Legitimate Exercises Of The Police Power Or Compensable Takings: Courts May Recognize Private Property Rights, Terence J. Centner Dec 2011

Legitimate Exercises Of The Police Power Or Compensable Takings: Courts May Recognize Private Property Rights, Terence J. Centner

Journal of Food Law & Policy

Under their police power, governments regulate nuisances and take actions in emergency situations. For protecting humans, animals, and plants from diseases and other pests (jointly referred to as diseases), governments order inoculations, quarantine items and people, and seize and destroy property.' With respect to plants and animals, the United States Secretary of Agriculture is authorized to prohibit the importation and movement of items than may be infested. The Secretary also has the authority to hold, treat, and destroy items to prevent the dissemination of plant and animal pests. State governments take additional actions to prevent the introduction and dissemination of …

Current And Emerging Issues In The New Urban Agriculture: A Case Study, Kathryn A. Peters Dec 2011

Current And Emerging Issues In The New Urban Agriculture: A Case Study, Kathryn A. Peters

Journal of Food Law & Policy

Urban agriculture takes many forms, including individual gardens on privately owned land, neighborhood gardens, community gardens, and gardens located on church and school grounds, housing developments, and other publicly owned property. The most essential factors for successful urban agriculture efforts include land acquisition, zoning ordinances, access to affordable water, infrastructure, and support services such as education and outreach. Cities across the United States have formed task forces with the mission of making their cities more sustainable or strengthening the local food supply system; urban agriculture is instrumental in both of these missions. Major cities across the United States are recognizing …

The Tragedy Of The Horse, American Icon, Tim Opitz Dec 2011

The Tragedy Of The Horse, American Icon, Tim Opitz

Journal of Food Law & Policy

Whether a prohibition on slaughter improves the welfare of the American horse population is the focus of this article. At the time it was written, winter of 2010-2011, a confluence of Federal and State legislative action had ended domestic slaughter. These actions are detailed in the body of this article. Since 2007, the legal status of horse slaughter remained static. Just as Sir Isaac Newton's first law of motion explained, an object at rest tends to stay at rest. Legislative inertia is the perspective from which this article was originally written. However, Newton's first law also stated that the object …

Role Of Mallampati As A Predictor Of Difficult Intubation In Obese Adults, Quyen Lee Dec 2011

Role Of Mallampati As A Predictor Of Difficult Intubation In Obese Adults, Quyen Lee

Theses and Dissertations

Background: Morbid obesity is increasingly prevalent. Tracheal intubation in this patient population may be hampered by factors such as limited neck extensibility, redundant soft tissue in the neck, chest, and pharynx. It is unclear whether traditional clinical predictors of difficult intubation, such as Mallampati's classification, remain valid for the more obese patient population today. The purpose of this study is to review the current literature to clarify whether Mallampati's classification, first described in 1985, is relevant in the more obese population today. This study is a literature review of morbidly obese adult patients undergoing general anesthesia. A Pub Med search …

Understanding Systems Experience: The Centrality Of Perception In The Context Of Healthcare Quality And Cost Management, Heather Grooms Dec 2011

Understanding Systems Experience: The Centrality Of Perception In The Context Of Healthcare Quality And Cost Management, Heather Grooms

Student Scholarship

Hospitals are increasingly challenged to improve healthcare quality while reducing costs but key actors in healthcare, specifically physicians (as leaders or clinicians) and administrators, are not always aligned in how to do it. What emerged in this qualitative analysis were three fundamental areas embedded in systems experience – people, structure, and perception, of which perception is the key driver. Additionally, processes are how people describe systems experiences and moral dilemmas are sources of system tensions. What causes a system to become a living entity – or to function with fluidity versus turbulence – is embedded in people. The centeredness of …

The Lived Experiences Of Families Who Have Attended A Cardiogenetics Clinic, Esma D. Paljevic Dec 2011

The Lived Experiences Of Families Who Have Attended A Cardiogenetics Clinic, Esma D. Paljevic

Education Doctoral

This study explored the lived experiences of the family members who have participated in a Cardiogenetics Clinic at The Children’s Hospital at Montefiore, which utilizes an interprofessional approach to care. A qualitative phenomenological approach was used to explore the lived experience of the families. Families that are referred to the clinic have suffered the loss of a family member to sudden cardiac death (SCD). This interprofessional model of care offers information regarding SCD, a genetic profile to determine risk for SCD, an integrative collaborative approach to care as well as nursing, medical interventions, psychological support, and counseling. The theory of …

Polyglutamine (polyQ) stretches exceeding a threshold length confer a toxic function to proteins that contain them and cause at least nine neurological disorders. The basis for this toxicity threshold is unclear. Although polyQ expansions render proteins prone to aggregate into inclusion bodies, this may be a neuronal coping response to more toxic forms of polyQ. The exact structure of these more toxic forms is unknown. Here we show that the monoclonal antibody 3B5H10 recognizes a species of polyQ protein in situ that strongly predicts neuronal death. The epitope selectively appears among some of the many low-molecular-weight conformational states assumed by …

Bycatch Of The Lake Pontchartrain Basin Inshore Shrimp Fishery And Its Effect On Two Sea Catfish Species: The Gafftopsail Catfish (Bagre Marinus) And The Hardhead Catfish (Ariopsis Felis), Scott P. Eustis Dec 2011

Bycatch Of The Lake Pontchartrain Basin Inshore Shrimp Fishery And Its Effect On Two Sea Catfish Species: The Gafftopsail Catfish (Bagre Marinus) And The Hardhead Catfish (Ariopsis Felis), Scott P. Eustis

LSU New Orleans Theses and Dissertations

In Lake Pontchartrain Basin, commercial fishing in estuarine habitats impacts many non-target species collected as bycatch. I investigated the bycatch assemblages collected by commercial vessels and compared these to assemblages collected by typical fishery-independent methods. I compared assemblages using analysis of similarity (ANOSIM) and determined important species by weight and abundance using similarity percentages analyses (SIMPER). I also examined differences in size-class distributions by gear type using density kernel plots and Mann-Whitney U tests. The two gear types collected significantly different assemblages (ANOSIM R = 0.522, p = 0.001) and gear type explained more composition differences than other factors such …

Financing Inclusive Growth In Nigeria: Challenges And Prospects, P. I. Esenwah Dec 2011

Financing Inclusive Growth In Nigeria: Challenges And Prospects, P. I. Esenwah

Economic and Financial Review

In this paper, the author lays a great deal of emphasis on the importance Inclusive Growth (IG). Inclusive Growth is growth in its entirety, holistic and comprehensive, including everything. It could be broad-based growth across sectors, shared growth and pro-poor growth. Inclusive growth can be described as economic growth with widest participation and benefits best shared through equal opportunities. It is concerned with opportunities for the majority of the labour force, poor and middle-class alike to participate in the production of goods and services rather than in income redistribution as was done in India some years ago. Inclusive growth is …

Clinical Trial Enrollment In A Multidisciplinary Prostate Cancer, Delora A. Domain Dec 2011

Clinical Trial Enrollment In A Multidisciplinary Prostate Cancer, Delora A. Domain

Dissertations and Theses (Open Access)

Purpose: Clinical oncology trials are hampered by low accrual rates. Less than 5% of adult cancer patients are treated on a clinical trial. We aimed to evaluate clinical trial enrollment in our Multidisciplinary Prostate Cancer Clinic and to assess if a clinical trial initiative, introduced in 2006, increased our trial enrollment.
Methods: Prostate cancer patients with non-metastatic disease who were seen in the clinic from 2004 to 2008 were included in the analysis. Men were categorized by whether they were seen before or after the clinical trial enrollment initiative started in 2006. The initiative included posting trial details in the …

The Other Side Of Health Care Reform: An Analysis Of The Missed Opportunity Regarding Infertility Treatments., Nizan Geslevich Packin Dec 2011

The Other Side Of Health Care Reform: An Analysis Of The Missed Opportunity Regarding Infertility Treatments., Nizan Geslevich Packin

The Scholar: St. Mary's Law Review on Race and Social Justice

Recent studies show that one in eight American couples suffered from infertility. Infertility treatments are riddled with accessibility barriers including high costs, marital status, and sexual orientation. Despite President Obama’s promise of universal health care, his health care reform acts missed the opportunity to squarely address this widespread problem. In fact, the recent health care reform did not include any provisions specific to fertility. Despite this glaring oversight, this article argues that regulators interpreting the acts can still provide the desired relief. The minimum coverage requirements beginning in 2014 can be interpreted to include fertility care if infertility is treated …

Dividing Stereotyping And Religion: The Legal Implications Of The Ambiguous References To Voodoo In U.S. Court Proceedings., Danielle N. Boaz

The Scholar: St. Mary's Law Review on Race and Social Justice

In human rights law, freedom of religion generally possesses three main components: the right to freedom of thought and conscience, freedom to manifest religion or beliefs, and freedom to profess, disseminate, or share religion or beliefs. The latter two are typically subject to restrictions such as public safety, health, morals, and the rights and freedoms of others. They are also the two most often litigated components. For centuries, colonizers deprived practitioners of their freedom of religion in the Americas – specifically African-based traditions, such as Voodoo. Stereotypes about Voodoo, which stem from early colonizer observance and belief that Haitians were …

In Times Of Medical Crisis: Inadequacy Of Legal Remedies Available To Sexual Minorities., A. Nicole Kwapisz

The Scholar: St. Mary's Law Review on Race and Social Justice

Society has become more tolerant and accepting of changes to the social order. Yet many people still feel the need to cover when in public. Covering is a practice of sexual minorities hiding who they really are for fear of judgment and stereotyping. The media portrayal of lesbian, gay, bisexual, and transgender (collectively LGBT) issues allows people to grow more comfortable and accepting of sexual minorities. In the climate of change and acceptance, many LGBT individuals choose to live their lives cover-free. However, refusing to downplay their stigmatized identities leads to routine denial of equal treatment. The rights of sexual …

Alignment-Free Methods And Its Applications, Ramez Mina Dec 2011

Alignment-Free Methods And Its Applications, Ramez Mina

Student Work

Comparing biological sequences remains one of the most vital activities in Bioinformatics. Comparing biological sequences would address the relatedness between species, and find similar structures that might lead to similar functions.

Sequence alignment is the default method, and has been used in the domain for over four decades. It gained a lot of trust, but limitations and even failure has been reported, especially with the new generated genomes. These new generated genomes have bigger size, and to some extent suffer errors. Such errors come mainly as a result from the sequencing machine. These sequencing errors should be considered when submitting …
