Age, Forest Structure, And Disturbance History Of Five Potential Old-Growth Forests In Eastern Kentucky's Cumberland Plateau, Adrienne Michelle Cooper Jan 2011

Age, Forest Structure, And Disturbance History Of Five Potential Old-Growth Forests In Eastern Kentucky's Cumberland Plateau, Adrienne Michelle Cooper

Online Theses and Dissertations

The Cumberland Plateau (CP) is an ecoregion of global importance, yet its extent of old- growth forest (OG) is not well known. Due to its rarity and importance, understanding what OG remains is needed to deduce the region's health. This study described five potential OG forests in eastern Kentucky. Sites possessing >5 trees/ha established prior to 1780, and being similar in disturbance history and forest structure to other regional OG were to be considered OG. Shillalah Creek (SC) and Hensley-Pine Mountain (HP) possess no in plot trees established prior to 1780, show evidence of stand-wide disturbance during the 1930's, are …

Sexting As Moral Panic: An Exploratory Study Into The Media's Construction Of Sexting, Brandon Scott Marker Jan 2011

Sexting As Moral Panic: An Exploratory Study Into The Media's Construction Of Sexting, Brandon Scott Marker

Online Theses and Dissertations

This paper presents a study of sexting as a socially constructed moral panic. Central to a social construction of moral panic perspective is the role the media plays in creating the panic. The purpose of this exploratory study was to make sense of the phenomenon of sexting by analyzing media reports for indication that sexting was constructed by the media as a moral panic. A content analysis was conducted on media reports for three concepts: Theme Setting, Sensational Stories, and Policy Changes. I conclude that sexting is constructed as a moral panic by the media.

Postwar Media Manifestations And Don Delillo, Joshua Adam Boldt Jan 2011

Postwar Media Manifestations And Don Delillo, Joshua Adam Boldt

Online Theses and Dissertations

Media's influence on postwar American culture is undeniable. Don DeLillo's fiction is often a commentary on that influence. Hyperreality, Simulacra, Consumerism, and News Addiction are all regular themes in DeLillo's novels; this paper explores all of these concepts through the lens of media theory. Special attention is given to the novels White Noise, Americana, and Mao II, as well as to the media theorists Jean Baudrillard, Walter Benjamin, and Antonio Gramsci. The paper is both a history and a critique of postwar consumer culture and the role that media plays in the construction of that culture.

Thirty-three different rest sites were located throughout the spring and summer seasons of 2009-10. With some rest sites being used multiple times for a total of 50.

Of the individual rest sites located, 9, 16, and 8 were located in trees, in …

Clarifying Stereotyping, Kerri Lynn Stone Jan 2011

Clarifying Stereotyping, Kerri Lynn Stone

Faculty Publications

This Article addresses the largely undefined, misunderstood-yet-often-resorted-to concept of “stereotyping” as a basis for, or sufficient evidence of, liability for employment discrimination. Since, the concept’s genesis in Supreme Court jurisprudence in 1989, Price Waterhouse v. Hopkins, plaintiffs have proffered remarks alleged to be tinged with, or indicating the presence of, impermissible stereotypes as evidence of discrimination based on protected-class status – be that sex, race, color, religion, or national origin – in contravention of Title VII of the Civil Rights Act of 1964. The Article examines the language in Hopkins and its precise mandates and guidance for lower courts. It …

Ovine scrapie is considered a neurodegenerative disease characterized by the accumulation of an abnormal, protease-resistant isoform of PrP. The polymorphisms at codons 136, 154, and 171 are associated with susceptibility to scrapie. In order to detect the existing polymorphisms at the 3 codons we used the real-time PCR technique. The obtained genotypes were confirmed by PCR amplification and sequencing of a 402 bp fragment of exon 3 of the prion gene. Known polymorphisms were detected at codons 136, 154, and 171 and 5 different genotypes were determined. The results showed that all animals were homozygous for A at codon 136 …

Comparative Imaging Study In Ultrasound Mri, Ct And Dsa Using A Multi-Modality Renal Artery Phantom, Deirdre King, Andrew Fagan, Carmel Moran, Jacinta Browne

Articles

A range of anatomically-realistic multi-modality renal artery phantoms consisting of vessels with varying degrees of stenosis was developed and evaluated using four imaging techniques currently used to detect renal artery stenosis (RAS). The spatial resolution required to visualize vascular geometry and the velocity detection performance required to adequately characterize blood flow in patients suffering from RAS is currently ill-defined, with the result that no one imaging modality has emerged as a gold standard technique for screening for this disease.

Methods: The phantoms, which contained a range of stenosis values (0, 30, 50, 70 and 85%), were designed for use with …

Leading Unconducted Chamber Vocal Ensembles: A Case Study Of The University Of Northern Iowa Varsity Men's Glee Club Camerata, David Hoobler

Honors Program Theses

Recently, unconducted chamber vocal ensembles have emerged as one of, if not the most popular forms of vocal performing groups. TV shows such as "The Sing Off' and "Glee" showcase the musical abilities of this type of ensemble. Barbershop quartets enjoy high levels of popularity. Professional groups such as Voces8 and other groups on many college campuses are constantly in demand for performances. In addition, educators find it necessary to learn how to lead these groups especially in the state of Iowa where quartets are used for All-State auditions, and the popularity of Show Choir necessitates an unconducted vocal ensemble …

The Diffusion Of Microgeneration Technologies.: Assessing The Influence Of Perceived Product Characteristics On Home Owners’ Willingness To Pay, Marius Claudy, Claus Michelsen, Aidan O'Driscoll

Articles

This study presents empirical insight into willingness to pay (WTP) for microgeneration technologies and the relative influence of subjective consumer perceptions. First, we apply a double-bounded-contingent valuation method to elicit Irish home owners’ willingness to pay for micro wind turbines, wood pellet boilers, solar panels and solar water heaters. Utilizing findings from the adoption of innovation literature, in a second step, we assess the influence of different antecedents on WTP for each of the four technologies, including (1) home owners’ perception of product characteristics, (2) normative influences, and (3) socio demographic characteristics. Our results show that WTP varies significantly between …

The New Old Legal Realism, Mitu Gulati, Tracey E. George, Ann Mcginley Jan 2011

The New Old Legal Realism, Mitu Gulati, Tracey E. George, Ann Mcginley

Faculty Scholarship

Do the decisions of appellate courts matter in the real world? The American judicial system, legal education, and academic scholarship are premised on the view that they do. The authors want to reexamine this question by taking the approach advocated by the original Legal Realists. The current project seeks to add to our knowledge of the relevance of case law by focusing on an area that has received little examination: how pronouncements about employment discrimination law by appellate courts translate into understandings and behavior at the ground level. As our lens, we use evidence of how people talk about the …

Charities And Lobbying: Institutional Rights In The Wake Of Citizens United, Lloyd Hitoshi Mayer Jan 2011

Charities And Lobbying: Institutional Rights In The Wake Of Citizens United, Lloyd Hitoshi Mayer

Journal Articles

One of the many aftershocks of the Supreme Court’s landmark decision in Citizens United v. FEC is that the decision may raise constitutional questions for the long-standing limits on speech by charities. There has been much scholarly attention both before and after that decision on the limit for election-related speech by charities, but much less attention has been paid to the relating lobbying speech limit. This article seeks to close that gap by exploring that latter limit and its continued viability in the wake of Citizens United. I conclude that while Citizens United by itself does not undermine the limit …

Localism And Capital Punishment, Stephen F. Smith Jan 2011

Localism And Capital Punishment, Stephen F. Smith

Journal Articles

Professor Adam Gershowitz presents an interesting proposal to transfer from localities to states the power to enforce the death penalty. In his view, state-level enforcement would result in a more rationally applied death penalty because states would be much more likely to make capital charging decisions based on desert, without the distorting influence of the severe resource constraints applicable to all but the wealthiest of localities. As well conceived as Professor Gershowitz’s proposal is, however, I remain skeptical that statewide enforcement of the death penalty would be preferable to continued local enforcement. First, Professor Gershowitz underestimates the benefits of localism …

The Political (And Other) Safeguards Of Religious Freedom, Richard W. Garnett Jan 2011

The Political (And Other) Safeguards Of Religious Freedom, Richard W. Garnett

Journal Articles

This essay is a contribution to a symposium marking the 20th anniversary of the Supreme Court’s still-controversial decision in Employment Division v. Smith. That decision, it is suggested, should not be read as reflecting or requiring hostility or indifference towards claims for legislatively enacted accommodations of religion. Smith is not an endorsement of religion-blind neutrality in constitutional law; instead, it assigns to politically accountable actors the difficult, but crucially important, task of accommodating those whose religious exercise would otherwise be burdened by generally applicable laws. The essay goes on to suggest several things that must be true of our law …

The Self-Judging Wto Security Exception, Roger P. Alford Jan 2011

The Self-Judging Wto Security Exception, Roger P. Alford

Journal Articles

This Article analyzes the WTO security exception, with a particular focus on State practice. In the absence of any GATT or WTO jurisprudence, State practice affords the best vehicle to understand the meaning of Article XXI. In the few instances when invocation of the security exception has been challenged, State practice suggests that the security exception is not judicially reviewable.

A critical question emerges from this analysis of State practice. If a Member State can avoid WTO obligations through a self-judging security exception, what is to prevent bad faith invocations? The WTO regime includes a number of devices to address …

Strategic Spillovers, Daniel B. Kelly Jan 2011

Strategic Spillovers, Daniel B. Kelly

Journal Articles

The conventional problem with externalities is well known: Parties often generate harm as an unintended byproduct of using their property. This Article examines situations in which parties may generate harm purposely, in order to extract payments in exchange for desisting. Such “strategic spillovers” have received relatively little attention, but the problem is a perennial one. From the “livery stable scam” in Chicago to “pollution entrepreneurs” in China, parties may engage in externality-generating activities they otherwise would not have undertaken, or increase the level of harm given that they are engaging in such activities, to profit through bargaining or subsidies. This …

Restoring Lost Connections: Land Use, Policing, And Urban Vitality, Nicole Stelle Garnett Jan 2011

Restoring Lost Connections: Land Use, Policing, And Urban Vitality, Nicole Stelle Garnett

Journal Articles

Justice William Brennan rightfully reminded all of us that state constitutional law is too often neglected in our courtrooms and our classrooms. State constitutions, to borrow from the late Chief Justice William Rehnquist, ought not to be "relegated to the status of a poor relation" in our constitutional legal structure. They differ in important ways from the federal law Constitution-and those differences provide the space within which our democratic experiment flourishes. And I am sure if Justice Brennan were here with us today, he would agree that we also should not neglect the study of the state and local policies …

Prerequisites In Behavioral Science And Business: Opportunities For Dental Education., David G. Dunning, Brian M. Lange, Robert D. Madden, Koko K. Tacha

Journal Articles: College of Dentistry

There is increasing pressure on recent dental school graduates to understand and successfully utilize patient management and business management strategies to run a productive dental office. Dental schools are faced with the dilemma to either add more credit hours in their already crowded curriculum or adjust predental school requirements. All fifty-nine U.S. dental schools were assessed online to determine admission requirements in the areas of behavioral science and business education. Results show that only 11.9 percent of the schools require prerequisite course work in behavioral science and no school requires prerequisite course work in business. However, 64.4 percent and 30.5 …

Human Chondrosarcoma Cells Acquire An Epithelial-Like Gene Expression Pattern Via An Epigenetic Switch: Evidence For Mesenchymal-Epithelial Transition During Sarcomagenesis., Matthew P. Fitzgerald, Francoise Gourronc, Melissa L.T. Teoh, Matthew J. Provenzano, Adam J. Case, James A. Martin, Frederick E. Domann

Journal Articles: Cellular & Integrative Physiology

Chondrocytes are mesenchymally derived cells that reportedly acquire some epithelial characteristics; however, whether this is a progression through a mesenchymal to epithelial transition (MET) during chondrosarcoma development is still a matter of investigation. We observed that chondrosarcoma cells acquired the expression of four epithelial markers, E-cadherin,desmocollin 3, maspin, and 14-3-3σ, all of which are governed epigenetically through cytosine methylation. Indeed, loss of cytosine methylation was tightly associated with acquired expression of both maspin and 14-3-3σ in chondrosarcomas. In contrast, chondrocyte cells were negative for maspin and 14-3-3σ and displayed nearly complete DNA methylation. Robust activation of these genes was also …
