Race Audits, R. A. Lenhardt Jul 2011

Race Audits, R. A. Lenhardt

UC Law Journal

The persistence of the problems that attend the American color line makes clear the need for greater experimentation and innovation in the area of race. For years now, we have looked primarily to courts for solutions. But current jurisprudence offers very little that is useful in dealing with the modern realities of durable racial inequality and segregation. As cases such as Parents Involved in Community Schools v. Seattle School District No. 1 and Ricci v. DeStefano make clear, it limits dramatically the tools available to address racial inequality, regarding as “bad cities” localities that try affirmatively to grapple with matters …

Making Sand Castles As The Tide Comes In: Legal Aspects Of Climate Justice, Elizabeth Burleson

Elisabeth Haub School of Law Faculty Publications

Achieving climate justice and the Millennium Development Goals (“MDGs”)2 are mutually reinforcing challenges. The achievement of both is well within the capacity of the international community. Indeed, reaching carbon neutrality in an affordable, environmentally sound way requires integrating the strategies of mitigation, adaptation, sustainable development, and disaster risk management.

Dynamo In The Desert: Energy Development And Environmental Contestation In The San Juan Basin, 1960-1985, S. Andrew Wakefield

History ETDs

This thesis examines coal-energy development in the San Juan Basin, which is located in the culturally rich and environmentally diverse Four Corners region. Between 1960 and 1985 intensive coal-energy development—in the form of strip mines and power plants—took place in the western portion of the San Juan Basin. This period saw the enactment of major environmental legislation and the rise of the modern environmental movement. My thesis specifically focuses on how this development unleashed environmental damage upon the regions land, water, and air. Beyond examining environmental destruction, my thesis explores how different groups came into conflict over coal-energy development. The …

Values As Part Of The Clinical Experience, Jaime Baker Roskie

Scholarly Works

This essay is based on a short talk I gave at the “Practically Grounded” conference hosted by Pace Law School’s Land Use Law Center. This piece discusses the University of Georgia (UGA) Land Use Clinic, specifically why and how I interact with my students in the classroom about values as part of the clinic experience. It attempts to tie my own teaching methods to those suggested in Best Practices for Legal Education.

An Information Technology (It) Based Approach For Enhancing Prompt And Effective Post-Disaster Reconstruction, Faisal Manzoor Arain Jul 2011

An Information Technology (It) Based Approach For Enhancing Prompt And Effective Post-Disaster Reconstruction, Faisal Manzoor Arain

Business Review

Information technology (IT) has become strongly established as a supporting tool for many professional tasks in recent years. One application of IT, namely the knowledge management system, has attracted significant attention requiring further exploration as it has the potential to enhance processes, based on the expertise of the decision-makers. A knowledge management system can undertake intelligent tasks in a specific domain that is normally performed by highly skilled people. Typically, the success of such a system relies on the ability to represent the knowledge for a particular subject. Post-disaster reconstruction and rehabilitation is a complex issue with several dimensions. Government, …

"Movie To Movement: Creating Social Change With The Documentary Film 'Food Stamped'", Shira Potash Jun 2011

"Movie To Movement: Creating Social Change With The Documentary Film 'Food Stamped'", Shira Potash

Health, Exercise, and Sports Sciences ETDs

There is substantial evidence linking obesity to lower incomes. Governmental food and farm policy directly affects the affordability, availability, and accessibility of healthy food in low-income areas. Policy also impacts the supplemental nutrition assistance program (SNAP) and nutrition education for SNAP recipients. Documentary film is a powerful medium that can be used for social change. This paper explores the ways in which documentary film can be used to decrease health disparities and improve public health. Specifically it provides the scientific evidence and theoretical framework for the creation of the documentary film, Food Stamped. Similar to other popular documentary films such …

Media Attention On African Americans With Human Immunodeficiency Virus, Charles S. Beverley Jr., Edith M. Williams, Saundra H. Glover

Faculty Publications

Human immunodeficiency virus (HIV) is a disease that has captured the attention of the media in various ways and to varying degrees. One of the ongoing debates and areas of research in HIV that provide many opportunities for discovery is the disproportionate number of African Americans infected with HIV compared to the amount of attention they receive in the media. This manuscript addresses the question that has preoccupied the minds of many people: Why have African Americans infected with HIV received so little media attention? Analysis of this question suggests that there are many reasons for this lack of media …

Agenda: Navigating The Future Of The Colorado River, University Of Colorado Boulder. Natural Resources Law Center, Western Water Policy Program

Navigating the Future of the Colorado River (Martz Summer Conference, June 8-10)

Competition for scarce Colorado River water resources is nothing new, but the conflicts that prompted the seven basin states to negotiate the 1922 Colorado River Compact have grown considerably fiercer and more complex in recent decades. In 2007, responding to the challenges of increasing demand and sustained drought, the seven basin states and a number of other affected interests agreed to a set of interim guidelines for allocating Colorado River water in the event of shortages. This agreement represents an important evolution in the governance of the Colorado River, suggesting that the many interests in the basin can work together …

Fair Trade And Development: A Changing Paradigm, Daniel Jaffee Jun 2011

Fair Trade And Development: A Changing Paradigm, Daniel Jaffee

Sociology Faculty Publications and Presentations

Book chapter.

By the time the fair trade movement celebrated the 20th anniversary of its founding in 2008, it had been transformed virtually beyond recognition. From a marginal European movement characterized by small ethical companies, non-profit charities, solidarity groups and alternative trading organizations (ATOs) selling coffee and handicrafts to a small group of politicized consumers through alternative world shops, fair trade has become an international market system with annual sales of nearly US $5,000m. (€3,500m.) (FLO 2010), reaching mass audiences of mainstream shoppers across the global North with a wide range of food and non-food products originating from both small …

The Problem Of Enforcing Nature's Rights Under Ecuador's Constitution: Why The 2008 Environmental Amendments Have No Bite, Mary Elizabeth Whittenmore Jun 2011

The Problem Of Enforcing Nature's Rights Under Ecuador's Constitution: Why The 2008 Environmental Amendments Have No Bite, Mary Elizabeth Whittenmore

Washington International Law Journal

In 2008, Ecuador became the first nation to give rights to nature when it ratified constitutional amendments (new articles 71-74) that grant the environment the inalienable right to exist, persist, and be respected. Environmentalists hope Ecuador’s amendments will lead to improvement in a country devastated by resource exploitation, and that other countries will follow. Yet, many wonder whether the amendments will be enforced. This comment argues that—all things considered—successful execution of the amendments is unlikely. Ecuador’s President has not demonstrated a sincere intention or ability to implement the amendments. Further, plaintiffs who sue under the amendments face significant legal barriers, …

Leadership In Sustainable Chemicals Policy: Opportunities For Oregon, Jennifer H. Allen, Alexis Dinno Jun 2011

Leadership In Sustainable Chemicals Policy: Opportunities For Oregon, Jennifer H. Allen, Alexis Dinno

Institute for Sustainable Solutions Publications and Presentations

Oregon is uniquely positioned to lead in the development of safer alternatives to toxic chemicals. Existing chemicals policy in the United States does not comprehensively protect human health or the environment from the potential impacts of chemical exposure. Very few of the 84,000 chemical substances produced, processed or imported for commercial purposes in the United States have been studied for health and environmental impacts. The federal Environmental Protection Agency has access to only limited information about potential health or environmental hazards. Manufacturers have the right to withhold what they consider to be confidential business information. Because of this lack of …

Food & Shelter: Low-Income Housing Tax Credit Developments In California And Access To Grocery Stores, Darci Coleen Palmer Jun 2011

Food & Shelter: Low-Income Housing Tax Credit Developments In California And Access To Grocery Stores, Darci Coleen Palmer

Master's Theses

Since the mid-century proliferation of public housing, policy makers and environmental justice advocates have exposed the fact that geographically and economically isolated public housing sites are ultimately detrimental to residents and communities. In recent years, more progressive housing policies have emphasized the importance of site location in the success of housing programs. This study explores the intersection of affordable housing policy and “food desert” research, by assessing the Low-Income Housing Tax Credit (LIHTC) program in California, with specific attention to the grocery store category within the Site Amenities section. Since the inception of the LIHTC program in 1986, the California …

Towards Transnational Native American Literary Studies, Hsinya Huang Jun 2011

Towards Transnational Native American Literary Studies, Hsinya Huang

CLCWeb: Comparative Literature and Culture

In her article "Towards Transnational Native American Literary Studies" Hsinya Huang discusses how Native American literature can be adapted, translated, articulated, and interpreted in a transnational/trans-Pacific context, using the recently emerging Native American scholarship in Taiwan as a point of departure. Through collaboration across institutional lines, exploration of the community production of local knowledge, and our obligation and desire to participate meaningfully as intellectuals in the international initiatives in Native Studies, can we conceive of an expansive indigenous region across the Pacific? How can indigeneity be both rooted in and routed through particular places and articulated? Through envisioning an expanding …

Article 24 Of The African Charter On Human And Peoples' Rights: An Individual Or Peoples' Right To A Satisfactory Environment?, Evan Longo Jun 2011

Article 24 Of The African Charter On Human And Peoples' Rights: An Individual Or Peoples' Right To A Satisfactory Environment?, Evan Longo

Theses and Dissertations

Article 24 of the African Charter on Human and Peoples' Right has been viewed similarly to the individual right to a satisfactory environment within international law. The African Charter however differs from the broader conception of the right to a satisfactory environment by expressing the right as a peoples' and not an individual right. Unlike previous authors, I argue that the fact that article 24 of the charter characterizes the right, as a peoples' right is significant and cannot be ignored. The SERAC v. Nigeria communication in the African commission is the only time in which the right to a …

Chaos As Ecological And Autochthonous Expression: An Ecocritical Study Of La Vorágine, Danion L. Doman Jun 2011

Chaos As Ecological And Autochthonous Expression: An Ecocritical Study Of La Vorágine, Danion L. Doman

The Coastal Review

This article utilizes principles of ecological criticism to provide new readings of both the role and presentation of nature in José Eustasio Rivera’s novel La vorágine. Whereas critics have heretofore focused on Rivera’s memorable subjective descriptions of the Amazon jungle, the present study foregrounds the rich diversity of the real organisms represented in these depictions. In addition, this essay explores the connections between the text’s core trope, chaos, and the current ecological and social scientific understanding of the ecology and the human history of the Amazon Basin.

The Hearts And Minds Of The Citizens, Brooke Ackerly Jun 2011

The Hearts And Minds Of The Citizens, Brooke Ackerly

Human Rights & Human Welfare

If the US contributes increased military support to Guatemala under the premise of curtailing the drug trade, it could inadvertently further destabilize this already politically unstable country. It certainly will not contribute to developing a sense of political alliance in the hearts and minds of its citizens. Concerns about destabilization in Guatemala (and Central America more generally) and the role of this destabilization in facilitating the drug trade have led the Economist to suggest that the solution is to increase military foreign aid to Guatemala.
