Student Engagement In New Zealand’S Universities, Ali Radloff Dec 2011

Student Engagement In New Zealand’S Universities, Ali Radloff

Australasian Survey of Student Engagement (AUSSE)

Although the numbers of students entering bachelor level study in New Zealand is growing and is high relative to OECD averages, the number of students leaving with a qualification is low compared to many other countries. Data from the Ministry of Education show that completion rates are relatively low, particularly among certain groups of students. Around one-third of students who began a bachelor degree in 2002 had not completed the degree, or a degree at the same or a higher level, eight years after starting. Completion rates are higher among Asian New Zealand students, but much lower among Maori and …

Making History Anew: Feminine Melodrama In Eileen Chang's Love In A Fallen City, Li Guo Dec 2011

Making History Anew: Feminine Melodrama In Eileen Chang's Love In A Fallen City, Li Guo

Languages, Philosophy, and Communication Studies Faculty Publications

This essay will explore the narrative mode of feminine melodrama in Love in a Fallen City, a novella by the Shanghainese writer Eileen Chang (1920–1995). Chang has gained international fame for her depiction of Chinese women in the tumultuous transitional period prior to the modern era, especially traditional women figures that are in stark contrast with the New Woman ideal portrayed by her contemporary writers. Born in Shanghai, Chang was a descendant of an eminent late imperial official and received western education in Hong Kong under the influence of her open-minded mother. A literary sensation at the age of twenty-five, …

Antitrust Review Of The At&T/T-Mobile Transaction, Maurice Stucke, Allen Grunes Dec 2011

Antitrust Review Of The At&T/T-Mobile Transaction, Maurice Stucke, Allen Grunes

Scholarly Works

In this Essay, we review AT&T Inc.’s proposed $39 billion acquisition of T-Mobile USA, Inc., under federal merger law, under the U.S. Department of Justice and Federal Trade Commission’s 2010 Horizontal Merger Guidelines, and with a focus on possible remedies. We find, under a rule of law approach, that the proposed acquisition is presumptively anticompetitive, and the merging parties in their public disclosures have failed to overcome this presumption. Next we find that under the Merger Guidelines, there is reason to believe that the transaction may result in higher prices to consumers under several different plausible theories. Finally, we turn …

Hacking, Theft, And Corporate Negligence: Making The Case For Mandatory Encryption Of Personal Information, Stephen J. Rancourt Dec 2011

Hacking, Theft, And Corporate Negligence: Making The Case For Mandatory Encryption Of Personal Information, Stephen J. Rancourt

Texas Wesleyan Law Review

Information is being created at an astonishing rate, and the electronic storage of personal data is at the forefront of this growth. Social security numbers, home and email addresses, and financial records are almost universally stored electronically, whether on internal servers, hard drives, or portable devices, such as flash drives and diskettes. The ubiquity of this information has undoubtedly benefitted commerce, but it has not come without drawbacks. As recent evidence suggests, personal information is increasingly vulnerable to hacking and other forms of theft, putting the consumer at serious risk of identity theft and misuse of their personal information. The …

Feminizing Presidents: Joseph Keppler And Gender In Gilded Age Political Cartoons, Jerome Gonzalez Dec 2011

Feminizing Presidents: Joseph Keppler And Gender In Gilded Age Political Cartoons, Jerome Gonzalez

American Studies Senior Theses

Amid the crowded newsstands of American cities in the late nineteenth century, the average reader flipping through a copy of Puck, a weekly humor magazine devoted to political and social issues, may have been surprised to see an unusual print: that of the President of the United States depicted in women’s clothing, with feminine features, performing a womanly task! These few drawings, alluding to both literary and social ideas, done by the Austrian immigrant artist Joseph Keppler, appeared in his Puck magazine in the years 1877, 1880, and 1884, coinciding around an election year. While Presidents Rutherford B. Hayes, James …

Mechanical Stretch And Shear Flow Induced Reorganization And Recruitment Of Fibronectin In Fibroblasts, Robert L. Steward, Chao Min Cheng, Jonathan D. Ye, Robert M. Bellin, Philip R. Leduc Dec 2011

Mechanical Stretch And Shear Flow Induced Reorganization And Recruitment Of Fibronectin In Fibroblasts, Robert L. Steward, Chao Min Cheng, Jonathan D. Ye, Robert M. Bellin, Philip R. Leduc

Biology Department Faculty Scholarship

It was our objective to study the role of mechanical stimulation on fibronectin (FN) reorganization and recruitment by exposing fibroblasts to shear fluid flow and equibiaxial stretch. Mechanical stimulation was also combined with a Rho inhibitor to probe their coupled effects on FN. Mechanically stimulated cells revealed a localization of FN around the cell periphery as well as an increase in FN fibril formation. Mechanical stimulation coupled with chemical stimulation also revealed an increase in FN fibrils around the cell periphery. Complimentary to this, fibroblasts exposed to fluid shear stress structurally rearranged pre-coated surface FN, but unstimulated and stretched cells …

Our agenda is to offer a conceptual/theoretical understanding of the post-structural approach to literature interpretation/performance. We make a practice of the theory in the construction of the paper—we allow the text to speak for itself. We provide a juxtaposition numerous authors. We focus on the text rather than the author. We offer the following reading instructions: Please read the text as a whole and skimming the referential notations. The citations are provided for readers who wish to further the topic. We realize we depart from the traditional academic writing form. The common occurrence of the style in competition underscores the …

The Alien Terrorist Removal Court And Other National Security Measures You May Have Never Heard Of: The Need For Comprehensive National Security Reform, Emily C. Kendall Dec 2011

The Alien Terrorist Removal Court And Other National Security Measures You May Have Never Heard Of: The Need For Comprehensive National Security Reform, Emily C. Kendall

Texas Wesleyan Law Review

In light of the decade that has passed since 2001, cooler heads have prevailed. Advancements in technology and information-seeking have paved the way to prune unnecessary laws that are archaic, redundant, in many instances contradictory, and which merely frustrate the real policy behind these laws: safeguarding the U.S. and its citizens. To assist in this pruning, this Article presents a comprehensive plan for national security reform, specifically involving immigration, with an emphasis on the agency tasked with its implementation-the Department of Homeland Security. In light of this goal, Section II provides a brief background into the U.S.'s current approach to …

Open For Business: The Ada Beyond An Employer’S Front Door, Scott C. Thompson Dec 2011

Open For Business: The Ada Beyond An Employer’S Front Door, Scott C. Thompson

Texas Wesleyan Law Review

Although heralded as an emancipation proclamation for people with disabilities, the Americans with Disabilities Act ("ADA") has done little over the course of its twenty-year history to increase the number or quality of employment opportunities available to individuals with a disability. Title I of the ADA requires employers to make reasonable accommodations for qualified employees with a disability so long as the accommodations do not impose an undue hardship on the employer. In applying Title [ of the ADA, courts consistently drew a bright line at the employer's threshold and refused to compel employers to make any accommodations unrelated to …

Clean Air Act Mayhem: Epa’S Tailoring Rule Stitches Greenhouse Gas Emissions Into The Wrong Regulatory Fitting, Teal Jordan White Dec 2011

Clean Air Act Mayhem: Epa’S Tailoring Rule Stitches Greenhouse Gas Emissions Into The Wrong Regulatory Fitting, Teal Jordan White

Texas Wesleyan Law Review

Regardless of whether you believe that human activities cause or contribute to global warming, regulatory action seeking to mitigate the future consequences of climate change will impact the lives of every American. On January 2, 2011, U.S. Environmental Protection Agency ("EPA") regulation of greenhouse gas emissions from stationary sources took effect. The EPA rule implementing this regulation is the conclusion, for the time being, of a sequence of recent judicial and administrative activities comparable to a regulatory domino effect. The Supreme Court started the cascade of regulation in Massachusetts v. EPA, in which the Court held that the EPA has …

A True Threat To First Amendment Rights: United States V. Turner And The True Threats Doctrine, Casey Brown Dec 2011

A True Threat To First Amendment Rights: United States V. Turner And The True Threats Doctrine, Casey Brown

Texas Wesleyan Law Review

The Supreme Court has carved out several exceptions to what qualifies as protected speech under the First Amendment, including true threats and incitement. The majority rule in the circuit courts is that speech qualifies as a true threat if the speech would be interpreted by an objectively reasonable person as an intent to commit serious harm or injury. Most courts apply a true threats analysis to cases involving a charge under 18 U.S.C. § 115(a)(1)(B). Furthermore, most courts do not require that the speaker actually intend to carry out the threat in order to be convicted. Although courts have generally …
