An Empirical Analysis Of Empirical Legal Scholarship Production, 1990-2009, Michael R. Heise
An Empirical Analysis Of Empirical Legal Scholarship Production, 1990-2009, Michael R. Heise
Cornell Law Faculty Publications
Inspired by the retirement of Professor Tom Ulen of the University of Illinois, the author considers the growth and development of empirical legal scholarship over two decades—a period of time that corresponds, not coincidentally, with Professor Ulen’s career. Starting in the 1990s when empirical scholarship had not yet “caught on,” the author first documents the increase in quantity of empirical scholarship over two decades. Next, the author applies a law and economics perspective to the recent surge in empirical scholarship, explaining that the trend has been fueled by an increase in the number of empirically trained scholars and also by …
Religious And Customary Laws In Nigeria, Abdulmumini A. Oba
Religious And Customary Laws In Nigeria, Abdulmumini A. Oba
Emory International Law Review
This Essay discusses the 'religious law' and 'customary law' paradigms in the context of the Nigerian legal system. It also examines the pluralistic nature of Nigeria in terms of ethnicity, religion, and law, and argues that the religious law paradigm is problematic for the discussion of laws at the global level generally and within the Nigerian legal system in particular. Then this Essay identifies customary law, Islamic law, and English law (common law) as the three legal traditions in Nigeria, and then proceeds to discuss their status and scope, the conflicts between them, and the particular challenges facing the Islamic …
The New Icc Rule On Consolidation: Progress Or Change?, Lara M. Pair, Paul Frankenstein
The New Icc Rule On Consolidation: Progress Or Change?, Lara M. Pair, Paul Frankenstein
Emory International Law Review
In September 2011, the International Chamber of Commerce ('ICC') published the tenth revision of its Arbitration Rules. A task force of more than 175 members from forty-one countries revised the ICC Rules, starting in October 2008. These new rules will enter into effect on January 1, 2012, replacing the current ICC Rules that entered into force on January 1, 1998. Numerous changes were made, ranging from the trivial to the significant. This Article analyzes the expansion of the provision on consolidation in an attempt to predict whether there will be material improvement in the consolidation process or whether the changes …
Protecting The Human Rights Of Lgbt People In Uganda In The Wake Of Uganda's "Anti Homosexuality Bill, 2009", Daniel Englander
Protecting The Human Rights Of Lgbt People In Uganda In The Wake Of Uganda's "Anti Homosexuality Bill, 2009", Daniel Englander
Emory International Law Review
A bill pending before the Ugandan Parliament from October 2009 to May 2011 sought to punish anyone who engages in 'homosexuality' with life imprisonment and prescribed the death penalty for a variety of activities deemed 'aggravated homosexuality.' Many commentators saw the 'Anti Homosexuality Bill, 2009' ('Bill' or 'Anti-homosexuality Bill') as the most pernicious legislative proposal aimed at gays and lesbians anywhere in the world and feared the death penalty provision could signal a 'looming gay genocide' in Uganda. This Comment seeks to begin the conversation on legal solutions to vindicate the rights of LGBT people in Uganda in the wake …
International Law, Religious Limitations, And Cultural Sensitivity: The Park51 Mosque At Ground Zero, Heather Greenfield
International Law, Religious Limitations, And Cultural Sensitivity: The Park51 Mosque At Ground Zero, Heather Greenfield
Emory International Law Review
In the summer of 2010, a controversy erupted after news surfaced of a planned mosque two blocks from New York City's Ground Zero. The proposed location of the mosque, now named Park51, inflamed the passions of many Americans who believed that the Muslim institution would threaten both the memories of September 11, 2001, and the respect for those killed by the terrorist attacks. The Park51 mosque quickly attracted international attention, and the question of whether the state could restrict the mosque became entangled in a web of legal and 'cultural sensitivity' arguments. This Comment advocates an international human rights framework …

Colorism In The Spanish Caribbean: Legacies Of Race And Racism In Dominican And Puerto Rican Literature, Malinda Marie Williams
Colorism In The Spanish Caribbean: Legacies Of Race And Racism In Dominican And Puerto Rican Literature, Malinda Marie Williams
Electronic Theses and Dissertations
This dissertation explores the impact of colorism on Spanish Caribbean literature--more specifically, works of fiction and memoir by both island and diaspora writers from the Dominican Republic and Puerto Rico. Colorism, or discrimination based on the shading of skin, manifests itself in Spanish Caribbean literature in a variety of ways. It is often used as a marker of class and/or class difference; it may reflect and/or play a part in shaping cultural standards of beauty or attractiveness; and it signifies the entrenched complexities of the Spanish Caribbean's history of conquest and colonization. Colorism appears in these texts as both a …
Rmb Exchange Rate Reform And Cross Listed Stock Price Disparity, Yuqian Rong
Rmb Exchange Rate Reform And Cross Listed Stock Price Disparity, Yuqian Rong
Lingnan Theses
A growing number of Chinese corporations have been listing their shares on foreign stock markets. Hong Kong Stock Exchange (HKEX) and New York Stock Exchange (NYSE) are their major targets. Taking China’s exchange rate system reform as a unique event, I examine the price disparity between A-share and H-share (or ADR) using a sample of 28 Chinese companies listed in Shenzhen, Shanghai, Hong Kong, and New York. I conduct a panel-data investigation to examine the price disparity before and after the transition from the pegged to the managed floating exchange rate.
I have obtained several important findings in this study. …
Lijuan Chen
Lijuan Chen
Lingnan Theses
Yongsui Peng
Yongsui Peng
Lingnan Theses

The Relationship Between Counselor Hope And Optimism On Client Outcome, Michelle M. Muenzenmeyer
Electronic Theses and Dissertations
The counselor is an important contributor to client outcome. Research findings about therapist effects are mixed. In this study positive psychology variables, hope and optimism, were evaluated with client outcome. The sample for this study consisted of 43 graduate-level counselor trainees in the first or second practicum semester and their adult clients in a university’s community counseling clinic. Results revealed no statistically significant relationships between student counselors’ hope and optimism and client outcomes. Post hoc analysis of student hope and their post-graduation expectations, revealed statistically significant relationships. Implications for counselor educators are presented along with areas for future research.
Genetic And Physiological Contribution Of Adrenergic Cells In Heart Development, Kingsley Osuala
Genetic And Physiological Contribution Of Adrenergic Cells In Heart Development, Kingsley Osuala
Electronic Theses and Dissertations
The adrenergic hormones norepinephrine (NE) and epinephrine (EPI) are essential for cardiovascular development as embryos lacking NE/EPI begin to die abruptly between embryonic days 10.5 and 11.5 due to apparent cardiac failure. The objective of this research aims to elucidate the mechanism of the embryonic fatality observed in the NE/EPI deficient mouse model. Here we utilized the dopamine β- hydroxylase knockout (Dbh-/-) mouse model, which lacks the gene and subsequent enzyme necessary for the conversion of dopamine to norepinephrine. Embryonic mouse hearts were extracted from Dbh+/+ (control) and Dbh-/- (experimental model) mice for mRNA transcript expression profiling. These studies were …

The method of instruction and the formal curriculum within two Kenyan teacher training colleges were studied in order to discover which messages regarding pedagogical practice are internalized within novice Kenyan primary school teachers and then actualized within their classrooms. An educational connoisseurship approach was utilized to give descriptive, interpretive, evaluative, and thematic insight. Three data streams were collected through interview, observation, and design evaluation in order to establish structural corroboration and internal validity. The study found that the method of instruction by the teacher training college faculty was teacher-centered and utilized lower order cognitive methodology. Though the formal curriculum design …
Metal Blacks As Scattering Centers To Increase The Efficiency Of Thin Film Solar Cells, Deep R. Panjwani
Metal Blacks As Scattering Centers To Increase The Efficiency Of Thin Film Solar Cells, Deep R. Panjwani
Electronic Theses and Dissertations
Metal nano particles are investigated as scattering centers on front surface of thin-film solar cells to improve efficiency. The principle is that scattering, which is enhanced near the plasmon resonance frequency of the particle and depends on particle size, increases the effective optical path length of incident light, leading to more light absorption in active layer of thin film solar cell. The particular types of particles investigated here are known as "metal-black", well known as an IR absorber for bolometric infrared detectors. Gold-black was deposited on commercial thin-film solar cells using a thermal evaporator in a nitrogen ambient at pressures …
Human Trafficking For Labor Purposes An Analysis Of Immigration Policy And Economic Forces Within The United States, Candace G. Owen
Human Trafficking For Labor Purposes An Analysis Of Immigration Policy And Economic Forces Within The United States, Candace G. Owen
Electronic Theses and Dissertations
Human trafficking is an international crisis which has emerged as a human rights issue of the highest priority for many nations. This is not a new occurrence, although the onset of globalization has provoked increased intensity in this international crime. Recent studies, including the U.S. State Department’s 2009 Trafficking in Persons Report have predicted that the recent global economic crisis will inflate these numbers to an even larger number of victims. This thesis will investigate these phenomena ultimately asking: Do immigration policies and economic conditions contribute to the recent proliferation in cases of human trafficking for labor purposes? Moreover with …

The Stigmatization Of Deathcare Workers, Shannon Rose Simone
The Stigmatization Of Deathcare Workers, Shannon Rose Simone
Electronic Theses and Dissertations
Research has indicated that Funeral Directors and Embalmers are stigmatized for their work. Studies have shown that, although the decay of dead bodies is a stigmatized process in American culture, these particular deathcare workers are able to shift the focus of their services from the dead to the living. However, there remains a lack of research regarding deathcare workers who are not employed as Funeral Directors or Embalmers— those whose positions are not as obvious to the general public. This research explores how, why, and to what degree stigma is placed on those individuals who spend the majority of their …
Student Perceptions Of Race And Gender Representations Within College Textbooks, Chastity Lynn Blankenship
Student Perceptions Of Race And Gender Representations Within College Textbooks, Chastity Lynn Blankenship
Electronic Theses and Dissertations
This study examines introductory textbooks images across a variety of disciplines, with particular focus on the ways in which race and gender are shown. This study goes beyond a basic analysis of textbooks, however, and also explores student perceptions of textbook images. My data show that compartmentalization of gender and race into certain themes still occurs within some textbooks. Specifically, white men were more likely to be depicted as hard workers and contributors to the field than any other race and gender. Despite these results, students seemed mixed on the importance of textbook images with many students focused on the …

Fine-Scale Structures In Saturn's Rings Waves, Wakes And Ghosts, Kevin Baille
Fine-Scale Structures In Saturn's Rings Waves, Wakes And Ghosts, Kevin Baille
Electronic Theses and Dissertations
The Cassini mission provided wonderful tools to explore Saturn, its satellites and its rings system. The UVIS instrument allowed stellar occultation observations of structures in the rings with the best resolution available (around 10 meters depending on geometry and navigation), bringing our understanding of the physics of the rings to the next level. In particular, we have been able to observe, dissect, model and test the interactions between the satellites and the rings. We first looked at kilometer-wide structures generated by resonances with satellites orbiting outside the main rings. The observation of structures in the C ring and their association …
Innovation On A Budget The Development Of Military Technology During The Interwar Period, 1919-1939, William Erik Deupree
Innovation On A Budget The Development Of Military Technology During The Interwar Period, 1919-1939, William Erik Deupree
Electronic Theses and Dissertations
This thesis investigates the progress of technological development during the interwar period of 1919 to 1939. The interwar period was a time of slashed military budgets and isolationist policies. However, despite political, financial, and organizational handicaps, each branch of the military made significant progress in the development of military technology, and the air corps and navy achieved significantly better results. The reason these two branches were able succeed was through a combination of organizational policy and the development of an overarching goal for their respective branch. Within this thesis, I investigated each of the major military branches during the interwar …
Supporting Hispanic Mothers With Preschool Children With Speech And/ Or Language Delays Via Dialogic Reading And Coaching Within The Home, Natalie Elizabeth Dopson
Supporting Hispanic Mothers With Preschool Children With Speech And/ Or Language Delays Via Dialogic Reading And Coaching Within The Home, Natalie Elizabeth Dopson
Electronic Theses and Dissertations
Young children who are Hispanic, from low-income homes and have developmental delays are at a disadvantage for not having the basic early literacy foundation to become successful readers later in school (Ballantyne, Sanderman, D‘Emilio, & McLaughlin, 2008; Hammer, Farkas, & Maczuga, 2010; Ezell & Justice 2005; McCardle, Scarborough, & Catts, 2001). These challenges can be addressed in several ways. Early intervention including parent education and collaboration along with shared book reading are considered best practices and critical to improving child outcomes (NELP, 2008). In addition, children who have a solid foundation in early literacy skills including vocabulary development in their …

A Comparison Of Paper-Pencil Versus Video-Conferencing Administration Of A Neurobehavioral Screening Test, Tyler Cole Duffield
Electronic Theses and Dissertations
Regardless of the reason, many patients/clients do not have access to face-to-face medical, neuropsychological, or mental health consultation, assessment, or treatment (Cowain, 2001). The term Remote Neuropsychological Assessment (RNA) has been proposed by Browndyke to denote the general use of telecommunication and Internet-based technologies in neuropsychological assessment and practice (as cited in Schatz & Browndyke, 2002). RNA (Telemedicine) offers a plausible, potentially cost-effective solution to individuals in need of medical, neuropsychological, or mental health consultation, assessment, or treatment that are located in geographical areas away from the specialist (Armstrong, 2006; Berman, 2005; Cowain, 2001; Jacobsen, Sprenger, Andersson, & Krogstad, 2003). …
Towards Calibration Of Optical Flow Of Crowd Videos Using Observed Trajectories, Iman K. Elbadramany
Towards Calibration Of Optical Flow Of Crowd Videos Using Observed Trajectories, Iman K. Elbadramany
Electronic Theses and Dissertations
The need exists for finding a quantitative method for validating crowd simulations. One approach is to use optical flow of videos of real crowds to obtain velocities that can be used for comparison to simulations. Optical flow, in turn, needs to be calibrated to be useful. It is essential to show that optical flow velocities obtained from crowd videos can be mapped into the spatially averaged velocities of the observed trajectories of crowd members, and to quantify the extent of the correlation of the results. This research investigates methods to uncover the best conditions for a good correlation between optical …
Genetically Modified Es Cells Enhance Cardiac Repair And Regeneration In The Infarcted Heart, Carley E. Glass
Genetically Modified Es Cells Enhance Cardiac Repair And Regeneration In The Infarcted Heart, Carley E. Glass
Electronic Theses and Dissertations
Transplanted embryonic stem (ES) cells following myocardial infarction (MI) contribute to limited cardiac repair and regeneration with improved function. Therefore novel strategies are still needed to enhance the efficacy by which ES cells differentiate into cardiac cell types and inhibit adverse remodeling in the infarcted myocardium. Our studies evaluate whether genetic manipulation of transplanted ES cells employing miR- 1, a pro-cardiac microRNA, and TIMP-1, an anti-apoptotic and anti-fibrotic protein, will enhance cardiac myocyte differentiation, inhibit native cardiac apoptosis, and reduce fibrosis in the infarcted myocardium. Furthermore, we assess levels of associated pro- (caspase-3, PTEN) and anti-(Akt) apoptotic proteins as well …
Out A Sociological Analysis Of Coming Out, Nicholas A. Guittar
Out A Sociological Analysis Of Coming Out, Nicholas A. Guittar
Electronic Theses and Dissertations
This study uses a constructivist grounded theory approach to investigate the meaning of “coming out” for LGBQ individuals. Analysis of open-ended interviews with 30 LGBQ persons revealed three main themes. First, coming out does not have a universal meaning among LGBQ persons; rather, it varies on the basis of an individual’s experiences, social environment, and personal beliefs and values. Coming out is a transformative process, and an important element in identity formation and maintenance. Second, despite being attracted only to members of the same sex, ten interviewees engaged in a queer apologetic, a kind of identity compromise whereby individuals disclose …
Write The Community The Effects Of Service-Learning Participation On Seven University Creative Writing Students, Lauren Hodges
Write The Community The Effects Of Service-Learning Participation On Seven University Creative Writing Students, Lauren Hodges
Electronic Theses and Dissertations
Research in higher education service-learning suggests that there is a positive relationship between service-learning and student learning outcomes as well as a positive relationship between students‘ interactions with the ―real world‖ through service-learning and the effects of these experiences on deepening students‘ knowledge in their disciplines. Recent studies have established this positive relationship between service-learning and university composition and literature students. However, aside from the existing literature on service-learning and composition and writing, there has been virtually no examination of the relationship between service-learning and creative writing. The purpose of this study was to investigate how seven creative writing students …
