Are Corporations "Subjects" Of International Law?, Jose E. Alvarez

Santa Clara Journal of International Law

Courts and scholars often attempt to draw legal conclusions from the status of entities, whether states, international organizations or corporations. Debates concerning whether corporations are “subjects” of international law and the legal conclusions that supposedly follow from this are particularly vociferous within Alien Tort Claims litigation in U.S. courts. Using the Supreme Court’s recent decision in Citizens United as a cautionary tale, the author argues that drawing legal conclusions from the fact of “subject-hood” is fraught with peril, particularly in the case of corporations. He argues that such top-down approaches are likely to lead to unintended consequences and that corporations, …

Explaining Constitutional Review In New Democracies: The Case Of Taiwan, Nuno Garoupa, Veronica Grembi, Shirley Ching-Ping Lin Jan 2011

Explaining Constitutional Review In New Democracies: The Case Of Taiwan, Nuno Garoupa, Veronica Grembi, Shirley Ching-Ping Lin

Washington International Law Journal

This paper extends the empirical analysis of the determinants of judicial behavior by considering the Taiwanese case. Taiwan is a particularly interesting case because the establishment and development of constitutional review corresponds to a political transition from an authoritarian regime dominated by one party to an emerging democracy. We test the attitudinal hypothesis by making use of a new dataset of ninety-seven decisions issued by the Taiwanese constitutional court in the period between 1988 and 2008. The attitudinal hypothesis is that the Taiwanese constitutional judges respond to party interests, either because their preferences coincide with the appointer or because they …

Using Pedometers In Physical Education Teacher Education (Pete) Programs, Robert Christenson, David C. Barney Jan 2011

Using Pedometers In Physical Education Teacher Education (Pete) Programs, Robert Christenson, David C. Barney

Faculty Publications

Pedometers have been found to be a valuable teaching tool in physical education class at almost every level of education (Scruggs, Beveridge, Eisenman, Watson, Shultz & Ransdell, 2003). While there are a variety of different pedometer styles, shapes and sizes, the information that can be compiled from each can be just as different. The basic pedometer can measure steps taken, distance, time a person is in activity, calories burned and a few other fundamental measures. In addition, some pedometers record heart rate, have time-of-day displays, are weather resistant, have alternate metric capabilities and provide easy-to-read displays. There has been a …

Understanding Streaming In Dictyostelium Discoideum: Theory Versus Experiments, J. C. Dallon, Brittany Dalton, Chelsea Malani Jan 2011

Understanding Streaming In Dictyostelium Discoideum: Theory Versus Experiments, J. C. Dallon, Brittany Dalton, Chelsea Malani

Faculty Publications

Recent experimental work involving Dictyostelium discoideum seems to contradict several theoretical models. Experiments suggest that localization of the release of the chemoattractant cyclic adenosine monophosphate to the uropod of the cell is important for stream formation during aggregation. Yet several mathematical models are able to reproduce streaming as the cells aggregate without taking into account localization of the chemoattractant. A careful analysis of the experiments and the theory suggests the two major features of the system which are important to stream formation are random cell motion and chemotaxis to regions of higher cell density. Random cell motion acts to reduce …

Instruction And Physical Environments That Support Process Writing In Elementary Classrooms, Monica Thomas Billen, Brad Wilcox, Damon Bahr, Jill Shumway, Byran Korth, Elizabeth Yates, Timothy G. Morrison, Sue Simmerman, Stan V. Harwarad, Nancy Peterson, Linda E. Pierce

Faculty Publications

This study conducted in eight Utah school districts documented the amount of time devoted to elementary writing instruction and described classroom physical environments related to that instruction. One-hundred-seventy-seven full-day observations were completed during a one-week period. Results indicated that process-writing time was dominated by explicit instruction from the teacher. Other elements of the writing workshop were implemented, but in a fragmented way. Classroom physical environments were generally not literacy rich. Process-oriented teachers had richer environments than those who focused on conventions.
