An Investigation Of How Elementary School Teachers Make Data-Driven Instructional Decisions In Literacy, Cheryl Carangian Pham Edd Jan 2011

An Investigation Of How Elementary School Teachers Make Data-Driven Instructional Decisions In Literacy, Cheryl Carangian Pham Edd

Dissertations

The purpose of this mixed methods phenomenological study was to explore the data-driven instructional decisions that elementary teachers make in literacy. Educators have moved towards a culture of being data-driven, and have declared data use in schools to be significant to school improvement and accountability. Yet, as school districts make great strides in creating a culture of data-driven decision making – collecting, analyzing and interpreting data – little is known about how individual teachers make sense of data and how they use the data to inform instruction. To explore the data-driven instructional decisions made by classroom teachers using literacy assessment …

Strength And Erodability Of South Carolina Soils For Embankment Construction, Ke Zhou Jan 2011

Strength And Erodability Of South Carolina Soils For Embankment Construction, Ke Zhou

Theses and Dissertations

When a particular soil from a borrow pit is being used to construct a road embankment, it is important that the strength and erodibility characteristics are known to ensure the embankment has sufficient load capacity and is resistant to erosion by rain or flooding. To evaluate the borrow pit material’s strength and erodibility characteristics, forty five-gallon buckets of soils were collected from fourteen borrow pits in South Carolina. Three buckets were collected at three different locations within each pit.

Fifteen sets of direct shear tests were performed on the selected fifteen buckets of soils. There are six buckets of soils …

The Relationship Of Preschool Children's Television Viewing, Food/Brand Recognition/Recall, Weight Classification, And Parent's Knowledge Of American Academy Of Pediatrics' Recommendations Of Daily Television Viewing, Patricia Marley Howell Jan 2011

The Relationship Of Preschool Children's Television Viewing, Food/Brand Recognition/Recall, Weight Classification, And Parent's Knowledge Of American Academy Of Pediatrics' Recommendations Of Daily Television Viewing, Patricia Marley Howell

UNF Graduate Theses and Dissertations

The prevention of childhood obesity during the formative years is necessary because dietary patterns influenced by parents are developed early. A major obstacle to healthy feeding patterns in children is television advertising. The study tested three hypotheses. 1) Preschool children ages two to five years who watch more television are able to recognize/recall more food brands than those who view less television. 2) An increase in food brand recognition/recall in preschool children is associated with an overweight classification based on calculated Body Mass Index. 3) Children of parents who are unaware of the American Academy of Pediatrics (AAP) recommendations for …

Rethinking Reasonable Expectations Of Privacy In Online Social Networks, Bryce Clayton Newell Jan 2011

Rethinking Reasonable Expectations Of Privacy In Online Social Networks, Bryce Clayton Newell

Richmond Journal of Law & Technology

In 1890, Warren and Brandeis “invented” the common law right to privacy in the United States. They declared the need for a right to privacy – “to be let alone” – because technological advancements (photography) and business methods (yellow journalism) enabled the media to bring previously private details to the attention of a much larger audience. Warren and Brandeis declared, “[i]nstantaneous photographs and newspaper enterprise have invaded the sacred precincts of private and domestic life; and numerous mechanical devices threaten to make good the prediction that ‘what is whispered in the closet shall be proclaimed from the house-tops.’” Because of …

A Critical Look At The Anti-Counterfeiting Trade Agreement, David M. Quinn Jan 2011

A Critical Look At The Anti-Counterfeiting Trade Agreement, David M. Quinn

Richmond Journal of Law & Technology

On October 23, 2007, the United States announced an initiative to strengthen intellectual property enforcement measures within the international community via the Anti-Counterfeiting Trade Agreement (“ACTA”). During the following years, eleven rounds of negotiations among as many parties culminated in a finalized text released on December 3, 2010. The dialogue occurred outside the purview of existing bodies such as the WIPO and WTO. The ACTA now awaits acceptance following the March 31, 2011 commencement of the ratification period. It will enter into force thirty days following the sixth formal approval.

Do Not Track: Revising The Eu’S Data Protection Framework To Require Meaningful Consent For Behavioral Advertising, Matthew S. Kirsch

Richmond Journal of Law & Technology

The advertisements you see while browsing the Internet are rarely accidental. For instance, Alliance Data, one of many new companies in the booming data-marketing industry, can instantaneously recognize that a user visiting their client’s website is Joel Stein, a thirty-nine year-old, college educated male, who makes over $125,000 a year. Alliance Data also knows that Joel is likely to make purchases online, but only spends about $25 dollars a purchase. Using this information, and the specifics of over 100 of Joel’s past online purchases, Alliance Data creates advertisements specifically tailored to Joel and displays them as he continues to browse …

Breaking Through "The Wall": An Examination Of Elite Rowers And Their Experience Of Conquering Their Mental Boundaries, Nicole Jordens Jan 2011

Breaking Through "The Wall": An Examination Of Elite Rowers And Their Experience Of Conquering Their Mental Boundaries, Nicole Jordens

College of Graduate Studies: Theses & Dissertations

Throughout sports, elite athletes have faced mental boundaries in pursuit of their success. These mental boundaries, often referred to as "The Wall", have typically been investigated in endurance sports. Within the sport of rowing, Baltzell (1999) found that elite rowers coped with their mental boundaries by using; mental preparation, goal setting, social support and psychological well-being. However even though rowing is a sport where athletes experience "The Wall" frequently, modest research has been done to further understand this phenomenon. The purpose of this study was to examine the lived experience of elite rowers when challenged with "The Wall". The study …

Sex And Gasoline: Selling Sex In Twentieth Century America, Elizabeth Puckett

College of Graduate Studies: Theses & Dissertations

The adult entertainment industry as modern mankind knows it began to from at the end of the Victorian age, a time where America also happened to become a major international power for the first time. The history of the adult entertainment industries from 1900 till today can almost be seen as a history of amazing business savvy, moral battles and classic T and A. No one book or one story would capture all the jobs and products that fall under the heading of adult entertainment. But the adult entertainment industry is made of up of people and business that have …

One Nation, Separate Spheres: An Examination Of Red Power Activism Between Two Mohawk Communities, Carlyn N. Pinkins Jan 2011

One Nation, Separate Spheres: An Examination Of Red Power Activism Between Two Mohawk Communities, Carlyn N. Pinkins

College of Graduate Studies: Theses & Dissertations

Red Power activism in the United States and Canada during the 1940s and 1950s is primarily localized, consisting of several tribes or particular regions of tribes simultaneously, but separately protesting local, state, or federal legislation that threatened aspects of their tribal sovereignty. The occupation of Alcatraz Island in 1969 by a group called Indians of All Tribes marked the beginning of pan-Indian activism, inspiring diverse, indigenous efforts to bring about social change. The localism of native activism before the occupation of Alcatraz also extended to intratribal divisions which is illustrated by two separate activist events in the Mohawk communities of …

Adopting The "Other": A Peculiar U.S. Orientalism In The Response To The Circassian War, 1838-1859, Christopher L. Miller Jan 2011

Adopting The "Other": A Peculiar U.S. Orientalism In The Response To The Circassian War, 1838-1859, Christopher L. Miller

History Faculty Publications

This study seeks to complicate the rather one-dimensional character of so-called "Orientalist" discourse as outlined by Edward Said by examining the way in which periodical literature in the United States during the early nineteenth century looked at a particular set of events in a particular region of the Greater Middle East: the so-called Circassian War in the Caucasus Mountains. There clearly was a variety of U.S. Orientalism that was partially a product of an imperialist project, though only partially. The attention paid to the Circassian War by nineteenth-century U.S. newspapers and magazines provides a unique window for understanding how and …

Nonlinear Evaluation Of Stock Assessment And Marine Ecosystem Models, Laura Storch Jan 2011

Nonlinear Evaluation Of Stock Assessment And Marine Ecosystem Models, Laura Storch

Master's Theses and Capstones

In fisheries management, single-species stock assessment models use fisheries-dependent catch and landings data along with fishery-independent estimates of relative or absolute abundance to make estimates of species biomass for a given area. This output is used by the Atlantis marine ecosystem model as input. Atlantis uses an array of physical, biological, and anthropogenic factors to predict biomass for individual species or functional groups of species. Nonlinear analysis was used to assess the output for both the stock assessment, and Atlantis models for the marine ecosystem off the California coast. The number of time series displaying nonlinear characteristics decreases from raw …

Reconstructing The Variability In The Indian Monsoon From The Last Glacial Period To Present, Sarah Arianne Schulenberg Jan 2011

Reconstructing The Variability In The Indian Monsoon From The Last Glacial Period To Present, Sarah Arianne Schulenberg

Master's Theses and Capstones

Asian monsoon rains provide freshwater to one of the most densely populated regions on Earth. However, despite the societal and economic importance of the monsoon, its forcing mechanisms are not fully understood. Here I present a new reconstruction of monsoon variability from the last glacial period to the present as recorded in planktic foraminiferal Mg/Ca and delta18 O of a marine sediment core from the Mahanadi Basin in the northwestern Bay of Bengal.

This new reconstruction reveals an increase in the intensity of the summer monsoon since the last glacial period, in agreement with known changes in northern hemisphere summer …

Measuring Residual Strength Of Liquefied Soil With The Ring Shear Device, Jay Hargy Jan 2011

Measuring Residual Strength Of Liquefied Soil With The Ring Shear Device, Jay Hargy

Master's Theses and Capstones

Natural and constructed slopes may contain zones of loose granular soils capable of liquefaction. Liquefied soils behave like heavy fluids and consequent rapid flowslides can produce great damage. The "residual strength" (Sur) of the liquefied soil can be estimated by back-calculation from field case histories; however, very little confirmation laboratory testing has been conducted thus far. A reliable laboratory measurement technique is needed to independently verify Sur values used for mitigation design.

A ring shear device (RSD) designed and built at the University of New Hampshire (UNH) allows for residual strength testing under controlled strain rates and infinite total strain. …

Renditions, Nathan Halverson Jan 2011

Renditions, Nathan Halverson

Theses and Dissertations

This thesis includes ideas and explorations behind my MFA thesis work and the work that that preceded it in late 2010 and early 2011. In it, I use a creative text by Gertrude Stein, in which she reveals ways that writing reveals and creates language and culture, to illustrate similar ideas regarding field recording and appropriation in my art practice. I use this thesis writing to investigate practices and relationships between media and how these practices can encourage an active, participatory, listening and looking. It also contains discussion of the use of popular music in torture, which inspired Rendition(s), and …

Post-Racial Proxies: Resurgent State And Local Anti-"Alien" Laws And Unity-Rebuilding Frames For Antidiscrimination Values, Mary D. Fan Jan 2011

Post-Racial Proxies: Resurgent State And Local Anti-"Alien" Laws And Unity-Rebuilding Frames For Antidiscrimination Values, Mary D. Fan

Cardozo Law Review

Though unauthorized migration into the United States has diminished substantially since 2007, anti-"illegal alien" state and local laws and furor are flaring again. While one of the biggest worries regarding such "anti-alien" laws is the risk of racialized harm, courts invalidating overreaching statutes are relying on structural or procedural grounds, such as preemption and due process doctrines. This Article examines how these political and legal trends point to how proxies are used in a post-racial era to dance around race, in constructive, national unity-rebuilding as well as divisive, inflammatory ways. Anti-alien legislation is a proxy way to vent resurgent racialized …

Design And Control Of A Multi-Axis Micro-Electro-Mechanical System Array For Coordinated Micro-Manipulation, Patrick Jesse White Jan 2011

Design And Control Of A Multi-Axis Micro-Electro-Mechanical System Array For Coordinated Micro-Manipulation, Patrick Jesse White

Masters Theses

"Micro-electro-mechanical system design and implementation is a field that has received much attention over the past few decades. These robotic systems with features on the micro-scale have an unparalleled opportunity to change the way scientists interact with and understand micro and nano-scale phenomenon. Their capabilities allow experimentation that cannot be achieved with standard macro-scale equipment. Potential applications range from observing biological processes in living cells, to smart materials that automatically detect microcracks. So far, however, only a few truly successful applications have been realized. One of the most elusive goals in MEMS design is creating a system capable of coordinated …

Comparison Of Fencing Designs For Excluding Deer From Roadways, Daniel W. Stull, William D. Gulsby, James A. Martin, Gino J. D'Angelo, George R. Gallagher, David A. Osborn, Robert J. Warren, Karl V. Miller Jan 2011

Comparison Of Fencing Designs For Excluding Deer From Roadways, Daniel W. Stull, William D. Gulsby, James A. Martin, Gino J. D'Angelo, George R. Gallagher, David A. Osborn, Robert J. Warren, Karl V. Miller

Human–Wildlife Interactions

We evaluated the efficacy of several fencing designs for restricting movements of 18 captive, female white-tailed deer (Odocoelus virginianus), including standard wovenwire fencing (1.2-m, 1.5-m, 1.8-m, 2.1-m, and 2.4-m tall), opaque fencing (1.2-m, 1.5-m, and 1.8-m tall), and an outrigger fence (i.e., 0.6-m outriggers attached to a 1.2-m-tall wire fence angled at 45º). We recorded the number of successful fence crossings for each deer and characterized behaviors associated with each failed crossing attempt. No deer crossed the 2.4-m fence, whereas all deer crossed the 1.2-m fence. We observed no differences in crossing success between woven-wire and opaque fencing …

Public Perceptions Of Bears And Management Interventions In Japan, Ryo Sakurai, Susan K. Jacobson Jan 2011

Public Perceptions Of Bears And Management Interventions In Japan, Ryo Sakurai, Susan K. Jacobson

Human–Wildlife Interactions

Conservation of bears is a challenge globally. In Japan, Asiatic black bears (Ursus thibetanus) and brown bears (Ursus arctos) are considered a nuisance because of agricultural and property damage and personal human danger due to occasional human casualties. Reduction of human–bear conflicts in Japan would improve long-term conservation of bears and reduce risks to human health and safety. To understand Japanese perceptions of and experience with bears, we analyzed results of 5 public surveys and reviewed 29 articles from the research and gray literature in Japan. We compared recommendations for interventions to reduce human–bear conflicts with …

The Common School Before And After Brown: Democracy, Equality, And The Productivity Agenda, Rosemary C. Salomone Jan 2011

The Common School Before And After Brown: Democracy, Equality, And The Productivity Agenda, Rosemary C. Salomone

Faculty Publications

(Excerpt)

In recent years, economic forces of global magnitude have placed the substance and value of education in the national spotlight. With jobs for college graduates in short supply, political pundits and news commentators have placed different estimates on the worth of a college degree and the continued utility of the liberal arts. Economists tie specific educational factors to future income. A high school diploma, we are told, can translate into an additional $300,000 in lifetime salary. A highly effective kindergarten teacher likewise carries a value-added benefit of $320,000, the additional income that a classroom of today’s students may earn …

Fiduciary Duty And The Public Interest, Cheryl L. Wade Jan 2011

Fiduciary Duty And The Public Interest, Cheryl L. Wade

Faculty Publications

(Excerpt)

Professor Tamar Frankel’s excellent book, Fiduciary Law, is a thorough and comprehensive look at the fiduciary-law forest. My contribution to the Symposium on The Role of Fiduciary Law and Trust in the Twenty-First Century is one leaf on one branch of one tree in the forest that Professor Frankel so expertly navigates. In this Essay, I explore the fiduciary relationship between corporate directors and officers and the shareholders they serve. I examine how the breach of fiduciary duties owed to shareholders has the power to dramatically impact non-shareholder groups.

Professor Frankel accurately observes that “[f]iduciary duties are anchored …
