Review Of The Subversive Scribe, By Suzanne Jill Levine, Sandro Barros Jan 2011

Review Of The Subversive Scribe, By Suzanne Jill Levine, Sandro Barros

Reconstruction: Studies in Contemporary Culture

[First paragraph]

In The Subversive Scribe, Suzanne Jill Levine explores the intricacies and issues present at the process of translation. The author seeks to disclose to readers of Hispanic American literature the translator’s quest to decide on how to bridge similarities and differences between languages and cultures, and how certain decisions made by the translator affect the outcome of translations in unexpected ways. However, more than elaborating on a theory about the process of translation, Levine’s TSS establishes a cogent argument in favor of the re/vision of the translator as a secondary actor. The author crafts a manifesto-of-sorts that …

Prosodylab-Aligner: A Tool For Forced Alignment Of Laboratory Speech, Kyle Gorman, Jonathan Howell, Michael Wagner Jan 2011

Prosodylab-Aligner: A Tool For Forced Alignment Of Laboratory Speech, Kyle Gorman, Jonathan Howell, Michael Wagner

Department of Linguistics Faculty Scholarship and Creative Works

The Penn Forced Aligner automates the alignment process using the Hidden Markov Model Toolkit (HTK). The core of Prosodylab-Aligner is align.py, a script which performs acoustic model training and alignment. This script automates calls to HTK and SoX, an open-source command-line tool which is capable of resampling audio. The included README file provides instructions for installing HTK and SoX on Linux and Mac OS X, and can also be run on Windows. During training, the model is initialized with flat-start monophones, which are then submitted to a single round of model estimation. Then, a tied-state 'small pause' model is inserted …

Optimization Of Textual Affect Entity Relation Models, Ajith Cherukad Jose Jan 2011

Optimization Of Textual Affect Entity Relation Models, Ajith Cherukad Jose

Masters Theses

"Affective computing is a recent research area in computer science which deals with the design and development of systems that can recognize, interpret and process human affects/emotions. Various research projects in the past have focused on affect sensing and processing raw textual data. One such research effort conducted at the Oak Ridge National Laboratory (ORNL) has introduced an affect propagation algorithm which can generate affective relationships between entities contained in a given textual document. The algorithm depends upon a set of real-valued numeric parameters for which the best possible values are unknown. This thesis describes three different contributions to ORNL's …

Two Kinds Of Plain Meaning, Victoria Nourse Jan 2011

Two Kinds Of Plain Meaning, Victoria Nourse

Georgetown Law Faculty Publications and Other Works

Is plain meaning so plain? This is not meant to be a philosophical question, but one deserving serious legal analysis. The plain-meaning rule claims to provide certainty and narrow statutes' domains. The author agrees with, as a relative claim, comparing plain meaning with purposivism. She does not agree that plain-meaning analysis is as easy as its proponents suggest. In this piece, the author teases out two very different ideas of plain meaning--ordinary/popular meaning and expansive/legalist meaning--suggesting that doctrinal analysis requires more than plain-meaning simpliciter. Perhaps more importantly, she argues that plain meaning, as legalist meaning, can quite …

Mental Torture: A Critique Of Erasures In U.S. Law, David Luban, Henry Shue Jan 2011

Mental Torture: A Critique Of Erasures In U.S. Law, David Luban, Henry Shue

Georgetown Law Faculty Publications and Other Works

Both international and federal law criminalize mental torture as well as physical torture, and both agree that “severe mental pain or suffering” defines mental torture. However, U.S. law provides a confused and convoluted definition of severe mental pain or suffering—one that falsifies the very concept and makes mental torture nearly impossible to prosecute or repress. Our principal aim is to expose the fallacies that underlie the U.S. definition of mental torture: first, a materialist bias that the physical is more real than the mental; second, a substitution trick that defines mental pain or suffering through a narrow set of causes …

Risk Taking And Force Protection, David Luban Jan 2011

Risk Taking And Force Protection, David Luban

Georgetown Law Faculty Publications and Other Works

This paper addresses two questions about the morality of warfare: (1) how much risk must soldiers take to minimize unintended civilian casualties caused by their own actions (“collateral damage”), and (2) whether it is the same for the enemy's civilians as for one's own.

The questions take on special importance in warfare where one side is able to attack the other side from a safe distance, but at the cost of civilian lives, while safeguarding civilians may require soldiers to take precautions that expose them to greater risk. In a well-known article, Asa Kasher and Amos Yadlin argue that while …

Interpretation And Construction, Randy E. Barnett Jan 2011

Interpretation And Construction, Randy E. Barnett

Georgetown Law Faculty Publications and Other Works

In recent years, it has become apparent that there is a difference between (a) discovering the semantic meaning of the words in the text of the Constitution, and (b) putting that meaning into effect by applying it in particular cases and controversies. To capture this difference, following the lead of political science professor Keith Whittington, legal scholars are increasingly distinguishing between the activities of “interpretation” and “construction.” Although the Supreme Court unavoidably engages in both activities, it is useful to keep these categories separate. For one thing, if originalism is a theory of interpretation, then it may be of limited …

Law's Visual Afterlife: Violence, Popular Culture, And Translation Theory, Naomi Mezey Jan 2011

Law's Visual Afterlife: Violence, Popular Culture, And Translation Theory, Naomi Mezey

Georgetown Law Faculty Publications and Other Works

In Walter Benjamin’s essay, “The Task of the Translator,” Benjamin argues that translations enable a work’s afterlife.  Afterlife is not what happens after death but what allows a work (or event or idea) to go on living and to evolve over time and place and iteration.  In its afterlife, the original is transformed and renewed.  In this piece I explore film’s visual translation of law and the role film plays in law’s afterlife.  Film translates law not by translating from one language to another, but by translating between media and discourses.  The cultural-critical lens of translation highlights the discursive similarities …

Automatic Annotation Of Referring Expression In Situated Dialogues, Niels Schütte, John D. Kelleher, Brian Mac Namee Jan 2011

Automatic Annotation Of Referring Expression In Situated Dialogues, Niels Schütte, John D. Kelleher, Brian Mac Namee

Articles

To apply machine learning techniques to the production and interpretation of natural language, we need large amounts of annotated language data. Manual annotation, however, is an expensive and time consuming process since it involves human annotators looking at the data and explicitly adding information that is implicitly contained in the data, based on their judgment. This work presents an approach to automatically annotating referring expressions in situated dialogues by exploiting the interpretation of language by the participants in the dia- logue. We associate instructions concerning objects in the environment with automatically detected events involving these objects and predict the referents …

Casting A Cold Eye On The Origins And Development Of An All-Island Charter Of Rights, Suzanne Egan, Rachel Murray Jan 2011

Casting A Cold Eye On The Origins And Development Of An All-Island Charter Of Rights, Suzanne Egan, Rachel Murray

Fordham International Law Journal

One of the most striking outcomes of the Good Friday/Belfast Agreement ("Agreement") was the extent to which the establishment of human rights institutions and mechanisms was brought center-stage into the shaping of the political settlement. The dynamic talks process that led to the signing of the Agreement resulted in an extensive range of obligations in regard to human rights on the part of the Irish and British governments, many of which were implemented very soon afterwards. Paragraph 10 of the "Rights, Safeguards and Equality of Opportunity" section of the Agreement makes mention of a trans-jurisdictional human rights initiative that would …

Mediation To Resolve The Bedouin-Israeli Government Dispute For The Negev Desert, Sarah S. Matari

Fordham International Law Journal

In Part I, this Note elaborates on the rights that indigenous persons have to ancestral land and the sources of international law that support those rights. Part I also discusses the alternative dispute resolution process of mediation and the customary discouragement of mediation between parties with a power imbalance. Part II explores whether the Negev Bedouins and Israeli government should pursue mediation to resolve their land dispute and generally addresses techniques used to monitor mediation sessions between parties with a power imbalance. Part III explores why mediation is better suited to resolve the Israeli government-Negev Bedouin land dispute than is …

Formalization Of Plea Bargaining In Germany: Will The New Legislation Be Able To Square The Circle?, Regina E. Rauxloh Jan 2011

Formalization Of Plea Bargaining In Germany: Will The New Legislation Be Able To Square The Circle?, Regina E. Rauxloh

Fordham International Law Journal

In German criminal trials, the common law instrument of the guilty plea is unknown. Consequently, one cannot speak of plea bargaining in the strict sense. Nevertheless, informal negotiations, which center on the exchange of a confession for a sentence concession, play an increasing role in the German criminal process. It is claimed that in today’s Germany “the criminal procedure cannot be imagined without the phenomenon of informal agreements.” After years of academic debate and developing case law on informal agreements, the German Federal Parliament (Deutscher Bundestag) has now passed new legislation that regulates agreements and makes them part of the …

And Justice For All: Non-Native English Speakers In The American Legal System, Leah Michelle Nodar Jan 2011

And Justice For All: Non-Native English Speakers In The American Legal System, Leah Michelle Nodar

Honors Theses

One of the most important rights enshrined in the American Constitution is the right to due process of law. However, the execution of this right has been sporadic, and some groups have been consistently disadvantaged. Speakers of English as a second language make up one such group, especially limited English proficiency (LEP) speakers. LEP speakers' access to due process took a step forward with the 1978 Court Interpreters Act, which guaranteed interpreters for anyone who ‘‘speaks only or primarily a language other than the English language." However, decisions as to who speaks “primarily” a foreign language and who speaks English …

Ecophilosophies And Environmental Perspectives In The Amazon Rainforest: Conservation Through Sustainable Use Projects, Scarlett Ashlen Andrews

Honors Theses

Non-governmental organizations are on the forefront of conservation strategies throughout the world, and the Amazon Rainforest is one of the most crucial regions in the world for these efforts. Though many conservation strategies in the past focused on the establishment of protected areas, there has been a recent increase in projects aimed at sustainable use of land with the goal of conserving natural resources and ecosystem processes. This thesis is an exploration of sustainable use projects in the Andes-Amazon border region, specifically those projects which focus on agriculture and forestry. By comparing historical and theoretical ecophilosophies and analyzing survey responses …

The Dynamics Of Collaboration In Universal Pre-K Counties Of West Virginia, Kimberly S. Miller Jan 2011

The Dynamics Of Collaboration In Universal Pre-K Counties Of West Virginia, Kimberly S. Miller

Graduate Theses, Dissertations, and Problem Reports (ETD)

West Virginia Senate Bill 247 mandated that local school systems develop and implement universal preschool programs for all four-year-old children and three-year-old children as mandated by federal law. Within policy, local school systems are mandated to collaborate with licensed childcare providers and Head Start to make up at least 50% of the preschool classrooms. This descriptive qualitative case study investigated how the experience of compulsory collaboration required by WV policy 2525 is described by early education providers. The description of the …

A New Youth Discipling Model For The Los Altos Chinese Seventh-Day Adventist Church, John Kangho Ang Jan 2011

A New Youth Discipling Model For The Los Altos Chinese Seventh-Day Adventist Church, John Kangho Ang

Doctor of Ministry Projects

Problem. The Los Altos Chinese Seventh-day Adventist (LACSDA) church has not been able to effectively disciple and retain its American-born Chinese (ABC) members. Over the years, the LACSDA church has seen a gradual withdrawal of the ABC members from the church; most have either left the area to attend other Seventh-day Adventist churches, or have stopped attending church altogether. This attrition of membership was a serious problem for the LACSDA church and proper measures were needed if the trend was to be reversed.

Method. This research project led to the development and implementation of an innovative model of ministry that …

Myers-Briggs Type Indicator: A Potential Training Tool For Leadership Development In Kenya, Kefa Obure Matena

Doctor of Ministry Projects

Problem. The Seventh-day Adventist Church members in Kenya often experience misunderstandings and negative conflicts in their homes, places of work, schools, and churches as a result of a lack of understanding of the uniqueness of individual differences. When these misunderstandings lead to strained relationships, they are a real hindrance to the accomplishment of the core mission of the church in Kenya. Additionally, they often prevent successful endeavors to witness to non-Christians. This problem affects not only the laity, but also the clergy and all leaders engaged at different levels of organizations in society.

Method. The task of the project is …

Master's Theses

Finding the predictors for academic success is critical for foster youth to become productive citizens as adults. The purpose of this study was to investigate the role of social support in the academic confidence of transitional foster youth. Because the literature suggests men and women benefit from social support differentially, I also examined gender as the moderating variable for social support and academic confidence. A sample of 82 foster youth (15-18 years old) from San Joaquin County's Human Service Agency volunteered to participate. Participants were given the Student Perceived Availability of Social Support Questionnaire (SPASSQ) to assess their perceptions of …

The Intersection Of Intellectual Property And Race In The Twenty-First Century: An Examination Of The Interpretation Of Racial Categories In Patent Law, Tiffany Cruz Gonzalez Jan 2011

The Intersection Of Intellectual Property And Race In The Twenty-First Century: An Examination Of The Interpretation Of Racial Categories In Patent Law, Tiffany Cruz Gonzalez

UC Law Journal of Race and Economic Justice

The political and jurisprudential treatment of racespecific patents, patents on inventions that are aimed at certain racially or ethnically defined groups, in the United States has the potential to legitimize the reification of race and severely impact society's understanding of racial disparities. Accordingly, with the increase in race-specific patents, and race-based technology in general, the way that the courts will construe racial categories in claim terms will determine the pattern and practice of future race relations in the United States. This note examines the role of a judge and an inventor in the potential litigation of a racespecific patent both …
