Between The Letter And Spirit Of The Law: Ethnic Chinese And Philippine Citizenship By Jus Soli, 1899-1947, Filomeno V. Aguilar Jr

Through an examination of archival materials and decisions of the Philippine Supreme Court, this article documents and analyzes the history of citizenship laws and jurisprudence in the Philippines from the close of the nineteenth century to the immediate postwar period. It demonstrates that the articulation between race and nation, mediated by citizenship, varied according to historical and geopolitical contexts, which informed citizenship debates, policies, and interpretations of legal texts. The short-lived 1899 Malolos Constitution offered an inclusive principle of jus soli, but it was superseded by the concept of Philippine citizenship enunciated in the 1902 Philippine Bill. The Federal Highway Administration (FHWA) requires state transportation agencies to submit a biennial report on local highway finances. The purpose of these reports is to provide FHWA with the data it needs to capture the financing of highway activities at the local level. Based on this information, it can identify trends in revenue, expenditures, investments, and program development, and in turn make decisions about future investments. The report, FHWA-536, asks agencies to report on four areas of local highway finance: 1) disposition of highway-user revenues; 2) revenues used for roads and streets identified by source and funding type; 3) road …

Social media have the potential to revolutionize discourse between American citizens and their governments. At present, however, the U.S. Supreme Court's public forum jurisprudence frustrates rather than fosters that potential. This article navigates the notoriously complex body of public forum doctrine to provide guidance for those who must develop or administer government-sponsored social media or adjudicate First Amendment questions concerning them. Next, the article marks out a new path for public forum doctrine that will allow it to realize the potential of Web 2.0 technologies to enhance democratic discourse between the governors and the governed. Lots of people of different races are increasingly uncomfortable talking about race. They prefer to function in a colorblind society where they insist that race is irrelevant. Not surprisingly, the concept of racial silencing is consistent with the concept of colorblindness. Logically, it seems impossible to talk about race if we are not even supposed to see it. The idea seems to be that if people who believe in racial equality magically stopped seeing and talking about race they could avoid the negativity surrounding racial issues and just hope that the inequality would fix itself. Water quality monitoring was conducted in two urban watersheds (Colonial Hills and Taylor Park) located in southeast Lincoln, NE over a three year period spanning from October 2008 through September 2011. In-line probes continuously measured for turbidity, conductivity, dissolved oxygen, and water temperature while other water quality constituents were analyzed for discrete water samples collected using grab and automatic sampling techniques. The water quality data was used to calculate event mean concentrations (EMCs) for sixteen storm events sampled over the duration of the project period. The purpose of this research project was to assess the water quality of an urban stream for total maximum daily load assessment in Omaha, Nebraska. This was accomplished by sampling the water quality at four different sites. These sites included sampling upstream, within, and downstream of the city. These samples were conducted throughout 2010 and 2011.
The results showed that concentrations of Escherichia coli (E. coli) are routinely above established criteria for the state of Nebraska. Concentrations of E. coli that exist in the Papillion Creek Watershed upstream of the City of Omaha have also been shown to be above …

Sexual assault is a common problem faced by women. Research has suggested 1 in 4 women will experience a sexual assault at some point during their life (Casey & Nuris, 2006; Tjaden & Thoennes, 1998; Fisher, Cullen & Turner, 2000). College females are one of the highest risk groups for experiencing a sexual assault. Currently, self defense courses are offered on college campuses. Self defense courses have proven to reduce depression and anxiety as well as increase a participant’s self esteem (Brecklin & Ullman, 2005). Communication encores have been identified by The Joint Commission on Accreditation of Healthcare Organization (JCAHO) as the leading cause of wrong site operations and other sentinel events (Makary et al., 2006; Neily et al., 2009). Additionally, poor teamwork in the OR results in higher morbidity and mortality (Mazzocco et al., 2009). Millions of children undergo seemingly safe general anesthesia and sedation to facilitate procedures located in surgery, imaging suites, radiology suites, emergency departments, and intensive care units. With appropriate doses and administration, anesthetics are thought to be fully reversible and free from lasting harm. However, those assumptions are being challenged with recent research documenting anesthesia-induced neurotoxicity with subsequent neurological sequelae. A comprehensive literature review will be performed using medical databases including CINAI-IL, Google Scholar, Medline, and PubMed. This paper is a study of current perceptions of perioperative nurses view of competency in the operating room. Perioperative education, competency standards, and competency assessment have been used to guide clinical and professional nursing behaviors. The need for a standardized education program and competency assessment tool has been identified, but inconsistencies and disagreement about the components that should be included for these areas still remains. A review of current literature was conducted to include topics involving perioperative education, competency assessment, and nursing perceptions regarding competency. Although community gardening on college campuses is not a new concept, campus community gardens have recently grown in popularity. Campus community gardens, however, have not been extensively researched. In order to better understand campus community gardens and to determine the feasibility of a campus community garden at the University of Arkansas in Fayetteville (UAF), this study was conducted in three components. An online survey of 88 campus community gardens in the United States and Canada served as the first national survey of universities and colleges with campus community gardens. This qualitative action research study examined the effects of introducing diverse contemporary artworks into a non-diverse educational setting. For 3 months, 18 female high school students explored a range of artists, art styles, and artworks, in aid to discovering their own diverse qualities as well as the diversity of their classmates. Through participatory action research, I investigated how diverse contemporary artwork impacted student actions, discussions, and artworks. With the assistance of the transformative learning theory, I expected to convert students with non-accepting diversity views into unbiased young women. Though much research has been conducted concerning the horizontal and vertical attributes of individualism and, not much has been done comparing and contrasting an Eastern culture, collectivism to a specific aspect of American culture, individualism, such as Korean American. The 32-item INDCOL scale was used to measure the 4 attributes (Singelis et al., 1995). Contrary to the proposed hypothesis, this study found high scores in horizontal individualism in Korean American participants and high scores in horizontal individualism and horizontal collectivism in Korean participants. These results could indicate a shift towards a different attribute in the Korean and Korean American community.

Chronic infections have been a major topic of investigation in recent years, but the mechanisms that dictate whether or not a pathogen is successfully controlled are incompletely understood. Cytomegalovirus (CMV) is a herpesvirus that establishes a persistent infection in the majority of people in the world. Like other herpesviruses, CMV is well controlled by an effective immune response and induces little, if any, pathology in healthy individuals. However, controlling CMV requires continuous immune surveillance, and thus, CMV is a significant cause of morbidity and death in immune-compromised individuals. T cells in particular play an important role in controlling CMV and …

The silo effect creates boundaries and separation within parts of a larger organized entity. In order to overcome the silo effect, the entity must seek holistic ways to unite the parts. This paper addresses the need for a collective that serves students from all three concentrations in Cal Poly’s journalism department: news editorial, public relations, and broadcast. The collective, Poly Press Association, will feature student work, and provide comprehensive tutorials, internship opportunities/ratings, and student blogs. The Poly Press Association aims to help eliminate any boundaries between the three concentrations.

Blindsight: How We See Disabilities In Tort Litigation, Anne Bloom, Paul Steven Miller

Tort litigation operates with a distorted perspective of disability. It suffers from blindsight; it does not see people with disabilities the way they see themselves. Disability advocates emphasize that most people with disabilities lead happy lives. Deeply rooted biases, however, make it difficult for this perspective to be recognized. Tort litigation’s heavy emphasis on medical testimony and its repeated portrayal of plaintiffs as “less than whole” over-emphasize the physical aspects of disability and unfairly depict people with disabilities as tragic. When legal actors embrace these views, they reinforce harmful stereotypes outside the courthouse doors. Newly disabled plaintiffs are also likely …

Integration Versus Apartheid In Post-Roman Britain: A Response To Thomas Et Al. (2008), John E. Pattison

The genetic surveys of the population of Britain conducted by Weale et al. and Capelli et al. produced estimates of the Germani immigration into Britain during the early Anglo-Saxon period, c.430-c.730. These estimates are considerably higher than the estimates of archaeologists. A possible explanation suggested that an apartheid-like social system existed in the early Anglo-Saxon kingdoms resulting in the Germani breeding more quickly than the Britons. Thomas et al. attempted to model this suggestion and showed that it was a possible explanation if all Anglo-Saxon kingdoms had such a system for up to 400 yrs. I noted that their explanation …

Sexuality education comprises the lifelong intentional processes by which people learn about themselves and others as sexual, gendered beings from biological, psychological, and sociocultural perspectives. It takes place through a potentially wide range of programs and activities in schools, community settings, religious centers, as well as informally within families, among peers, and through electronic and other media. Sexuality education for adolescents occurs in the context of the biological, cognitive, and social-emotional developmental progressions and issues of adolescence. Formal sexuality education falls into two main categories: behavior change approaches, which are represented by abstinence-only and abstinence-plus models, and healthy sexual development …
