Reason, The Common Law, And The Living Constitution (Review Of The Living Constitution By David Strauss), Matthew J. Steilen Nov 2011

Reason, The Common Law, And The Living Constitution (Review Of The Living Constitution By David Strauss), Matthew J. Steilen

Book Reviews

This article reviews David Strauss’s recent book, The Living Constitution. The thesis of Strauss’s book is that constitutional law is a kind of common law, based largely on judicial precedent and common-sense judgments about what works and what is fair. Strauss argues constitutional doctrines prohibiting discrimination and protecting free speech have a common law basis, and that the originalist would have to reject them. However, it is unclear that the common law can justify these rights. This review examines Strauss’s account of the common law and shows why it cannot justify our First Amendment protections of subversive advocacy, as Strauss …

Effect Of Protein Kinase C Delta (Pkc-Δ) Inhibition On The Transcriptome Of Normal And Systemic Sclerosis Human Dermal Fibroblasts In Vitro., Peter J Wermuth, Sankar Addya, Sergio A Jimenez Nov 2011

Effect Of Protein Kinase C Delta (Pkc-Δ) Inhibition On The Transcriptome Of Normal And Systemic Sclerosis Human Dermal Fibroblasts In Vitro., Peter J Wermuth, Sankar Addya, Sergio A Jimenez

Jefferson Institute of Molecular Medicine Papers and Presentations

Previous studies demonstrated that protein kinase C- δ (PKC-δ) inhibition with the selective inhibitor, rottlerin, resulted in potent downregulation of type I collagen expression and production in normal human dermal fibroblasts and abrogated the exaggerated type I collagen production and expression in fibroblasts cultured from affected skin from patients with the fibrosing disorder systemic sclerosis (SSc). To elucidate the mechanisms involved in the ability of PKC-δ to regulate collagen production in fibroblasts, we examined the effects of PKC-δ inhibition on the transcriptome of normal and SSc human dermal fibroblasts. Normal and SSc human dermal fibroblasts were incubated with rottlerin (5 …

Explaining The "Female Victim Effect" In Capital Sentencing Decisions: A Case For Sex-Specific Models Of Capital Sentencing Research, Tara N. Richards Nov 2011

Explaining The "Female Victim Effect" In Capital Sentencing Decisions: A Case For Sex-Specific Models Of Capital Sentencing Research, Tara N. Richards

USF Tampa Graduate Theses and Dissertations

The potential influence of extralegal characteristics on the outcome of post-Furman capital cases (1972) has been a focus of criminal justice researchers and legal scholars. Much of this literature has assessed the impact of victim and defendant race on the likelihood of receiving the death penalty while a relatively underdeveloped body of research focuses on how victim sex may affect capital sentencing decisions. The present study uses focal concerns theory and the chivalry hypothesis to test the potential mediating effect of theoretical variables on the relationship between victim sex and juror capital sentence decision-making. In addition, it uses victim sex …

Evaluation Of Cancer From Exposure To Cyanotoxins In Drinking Water At Grand Lake Saint Marys, Timothy Edward Soward Nov 2011

Evaluation Of Cancer From Exposure To Cyanotoxins In Drinking Water At Grand Lake Saint Marys, Timothy Edward Soward

Master of Public Health Program Student Publications

Background: The Celina Water Department treats and supplies surface water contaminated by cyanotoxins from Grand Lake Saint Marys (GLSM) to approximately 12,000 customers in Celina, Ohio. Cyanotoxins are a biochemically and bioactively diverse group of extremely potent natural toxins in water. A common cyanotoxin called microcystin-LR found in GLSM has been associated with acute liver damage and potentially liver and colorectal cancer.

Methods: In this observational study, the city of Celina (Mercer County) Ohio that had a contaminated surface water supply, the cancer incidence was compared with two control cities, St. Marys, and Wapakoneta (Auglaize County) in Ohio, both served …

Critical Torque For Kink Formation In Double-Stranded Dna, Hao Qu, Yong Wang, Chiao-Yu Tseng, Giovanni Zocchi Nov 2011

Critical Torque For Kink Formation In Double-Stranded Dna, Hao Qu, Yong Wang, Chiao-Yu Tseng, Giovanni Zocchi

Physics Faculty Publications and Presentations

We measure the bending energy of double-stranded DNA in the nonlinear (sharply bent) regime. The measurements are obtained from the melting curves of stressed DNA ring molecules. The nonlinear elastic behavior is captured by a single parameter: the critical torque τc at which the molecule develops a kink. In this regime, the elastic energy is linear in the kink angle. This phenomenology is the same as for the previously reported case of nicked DNA. For the sequences examined, we find τc=31 pN×nm. This critical torque corresponds to a characteristic energy scale (π/2)τc=12 kT room relevant for molecular biology processes associated …

Separation Of Powers And The Middle Way, Jack M. Beermann Nov 2011

Separation Of Powers And The Middle Way, Jack M. Beermann

Shorter Faculty Works

Composer Arnold Schoenberg famously once quipped that “the middle way is the one that surely does not lead to Rome.” The idea behind this thought, I gather, is that intellectual compromise does not lead to the truth. John Manning’s recently published article, Separation of Powers as Ordinary Interpretation, 124 Harv. L. Rev. 1940 (2011), proves Schoenberg’s principle wrong, at least with regard to separation of powers. In this article, Manning, the Bruce Bromley Professor of Law at Harvard Law School, persuasively demonstrates that neither extreme in current debates about separation of powers is correct, and that a true understanding …

Childhood Maltreatment, Coping, And Coping Self-Efficacy Among Offenders, David Guion Nov 2011

Childhood Maltreatment, Coping, And Coping Self-Efficacy Among Offenders, David Guion

Theses and Dissertations

This study explored the relationship between childhood interpersonal trauma and coping self-efficacy, coping styles, and emotion regulation difficulties among male and female offenders in detention and diversion centers (N = 183). The coping-relapse model of recidivism posits that offenders’ coping ability plays a pivotal role in successful reentry (Zamble & Quinsey, 1997). Past research reveals that childhood maltreatment is associated with avoidant coping and emotion regulation difficulties, which could negatively impact reentry (e.g., Cloitre et al., 2009; Min, Farkas, Minnes, & Singer, 2007). The relationship between childhood maltreatment and coping self-efficacy has not been addressed. This study found that childhood …

Graduate School of Oceanography Faculty Publications

Detailed comparisons of airborne CH2O measurements acquired by tunable diode laser absorption spectroscopy with steady state box model calculations were carried out using data from the 2006 INTEX-B and MILARGO campaign in order to improve our understanding of hydrocarbon oxidation processing. This study includes comparisons over Mexico (including Mexico City), the Gulf of Mexico, parts of the continental United States near the Gulf coast, as well as the more remote Pacific Ocean, and focuses on comparisons in the boundary layer. Select previous comparisons in other campaigns have highlighted some locations in the boundary layer where steady state box …

Relics, Rex Kalehoff

Theses

RELICS is a group of familiar, yet evocative objects, handcrafted in wood. Inspired by first-hand experiences living abroad, each sculpture aims to represent the physical remains and ideologies of past cultures around the world. The work reflects gently on universal themes of cultural persistence and survival, and presents a thoughtful investigation into our current patterns of living. My message is in support of a sustainable future, celebrating diversity, and nurturing nature.
