Mcdonald V. Chicago, Self-Defense, The Right To Bear Arms, And The Future, Richard Aynes Jan 2011

Mcdonald V. Chicago, Self-Defense, The Right To Bear Arms, And The Future, Richard Aynes

Akron Law Faculty Publications

This article examines the opinion of the Court in McDonald v. Chicago and its implications for the future. The author participated as a party-amicus in the case and an article he authored in 1993 was cited by the Court.

Using a concept that others have applied in other situations, this paper suggests that Chicago was a “outlier” and that this case simply involved reigning in a maverick outlier. While the paper finds Justice Thomas’s concurring opinion (with the exception of dicta on the establishment clause) being the most faithful to the meaning, intention, and public understanding of the 14th Amendment, …

Constantly Approximating Popular Sovereignty: Seven Fundamental Principles Of Constitutional Law, Wilson Huhn Jan 2011

Constantly Approximating Popular Sovereignty: Seven Fundamental Principles Of Constitutional Law, Wilson Huhn

Akron Law Faculty Publications

The concept of “popular sovereignty” is not a simple, singular, unified concept; instead, as it has developed in the United States, popular sovereignty embraces the following seven fundamental principles:

1. The Rule of Law. The people are sovereign and their will is expressed through law.

2. Limited Government. The people are sovereign, not the government. By adopting the Constitution the people created the government, imposed limits upon its power, and divided that power among different levels and branches.

3. Inalienable Rights. Every individual person is sovereign in the sense that he or she retains certain inalienable rights, which the government …

The Impact Of The Nisl Executive Development Program On School Performance In Massachusetts: Cohort 2 Results, John A. Nunnery, Steven M. Ross, Shanan Chappell, Shana Pribesh, Elizabeth Hoag-Carhart

STEMPS Faculty Publications

School leaders are increasingly being asked, whether by rhetoric or policy, to measurably improve student achievement. The resultant need to assist school leaders in their ability to improve teaching and learning for all students in their schools led to the establishment of the National Institute of School Leadership's (NISL's) Executive Development Program. The NISL program emphasizes the role of principals as strategic thinkers, instructional leaders, and creators of a just, fair, and caring culture in which all students meet high standards. The current national focus on the importance of effective, instructional leadership has, in turn, led to calls for principal …

Overlapping Mornings, Joshua Andrew Cembellin Jan 2011

Overlapping Mornings, Joshua Andrew Cembellin

Master's Theses

This thesis project, Overlapping Mornings, is a book-length collection of poetry based upon my family. Throughout the collection I examine the lives of various family members, particularly my father, grandfather, and great-grandfather. In exploring the lives of my progenitors through poetry's lens, I strive to discover my own role as a direct member of this male lineage.

Comprised of four parts, the collection generally follows a chronological order that begins with poems about my childhood and ends with poems of the present. Part Two is a prose section that includes important biographical information about my great-grandfather, Edwin Schivo. This …

Mythology Of Love, Samantha Le Jan 2011

Mythology Of Love, Samantha Le

Master's Theses

This collection of love poems is divided into three parts. Section 1 is a collage, taking the reader through the moments of childhood infatuation, adult obsession, and weathered devotion. Thematically, the poems in this section, mostly confessional and persona in the form of dramatic monologues, follow a temporal and social structure. Grounded in memory, they capture a nostalgia for moments that are gone and the desire to revisit them. These poems, taking place both in the past and present, are about other people: "the others."

Section 2 is a conversation about romantic love. Confessional and narrative in nature, these poems …

According to Quynh, the owner of the salon, the polish has the magical power to give women what they need but not what they want. Once the six women have encountered the …

Academic Writing Development Through Dialogues Between Tutors And Second-Language Learners, Fabio De Oliveira Coelho

Master's Theses

This thesis presents an analysis of dialogues between writing tutors and second-language learners in a writing center setting. The analysis includes a discussion about session appropriation by tutors, the validity of addressing sentence-level mistakes during writing conferences, and strategies that tutors may use to make the sessions beneficial to second-language learners. Among the literature covered throughout the study are studies on Educational Psychology, L1 and L2 Composition, and Cognitive Linguistics (Situated Learning). Collected data include measurements of dialogical patterns in the sessions and qualitative data extracted from session recordings and interviews with interlocutors. Study results suggest that a) sentence-level correction …

Rock The Field, Laura Long Jan 2011

Rock The Field, Laura Long

Master's Theses

The title of this screenplay, Rock the Field, is a color guard slang term for performing with power. This script is a narrative feature length film that looks at marching band competition from the point of view of a 16-year-old high school color guard girl, Chloe Johnson. Underneath the dynamics of the intensity of the competition, this is actually a story about Chloe and her mother Sarah rediscovering their strength to carry on in life while mourning the sudden loss of Chloe's father to cancer. The script is structured with Joseph Campbell's Hero's Journey, except in this case the heroes …

The New Playgoer's Club: The Emergent Theater Weblog Culture And The Practice Of Theater Criticism, Elizabeth Hunter Spreen Jan 2011

The New Playgoer's Club: The Emergent Theater Weblog Culture And The Practice Of Theater Criticism, Elizabeth Hunter Spreen

Master's Theses

New York City has one of the most active and engaged theater blogging communities in the country. It is common practice for theater bloggers to supplement and comment on the journalistic and critical practices of the New York Times, Time Out, New York, and The Village Voice, but the idea of a theater blogosphere is still a relatively new phenomenon. The emerging role of blogger-critics and their critical practice is largely uncharted and far from understood. While sharing some of the same tasks as the journalist-critic, blogger-critics are still defining and identifying the scope of their practice and, in some …

An American Word For War, David Wirth Jan 2011

An American Word For War, David Wirth

Master's Theses

Jesse is in his early twenties and stuck in Salinas, California. He works at Lenscrafters, making glasses, making decent money and he is comfortable. The novel opens when Jesse’s high school friend, Ben, is visiting from Los Angeles, where he is a screenwriter. The two go to a party for another old acquaintance, Ian, who has just returned from a tour in Iraq. Their encounter with Ian sets the rest of the novel in motion. They are exposed to something big in the world (the machinery of a war that up to that point had been nothing more than words …

Visual Articulation Of Modernism: Self-Portraiture In Colonial Korea, 1915-1932, Julie Chun Jan 2011

Visual Articulation Of Modernism: Self-Portraiture In Colonial Korea, 1915-1932, Julie Chun

Master's Theses

From about 1914, Korean artists began painting on canvas using the Western medium of oil. This seemingly benign shift from ink on paper and silk to oil on canvas was pivotal in engendering Korean painting into the assured phase of artistic modernism. Prescribed conventions that had governed ink painting for over nine hundred years came to be supplanted within a few short years by a divergent artistic paradigm that centralized subjective identity and visually described the ambiguities of contemporary conditions.

The training and production of these early works of art took place not in Korea but in Japan where most …

A Survey Of Female Characters As Flâneuses And Their Interactions With Modernity In Early Modern British Literature, Thao Thi Nguyen Jan 2011

A Survey Of Female Characters As Flâneuses And Their Interactions With Modernity In Early Modern British Literature, Thao Thi Nguyen

Master's Theses

This thesis argues that the flâneuse is present in literature well before the late nineteenth century. Similar to Charles Baudelaire's flâneur figure, the flâneuse herself is an observer of modernity. Through her interactions with the crowd, the flâneuse is able to read the urban landscape. Chapter One focuses on defining the historical context of when the term flâneur appears in critical discourse. Chapter Two introduces the first example of a flâneuse: the narrator of Isabella Whitney's poem "Will and Testament." It focuses on how the narrator offers a reading of London in flux, its attractions as well as its growing …

The Body Dysmorphic, Nicholas Grant Goodwin Jan 2011

The Body Dysmorphic, Nicholas Grant Goodwin

Master's Theses

The Body Dysmorphic is a book of poetry situated around the absurdity of the human body in a world of fast advancing technologies, or around the body as a machine, a pump primed for sexual exertion in a cycle of life and death that is shit across the following pages while the poet grimaces and writhes in an overwhelming fit of laughter-induced vomiting. The whole gimmick is really to inspire a revolution.

In the vain effort to become another scab on the aging dermis of poetics, the poet here reconstructs life from the dismembered parts of ideologies, memories, and language …

Egypt’S National Strategy For Adaptation To Climate Change And Disaster Risk Reduction, Egypt’S Cabinet Information And Decision Support Centre

The main objective of Egypt’s National Strategy for Adaptation to Climate Change and Disaster Risk Reduction is to increase the flexibility of the Egyptian community when dealing with the risks and disasters that might be caused by climate change and its impact on different sectors and activities. It also aims at strengthening the capacity to absorb and reduce the risks and disasters to be caused by such changes. In essence, the strategy adopts accommodation and protection as the two basic means of defence, taking into consideration systematic retreat based upon predefined plans, in case the coastal zones are exposed to …

Strategic Competition Over School Inputs And Outputs, Gary Richard Cohen Jan 2011

Strategic Competition Over School Inputs And Outputs, Gary Richard Cohen

Honors Papers

Although public schools are not generally subject to direct competition for students, it is commonly thought that they nonetheless face competition through parents' residential choice. Such competitive effects are likely to depend on the relative proximity of school districts if it is less costly to move short distances than long, or if parents are able to more easily send their children to nearby districts through open enrollment policies. Using panel data for 607 Ohio school districts from 1998 to 2007, I test for strategic interaction over teacher salaries and standardized test scores. I present evidence that Ohio public school districts …

“Because We Were Japanese Soldiers": The Failure Of Japanese Tactics At Changkufeng And Nomonhan And Lessons Left Unlearned, Ryan Schultz Jan 2011

“Because We Were Japanese Soldiers": The Failure Of Japanese Tactics At Changkufeng And Nomonhan And Lessons Left Unlearned, Ryan Schultz

Honors Papers

In their conflicts with the Soviet Union in 1938-1939, Imperial Japanese Army forces suffered a series of dramatic defeats at the hands of the Red Army, the descendant of an enemy they had been preparing to face since the conclusion of the Russo-Japanese War. At the root of these military failures was the dramatic tactical insufficiency of Japanese army doctrine, which had not evolved to meet the combined arms threat of a modern opponent. Instead, relying on 'spiritual superiority' over firepower, they were forced to attack Soviet tanks with firebombs and operate continuously under the heavy fire of enemy artillery. …

Virtual Dance And Motion-Capture, Marc Boucher Jan 2011

Virtual Dance And Motion-Capture, Marc Boucher

Contemporary Aesthetics (Journal Archive)

A general view of various ways in which virtual dance can be understood is presented in the first part of this article. It then appraises the uses of the term “virtual” in previous studies of digital dance. A more in-depth view of virtual dance as it relates to motion-capture is offered, and key issues are discussed regarding computer animation, digital imaging, motion signature, virtual reality and interactivity. The paper proposes that some forms of virtual dance be defined in relation to both digital technologies and contemporary theories of virtuality.

The Role Of Westerners In The Conservation Of Legong Dance, Stephen Davies Jan 2011

The Role Of Westerners In The Conservation Of Legong Dance, Stephen Davies

Contemporary Aesthetics (Journal Archive)

The image of legong-sumtuosly costumed girl dancers crowned with frangiapanis-is the face of Balinese culture. Yet it is only one of twenty dance/drama genres and prominent in only some centers. Legong, a secular court dance, has often been (and still is) in danger of extinction. Balinese are now less interested in legong than ever before and musicians prefer to play other kinds of music.

Since the 1930s, legong has been presented at tourist centers and by ensembles touring overseas. Western expatriates have founded legong groups and generally brokered the relation between Balines and foreigners. Foreign scholars have studied, recorded, and …

Reframing "Professionalism:" An Integral View Of Lawyering's Lofty Ideals, Brooks A. Suttle Jan 2011

Reframing "Professionalism:" An Integral View Of Lawyering's Lofty Ideals, Brooks A. Suttle

Emory Law Journal

Whereas legal ethics define what every lawyer must do, legal professionalism takes on the more difficult task of defining the core values that the very best lawyers should aspire to in their practice. The legal profession is granted a certain amount of autonomy and independence by American society, and the continuing legitimacy of this social contract depends on the notion that the profession will take care to regulate itself and maintain standards of conduct commensurate with its essential function.
