Classroom: A Preservice Teachers' Perspective, Cinzia Forasiepi

Doctoral Dissertations

The increased percentage of immigrant children in the public school system in the United States has challenged schools to provide adequate academic language instruction to reach the same levels as their monolingual peers. Teachers must demonstrate the ability to support the development of academic language in accordance to both the standards' requirements and the linguistic needs of culturally and linguistically diverse students. It is very important to shed light on teacher preparation programs and how they support their candidates to develop a pedagogy that can best respond to students' needs. This study explore the beliefs and practices of preservice teachers …

Drip Irrigation System Cost Sharing By Irrigation Districts For Water Conservation, Charles M. Burt Jan 2011

Drip Irrigation System Cost Sharing By Irrigation Districts For Water Conservation, Charles M. Burt

BioResource and Agricultural Engineering

Government and irrigation district cost sharing programs have often included financial support for the installation of drip/micro irrigation systems. These programs seek advantages that might include improved crop yield, less applied water, and a reduction in subsurface drainage water and surface tailwater. They may also seek to reduce water consumption. The actual results have been shown to vary by district, hydrology, and crop.

It is true that drip systems in California, on average, have good Distribution Uniformities (DU) of irrigation water – meaning that there are only minor differences between the depths of water received by various plants throughout a …

Minimizing Chaos, Merritt H. Giles Jan 2011

Minimizing Chaos, Merritt H. Giles

College of Graduate Studies: Theses & Dissertations

The thesis works presented in this paper are mixed media paintings that explore the tension between artistic control and abandon in what is essentially an intuitive driven process of image making. With these thesis works I have sought to use additive and subtractive processes to create compositions that are as much an exploration of materials as they are an exploration of the formal elements of art. My work is focused on recreating the patterns, textures, and surfaces found in man-made objects and environments that I find in my daily life and I believe are often overlooked in their aesthetic value. …
