When Does F*** Not Mean F***?: Fcc V. Fox Television Stations And A Call For Protecting Emotive Speech, W. Wat Hopkins

The Supreme Court of the United States does not always deal cogently with nontraditional language. The most recent example is FCC v. Fox Television Stations, in which the Justices became sidetracked into attempting to define the f-word and then to determine whether, when used as a fleeting expletive rather than repeatedly, the word is indecent for broadcast purposes. The Court would do well to avoid definitions and heed Justice John Marshall Harlan's advice in Cohen v. California to provide protection for the emotive, as well as the cognitive, element of speech

Though much research has been conducted concerning the horizontal and vertical attributes of individualism and, not much has been done comparing and contrasting an Eastern culture, collectivism to a specific aspect of American culture, individualism, such as Korean American. The 32-item INDCOL scale was used to measure the 4 attributes (Singelis et al., 1995). Contrary to the proposed hypothesis, this study found high scores in horizontal individualism in Korean American participants and high scores in horizontal individualism and horizontal collectivism in Korean participants. These results could indicate a shift towards a different attribute in the Korean and Korean American community.

Integration Versus Apartheid In Post-Roman Britain: A Response To Thomas Et Al. (2008), John E. Pattison

The genetic surveys of the population of Britain conducted by Weale et al. and Capelli et al. produced estimates of the Germani immigration into Britain during the early Anglo-Saxon period, c.430-c.730. These estimates are considerably higher than the estimates of archaeologists. A possible explanation suggested that an apartheid-like social system existed in the early Anglo-Saxon kingdoms resulting in the Germani breeding more quickly than the Britons. Thomas et al. attempted to model this suggestion and showed that it was a possible explanation if all Anglo-Saxon kingdoms had such a system for up to 400 yrs. I noted that their explanation …

Language Learning And Study Abroad: A Critical Reading Of The Research (Review), Elizabeth M. Kissling

Kinginger’s interpretation of the research represents an endorsement of the great potential of study abroad, balanced with several limitations and caveats. Kinginger argues that while study abroad generally results in increased proficiency and oral fluency, slightly superior to gains resulting from at-home formal study, one should note the design flaws of many studies such as lack of a true control group as well as reliance on monologic, situation-less tasks to measure language gains, even in the areas of discursive, pragmatic, and sociocultural competencies. This study explores the lives of three generations of African American women teachers in my family, my mother, Carolyn T. Sims, my aunt, Natalie T. Woods, and myself. Using Critical Race Theory (e.g., Delgado & Stefancic; 2001; Ladson-Billings & Tate, 1995; Parker, Deyhle, & Villenas, 1999) as the theoretical framework and oral history (e.g., Armitage & Mercier, 2009; He, 2003; Jefferson, 2008; Scott-Simmons, 2008; Vaz, 1997) as the methodology, I explore the educational experience of my mother and my aunt during segregation, desegregation, and post segregation. A formal framework is presented that allows for the analysis of the potential for using engine thrust control for aircraft actuator failure accommodation. Three sets of parameters have been identified as critical: number of engines and their position, engine thrust and throttle dynamics, and type and severity of the actuator failure. A mathematical model was developed that allows for the determination of the values of some of the parameters when the others are imposed such as determining the thrust control authority when the engine locations and Euler angles are known. With the introduction of the No Child Left Behind Act (NCLB), speech-language pathologists (SLPs) have experienced a new focus on language and literacy within their roles and responsibilities to provide services to students. The American Speech and Hearing Association (ASHA) support the role of SLPs in literacy efforts through their policies regarding expanded roles and responsibilities for school-based SLPs. ASHA notes that school-based SLPs have a clearly defined role in Response to Intervention (RTI) based on their expertise, knowledge and training to provide services as a resource and an interventionist when appropriate. The purpose of this mixed methods study was to describe the current state of Algebra I instruction for students with mathematical learning disabilities (MLD) in West Virginia and teachers. preparation for this practice, as perceived by teachers. Capabilities Perception Of Well-‐Being And Development Effort: Some Evidence From Afghanistan, Jean-Francois Trani, Parul Bakhshi, Cécile Rolland

This paper examines the relationship between capabilities, well-being and the impact of development efforts in Afghanistan. Using data from a nationally representative survey, we argue that very vulnerable groups maintain a positive perception of well-being by referring to collective values and practices. Our data suggest that deprivation of individual basic capabilities does not systematically lead to a low perception of well-being if individuals have access to other capabilities such as love and care and participation in the community affairs. Nevertheless, access to basic capabilities remains crucial in order to ensure that social norms and expectations cease to constitute constraints and …

This article starts by critiquing two recent attempts to sociologically account for court delays in Mediterranean societies. The first account was produced by the sociologist David Nelken and uses the concept of legal culture to explore the causes of court delays in Italian criminal trials, while the second account was produced by the anthropologist Michael Herzfeld, who sees court delays in Crete as metonymically encapsulating a broader cultural context. It is argued that both accounts omit an important dimension of the issue, which is how such delays are produced and justified at the level of legal practice itself. By referring …

This article discusses the intersections between anthropological and Amazonian indigenous activism over a four decade period. Following a successful campaign to end the unlawful practices of trafficking that brought them to Manaus, indigenous Tukanoan women from the Upper Rio Negro established a local indigenous organization with which to plan and manage their own ethno-development, including cultural heritage activities, institution building, revenue development, health and legal services, community, and other initiatives. The case provides an opportunity to explore indigenous ethno-development, a concept at the heart of the theory and practice of Shelton (Sandy) Davis.

In this dissertation, I examine Friedrich Nietzsche's notion of the will to power, his account of friendship and his understanding of human flourishing. Through textual analysis, I offer a new way of interpreting the will to power, as the achieving of self-realization. The process of achieving self-realization is undergirded by the satisfaction of seven existential needs that are rooted in the paradoxical human conflict between instincts and consciousness. The Basque Country, Spain is a linguistically unique region where the minority indigenous language, Euskera, competes alongside the dominant state language, Castilian, and a lingua franca, English, for prestige and status. Following a history of cultural and linguistic repression and marginalization, the Basque community has, in the past 30 years, begun to reintroduce Euskera into new, multilingual school systems in order to teach, preserve and maintain their heritage language, while simultaneously acquiring English as an important language for global communication. The present study examined relationships among social skills including deceptive behavior, socioeconomic status, and theory of mind development in 98 predominantly Hispanic 3- to 7-year-old children residing in the Rio Grande Valley of Texas. Measures were of vocabulary, deceptive ability, true belief, and false belief understanding. Children’s interactions with others were also measured through observational methods and parental data was obtained to compute socioeconomic status and validate social skills information. It was hypothesized that social skill development, including deception would emerge along with theory of mind understanding in this population, and that children from households of lower socioeconomic status would …

This short essay, presented at Fordham's conference on the social functions of property (and in an earlier form at a conference on law and memory at USC), explores the relationship between property and memory. It distinguishes between property as the object of memory ("memory of property") and property as a medium of memory ("memory in property"). With respect to both kinds of memory, the common law expresses a great deal of ambivalence towards memory. This dissertation argues that a Deweyan reconstruction of philosophical theories of human well-being is needed. While philosophical interest about human well-being has existed for millennia, significant interest in such theories among philosophers has re-emerged during the past twenty-five years. During this same time there has been a resurgence of interest in the work of John Dewey. His critique of the “philosophical fallacy” is used to examine the legitimacy and value of the theories of human well-being offered by Plato and L.W. Since the cognitive revolution during the last century the mind has been conceived of as being computer-like. Like a computer, the brain was assumed to be a physical structure (hardware) upon which a computational mind (software) was built. The mind was seen as a collection of independent programs which each have their own specific tasks, or modules. These modules took sensory input "data" and transduced it into language-like representations which were used in mental computations. Differentiated instruction is a learner-centered philosophy of teaching based on Tomlinson’s research, but stems from a constructivist belief espoused by Dewey, Piaget, and Vygotsky. Through consideration of three diagnostic areas: readiness, interests, and learning profiles, a teacher differentiates how diverse students access the material (content), how students make sense of the material (process), and how students demonstrate their learning (product).
Differentiated instruction has been used successfully at the elementary, middle, and high school levels showing quantitative improvements for diverse students. A limited number of qualitative studies on differentiated instruction exist at the college level, with even fewer quantitative studies.

The recent history of scientific excellence of a society could be used as an indicator of its economic, cultural and communal prosperity. In this work, two examples of countries that successfully arose from the remnants of comparative poverty and established themselves as scientifically thriving societies, South Korea and Slovenia, are compared with the case of Serbia, a country that is presumably on the doorsteps of a similarly explosive developmental path. The following study examines the affect manipulatives have on sight word recognition. Data was collected in a variety of ways throughout this action research project, which include observations, interviews, audio recordings, questionnaires, as well as authentic work completed by the participant. This study reveals that the use of hands-on materials increase one’s sight word recognition, motivation, and engagement. As a result, teachers should incorporate manipulatives and educational games into their curriculum. These tools will motivate students and assist them in learning new sight words.

The Mediterranean Legacy In The Concept Of Sovereignty: A Case Of Legal And Philosophical Hybridity, Alessio Lo Giudice

The ideas of centralized political power and monarchy that emerged from the Mediterranean world are among the most important philosophical bases for the concept of sovereignty. My thesis is that the normative idea of an absolute, independent, and exclusive center of power originates in a complex case of philosophical hybridity. It is the outcome of the alternation between the conception of the Sovereign as representing the supreme power (the indirect theory) and the conception of the Sovereign as directly containing that power (the direct theory).
