Direct Concern In Regional Policy: The European Court Of Justice And The Southern Question, Daniela Caruso Nov 2011

Direct Concern In Regional Policy: The European Court Of Justice And The Southern Question, Daniela Caruso

Faculty Scholarship

For a few years, the European Court of Justice (ECJ) has declared inadmissible, for lack of direct concern, a number of annulment actions initiated by sub-state actors in the context of regional policy. This article compares the ECJ's holdings with the General Court's more generous application of the ‘direct concern’ standard in some of the same disputes, and argues in favour of the General Court's approach. The cases hereby analysed pertain to the implementation of structural funds in Southern Italy. Relating regional policy to the historical unfolding of the ‘Southern Question’, this article examines the unexpected opportunity for civic and …

Collateral Censorship And The Limits Of Intermediary Immunity, Felix T. Wu Nov 2011

Collateral Censorship And The Limits Of Intermediary Immunity, Felix T. Wu

Articles

The law often limits the liability of an intermediary for the speech it carries. And rightly so, because imposing liability on intermediaries can induce them to filter out questionable content and this “collateral censorship” risks suppressing much lawful, even highly beneficial, speech. The “collateral censorship” rationale has its limits, though, and correspondingly, so should the applicability of intermediary immunity. The worry with collateral censorship is not just that intermediaries censor, but that they censor more than an original speaker would in the face of potential liability. Increased censorship, in turn, is the product of applying liability targeted at original speakers …

Cultural Metaphors: Their Use In Management Practice As A Method For Understanding Cultures, Martin J. Gannon Nov 2011

Cultural Metaphors: Their Use In Management Practice As A Method For Understanding Cultures, Martin J. Gannon

Online Readings in Psychology and Culture

This paper argues that the dimensional perspective on culture, arguably the most important development in cross-cultural understanding in 50 years, needs to be supplemented by in-depth treatments of national cultures. Such a treatment is the goal of a cultural metaphor, which is any activity, phenomenon, or institution with which members of a given culture emotionally and/or cognitively identify. As such, cultural metaphors reflect the underlying values of a culture. Examples of national cultural metaphors include the Japanese garden, the Chinese family altar, and American Football. The paper also argues that the focus on specific national cultures can lead to the …

Tired Of Talking: A Call For Clear Strategies For Legal Education Reform: Moving Beyond The Discussion Of Good Ideas To The Real Transformation Of Law Schools, Sara K. Rankin Nov 2011

Tired Of Talking: A Call For Clear Strategies For Legal Education Reform: Moving Beyond The Discussion Of Good Ideas To The Real Transformation Of Law Schools, Sara K. Rankin

Seattle Journal for Social Justice

Legal education reform efforts have persisted for over one hundred years, supported by substantive expertise, empirical data, cutting-edge curricula, and effective pedagogy. But today, the normative face of legal education remains essentially unchanged. If the substance behind legal education reform is valid, then what is the problem? This article examines the stasis of legal education through the lens of historical reform efforts, political science, and contemporary organizational change theory. The author argues that legal education reform efforts are marginalized and have limited normative impact because reformers underestimate the strategic demands of systemic change. As a result, reformers have yet to …

A History Of Low Back Pain Associates With Altered Electromyographic Activation Patterns In Response To Perturbations Of Standing Balance, Jesse V. Jacobs, Sharon M. Henry, Stephanie L. Jones, Juvena R. Hitt, Janice Y. Bunn Nov 2011

A History Of Low Back Pain Associates With Altered Electromyographic Activation Patterns In Response To Perturbations Of Standing Balance, Jesse V. Jacobs, Sharon M. Henry, Stephanie L. Jones, Juvena R. Hitt, Janice Y. Bunn

Exercise and Sport Studies: Faculty Publications

People with a history of low back pain (LBP) exhibit altered responses to postural perturbations, and the central neural control underlying these changes in postural responses remains unclear. To characterize more thoroughly the change in muscle activation patterns of people with LBP in response to a perturbation of standing balance, and to gain insight into the influence of early- vs. late-phase postural responses (differentiated by estimates of voluntary reaction times), this study evaluated the intermuscular patterns of electromyographic (EMG) activations from 24 people with and 21 people without a history of chronic, recurrent LBP in response to 12 directions of …

Beyond Search: Event-Driven Summarization For Web Videos, Richard Hong, Jinhui Tang, Hung-Khoon Tan, Chong-Wah Ngo, Shuicheng Yan, Tat-Seng Chua

Research Collection School Of Computing and Information Systems

The explosive growth of Web videos brings out the challenge of how to efficiently browse hundreds or even thousands of videos at a glance. Given an event-driven query, social media Web sites usually return a large number of videos that are diverse and noisy in a ranking list. Exploring such results will be time-consuming and thus degrades user experience. This article presents a novel scheme that is able to summarize the content of video search results by mining and threading "key" shots, such that users can get an overview of main content of these videos at a glance. The proposed …

Coping With Distance: An Empirical Study Of Communication On The Jazz Platform, Renuka Sindhgatta, Bikram Sengupta, Subhajit Datta

Research Collection School Of Computing and Information Systems

Global software development - which is characterized by teams separated by physical distance and/or time-zone differences - has traditionally posed significant communication challenges. Often these have caused delays in completing tasks, or created misalignment across sites leading to re-work. In recent years, however, a new breed of development environments with rich collaboration features have emerged to facilitate cross-site work in distributed projects. In this paper we revisit the question "does distance matter?" in the context of IBM Jazz Platform -- a state-of-the-art collaborative development environment. We study the ecosystem of a large distributed team of around 300 members across 35 …

Software Process Evaluation: A Machine Learning Approach, Ning Chen, Steven C. H. Hoi, Xiaokui Xiao Nov 2011

Software Process Evaluation: A Machine Learning Approach, Ning Chen, Steven C. H. Hoi, Xiaokui Xiao

Research Collection School Of Computing and Information Systems

Software process evaluation is essential to improve software development and the quality of software products in an organization. Conventional approaches based on manual qualitative evaluations (e.g., artifacts inspection) are deficient in the sense that (i) they are time-consuming, (ii) they suffer from the authority constraints, and (iii) they are often subjective. To overcome these limitations, this paper presents a novel semi-automated approach to software process evaluation using machine learning techniques. In particular, we formulate the problem as a sequence classification task, which is solved by applying machine learning algorithms. Based on the framework, we define a new quantitative indicator to …

Finding Relevant Answers In Software Forums, Swapna Gottopati, David Lo, Jing Jiang Nov 2011

Finding Relevant Answers In Software Forums, Swapna Gottopati, David Lo, Jing Jiang

Research Collection School Of Computing and Information Systems

Online software forums provide a huge amount of valuable content. Developers and users often ask questions and receive answers from such forums. The availability of a vast amount of thread discussions in forums provides ample opportunities for knowledge acquisition and summarization. For a given search query, current search engines use traditional information retrieval approach to extract webpages containing relevant keywords. However, in software forums, often there are many threads containing similar keywords where each thread could contain a lot of posts as many as 1,000 or more. Manually finding relevant answers from these long threads is a painstaking task to …

A Permutation Test For Compound Symmetry With Application To Gene Expression Data, Tracy L. Morris, Mark E. Payton, Stephanie A. Santorico

Journal of Modern Applied Statistical Methods

The development and application of a permutation test for compound symmetry is described. In a simulation study the permutation test appears to be a level-α test and is robust to non-normality. However, it exhibits poor power, particularly for small samples.

Ordinal Regression Analysis: Predicting Mathematics Proficiency Using The Continuation Ratio Model, Xing Liu, Ann A. O'Connell, Hari Koirala Nov 2011

Ordinal Regression Analysis: Predicting Mathematics Proficiency Using The Continuation Ratio Model, Xing Liu, Ann A. O'Connell, Hari Koirala

Journal of Modern Applied Statistical Methods

One commonly used model to analyze ordinal response data is the proportional odds (PO) model. However, if research interest is focused on a particular category and if an individual must pass through lower categories before achieving a higher level, the continuation ratio (CR) model is a more appropriate choice than the PO model. In addition, statistical software, such as Stata and SAS, may use different techniques to estimate the parameters. The CR model is used to illustrate the analysis of ordinal data in education using Stata and SAS and compares the results of fitting the CR model between these two …

Estimation And Hypothesis Testing In Lav Regression With Autocorrelated Errors: Is Correction For Autocorrelation Helpful?, Terry E. Dielman Nov 2011

Estimation And Hypothesis Testing In Lav Regression With Autocorrelated Errors: Is Correction For Autocorrelation Helpful?, Terry E. Dielman

Journal of Modern Applied Statistical Methods

Using the Prais-Winsten correction and adding a lagged variable provides improved estimates (smaller MSE) in least absolute value (LAV) regression when moderate to high levels of autocorrelation are present. When comparing empirical levels of significance for hypothesis tests, adding a lagged variable outperforms other approaches but has a relative high empirical level of significance.

Probabilistic Inferences For The Sample Pearson Product Moment Correlation, Jeffrey R. Harring, John A. Wasko Nov 2011

Probabilistic Inferences For The Sample Pearson Product Moment Correlation, Jeffrey R. Harring, John A. Wasko

Journal of Modern Applied Statistical Methods

Fisher’s correlation transformation is commonly used to draw inferences regarding the reliability of tests comprised of dichotomous or polytomous items. It is illustrated theoretically and empirically that omitting test length and difficulty results in inflated Type I error. An empirically unbiased correction is introduced within the transformation that is applicable under any test conditions.

Salary Equity Studies: An Analysis Of Using The Blinder-Oaxaca Decomposition To Estimate Differences In Faculty Salaries By Gender, Sally A. Lesik, Carolyn R. Fallahi Nov 2011

Salary Equity Studies: An Analysis Of Using The Blinder-Oaxaca Decomposition To Estimate Differences In Faculty Salaries By Gender, Sally A. Lesik, Carolyn R. Fallahi

Journal of Modern Applied Statistical Methods

Parameter estimates for equity studies tested for stability are described. Bootstrap simulation can test whether parameter estimates remain stable given changes in the sample data; fractional polynomials can be used to access functional form specification; and variance inflation factors can be used to test for multicollinearity.

Effect Of Sensory Feedback From The Proximal Upper Limb On Voluntary Isometric Finger Flexion And Extension In Hemiparetic Stroke Subjects, Gilles Hoffmann, Brian D. Schmit, Jennifer H. Kahn, Derek G. Kamper

Biomedical Engineering Faculty Research and Publications

This study investigated the potential influence of proximal sensory feedback on voluntary distal motor activity in the paretic upper limb of hemiparetic stroke survivors and the potential effect of voluntary distal motor activity on proximal muscle activity. Ten stroke subjects and 10 neurologically intact control subjects performed maximum voluntary isometric flexion and extension, respectively, at the metacarpophalangeal (MCP) joints of the fingers in two static arm postures and under three conditions of electrical stimulation of the arm. The tasks were quantified in terms of maximum MCP torque [MCP flexion (MCPflex) or MCP extension (MCPext)] and activity …

Rethinking Extraordinary Circumstances, Scott Dodson Nov 2011

Rethinking Extraordinary Circumstances, Scott Dodson

Faculty Publications

This short essay for Northwestern University Law Review's Colloquy seeks to rationalize the "extraordinary circumstances" doctrine of Rue 60(b)(6) of the Federal Rules of Civil Procedure. The usual rule is that a movant for Rule 60(b)(6) relief must show extraordinary circumstances for that relief. Under the Ackermann rule (so named after the Supreme Court decision that spawned it), courts have held that any extraordinary circumstances cannot have been caused by the movant's own litigation conduct. I argue that the Ackermann rule, at its broadest, would be unjust to those litigants most in need of Rule 60(b)(6) relief and would overserve …

Estimation Of Velocity Uncertainties From Gps Time Series: Examples From The Analysis Of The South African Trignet Network, Matthias Hackl, Rocco Malservisi, Urs Hugentobler, Richard Wonnacott Nov 2011

Estimation Of Velocity Uncertainties From Gps Time Series: Examples From The Analysis Of The South African Trignet Network, Matthias Hackl, Rocco Malservisi, Urs Hugentobler, Richard Wonnacott

School of Geosciences Faculty and Staff Publications

We present a method to derive velocity uncertainties from GPS position time series that are affected by time‐correlated noise. This method is based on the Allan variance, which is widely used in the estimation of oscillator stability and requires neither spectral analysis nor maximum likelihood estimation (MLE). The Allan variance of the rate (AVR) is calculated in the time domain and hence is not too sensitive to gaps in the time series. We derived analytical expressions of the AVR for different kinds of noises like power law noise, white noise, flicker noise, and random walk and found an expression for …

Background: Previous studies have suggested that marital status is associated with mortality, but few studies have been conducted in China where increasing aging population and divorce rates may have major impact on health and total mortality.

Methods: We examined the association of marital status with mortality using data from the Shanghai Women’s Health Study (1996–2009) and Shanghai Men’s Health Study (2002–2009), two population-based cohort studies of 74,942 women aged 40–70 years and 61,500 men aged 40–74 years at the study enrollment. Deaths were identified by biennial home visits and record linkage with the vital statistics registry. Marital status was categorized …
