A Child Rights-Based Approach To Reconstruction In Haiti, Jonathan Todres Jan 2011

A Child Rights-Based Approach To Reconstruction In Haiti, Jonathan Todres

Intercultural Human Rights Law Review

The January 2010 earthquake in Haiti created a major humanitarian crisis for all of Haiti's population, not least for its children. The devastation resulting from any large scale natural disaster raises numerous children's rights issues. Immediately following the Haiti earthquake, however, public attention focused largely, and selectively, on only certain issues confronting children, most notably the threat of trafficking. Anti-trafficking initiatives are essential, but isolating trafficking as an issue can lead to overlooking the structural issues that heighten children's vulnerability to being trafficked as well as other equally pressing children's rights violations. This article proposes a more holistic rights-based approach …

Haitian Immovable Property Law: A Major Obstacle To Earthquake Recovery And Economic Development, Winston W. Riddick Jan 2011

Haitian Immovable Property Law: A Major Obstacle To Earthquake Recovery And Economic Development, Winston W. Riddick

Intercultural Human Rights Law Review

This symposium encompasses human rights issues in Haiti, the poorest country in the Western hemisphere, after its devastating earthquake in January 2010 - its problems with governance, human trafficking, dealing with displaced populations, and rebuilding. This article examines an issue that may cut across all of those topics. It is important to reform, stabilize, and enforce property rights in order to provide a basis for protecting individual rights and economic freedom, and to promote government stability and economic development in Haiti's rebuilding efforts. The right of private ownership of property to be free from unreasonable expropriation and confiscation by rulers …

Investing In The Business Against Human Trafficking: Embracing The Fourth P - Partnerships, Maudisa Mcsween

Intercultural Human Rights Law Review

This article recognizes that the fight against human trafficking is a global one, with the business of human trafficking intersecting many legal and social constructs, and as such, it should be tackled with all available mechanisms - legal, social, moral, community, and religious. More importantly, the integration, communication, and involvement of government, non-government, private, faith-based, social, and civil sectors are critical elements to successfully combat this scourge against human dignity. Part I of this article will discuss the legal construct of partnerships and the dynamic of private-public partnerships. Part II will focus on the laws and provisions in domestic, international, …

Linguistic Rights Of Indigenous Peoples In The States Of Latin America, Jose Manuel Perez Fernandez Jan 2011

Linguistic Rights Of Indigenous Peoples In The States Of Latin America, Jose Manuel Perez Fernandez

Intercultural Human Rights Law Review

The protection of language rights of speakers of indigenous languages has experienced important developments in the Latin American sphere, which has served as a framework for the whole process of recognition of cultural and ethnical identity of Indigenous Peoples. This reflects a rejection of assimilation, and an assertion of multicultural and multilingual aspects in Latin American societies. On the one hand, the author focuses on the role that international law instruments related to human rights, those for the general protection of minorities and those specific for the indigenous peoples, may perform in the recognition of linguistic rights when granting legal …

Parental Autonomy And The Role Of The State: Arranged Marriages In India, Marjorie Uzquiano Jan 2011

Parental Autonomy And The Role Of The State: Arranged Marriages In India, Marjorie Uzquiano

Intercultural Human Rights Law Review

The doctrine that has become known as Parental Autonomy refers to a belief that parents have a fundamental right to bring up their offspring and to make all sort of decisions concerning the child, free from government intervention, absent a threat to the health and welfare of the offspring. The government has the right to interfere if public health, welfare, safety, and order are jeopardized by parental decisions. The focus of this paper is the issue of parental autonomy in India in the context of arranged marriages, and the role of the state in limiting parental freedom when children are …

Stories In Pictures (And Non-Pictorial Objects): A Narratological And Cognitive Psychological Approach, Michael Ranta

Contemporary Aesthetics (Journal Archive)

Narratological studies have frequently focused upon linguistic structures, considered to be paradigmatic cases of narrativity, while pictorial signs, such as icons and symbols or indices, have received comparably much less attention. In this paper, however, some basic and regularly occurring narrative aspects of pictures and non-pictorial objects will be presented and discussed.

Getting To Know You: Key Clinical Concepts In Relationship-Based Interventions And Neurobehavioral Observations With Young Infants, Yvette Blanchard Jan 2011

Getting To Know You: Key Clinical Concepts In Relationship-Based Interventions And Neurobehavioral Observations With Young Infants, Yvette Blanchard

All PTHMS Faculty Publications

The newborn infant is a social organism, pre-disposed to interact with his caregiver and able to elicit the kind of caregiving necessary for successful adaptation. The earliest developmental task of the newborn is to organize behavior to be able to play an active role in influencing the caregiving environment and eliciting the kind of support needed for development. This task is accomplished through the attainment of self-regulation or balanced neurobehavioral functioning of the infant's autonomic, motor, state, and responsivity behavioral dimensions as described by Als.

Helping Haiti In The Wake Of Disaster: Law Students As First Responders, Melissa Gibson Swain, Jonel Newman Jan 2011

Helping Haiti In The Wake Of Disaster: Law Students As First Responders, Melissa Gibson Swain, Jonel Newman

Intercultural Human Rights Law Review

This is the story of how we put an immediate-need and longer-term TPS service effort together, the lessons we learned in doing so, and what we believe to be a sustainable clinical pedagogy, and law school service model built around disaster assistance and recovery. We begin by examining how lawyers and law students have traditionally made valuable contributions to disaster response by using their legal training. All too often, those efforts have been hampered by the post-disaster ad hoc nature in which they have been constructed, and by the limitations inherent in the relatively small number of lawyers available to …

Rule Of Law In Haiti Before And After The 2010 Earthquake, James D. Wilets, Camilo Espinosa Jan 2011

Rule Of Law In Haiti Before And After The 2010 Earthquake, James D. Wilets, Camilo Espinosa

Intercultural Human Rights Law Review

When discussing the myriad challenges facing Haiti in the wake of the devastating 2010 earthquake, it is difficult to prioritize the needs of a country where basic needs such as shelter and basic medical care compete for long-term needs such as education, good governance, and economic reconstruction and growth. The current immediate and emergent needs of Haiti in the face of its national calamity have been well identified by international aid bodies and national leaders, and there has been a considerable literature on those needs. What is of equal importance in the long run, however, is building a solid foundation …

Guardianship For Persons With Mental Illness - A Legal And Appropriate Alternative?, Leslie Salzman Jan 2011

Guardianship For Persons With Mental Illness - A Legal And Appropriate Alternative?, Leslie Salzman

Articles

The article critiques the U.S. guardianship system for individuals with psychosocial disabilities, arguing that it often unnecessarily restricts their autonomy by removing their legal right to make decisions. It advocates for supported decision-making models as a less restrictive alternative, aligning with the Americans with Disabilities Act (ADA) and the United Nations Convention on the Rights of Persons with Disabilities (CRPD). The analysis emphasizes the importance of maximizing integration and participation in social, economic, and civic life, while highlighting the need for safeguards to ensure effective support without undue bureaucratic complexity.

Tracing International Differences In Online Learning Development: An Examination Of Government Policies In New Zealand, Allison Powell, Michael Barbour

Education Faculty Publications

In 2006 the North American Council for Online Learning surveyed the activity and policy relating to primary and secondary e-learning, which they defined as online learning, in a selection of countries. They found most were embracing e-learning delivery of education as a central strategy for enabling reform, modernising schools, and increasing access to high-quality education. While North American countries appeared to be using the internet as a medium to provide distance education at the secondary level longer than most countries, the lack of a guiding vision has created uneven opportunities for students depending on which state or province they live …

Fiber-Reinforced Calcium Sulfate Bone Cement Composites With Enhanced Bioactivity, Mechanical Properties And Controlled Biodegradability, Nuha Fathi Hussien Jan 2011

Fiber-Reinforced Calcium Sulfate Bone Cement Composites With Enhanced Bioactivity, Mechanical Properties And Controlled Biodegradability, Nuha Fathi Hussien

Theses

Hard tissues are natural composites of inorganic and organic components. The inorganic component is a basic Calcium phosphate; known as hydroxyapatite (HAp) while the organic is a natural polymer; known as collagen. The interlocking between the collagen nanofibers and the Hap nanocrystals growing on them offers the known unique mechanical stability of hard tissues. In case of partial fractures; bone or dental cements are often used. Cements such as polymethylmethacrylate (PMMA) has been long used in this regard. However, this polymer is classified as a bio inert material that can be accepted by the human body without having a positive …

The Costs Of Heightened Pleading, Alexander A. Reinert Jan 2011

The Costs Of Heightened Pleading, Alexander A. Reinert

Articles

In Conley v. Gibson, 355 U. S. 41 (1957), the Supreme Court announced its commitment to a liberal pleading regime in federal civil cases, and for decades thereafter was steadfast in resisting ad hoc heightened pleading rules adopted by lower courts. Thus, from 1957 until a few years ago, most litigants could count on surviving a motion to dismiss a complaint for failure to state a claim so long as their pleading provided some minimal notice to the defendant of the nature of their claim. Enter Ashcroft v. Iqbal, 129 S. Ct. 1937 (2009) and Bell Atlantic Corp. v. Twombly, …

Aerosol Route Synthesis And Applications Of Doped Nanostructured Materials, Manoranjan Sahu Jan 2011

Aerosol Route Synthesis And Applications Of Doped Nanostructured Materials, Manoranjan Sahu

All Theses and Dissertations (ETDs)

Nanotechnology presents an attractive opportunity to address various challenges in air and water purification, energy, and other environment issues. Thus, the development of new nanoscale materials in low-cost scalable synthesis processes is important. Furthermore, the ability to independently manipulate the material properties as well as characterize the material at different steps along the synthesis route will aide in product optimization. In addition, to ensure safe and sustainable development of nanotechnology applications, potential impacts need to be evaluated. In this study, nanomaterial synthesis in a single-step gas phase reactor to continuously produce doped metal oxides was demonstrated. Copper-doped TiO2 nanomaterial properties: …

Mechanics Of Heart Tube Formation In The Early Chick Embryo, Victor Varner Jan 2011

Mechanics Of Heart Tube Formation In The Early Chick Embryo, Victor Varner

All Theses and Dissertations (ETDs)

The heart is the first functioning organ to form in the embryo. For decades, biologists have worked to identify many of the genetic and molecular factors involved in heart development, and over the years, these efforts have helped elucidate the vast biochemical signaling networks, which drive cardiac specification and differentiation in the embryo. Still, the biophysical mechanisms which link these molecular factors to actual, physical changes in cardiac morphology remain unclear. The aim of this thesis is to identify some of the mechanical forces which drive heart tube assembly in the early chick embryo. A unique feature of this work …

Mixed-Mode Control Interfaces Of Mobile Robot Teams, Erik Karulf Jan 2011

Mixed-Mode Control Interfaces Of Mobile Robot Teams, Erik Karulf

All Theses and Dissertations (ETDs)

We propose applying various techniques and ideas, from video games, to the design of a task-level control interface for teams of mobile robots. The control interface, which visually resembles a video game and contains the functional elements of traditional robot control software, was designed and implemented using the ROS software framework. Unlike previous interfaces in the literature, our interface allows the user to control more than one robot and supports "sliding autonomy." This application allows the user to assign differing levels of independence to the robots dynamically, dependent on the situation. We present an overview of the implemented system, a …

Localities As Equality Innovators, Robin A. Lenhardt Jan 2011

Localities As Equality Innovators, Robin A. Lenhardt

Faculty Scholarship

This Article thus argues that instead of regarding cities and localities that, like Seattle and Louisville, try to develop serious solutions to existing racial disparities as "bad cities" no different from those whose notorious policies spurred the civil rights movement of the 1950s and 1960s, we should be regarding them as potential "equality innovators.” Their on-the-ground experience with the realities of race and its operation in the twenty-first century arguably places them in a better position than courts to develop innovative approaches to the structural racial inequities with which so many municipalities must grapple. Existing doctrine limits dramatically the ability …

Urine Microscopy Findings Predict Outcomes In Hospitalized Patients With Acute Kidney Injury, Patricia Peter Jan 2011

Urine Microscopy Findings Predict Outcomes In Hospitalized Patients With Acute Kidney Injury, Patricia Peter

Yale Medicine Thesis Digital Library

Though urine microscopy has long been highly regarded by nephrologists as an essential diagnostic tool, its potential utility in predicting outcome in acute kidney injury (AKI) warrants further exploration. In this study, urine sediment microscopy was performed on 165 hospitalized patients on the first day of their clinical AKI diagnosis to determine whether microscopy findings early in the course of this disease correlate with "worsening," a composite of increasing AKI stage and in-hospital mortality. Microscopy findings were recorded as individual cells and casts along with a microscopy score derived from renal tubular epithelial (RTE) cells and granular casts. Our data …

Evaluation Of Need And Feasibility Of Tuberculosis Screening In Buprenorphine Treatment Programs, Ryan Schwarz Jan 2011

Evaluation Of Need And Feasibility Of Tuberculosis Screening In Buprenorphine Treatment Programs, Ryan Schwarz

Yale Medicine Thesis Digital Library

Background: Buprenorphine's availability in primary care settings offers increased access to treatment and linkage to primary care for opioid-dependent patients. Currently, tuberculin skin testing (TST) is recommended for patients enrolling in methadone maintenance treatment (MMT), but not for those enrolling in buprenorphine maintenance treatment (BMT).

Objectives: To compare TST screening results in enrollees in BMT and MMT programs and assess the correlates of TST positivity among these subjects.

Methods: A cross-sectional analysis of a retrospective cohort study was conducted to compare concurrent TST results among contemporaneously matched groups of MMT and BMT patients in the same community.

Results: TST positivity …
