Comparing Fundamentalisms: A Social Movement Theory Approach, David Romney Aug 2011

Comparing Fundamentalisms: A Social Movement Theory Approach, David Romney

Student Works

The last forty years have witnessed the emergence of a number of Islamist and Jewish fundamentalist groups, resulting in a number of comparative studies that try to explain this phenomenon (e.g. Antoun and Hegland 1987; Sivan and Friedman 1990). Although scholars have argued varying reasons for this recent religious resurgence, most have recognized the importance of the 1967 war to both Jewish and Islamist fundamentalist movements. Some of these scholars see the religious resurgence following this war as a continuation of religious sentiments expressed by pre-1967 Zionist and fundamentalist Islamic groups rather than as a new movement (Davis 1987, 149-152).

Postmodern Subjects And The Nation: Contemporary Arab Women Writers' Reconfigurations Of Home And Belonging, Ghadir Khalil Zannoun

Graduate Theses and Dissertations

A lot has been said about the declining status of national paradigms. Most recently, the forces of change have been located in the transnational and global phenomenon. Contemporary Arabic literature, however, identifies globalism as only one among many factors undermining the existing national formations in the Arab countries. Among these factors is the postcolonial condition, and in the case of Palestine, the struggle against the continuing military occupation of Palestinian lands, wholesale and unsystematized modernization, and complex internal Social, cultural, religious and racial differences exacerbated by neo-colonialism. The contemporary Arab women writers' fiction analyzed in this dissertation posits yet another …

Rights Of Women And Muslim Societies, Asghar Ali Engineer Jul 2011

Rights Of Women And Muslim Societies, Asghar Ali Engineer

Socio-Legal Review

This comment engages with the gap between the Qur'anic pronouncements and Shari'ah requirements pertaining to the treatment of women under Islam. The author historically traces this development from 7th century Arabia till present and examines issues such as wife beating, the capacity of women as half-witnesses, inheritance, marriage and divorce. In doing so, the comment seeks to dispel the myth that Shari'ah laws are divine and hence immutable. It concludes with an examination of the socio-political context of the codification of personal laws and women’s status in contemporary Muslim world today.

Understanding The Sources Of The Sino-Islamic Intellectual Tradition: A Review Essay On The Sage Learning Of Liu Zhi: Islamic Thought In Confucian Terms, By Sachiko Murata, William C. Chittick, And Tu Weiming, And Recent Chinese Literary Treasuries, Kristian Petersen

Religion Faculty Publications

An oft-quoted Hadith purports that it is incumbent upon every Muslim to seek knowledge, even if it is to be found as far away as China.1 However, the plethora of knowledge that was discovered there generally has yet to be unraveled by Western academics. If the intellectual tradition of Chinese Muslims may appear to be of minor consequence to the larger field of Islamic studies, this is in part because of our failure to assess their influence. The abundant resources for understanding the Islamic sciences in China have barely been grazed and are awaiting our thorough analytical peregrination. This essay …

Succession In Family Businesses: Kinship Culture And Islamic Law Of Inheritance, Nasir Afghan Jul 2011

Succession In Family Businesses: Kinship Culture And Islamic Law Of Inheritance, Nasir Afghan

Business Review

Majority of research has been carried out on succession within family firms in the positivistic tradition of research and also has a very strong normative element to it. The successful research has been defined using researchers determined criterion such as firm performance, viability and harmony among the family members etc. This type of research obviously assumes an independent reality ‘out there’ ready to be collected by objective researcher. This positive stance has been apparent even in the case based research mostly conducted by practitioners. On the contrary, to carry out this research an interpretive approach was adopted. The aim of …

Sociology & Criminal Justice Theses & Dissertations

Female genital mutilation (FGM) is the cutting off of female genitals for nonmedical purposes (WHO 2008). FGM is a gender specific practice, which has no health benefits and severe consequences. In addition, the victims of this form of physical, sexual, psychological, and emotional violence are predominantly children between birth and age 15 (WHO 2008). Female genital mutilation is an egregious act, which must be eradicated. This study sought to begin the process of securing preliminary estimates for FGM in countries that lacked data on FGM in the Middle East and Africa, thereby shedding light on this extremely detrimental and oppressive …

Specifically, the paper traces and analyses the evolution of Bori cult practice in the Tunisian milieu and places it in its proper historical and diasporic contexts. To this end, the paper goes beyond questions that are not central …

Justice Delayed Is Justice Denied?: Divorce Case Management In Malaysian Shariah Court, S.Z. Ismail, I. Abdul Ghani Azmi, Z. Yasoa

Research Publications (2011 to 2015)

One of the problems that influence the quality of administering justice is the duration of court proceeding. This problem has been significantly recognized in many countries. In Malaysia, the lengthy duration of court proceedings pertaining to divorce cases of Muslim couples is particularly considered to be a problem in Malaysian shariah court. In fact, this is the most prevalent complaint ever lodged by the public to Shariah Judiciary Department (JKSM) every year. While it is true that delay indicates inefficiency in management, the interpretive standard used by the JKSM concerning delay is applied for cases which reach settlement after 360 …

However, a lot of factors can encourage students to cycling, such as the limitation of bus route, travel time, cost and individual physical condition. This paper presents the results and analysis on …

Peace And War In The Qur'an And Juridical Literature: A Comparative Perspective, Liyakat Takim Jun 2011

Peace And War In The Qur'an And Juridical Literature: A Comparative Perspective, Liyakat Takim

The Journal of Sociology & Social Welfare

The Qur'anic period of Islamic history took place in a social context of significant diversity. A number of important verses in the Qur'an reflect this diversity and encourage Islamic believers to seek peaceful coexistence with those of other faiths, especially those designated as "people of the Book," specifically Christians, Jews and Sabeans. In the later classical period of Islamic history, the exegesis of Islamic jurists markedly de-emphasized peaceful coexistence in favor of interpretations encouraging conquest and religious uniformity. Although the classical jurists have exercised enormous interpretive authority in subsequent Islamic history, their authority was never understood to be absolute or …

Protection Of Beliefs Or Believers: Incitement To Religious Hatred Replacing Blasphemy And Defamation Of Religion, Mahmoud Farag Jun 2011

Protection Of Beliefs Or Believers: Incitement To Religious Hatred Replacing Blasphemy And Defamation Of Religion, Mahmoud Farag

Theses and Dissertations

Incitement to religious hatred and restrictions on freedom of expression protect religious believers from unlawful expression. There is neither need to defamation of religion resolutions nor to blasphemy legislation. The Islamic and several developing states have internationalized blasphemy law under the name of defamation of religion. Defamation of religion and blasphemy's protection of religion contradicts with the individual based nature of human rights. It does not also comply with the classic understanding of defamation law that has only protected individual's reputation. Defamation of religion requires the state to arbitrate amongst intangible competing religious truth. The lack of clear guidelines on …

Where Lawfare Meets Lawsuit In The Case Of Padilla V. Yoo, Joseph Marchesano May 2011

Where Lawfare Meets Lawsuit In The Case Of Padilla V. Yoo, Joseph Marchesano

Seattle University Law Review

This Note argues that, despite the concern that the use of lawfare threatens American national-security interests, Padilla v. Yoo was decided correctly, both in its legal reasoning and in the appropriateness of the Judiciary’s intervention in a domestic question of constitutional rights. Part II examines Padilla’s capture and detention, as well as the development of the torture memos. Part III discusses the constitutional violations alleged in Padilla. Part IV suggests that, despite the use of lawfare, the Judiciary properly adjudicated a domestic-affairs issue and acted within its authority in not deferring to the coordinate branches of government. Part V …

Academic Journal Publishing In Nigeria: Issues, Challenges And Prospects, A.O. Amusan, Dele Olanisimi

Academic Leadership: The Online Journal (2003-2012)

Compared to the situation up to the late 1970s, academic publishing in Africa and its concomitant effect of scholarly research has declined in terms of output, quality and regularity of a publications (Olukoju, 2002). This reflects the general decline in the standards and funding of education, a consequence of prolonged military rule characterized by lack of accountability and thinly veiled culture of obscurantism (Olukoju, 2002). He also stressed the problem of collapsed currency, owing to plunder, and mismanagement by the country’s military rulers and their civilian collaborations.
