Fraud Created The Market: Presuming Reliance In Rule 10(B)-5 Primary Securities Market Fraud Litigation , Matt Silverman

Fordham Law Review

This Note addresses the circuit split regarding the “fraud created the market” presumption of reliance in Rule 10b-5 securities fraud cases. Fraud created the market was first adopted by the U.S. Court of Appeals for the Fifth Circuit in Shores v. Sklar, and applies in cases where a defendant has engaged in a “scheme to defraud” the investing public in the primary securities market. This Note first discusses Congress’s intent behind relevant securities laws, the effect presuming reliance has on the class certification process, and how the presumption of reliance has been applied in Rule 10b-5 actions by the U.S. …

Pulling The Trigger On Public Campaign Finance: The Contextual Approach To Analyzing Trigger Funds , George Lobiondo Nov 2011

Pulling The Trigger On Public Campaign Finance: The Contextual Approach To Analyzing Trigger Funds , George Lobiondo

Fordham Law Review

The unpredictable nature of electoral politics makes it difficult for public campaign financing programs to be both efficient and effective. Programs that award too much money to publicly funded candidates risk insolvency, while miserly systems cannot attract participants. Moreover, the competitiveness of any given race changes with each election cycle—what was a landslide one year might be the closest of contests next November. Several states have tried to address this dilemma by enacting “trigger” provisions that disburse extra money to publicly funded candidates only after their opponents raise or spend beyond a certain amount. These laws have faced legal challenges …

Keeping Up With Officer Jones: A Comprehensive Look At The Fourth Amendment And Gps Surveillance , Kaitlyn A. Kerrane

Fordham Law Review

Each day, individuals use technological devices to make their lives easier. One such device is the Global Positioning System (GPS), which has increasingly gained popularity in recent years. Police use of GPS in robbery, drug, murder and other investigations has also increased. Several high profile cases have brought the law enforcement uses of GPS into the public eye and elicited a public response. Warrantless installation and monitoring of these devices for up to months at a time have been challenged as unreasonable Fourth Amendment searches. The U.S. Supreme Court has not decided on the constitutional issues raised by police GPS …

The Need For Non-Discretionary Interlocutory Appellate Review In Multidistrict Litigation , Andrew S. Pollis Nov 2011

The Need For Non-Discretionary Interlocutory Appellate Review In Multidistrict Litigation , Andrew S. Pollis

Fordham Law Review

Multidistrict Litigation (MDL) is a tool for managing complex litigation by transferring cases with common questions of fact to a single judge for coordinated pretrial proceedings. The subject matter of the cases can run the gamut from airplane crashes to securities fraud to environmental disasters, such as the recent BP oil spill in the Gulf of Mexico. Today, about a third of all pending civil cases in federal court are part of the MDL system. A single judge renders all the important legal decisions in each MDL, exerting outsized impact on the parties and on the evolution of the law—and …

Transference Love And Countertransference Love In Clinical Technique, Ronald J. Koshes, M.D., Colleen E. Sari, M.D. Nov 2011

Transference Love And Countertransference Love In Clinical Technique, Ronald J. Koshes, M.D., Colleen E. Sari, M.D.

Jefferson Journal of Psychiatry

The authors review the original and modern concepts of transference and countertransference love as described by Sigmund Freud followed by the more recent theories of Heinz Kohut and Otto Kernberg, focusing on dynamic clinical importance. Case examples are presented to illustrate the important clinical presentations, problems and pitfalls as well as techniques of managing the eroticized transference. The countertransference implications are especially explored as well as indications for supervision.

A Survey Of Selected Neurological Signs In Schizophrenia Research, Emanuel H. Rosen, M.D. Nov 2011

A Survey Of Selected Neurological Signs In Schizophrenia Research, Emanuel H. Rosen, M.D.

Jefferson Journal of Psychiatry

This review covers three areas of schizophrenia research not usually addressed in residents' curricula: smooth pursuit eye movements and genetics, orienting responses, and tardive dyskinesia. The significance of these neurological signs is explored in terms of their clinical symptom associations and their heuristic value. Neuroanatomical aspects of these signs is noted to be speculatively consistent with hypofrontality and negative symptoms in schieophrenia. The author describes the nature of occulomotor abnormalities and discusses an applicable research study. He summarizes relevant areas of genetic research including linkage analysis and marker studies and explains some of the orienting response abnormalities in schizophrenia. He …

The Pulpit And The Sabbath-School, Rev Henry A Nelson

ATS Digital Resources

"Can this turning the hearts of fathers to their children, and the hearts of children to their fathers, be accomplished in any other way, or by any other means, so well as by the combined and co-operative action of these two powers, the Sabbath-school and the pulpit? Are they not fitted to each other, and together fitted for this high use with a wisdom that is more than human? Have not they been predestined by God to be developed in this age, and to come forth together soon, in their beautiful harmony and marvelous adaptation, ready for the great work …

The Reasons Why Herman Cain Has Not Been Able To Talk His Way Out Of His Exploding Sexual Harassment Scandal, Joanna L. Grossman Nov 2011

The Reasons Why Herman Cain Has Not Been Able To Talk His Way Out Of His Exploding Sexual Harassment Scandal, Joanna L. Grossman

Hofstra Law Faculty Scholarship

The story of the sexual harassment allegations against GOP Presidential candidate Herman Cain, first broken by Politico, just keeps getting bigger. In addition to the two women who filed formal complaints of harassment against Cain while he was head of the National Restaurant Association (NRA) in the late 1990s, a third woman has now come forward to complain that she was also harassed by him, although she did not file a complaint at the time.

The details of the allegations and the settlements received by the two women who did file formal complaints against Cain have been leaking out in …

Loop Quantum Cosmology: A Status Report, Abhay Ashtekar, Parampreet Singh Nov 2011

Loop Quantum Cosmology: A Status Report, Abhay Ashtekar, Parampreet Singh

Faculty Publications

Loop quantum cosmology (LQC) is the result of applying principles of loop quantum gravity (LQG) to cosmological settings. The distinguishing feature of LQC is the prominent role played by the quantum geometry effects of LQG. In particular, quantum geometry creates a brand new repulsive force which is totally negligible at low spacetime curvature but rises very rapidly in the Planck regime, overwhelming the classical gravitational attraction. In cosmological models, while Einstein's equations hold to an excellent degree of approximation at low curvature, they undergo major modifications in the Planck regime: for matter satisfying the usual energy conditions, any time a …

Checking The Staats: How Long Is Too Long To Give Adequate Public Notice In Broadening Reissue Patent Applications?, David M. Longo Ph.D., Ryan P. O’Quinn Ph.D. Nov 2011

Checking The Staats: How Long Is Too Long To Give Adequate Public Notice In Broadening Reissue Patent Applications?, David M. Longo Ph.D., Ryan P. O’Quinn Ph.D.

Duke Law & Technology Review

A classic property rights question looms large in the field of patent law: where do the rights of inventors end and the rights of the public begin? The right of inventors to modify the scope of their claimed inventions, even after the patent issues, is in direct tension with the concepts of public notice and the public domain. The Patent Act currently permits broadening of claims so long as a reissue application demonstrating intent to broaden is filed within two years of the original patent issue. Over the years, however, this relatively straightforward statutory provision has sparked numerous disputes over …
