Providing Attorneys For Children In Dependency And Termination Of Parental Rights Proceedings In Florida: The Issue Updated, Michael J. Dale Apr 2011

Providing Attorneys For Children In Dependency And Termination Of Parental Rights Proceedings In Florida: The Issue Updated, Michael J. Dale

Faculty Scholarship

Florida's system for providing protection and safety to children in the State's child welfare system has changed over the past decade. Regretfully, the changes do not appear to have had a significant impact in two areas: increasing the safety and protection of children in the system' and providing children with independent attorneys to advocate on their behalf. Investigations, lawsuits, grand juries, amendments to court rules, and newspaper articles continue to demonstrate the myriad failures in the Florida system. Two notorious examples hi-lite the shortcomings: the cases of the foster child, Rilya Wilson, who disappeared in 2001, and Gabriel Myers, who …

Legal Mobilization On The Terrain Of The State: Immigrant Rights Practice In Two National Legal Fields, Leila Kawar Apr 2011

Legal Mobilization On The Terrain Of The State: Immigrant Rights Practice In Two National Legal Fields, Leila Kawar

Political Science Faculty Publications

Scholarship on law and social movements has focused attention primarily on the United States, and secondarily on countries that share the Anglo-American legal tradition. The politics of law and social movements in other national legal contexts remains under-examined. The analysis in this article contrasts legal mobilizations for immigrant rights in France and the United States and explores the relations between national fields of power and legal practices. I trace the institutionalization of immigrant rights legal organizations in each country, and argue that the divergent organizational forms and litigation strategies adopted by “professionalized” movement organizations reflect the dynamics of the nationally-distinct …

The Tax Man's Ethics: Four Of The Hardest Ethical Questions For An Irs Lawyer, Michelle M. Kwon Apr 2011

The Tax Man's Ethics: Four Of The Hardest Ethical Questions For An Irs Lawyer, Michelle M. Kwon

Scholarly Works

The traditional approach to legal ethics often is characterized to mean that lawyers must zealously advocate for their clients’ objectives tempered only by the bounds of the law. In contrast to the traditional approach, the public interest approach to legal ethics extends a government lawyer’s professional ethical duties from the agency client to the public at large to further the public interest. Commentators, in advocating either the traditional approach or the public interest approach to government lawyering, disagree about whether a government lawyer owes some sort of duty to the public and if so, the nature and scope of that …

Rethinking Iolta, Dru Stevenson Apr 2011

Rethinking Iolta, Dru Stevenson

Missouri Law Review

IOLTA (Interest on Lawyers' Trust Accounts) is a popular mechanism for funding legal services for the poor, and such programs now operate in every state. IOLTA programs suffer from badly depleted resources due to the current financial environment, causing painful cutbacks at the nonprofit legal aid entities that depend on IOLTA for their operating expenses. This shortfall casts doubt on the wisdom of widespread dependence on IOLTA. The previous academic literature about IOLTA focused on input-side issues: the original owners' property rights in the interest taken to fund the programs, the compliance of lawyers with the program's requirements, and the …

Unclaimed Financial Assets And The Promotion Of Microfinance, Andrew W. Hartlage Apr 2011

Unclaimed Financial Assets And The Promotion Of Microfinance, Andrew W. Hartlage

Michigan Law Review First Impressions

State governments can effectively promote domestic entrepreneurship in low-income communities and simultaneously fulfill their duties as conservator s of unclaimed property, by lending unclai med financial assets-in-trust at preferential interest rates to in-state microfinance providers. This plan presents an alternative to charitable contributions, though it does not resolve the tension between for-profit and not-for-profit microfinance providers. Such a scheme could be a significant funding source for many microfinance operations in the United States today. Even a small portion of the yearly intake of unclaimed assets would be substantial enough to support fully most microfinance loan portfolios. Also, reinvestment of unclaimed …

Explaining The Importance Of Public Choice For Law, D. Daniel Sokol Apr 2011

Explaining The Importance Of Public Choice For Law, D. Daniel Sokol

UF Law Faculty Publications

The next generation of government officials, business leaders and members of civil society likely will draw from the current pool of law school students. These students often lack a foundation of the theoretical and analytical tools necessary to understand law's interplay with government. This highlights the importance of public choice analysis. By framing issues through a public choice lens, these students will learn the dynamics of effective decision-making within various institutional settings. Filling the void of how to explain the decision-making process of institutional actors in legal settings is Public Choice Concepts and Applications in Law by Maxwell Stearns and …

The Tax Man's Ethics: Four Of The Hardest Ethical Questions For An Irs Lawyer, Michelle M. Kwon

Cardozo Public Law, Policy & Ethics Journal

The article explores the ethical framework governing IRS Office of Chief Counsel lawyers, comparing the traditional approach of client advocacy with the public interest approach. It argues that the Office has adopted self-imposed duties to the public, beyond the Model Rules, to ensure impartial and fair tax law application. These duties align with the IRS's mission and do not conflict with its primary role of representing the agency. The analysis examines four hypothetical scenarios to assess the effectiveness of these duties and their implications for legal ethics.

Police Independence And The Military Police, Kent Roach Apr 2011

Police Independence And The Military Police, Kent Roach

Osgoode Hall Law Journal

This article examines police independence in the context of the military police. The author concludes that the independence of the military police to investigate both Criminal Code and Code of Service Discipline offences should be recognized as part of the unwritten constitutional principle associated with the rule of law and as a principle of fundamental justice under section 7 of the Charter. The author examines the increased recognition of the importance of police investigative independence since the Somalia Inquiry, including the recent expansion of the command authority of the Canadian Forces Provost Marshal over all military police. The relation between …

Sectoral Changes And The Increase In Women's Labor Force Participation, Rahşan Akbulut Apr 2011

Sectoral Changes And The Increase In Women's Labor Force Participation, Rahşan Akbulut

Business Faculty Articles and Research

Throughout the second half of the 20th century, women in the United States decided to move increasingly into the labor market. This paper investigates the growth of the service sector as an explanation for the increase in women's employment. It develops an economic model that can account for the increase in women's employment and the growth of the service sector at the same time. A growth model with two sectors and a home production technology is constructed in order to quantitatively assess the contribution of sectoral productivity differences to the change in women's employment decision. The sectoral productivities are taken …
