Putting Students At The Center Of Legal Education: How An Emphasis On Outcome Measures In The Aba Standards For Approval Of Law Schools Might Transform The Educational Experience Of Law Students, Janet W. Fisher
Southern Illinois University Law Journal
Legal education has been notably absent from the assessment movement that has been underway in American higher education for over twenty-five years. Accreditors of virtually every other area of professional education in the United States have adopted assessment of educational outcomes as part of their accreditation process. Legal education is poised to join this movement as the American Bar Association considers revisions to its Standards for Approval of Law Schools that would emphasize educational outcomes.
This Article explores how the assessment of educational outcomes might be implemented in legal education at the institutional, programmatic and course levels. The Article focuses …
Unfashionably Late: Protecting A Designer‘S Identity After A Personal Name Becomes A Valuable Trademark, Allison B. Pitzer
Unfashionably Late: Protecting A Designer‘S Identity After A Personal Name Becomes A Valuable Trademark, Allison B. Pitzer
Southern Illinois University Law Journal
This comment discusses the use of personal name trademarks in the fashion industry, and in particular, its impact on the namesake designer. Designers currently have very few options regarding the use of their personal name as a trademark, and often cannot retain any use of their name after a designer has left the company owning the trademark. The fashion industry is unique in that personal name trademarks are widely used and become extremely valuable. At the commencement of a fashion enterprise, a designer will require investors to build his or her brand. Often, choosing to name the brand after the …
Fill Material Pollution Under The Clean Water Act: A Need For Legislative Change, Kory R. Watson
Fill Material Pollution Under The Clean Water Act: A Need For Legislative Change, Kory R. Watson
Southern Illinois University Law Journal
The Clean Water Act was implemented to restore and maintain the Nation’s waters. The National Pollutant Discharge Elimination System is the principal permitting scheme under the Clean Water Act that is designated to achieve that objective. In the wake of ambiguous regulations on fill material, a loophole in the Clean Water Act has arisen. Currently, an entity can apply for a fill permit to discharge waste normally regulated under the Nation Pollutant Discharge Elimination System if the discharge is composed of a sufficiently high concentration of solids. This Comment discusses the regulations on fill permitting and the cases interpreting them. …

A Comparison Of Fuel Efficiencies Between Dc-9-30 And B-737ng Aircraft For Delta Airlines At Atlanta Hartsfield Airport, Brandon Scott Newman
Doctoral Dissertations and Master's Theses
Improved fuel efficiency is one of aviation's top priorities, as it impacts the economy and the National Airspace System's environment. This descriptive study used data generated by the Total Airspace and Airport Modeler (TAAM) to show that the Boeing 737 Next Generation series aircraft would be more fuel-efficient than the McDonnell-Douglas DC-9-30 aircraft on various routes used by Delta Airlines out of Atlanta's Hartsfield-Jackson International Airport. Databases, such as Aircraft Situation Display to Industry (ASDI) and Base of Aircraft Data (BADA), were used to simulate the baseline flight route information. Simulations were performed on Boeing 737NG (-700, -800, -900) and …
The Relationship Between Physical Activity And Cognitive Symptoms Of Depression, Katy Manganella
The Relationship Between Physical Activity And Cognitive Symptoms Of Depression, Katy Manganella
Psychology and Counseling Theses
Existing research on exercise habits typically focuses on the physical health benefits. However, this research tends to neglect the potential psychological benefits of exercise. The present research adopts a different perspective by investigating the relationship between exercise and different symptom types of depression. By establishing the amount of physical activity participants consider to constitute exercising on a regular basis, participants were separated into self-reported high and low-exercise groups and completed the Zung-Self Rating Depression Scale. By employing a factor analysis of the Zung SDS, the results were analyzed assessing each symptom type of depression: Cognitive, affective, and somatic. Results suggest …
Effect Of Pesticides On Salicylic Acid Binding Protein 2 (Sabp2) And Plant Defense, Joannes Petrus Yuh
Effect Of Pesticides On Salicylic Acid Binding Protein 2 (Sabp2) And Plant Defense, Joannes Petrus Yuh
Electronic Theses and Dissertations
Tobacco SABP2 has been shown to display high affinity for salicylic acid (SA) and methylsalicylate (MeSA) and plays an important role in SAR signal development. Using biochemical approach, SABP2 has been shown to demonstrate strong esterase activity in converting MeSA to SA. Recent study shows that tetra fluoroacetophenone, a synthetic analog of SA, competitively inhibits SABP2 esterase activity as well as suppresses SAR signal development in tobacco mosaic virus (TMV)-infected tobacco plants. Not much has been studied on the effect of pesticides on plant defenses. Because both AChE and SABP2 are esterase-like proteins belonging to α/β hydroxylase superfamily, we hypothesize …

Lifting The Cloak: Preventive Detention As Punishment, Douglas Husak
Lifting The Cloak: Preventive Detention As Punishment, Douglas Husak
San Diego Law Review
Most of the scholarly reaction to systems of preventive detention has been hostile. Negative judgments are especially prevalent among penal theorists who hold nonconsequentialist, retributivist rationales for criminal law and punishment. Surely their criticisms are warranted as long as we confine our focus to the existing systems of preventive detention that flagrantly disregard fundamental principles of legality and desert. Nonetheless, I believe that many of their more sweeping objections tend to rest too uncritically on doctrines of criminal theory that are not always supported by sound arguments even though they are widely accepted. I will contend that we cannot fully …

Five of the fifteen samples were compacted at Standard proctor energy, five were compacted at 75 percent of Standard proctor energy, and five were compacted at 50 percent of Standard proctor energy. The results obtained from the laboratory portion of the testing program (the zone of acceptance) are presented. A ten …
The Effects Of Pten Deletion On Cell Size And Plasticity In The Hippocampus, Margaret Sperow
The Effects Of Pten Deletion On Cell Size And Plasticity In The Hippocampus, Margaret Sperow
Theses and Dissertations (ETD)
The tumor suppressor phosphatase and tensin homolog (PTEN) is the central negative regulator of the phosphatidylinositol 3-kinase (PI3K) -signaling pathway, which mediates diverse processes in various tissues. In the nervous system, the PI3K pathway modulates proliferation, migration, cellular size and synaptic transmission and plasticity. Neurologic abnormalities such as autism, seizures, and ataxia are associated with inherited PTEN mutations. Yet, how PTEN loss contributes to neurologic dysfunction remains unknown. PTEN loss during early development is associated with extensive deficits in neuronal migration and substantial hypotrophy of neurons and synaptic densities. However, whether its effect on synaptic transmission and plasticity is direct …
Development And Evaluation Of Nano‑Scale Systems For Targeted Delivery To Treat Liver Fibrosis, Ningning Yang
Development And Evaluation Of Nano‑Scale Systems For Targeted Delivery To Treat Liver Fibrosis, Ningning Yang
Theses and Dissertations (ETD)
Excessive deposition of ECM is the common characteristic of liver fibrosis. During hepatic fibrosis, various inflammatory cytokines are released and trigger the activation of quiescent HSCs. The activated HSCs play the major role in producing extra amount collagen. It becomes very crucial to focus on HSCs to find out therapeutics, such as inhibiting collagen synthesis, inhibiting activation to myofibroblasts, or controlling inflammation.
To control excessive collagen synthesis, one triplex forming oligonucleotides (TFO), was systemically administrated to prevent type I collagen mRNA transcription. To enhance circulation time and targeted delivery efficiency, TFO was conjugated to M6P‑HPMA and showed efficient targeted delivery …
Characterization Of The Key Mouse Cochlear Developmental Genes For Auditory Hair Cell Regeneration, Zhiyong Liu
Characterization Of The Key Mouse Cochlear Developmental Genes For Auditory Hair Cell Regeneration, Zhiyong Liu
Theses and Dissertations (ETD)
Mammalian inner ear cochlear auditory hair cells (HCs) and adjacent supporting cells (SCs) are believed to derive from the same progenitors during development. However, unlike SCs of nonmammalian vertebrates, mammalian cochlear SCs cannot be converted into functional hair cells (HCs) after damage, thus leading to permanent deafness. To entitle mammals with the ability to restore hearing capacity after HC damage, we first achieved proliferation of SCs by acute ablation of p27 or Sox2. Secondly, we overactivated Notch1 signaling in the mouse inner ear at different developmental stages, and found that the ability of Notch signaling in generating new HCs declines …

Increased climate variability has already been evidenced in Eritrea. Mean annual temperature has increased by 1.7 0C since 1960, an average rate of 0.370C per decade. The increase is most rapid in July, August and September at a rate of 0.550C per decade which is the most important season in Eritrea for agricultural production. Increases in the frequency of hot nights are larger and statistically significant in June, July and August as well as October, November and December and in the annual data. The average number of ‗cold‘ nights per year has decreased by 34 (9.3% of days). The 1912-2005 …
The Impact Of Ambrosia Trifida (Giant Ragweed) On Native Prairie Species In An Early Prairie Restoration Project, Krisztian Megyeri
The Impact Of Ambrosia Trifida (Giant Ragweed) On Native Prairie Species In An Early Prairie Restoration Project, Krisztian Megyeri
Senior Honors Theses
As the ecological importance of prairies is becoming more recognized, the number of prairie restoration projects is increasing worldwide. One of the major challenges in restoring any disturbed ecosystem is the successful establishment of native species at the expensive of invasive species. While some weedy species are gradually replaced as other, more desired, species become established, there are invasive species that, due to their level of dominance, may out-compete native species indefinitely. The objectives of this study were 1) to quantify the impact of Ambrosia trifida (giant ragweed) on the plant community of a newsly established prairie, 2) to assess …
A Masterable Past? Swiss Historical Memory Of World War Ii, Sara Ormes
A Masterable Past? Swiss Historical Memory Of World War Ii, Sara Ormes
Senior Honors Theses
After World War II, every country that had been touched by or involved in the war had to come to terms with its past. In the case of Switzerland, the Swiss government, the army and some of the country’s leadership established a strong official historical memory of the war, portraying Switzerland as a neutral, benevolent and well-fortified country that remained innocent and untouched by the war.
From the 1960s onwards, Swiss artists and intellectuals challenged these myths by presenting alternative views of the Swiss past in their work. Beginning in the 1970s, Swiss historians published an increasing amount of scholarly …

Colonia Population And Housing Estimation [Dataset], Daren Ruiz
BBER Publications
Colonias are small, under-represented communities often characterized by poor socioeconomic conditions. There are 142 HUD-designated colonias in southern New Mexico. There is a great need for information on colonias: government agencies and community planners want to improve infrastructure and allocate resources to serve colonia populations. As part of the effort to compile information about colonias, the UNM Bureau of Business and Economic Research (BBER) developed a technique for tabulating U.S. Census Bureau data for colonia geography. This article explains the technique, demonstrated by an estimated population and household count for the Rancho Grande colonia in Catron County. Location coordinates for …

The Significance Of Human Remains In Museum Collections: Implications For Collections Management, Kacey M. Page
The Significance Of Human Remains In Museum Collections: Implications For Collections Management, Kacey M. Page
History Theses
The significance of a museum collection has changed over the years, in how it is managed and cared for, and how it is viewed by the public. Best practice mandates that professional policies and guidelines be developed to standardize the acquisition, care, and use of all objects or artifacts that are kept within a museum environment. Although human remains are not an exception to these policies, they hold a unique position within museums; standardized guidelines for their care and management are still developing. The following thesis will look into the policies and issues of housing human remains within museums, both …
Anxiety: An Evolutionary Approach, M Bateson, B Brilot, D Nettle
Anxiety: An Evolutionary Approach, M Bateson, B Brilot, D Nettle
School of Biological and Marine Sciences
Anxiety disorders are among the most common mental illnesses, with huge attendant suffering. Current treatments are not universally effective, suggesting that a deeper understanding of the causes of anxiety is needed. To understand anxiety disorders better, it is first necessary to understand the normal anxiety response. This entails considering its evolutionary function as well as the mechanisms underlying it. We argue that the function of the human anxiety response, and homologues in other species, is to prepare the individual to detect and deal with threats. We use a signal detection framework to show that the threshold for expressing the anxiety …
Turning Unambiguous Statutory Materials Into Ambiguous Statutes: Ordering Principles, Avoidance, And Transparent Justification In Cases Of Interpretive Choice, Carlos E. González
Turning Unambiguous Statutory Materials Into Ambiguous Statutes: Ordering Principles, Avoidance, And Transparent Justification In Cases Of Interpretive Choice, Carlos E. González
Duke Law Journal
How should courts handle interpretive choices, such as when statutory text strongly points to one statutory meaning but strong evidence of legislative intent suggests a contradictory statutory meaning? Courts have addressed this longstanding dilemma inconsistently. Sometimes courts follow statutory text over contradictory legislative intent; sometimes they do the exact opposite.
Though reaching contradictory conclusions, many courts facing interpretive choices have argued that the law of interpretation provides definitive solutions. This Article argues that the opposite is true: the law of interpretation generates, rather than resolves, interpretive choices. When this occurs, legally unconstrained judicial discretion and extralegal factors, rather than the …
What Is Securities Fraud?, Samuel W. Buell
What Is Securities Fraud?, Samuel W. Buell
Duke Law Journal
As Rule 10b-5 approaches the age of seventy, deep familiarity with this supremely potent and consequential provision of American administrative law has obscured its lack of clear conceptual content. The rule, as written, interpreted, and enforced, is missing a fully developed connection to—of all things—fraud. Fraud is difficult to define. Several approaches are plausible. But the law of securities fraud, and much of the commentary about that body of law, has neither attempted such a definition nor acknowledged its necessity to the coherence and effectiveness of the doctrine.
Securities fraud’s lack of mooring in a fully developed concept of fraud …
Interpretive Freedom: A Necessary Component Of Article Iii Judging , Jennifer M. Bandy
Interpretive Freedom: A Necessary Component Of Article Iii Judging , Jennifer M. Bandy
Duke Law Journal
As judges have debated the best method of constitutional and statutory interpretation, scholars have begun calling for increased constraints on the methodological freedoms of Article III judges. This Note rejects such proposals on constitutional grounds. Drawing upon the jurisprudence and scholarship on inherent powers, I argue that interpretive choice is an inherent judicial power. The drafting and ratification history of Article III demonstrates that the Framers expected federal judges to interpret the law. To accomplish this task, however, judges must have some methodological approach to help them prioritize interpretive evidence. Thus, imposition of a binding interpretive methodology upon federal judges …
Dna As Patentable Subject Matter And A Narrow Framework For Addressing The Perceived Problems Caused By Gene Patents, Stephen H. Schilling
Dna As Patentable Subject Matter And A Narrow Framework For Addressing The Perceived Problems Caused By Gene Patents, Stephen H. Schilling
Duke Law Journal
Concerns about the alleged harmful effects of gene patents— including hindered research and innovation and impeded patient access to high-quality genetic diagnostic tests—have resulted in overreactions from the public and throughout the legal profession. These overreactions are exemplified by Association for Molecular Pathology v. U.S. Patent and Trademark Office, a 2010 case in the Southern District of New York that held that isolated DNA is unpatentable subject matter under 35 U.S.C. § 101. The problem with these responses is that they fail to adequately consider the role that gene patents and patents on similar biomolecules play in facilitating investment in …
Does Non-Steroidal Anti-Inflammatory Drug (Nsaid) Use Affect Dementia Progression And Survival Rates In Alzheimer's Disease? The Cache County Study, Trevor R. Buckley
Does Non-Steroidal Anti-Inflammatory Drug (Nsaid) Use Affect Dementia Progression And Survival Rates In Alzheimer's Disease? The Cache County Study, Trevor R. Buckley
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
Alzheimer's disease (AD) has multiple factors that contribute to the disease process. Among these is a state of chronic inflammation that is endured by the brain during the aging process. The use of non-steroidal anti-inflammatory drugs (NSAIDs) decreases the amount of neuroinflammation sustained by the brain, and greater levels of NSAID use have been demonstrated to be associated with decreased probability of developing AD. This study looked at whether greater rates of NSAID use were also associated with decreased rates of cognitive and funtional decline and survival in a population-based sample of persons with AD. Linear mixed models failed to …

Environmental Sensor Anomaly Detection Using Learning Machines, Erick F. Conde
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
The search for improvements in the quality assurance/quality control (QA/QC) of real-time environmental measurements has been a field well exploited in recent years. These measurements describe actual environmental conditions and processes that provide relevant information upon which water quality management decisions are based. In situ sensors (located at the site of interest) are commonly used for such real-time measurement purposes. However, the performance of these types of sensors can be affected by such things as human factors, lack of necessary maintenance, flaws on the transmission line or any part of the sensor, and unexpected changes in the sensors surrounding conditions. …

Ultrasonic Flow Measurement For Pipe Installations With Non-Ideal Conditions, Devin M. Stoker
Ultrasonic Flow Measurement For Pipe Installations With Non-Ideal Conditions, Devin M. Stoker
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
In the arid west, water is among the most valuable of resources. One of the most critical aspects of water resource management is that of flow measurement. Accurate flow measurement data is needed to effectively manage any water distribution system, whether for culinary or irrigation use. In order to successfully and accurately measure water flow in pipes, it is recommended that a straight section of pipe be installed immediately upstream from the flow meter to avoid distorted flow patterns at the metering location. In many existing piping scenarios, however, such flow conditions are impossible to achieve.
The performance of ultrasonic …
An Embedded Atom Method Investigation Into The Lattice Dynamics Of Metallic Surfaces, Richard B. Wilson
An Embedded Atom Method Investigation Into The Lattice Dynamics Of Metallic Surfaces, Richard B. Wilson
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
The explosion in electronic devices over the last half century is a result of the successful development and application of theories that explain the physical properties of solids. For example, the theory of lattice vibrations developed in the first half of the 20th century has had a huge impact on our ability to understand and design devices. The idea that atoms vibrate together in grouped vibrational modes, called phonons, has enabled scientists to quantify the impact that atomic motion has on mechanical, thermal, electrical, and optical properties. This has aided the creation of all sorts of useful technology ranging …
Evaluation And Seismically Isolated Substructure Redesign Of A Typical Multi-Span Pre-Stressed Concrete Girder Highway Bridge, Brian D. Richins
Evaluation And Seismically Isolated Substructure Redesign Of A Typical Multi-Span Pre-Stressed Concrete Girder Highway Bridge, Brian D. Richins
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
Seismic considerations greatly influence the lateral and vertical design of a structure, often necessitating larger elements than would otherwise be required. Seismic isolation greatly reduces the demands on a structure due to earthquake loading, allowing the use of smaller, more efficient members and foundations. This case study illustrates the theory and procedure of evaluating the response of a recently built multi-span highway bridge using the most recent (2009) AASHTO code. Based on this response, an equivalent structure was designed to incorporate a seismic isolation system, and the substructure of the isolated bridge redesigned to meet the reduced demands more economically. …
