Finding The Good In Holmes's Bad Man , Marco Jimenez Nov 2011

Finding The Good In Holmes's Bad Man , Marco Jimenez

Fordham Law Review

This Article critically examines Oliver Wendell Holmes’s widely influential but controversial “bad man” theory of law from its inception during a speech Holmes gave for the dedication of a new hall of the Boston University School of Law in 1897, through its development over the next century, to its current influence over legal fields as diverse as contract law, tort law, and modern punitive damages jurisprudence. This Article argues that Holmes’s theory, despite its extraordinary influence, has been widely misunderstood and can be more profitably understood—by both supporters and critics alike—not as supporting the bad man but the good, by …

Alien Language: Immigration Metaphors And The Jurisprudence Of Otherness , Keith Cunningham-Parmeter Nov 2011

Alien Language: Immigration Metaphors And The Jurisprudence Of Otherness , Keith Cunningham-Parmeter

Fordham Law Review

Metaphors tell the story of immigration law. Throughout its immigration jurisprudence, the U.S. Supreme Court has employed rich metaphoric language to describe immigrants attacking nations and aliens flooding communities. This Article applies research in cognitive linguistics to critically evaluate the metaphoric construction of immigrants in the law. Three conceptual metaphors dominate legal texts: immigrants are aliens, immigration is a flood, and immigration is an invasion. In order to gauge the prevalence of these metaphors, the Article engages in a textual analysis of modern Supreme Court opinions and presents original empirical data on the incidence of alienage terminology in federal court …

The Role Of Information Literacy Competence And Higher Order Thinking Skills To Develop Academic Writing In Science And Engineering Learners, B. Kranthi Kumari

Higher Learning Research Communications

The English syllabus for learners pursuing engineering courses includes teaching writing as one of the objectives. Learners who enroll for these courses are not equipped with the general writing skills that they should have mastered at the entry level. In this context, a study was organized to develop academic writing skills of the undergraduate learners who are pursuing engineering courses. The study focused on raising awareness in the learners of the nature and characteristics of academic texts in order to develop academic writing skills. The study also emphasizes that involving the learners in the cognitive processes of writing that include …

Digital Literacy Matters. Increasing Workforce Productivity Through Blended English Language Programmes., Kshema Jose

Higher Learning Research Communications

The three Rs, the ability to read, write and do basic arithmetic have traditionally been measured as indicators of knowledge and ability to communicate, and in turn, a predictor of success at workplace. However, survey any place of work today, and we see that the traditionally held literacy skills do not suffice; newer forms of literacies that go beyond the ability to decode print, like the skill to communicate, interact, solve complex problems, analyse, judge, evaluate, collaborate, construct, create, and to use information technology/ digital tools, are now considered essential contributors to enhanced employability opportunities as well as workplace success.

Teaching Community College Students Strategies For Learning Unknown Words As They Read Expository Text, Leslie Craigo, Linnea C. Ehri, Manijeh Hart Nov 2011

Teaching Community College Students Strategies For Learning Unknown Words As They Read Expository Text, Leslie Craigo, Linnea C. Ehri, Manijeh Hart

Higher Learning Research Communications

An experiment was conducted to investigate methods that enable college students to learn the meaning of unknown words as they read discipline-specific academic text. Forty-one college students read specific passages aloud during three sessions. Participants were randomly assigned to three vocabulary learning interventions or a control condition. The interventions involved applying context, morphemic, and syntactic strategies; applying definitions; or applying both strategies and definitions to determine word meanings. Word learning and comprehension were measured during the interventions and in a transfer task to assess treatment effects on independent text reading. Results revealed that students in all three intervention groups outperformed …

"Not If, But When": Sex, Risk, And Trust In Timing Gardasil Vaccine Decisions, An Exploratory Study Among Healthcare Providers And Middle-Class Parents In The U.S., Kathleen Marie Brelsford Nov 2011

"Not If, But When": Sex, Risk, And Trust In Timing Gardasil Vaccine Decisions, An Exploratory Study Among Healthcare Providers And Middle-Class Parents In The U.S., Kathleen Marie Brelsford

USF Tampa Graduate Theses and Dissertations

This dissertation research explores how values regarding sexuality, morality, responsibility, protection, trust, and risk — expressed through parent, daughter, and healthcare provider relationships and interactions — inform parental decisions regarding the Gardasil® vaccine. In particular, the research examines the competing and conflicting meanings that parents and providers ascribe to vaccination and how actors position the vaccine within a wider set of negotiated, value–laden discourses. Because these narratives are situated within a larger structural field that shapes the landscape in which providers and parents interact, relevant historical and structural factors, including vaccine policy, cost, and compensation are discussed.

A Sociocultural-Theory-Based Study Of The Impact Of Mediation During Post-Observation Conferences On Language Teacher Learning, Jane Harvey Nov 2011

A Sociocultural-Theory-Based Study Of The Impact Of Mediation During Post-Observation Conferences On Language Teacher Learning, Jane Harvey

USF Tampa Graduate Theses and Dissertations

The post-observation conference offers a potentially fecund context for promoting language teacher learning, but very little research has been conducted into how this actually happens. Taking Vygotskian sociocultural theory as its theoretical framework, this study examined the mediational discourse of a series of post-observation conferences between a mentor and two practicing English language teachers to investigate the nature of the discourse and the relationship between the mediational discourse and the language teachers` learning. Features of mediational discourse identified a priori (such as intersubjectivity, graduated and contingent help, and externalization of reasoning) were present in the data, but were found to …

Instructional Design In Online Learning: Components Of Quality, Lenore J. Kinne, Shannon M. Eastep Nov 2011

Instructional Design In Online Learning: Components Of Quality, Lenore J. Kinne, Shannon M. Eastep

Journal of Excellence in College Teaching and Learning

Although there are obvious differences between online instruction and face-to-face instruction, this paper focuses on their similarities. One of the challenges when designing a course that has been successfully taught in a face-to-face format is deciding what will stay the same versus what will be changed. How does one replace what happens in class with meaningful online content? In what ways can content be presented aside from reading text on one's computer screen? With these questions in mind, an instructor began collaborating with an instructional designer to develop her first online course, a graduate level course in pupil assessment and …

Graphic Organizers In The Social Studies Classroom: Effective Content Integration Tools For Preservice Teachers, Sharon Gieselmann Nov 2011

Graphic Organizers In The Social Studies Classroom: Effective Content Integration Tools For Preservice Teachers, Sharon Gieselmann

Journal of Excellence in College Teaching and Learning

Preservice teachers working with elementary school teachers in university practicum settings often report limited time for social studies instruction because of increased accountability for mathematics and reading achievement via No Child Left Behind. Incorporating content literacy tools such as graphic organizers with social studies learning can be an effective means for integrating these content areas. The author shares results of a university project describing preservice teachers use of graphic organizers during content reading instruction in practicum classroom settings.

Disparities Research In Public Health Pbrns, Glen P. Mays Nov 2011

Disparities Research In Public Health Pbrns, Glen P. Mays

Health Management and Policy Presentations

Public health agencies are well positioned within the health system to play key roles in addressing oral health issues on a population-wide basis, However, current evidence reveals wide geographic variation in the delivery of public health interventions for oral health promotion. This session explores the factors contributing to this variation, and it highlights studies underway through the Public Health Practice-Based Research Networks (PBRNs) to produce more and better evidence about public health delivery and impact.

El Pensamiento Intelectual Comunista En Argentina: Una Relectura De Héctor P. Agosti Y Su Introducción Al Pensamiento De Gramsci, Alexia Massholder

Research Papers

Translation Of Research Instruments: Research Processes, Pitfalls And Challenges, Khairunnisa Dhamani, M. S. Richter Nov 2011

Translation Of Research Instruments: Research Processes, Pitfalls And Challenges, Khairunnisa Dhamani, M. S. Richter

School of Nursing & Midwifery, East Africa

Multilingual and multi-ethnic societies are becoming the norm in the era of globalisation. Given the cultural diversity and multiple languages spoken in many countries, healthcare researchers (including nurses) are challenged to use psychometrically sound research instruments that are culturally and linguistically sensitive. Most psychometrically sound research instruments have been developed and their properties assessed in English-speaking populations. A literature review was performed to understand the process of translation, use of qualitative and quantitative methods to assess the quality of translation, and lastly, to identify strategies to overcome the challenges of the translation process. One-way translation was observed to be the …

Investigating The Role Of The Internet In Women And Minority Stem Participation: A Case Study Of Two Florida Engineering Programs, Arland Nguema Ndong

USF Tampa Graduate Theses and Dissertations

Despite our awareness of the fascination modern humans have with the Internet, little is known about how and why colleges and universities create and maintain Websites. At the most general level, in this case study, I hypothesize that university Websites serve as communication and marketing tools in attracting students. At the most specific level, I postulate that civil engineering programs with Web pages depicting images of women and minorities would be more successful in recruiting and retaining women and students of color than civil engineering programs with Web pages displaying fewer or no images of women and minorities. The primary …

A Pilot Study Of Cultural-Based Service-Learning: What Did Undergraduate Students Learn From Elementary School Teachers In An Urban Public School District?, Lori Simons, Nancy Hirshinger-Blank, Elizabeth Williams, Kimyette Willis, Lauren Camiollo, Cassandra Dry, Courtney Floyd, Brittany Russell

Journal of Excellence in College Teaching and Learning

This article describes what undergraduate students learned from school teachers involved in a cultural based service-learning program. Forty-four undergraduate students enrolled in an educational psychology course at a private, metropolitan University were paired with 30 teachers and provided tutoring and mentoring activities to the children in their classrooms over the course of the semester at the West or East School located in Chester, Pennsylvania. The results from a preliminary survey indicate that undergraduate students increase their civic action attitudes, problem-solving skills, multigroup and ethnic identity, community self-efficacy, and academic and community engagement from the beginning to the end of the …
