A Poet's Request : Text And Subtext In Horace's Odes 1.1, Virginia C. Cook

Theses, Dissertations and Capstones

As the first poem within Horace's original publication of Odes, Odes 1.1 embodies aspects of theme and style representative of the poet's approach to the genre of lyric poetry. The Odes of Horace allow various interpretations by the reader based on construction, vocabulary and imagery. This thesis explores Odes 1.1 in its entirety through such approaches and focuses on the text and subtext incorporated by the poet. The first chapter sets the foundation needed in order to begin a study of Horace's lyric poetry, detailing the genre as a whole, the life of the poet, as well as the contradiction …

Law, Strategy, And Competitive Advantage, Robert C. Bird

Connecticut Law Review

Firms aggressively seek a competitive advantage over rivals. A voluminous body of strategy scholarship has identified numerous sources of competitive advantage. Yet, the notion that law may be a source of competitive advantage remains largely unexplored. This is surprising given the significant time and resources managers dedicate to legal issues. This Article examines whether legal resources can generate a sustainable competitive advantage for firms. This Article also identifies firm attributes and managerial attitudes that might encourage legally strategic thinking. This Article concludes that law can be a source of a sustainable competitive advantage and that numerous variables exist worthy offuture …

False Perceptions On Limitation: Why Imposing A Nexus Requirement Under The Maritime Drug Law Enforcement Act Would Not Significantly Discourse Efforts To Prosecute Maritime Drug Trafficking Commentary: Critical Race Theory: A Commemoration: Note, John O'Neil Sheehy

Connecticut Law Review

The Maritime Drug Law Enforcement Act ("MDLEA') is the principal statute through which the United States prosecutes smugglers of narcotics on ocean-going vessels in international and territorial waters and remains one of the most important weapons in America's arsenal in the ongoing war on drugs. Most of the Federal Circuits require only that the MDLEA statutory jurisdictional requirements be met in order for suspected smugglers to stand trial in the United States. The Ninth Circuit, however, has required an additional provision that Fifth Amendment constitutional due process concerns be met by demonstrating a "nexus" of activity linking the smugglers and …

Looking For A Few Good Philosopher Kings: Political Gerrymandering As A Question Of Institutional Competence Is Our Constitutional Order Broken - Structural And Doctrinal Questions In Constitutional Law: Gerrymandering, Congressional Representation, And Trust In The Political System: Essay, Luis Fuentes-Rohwer Jan 2011

Looking For A Few Good Philosopher Kings: Political Gerrymandering As A Question Of Institutional Competence Is Our Constitutional Order Broken - Structural And Doctrinal Questions In Constitutional Law: Gerrymandering, Congressional Representation, And Trust In The Political System: Essay, Luis Fuentes-Rohwer

Connecticut Law Review

The redistricting season is about to begin in full swing, and with it will come renewed calls for the federal courts, particularly the U.S. Supreme Court, to aggressively review the work of the political branches. This is an intriguing puzzle. Since the early 1960s, the federal courts have regulated questions of politics aggressively. They have done this even in the face of difficult questions of political representation. The courts have taken sides, to be sure, but these can only be described as acts of volition and will, not constitutional law. The leading case was Reynolds v. Sims. This was when …

The Value Of Intersectional Comparative Analysis To The Post-Racial Future Of Critical Race Theory: A Brazil-U.S. Comparative Case Study Commentary: Critical Race Theory: A Commemoration: Response, Tanya Kateri Hernandez Jan 2011

The Value Of Intersectional Comparative Analysis To The Post-Racial Future Of Critical Race Theory: A Brazil-U.S. Comparative Case Study Commentary: Critical Race Theory: A Commemoration: Response, Tanya Kateri Hernandez

Connecticut Law Review

This Commentary Article aims to illustrate the value of comparative law to the jurisprudence of Critical Race Theory (CRT), particularly with reference to the CRT project of deconstructing the mystique of "postracialism. " The central thesis of the Article is that the dangerous seductions of a U.S. ideology of "post-racialism" are more clearly identified when subject to the comparative law lens. In particular, a comparison to the Brazilian racial democracy version of "post-racialism" is an instructive platform from which to assess the advisability of promoting post-racial analyses of U.S. racial inequality. In Part I the Article introduces the value of …

Disappearing Parents: Immigration Enforcement And The Child Welfare System, Nina Rabin Jan 2011

Disappearing Parents: Immigration Enforcement And The Child Welfare System, Nina Rabin

Connecticut Law Review

This Article presents original empirical research that documents systemic failures of the federal immigration enforcement and state child welfare systems when immigrant parents in detention and deportation proceedings have children in state custody. The intertwined but uncoordinated workings of the federal and state systems result in severe family disruptions and raise concerns regarding parental rights of constitutional magnitude. This Article documents this phenomenon in two ways. First, it presents an "anatomy of a deportation, "providing a case study of an actual parent whose detention and eventual deportation has separated her from her four young children for over two years and …

History, Identity, And Alienation Commentary: Critical Race Theory: A Commemoration: Response, Gary Peller Jan 2011

History, Identity, And Alienation Commentary: Critical Race Theory: A Commemoration: Response, Gary Peller

Connecticut Law Review

This Commentary Article sets forth a grid for distinguishing between approaches to racial justice by diferentiating between liberal and critical approaches in general, and between integrationist and nationalist stances regarding race in particular. The Article then utilizes the grid to contend that Kimberld Crenshaw and others on the left wing of Critical Race Theory have accomplished a significant breakthrough in identity theory and nationalist practice by articulating a critical, historicist way to understand race. The Article then considers the criticism, lodged by some theorists claiming postmodern sophistication, that critical race theorists mistakenly attribute essentialist meaning to race. The Article concludes …

Women, Vulnerability, And Humanitarian Emergencies, Fionnuala Ni Aolain Jan 2011

Women, Vulnerability, And Humanitarian Emergencies, Fionnuala Ni Aolain

Michigan Journal of Gender & Law

The catastrophic dimensions of humanitarian emergencies are increasingly understood and more visible to states and international institutions. There is greater appreciation for the social, economic and political effects that follow in the short to long term from the devastating consequences of humanitarian emergencies. There is also recognition of the gendered dimensions of humanitarian emergencies in policy and institutional contexts. It is generally acknowledged that women are overrepresented in the refugee and internally displaced communities that typically result from many humanitarian crises. Women bear acute care responsibilities in most societies and also disproportionately bear familial and communal care responsibilities in communities …

Differentiating The Federal Circuit, Elizabeth I. Winston Jan 2011

Differentiating The Federal Circuit, Elizabeth I. Winston

Scholarly Articles

In 1982, Congress created the United States Court of Appeals for the Federal Circuit. Often referred to as an experiment, the Federal Circuit has flourished. Born again from the ashes of its predecessors, the aptly nicknamed Phoenix Court continues to grow in significance, stature, and strength. As it grows, however, the court remains rooted in its history and in its unique nature. This Article explores the Federal Circuit’s structure and its impact on the development of Federal Circuit jurisprudence. The Federal Circuit is distinguishable by more than its national jurisdiction – the very essence of the court sets it apart …

Threatening The Founding Ideal Of A Republic Of Letters: An Assessment Of The Supreme Court's Copyright Decisions Over The First Decade Of The Twenty-First Century, Susanna Frederick Fischer

Scholarly Articles

Disregard for the social value of a modern Republic of Letters like that so revered by Madison and Jefferson is a conspicuous hallmark of the Supreme Court's recent copyright case law. The four decisions in which the Court has issued full opinions since 2001 (New York Times Co. v. Tasini (2001), Eldred v. Ashcroft (2003), MGM Studios, Inc. v. Grokster, Ltd. (2005), and Reed Elsevier, Inc. v. Muchnick (2010) indicate that a majority of the Court does not share with Jefferson and Madison a belief in the civic importance of protecting widespread public access …

"You Say Nano, We Say No-No:" Getting A "Yes" Instead For Special Economic Zones In India, Sumeet Jain

Northwestern Journal of International Law & Business

Special Economic Zones (SEZs) have the potential to be valuable in-struments of economic growth and development in India. Yet, as a result of the resistance facing them, SEZs in India have not delivered economic benefits to their fullest potential. For this reason, reducing the resistance facing SEZs is critical to their success. This article seeks to reduce this resistance by devising a consensus-building plan based on a regulatory negotiation approach. The ar-ticle first shows that the past and present resistance facing India’s economic zones is a product of the lack of public input in the design of their policy. It …

The Fight For Clean Technology Funds: Who Should Control The Future Of Low-Carbon Technology In The Developing World, William Gardner Jan 2011

The Fight For Clean Technology Funds: Who Should Control The Future Of Low-Carbon Technology In The Developing World, William Gardner

Indiana Journal of Global Legal Studies

As part of a multilateral climate change treaty, the parties to the United Nations Framework Convention on Climate Change (UNFCCC) have discussed establishing an international aid mechanism, or fund, to support low-carbon energy generation and energy efficiency projects in developing countries. The selection of a fund administrator has been particularly contentious. Many developed countries believe that, rather than creating a new fund, the COP should use an already established one-the World Bank's Clean Technology Fund (CTF)-and select the World Bank as fund administrator.H owever, many developing countries believe the Conference of the Parties (COP) to the UNFCCC should create a …

Language, Geography, Globalization: Susana Chavez-Silverman’S Rejection Of Translation In Killer Crónicas: Bilingual Memories, Ania Spyra

Scholarship and Professional Work - LAS

The ephemerality of Susana Chavez-Silverman's desires for a very specific scent, remembered well although smelt only once on a stranger in passing, meets the disappointment of the un-searched for, the inauthentic, the reality of cheap cologne. Maybe precisely for its lack of fulfillment the search remains a quest, and the latter term does not seem too exaggerated for as frivolous a search as this one, because it functions as a metaphor for many other searches.

A Comparison Of The Cretaceous (Albian) Edwards Limestone Bioherms Of Central Texas With The Holocene Coral Reefs Of Bermuda, Adam J. Damman Jan 2011

A Comparison Of The Cretaceous (Albian) Edwards Limestone Bioherms Of Central Texas With The Holocene Coral Reefs Of Bermuda, Adam J. Damman

KIP Theses and Dissertations

The Edwards Limestone of Central Texas is comprised of numerous rudist-dominated patch reefs that are collectively referred to as the Central Texas Reef Trend. These bioherms were protected by the Stuart City barrier reefs along the Texas Gulf Coast. The Stuart City reefs have been compared with the modern barrier reefs of Australia and Belize, but there is currently no modern analog for the Central Texas bioherms. Bermuda was chosen for a modern analog study based on the existence of a protective rim reef system, its low biodiversity, and a slower reef growth rate as compared with other modern reefs. …

Angler Survey Of The Connecticut River, Justin P. Davis Jan 2011

Angler Survey Of The Connecticut River, Justin P. Davis

EEB Articles

The Connecticut River is the largest and most diverse inland fishery resource in the State of Connecticut. Significant improvements in water quality over the past 30 years have led to progressive increases in recreational use, presumably increasing fishing pressure on some species and possibly decreasing overall fishing quality. To address this concern, the Inland Fisheries Division (IFD) of the Connecticut Department of Energy and Environmental Protection (CT DEEP) conducted an angler survey on the entire portion of the Connecticut River within the state during March-October of 2008-09. The survey used a similar design as a smaller-scale survey of the river’s …

Gis Ordination Approach To Model Distribution Of Shrub Species In Northern Utah, Samuel Rivera, Leila Shultz, Alexander J. Hernandez, R. Doug Ramsey

Natural Resources and Environmental Issues

Anthropogenic and natural disturbances represent a serious threat to natural ecosystems dominated by big sagebrush (Artemisia tridentata). Conservation efforts aim to restore original species composition and prevent the invasion of undesirable species. In order to restore the historic plant communities, we need a clear understanding of how species compositions are distributed along environmental gradients. Species ordination is a process of placing plant species along environmental gradients. This study was conducted in Rich County, Utah, where substantial changes in species composition have been documented in recent years. Field data, literature review, multivariate analyzes, GIS and remote sensing techniques, and expert knowledge …
