Addressing Sexual And Gender-Based Violence (Sgbv) Against Adolescent Girls, Sajeda Amin, Althea D. Anderson Jan 2011

Addressing Sexual And Gender-Based Violence (Sgbv) Against Adolescent Girls, Sajeda Amin, Althea D. Anderson

Poverty, Gender, and Youth

The Population Council’s extensive work on adolescent safe spaces and livelihoods programs has demonstrated the pathways of empowering adolescent girls and the substantial benefits for society. Monitoring and evaluation data from these initiatives have produced empirical evidence about threats to girls’ health and well-being that relate to both longstanding and emergent social forces. In developing countries, where the risk of adverse sexual and reproductive health outcomes is high and young girls are at high risk, it is important to address issues related to sexual and gender-based violence (SGBV) and gender norms that relate to these risks. The Council’s work with …

Commercial Law's Complexity, David Frisch Jan 2011

Commercial Law's Complexity, David Frisch

Law Faculty Publications

This Article proceeds as follows. Part I briefly surveys prevailing ideas about the social costs of complexity and identifies additional costs that have escaped the attention of earlier commentators. The aim is to demonstrate why reducing the complexity of the commercial law system matters. Part II describes three legislative responses-two already enacted ·and one proposed- representing efforts to mediate the tension between the need for precise regulation and the generation of overly complex rules that often results. Part III provides a closer examination of these legislative responses and demonstrates that, taken together, they create an opportunity for the implementation of …

Whos The Boss?: The Need For Thoughtful Identification Of The Client(S) In Special Education Cases', Yael Cannon

Faculty Scholarship

This Article explores the various models of representation used by attorneys in special education cases and advocates for thoughtful identification of the client or clients through a contextualized, individualized decision made collaboratively by the lawyer and client(s), with considerations of a panoply of factors. Part I attempts to unpack these models. While clear advantages exist with each of the models, the Article presents case examples and questions that illustrate some of the challenges that may be presented by each model. Part II includes a discussion of the factors that an attorney should consider in each case in determining the appropriate …

Decision Making Regarding Employee Access To Training And Development In Medium-Sized Enterprises, Alan Coetzer, Janice Redmond, Jalleh Sharafizad Jan 2011

Decision Making Regarding Employee Access To Training And Development In Medium-Sized Enterprises, Alan Coetzer, Janice Redmond, Jalleh Sharafizad

Research outputs 2011

Employees in small and medium-sized enterprises (SMEs) form part of a ‘disadvantaged’ group within the workforce that receives less access to formal training and development than employees in large firms. The manager’s decisional role is critical when considering employee access to training and development. Unfortunately, there is scant research into factors affecting managers’ decisions regarding employee access to a requested development opportunity in SMEs. To address this research gap, semi-structured interviews incorporating critical incidents were conducted with a purposive sample of 12 managers of medium-sized enterprises based in Perth. We report key findings of the interviews and assess the effectiveness …

Reframing "Professionalism:" An Integral View Of Lawyering's Lofty Ideals, Brooks A. Suttle Jan 2011

Reframing "Professionalism:" An Integral View Of Lawyering's Lofty Ideals, Brooks A. Suttle

Emory Law Journal

Whereas legal ethics define what every lawyer must do, legal professionalism takes on the more difficult task of defining the core values that the very best lawyers should aspire to in their practice. The legal profession is granted a certain amount of autonomy and independence by American society, and the continuing legitimacy of this social contract depends on the notion that the profession will take care to regulate itself and maintain standards of conduct commensurate with its essential function.

Introduction: A Tribute To Jean-Claude Piris, Director-General Of The Legal Service Of The Council Of The European Union, Roger J. Goebel

Fordham International Law Journal

On the occasion of his retirement, the Fordham International Law Journal is dedicating this issue on topics concerning European Union law to Jean-Claude Piris, who brilliantly served as Director-General of the Legal Service of the Council for the last twenty-three years. The Legal Service, currently composed of around 120 lawyers, not only provides legal advice to the Council itself and all of its supporting committees and staff, but also reviews all draft legislation and other legal acts of the European Union and represents the Council in proceedings before the Court of Justice of the European Union.

The Treaty Of Lisbon: A Story In History Or The Making Of A Treaty, Therese Blanchet Jan 2011

The Treaty Of Lisbon: A Story In History Or The Making Of A Treaty, Therese Blanchet

Fordham International Law Journal

And like all stories there are of course the main characters, the public heroes, and, around them, those who help them find a happy ending. The story in this Essay is written in honor of one of the characters who played a key role in achieving the Treaty of Lisbon: Jean-Claude Piris, who was for more than twenty two years, Director General of the Legal Service of the Council of the EU. But to understand this story, to understand the reasons behind it, one should know its roots.

A Civil Right To Counsel Through The States Using California's Efficiency Project As A Model Toward A Civil Gideon, Brian Brophy Jan 2011

A Civil Right To Counsel Through The States Using California's Efficiency Project As A Model Toward A Civil Gideon, Brian Brophy

UC Law Journal of Race and Economic Justice

While the United States Supreme Court's decision in Gideon v. Wainwright guaranteed the right to counsel in criminal trials, the poor are often left without representation in civil cases. These cases can have devastating impacts on the poor's access to housing, welfare benefits, children, and more. In 2009, California passed the Sargent Shriver Civil Counsel Act, which created pilot projects that guarantee access to counsel in civil cases for indigent Californians. This note examines how state legislatures can use California's act as a model to expand access to counsel into the civil context. If state officials are shown the dire …
