Nothing But A Pack Of Cards: Semi-Fictitious Persons And Flopping Jellyfish In Elizabeth Bowen, Renée C. Hoogland Jan 2011

Nothing But A Pack Of Cards: Semi-Fictitious Persons And Flopping Jellyfish In Elizabeth Bowen, Renée C. Hoogland

English Faculty Research Publications

Taking the wildly conflicting critical evaluations of Elizabeth Bowen's final novel, Eva Trout, or Changing Scenes (1969) as its starting-point, this essay argues against 'interpreting' both the novel and its 'monstrous' heroine in conventional representational terms, to argue, instead, for an appreciation, or experience, of both novel and protagonist as instantiations of a process of becoming along Deleuzian lines. Rather than seeing Bowen's final novel as a (failed) attempt to do what the Anglo-Irish writer's previous work would have suggested this text to do as well, the novel and its eponymous heroine are approached as Bowen's rigorously ethical effort to, …

Neuropsychological Instruction: A Process Related Approach In Early Reading Skill Development, Karen Boyle Donahue Jan 2011

Neuropsychological Instruction: A Process Related Approach In Early Reading Skill Development, Karen Boyle Donahue

PCOM Psychology Dissertations

Proficient and fluent reading ability for all Americans continues to be a highly prioritized, yet under achieved aspiration in current educational institutions. The acquisition of proficient reading fluency and comprehension are, undoubtedly, the most essential priorities in the academic development of school aged children, yet a discouraging number of students continue to struggle with the reading process throughout school aged years. Research has targeted key instructional areas that must be implemented in successful reading curriculum in the early childhood years. Namely, phonological awareness, phonics instruction, reading fluency, vocabulary development, and reading comprehension are core components that must be incorporated into …

Origins Of The Social Function Of Property In Chile, M C. Mirow Jan 2011

Origins Of The Social Function Of Property In Chile, M C. Mirow

Faculty Publications

In 1925, Chile was one of the first countries in Latin America to adopt a social-function limitation on property. This study traces the importance of Duguit’s work in the construction of the property provisions of the Chilean Constitution of 1925. This contribution notes the shift from the earlier expressions of property as an absolute right, as found in the Constitution of 1833, to the language of the Constitution of 1925 that submits property to “the maintenance and progress of the social order.” It tracks the debates in the drafting committees to expose the various concepts of property open to the …

Exporting Subjects: Globalizing Family Law Progress Through International Human Rights, Cyra Akila Choudhury Jan 2011

Exporting Subjects: Globalizing Family Law Progress Through International Human Rights, Cyra Akila Choudhury

Faculty Publications

This article examines the global export of domestic U.S. legal projects and strategies in the realm of family law and gender justice to South Asia. While such projects have undoubtedly achieved substantial gains for women in the U.S., there have also been costs. At a remove of two decades, scholars have now begun to theorize those costs and argue that feminism needs to reconsider its commitments to particular projects that have been held central to women’s emancipation. Yet much of these critiques have not reached the transnational women’s movements that are led by U.S. feminist activists and scholars. Relying on …

Judging Aggression, Noah Weisbord Jan 2011

Judging Aggression, Noah Weisbord

Faculty Publications

One of the most polarizing debates in international law is how the goal of peace should figure into the work of international criminal tribunals. The freshly minted crime of aggression lands the judges of the International Criminal Court in the middle of the peace versus justice dilemma and will challenge the court to prove its value for advancing peace in appropriate circumstances while building the rule of law and maintaining its legitimacy.

This article, the final installment in the author's trilogy on the crime of aggression, explores the gaps, ambiguities and contradictions woven into the definition of the crime and …

International Decision, International Criminal Court, Decision On The Authorization Of An Investigation Into The Situation In The Republic Of Kenya, Charles Chernor Jalloh Jan 2011

International Decision, International Criminal Court, Decision On The Authorization Of An Investigation Into The Situation In The Republic Of Kenya, Charles Chernor Jalloh

Faculty Publications

On March 31, 2010, in its first ever decision authorizing a prosecutorial proprio motu investigation, the Pre-Trial Chamber of the International Criminal Court (ICC) granted the ICC Prosecutor permission to investigate the shocking violence which followed Kenya’s December 2007 Presidential elections under Article 15 of the Rome Statute of the International Criminal Court. The majority of the Chamber ruled that both the contextual and underlying requirements of crimes against humanity had been fulfilled, including that they were committed as part of a state or organizational policy as required by Article7(2)(a) of the Rome Statute. According to the majority, the latter …

The United States And The International Criminal Court Post-Bush: A Beautiful Courtship But An Unlikely Marriage, Megan A. Fairlie Jan 2011

The United States And The International Criminal Court Post-Bush: A Beautiful Courtship But An Unlikely Marriage, Megan A. Fairlie

Faculty Publications

The article focuses on the relationship status between the U.S. and the International Criminal Court (ICC) from being dormant due to being renewed. The renewal was evident from the U.S. representation at the 2009 ICC's Assembly of States Parties annual meeting and the 2010 ICC Review Conference. Using the Rome Statute, the ICC has been granted subject matter jurisdiction over war crimes, crimes against humanity and genocide.

Religion And The Purification Of Reason: Why The Liberal State Requires More Than Simple Tolerance, John M. Breen Jan 2011

Religion And The Purification Of Reason: Why The Liberal State Requires More Than Simple Tolerance, John M. Breen

Campbell Law Review

What could Pope Benedict possibly mean by the astounding claim that reason in public discourse must be "purified" by religion? What does he mean in saying that religion has a "corrective" role to play in the political process? In the essay that follows, first, I explore the meaning of this provocative passage as elucidated in the other documents of Benedict's papacy, in the work of Joseph Ratzinger prior to his election as pope, and in the larger body of papal encyclicals, conciliar documents and episcopal statements collectively known as "Catholic social teaching." Second, I will show how much of what …

Is Constitutionalism Liberal?, Bruce P. Frohnen Jan 2011

Is Constitutionalism Liberal?, Bruce P. Frohnen

Campbell Law Review

Let me begin with the obvious: I am not claiming that any scholar, or educated person, believes that the only constitutions that have ever existed have been liberal. Everyone knows or should know that, for example, the Greek constitutions of Solon, Lycurgus, and others discussed in Aristotle's Politics predate liberalism by many centuries.' Moreover, constitutions come in a wide variety of forms, and many of these, whether written or unwritten, have explicitly been illiberal. What I maintain is that there is a prejudice among lawyers in particular that constitutions must be liberal in order to be worthy of the name. …

"Causing The Blood To Flow Where I Touched Him" - Liberalism, Constitutionalism, Christianity, And The "War" At Covey Farm, Anthony V. Baker Jan 2011

"Causing The Blood To Flow Where I Touched Him" - Liberalism, Constitutionalism, Christianity, And The "War" At Covey Farm, Anthony V. Baker

Campbell Law Review

I will begin my critique by going directly to the source here, the famous Philadelphia Constitutional Convention of 1787, and ask us to look somewhat carefully at the work of the "founders" there, in considering the ultimate integrity of the product they fashioned and the world they "created." That they gave us a classical liberal wonder, with tenets of that philosophy writ large in government for the very first time, is undeniable, though it will be submitted that they gave us "something else" as well. It is right for us then to explore that "something else," not abstractly, through ideas, …

Initial Design, Manufacture, And Testing Of A Cubelab Module Frame For Biological Payloads Aboard The International Space Station, Twyman Samuel Clements Jan 2011

Initial Design, Manufacture, And Testing Of A Cubelab Module Frame For Biological Payloads Aboard The International Space Station, Twyman Samuel Clements

University of Kentucky Master's Theses

This thesis investigates the design of a CubeLab Module frame to facilitate biological research aboard the International Space Station (ISS). With the National Laboratory designation of the ISS by the United States Congress the barriers for use of the facility have been lowered for commercial and academic entities, allowing greater volume and diversity in the research that can be done. Researchers in biology and other areas could benefit from development and adoption of a plug-and-play payload containment system for use in the microgravity/space environment of the ISS. This research includes design and analysis of such a system. It also includes …
