The Infancy Defense In The Modern Contract Age: A Useful Vestige, Victoria Slade
The Infancy Defense In The Modern Contract Age: A Useful Vestige, Victoria Slade
Seattle University Law Review
This Note argues that the state of a modern consumer society, when evaluated against the culture of marketing and consumerism surrounding America’s youth, calls for persisting protection of children in contract formation through retention of the infancy defense. Part II of this Note introduces the infancy defense, the philosophy behind it, the various exceptions to the defense, and how these exceptions have adapted to the modern marketplace to assure equitable results for adults. This Part also discusses other arenas of the law in which children are afforded special protection. Part III addresses the current state of the infancy doctrine as …
Swinburne's "The Tale Of Balen": An Edition With Critical Commentary, Warren Hill Kelly
Swinburne's "The Tale Of Balen": An Edition With Critical Commentary, Warren Hill Kelly
Electronic Theses and Dissertations
Warren Hill Kelly's Swinburne's The Tale of Balen: an Edition with Critical Commentary comprises a variorum-like edition of the poem that records all variances of the poem evident in its manuscript through its first and second editions, Chatto & Windus 1896 and 1904, or those editions produced during the poet's lifetime and therefore potentially bearing evidence of his editorial input. The edition forms as its basis the poet's final intention expressed in the manuscript, and notes all alterations within the manuscript and the first two published editions, and by coupling the edition's text with the notations pertaining to the manuscript, …

Differential Diagnoses Of Temporal Bone Defects And Zygomatic Bone Lesions Found In Fetal And Infant Individuals From The Kellis 2 Cemetery, Dakhleh Oasis, Egypt, Brittany A. Jardine
Electronic Theses and Dissertations
The Kellis 2 cemetery site within the Dakhleh Oasis, Egypt provides a unique study opportunity due to the large number of infant, perinatal, and fetal individuals that have been recovered. Several of the infant and fetal remains have undiagnosed circular defects on the temporal bone, and others have undiagnosed lesions on the zygomatic bone. Of the 268 individuals under one year of age that have been analyzed from the Kellis 2 cemetery, twentysix individuals have the temporal bone defect and six have the zygomatic bone lesions. A survey of clinical and paleopathological research provided possible pathological conditions that could cause …
The Visual Divide Islam Vs. The West, Image Peception In Cross-Cultural Contexts, Hatem Nazir Akil
The Visual Divide Islam Vs. The West, Image Peception In Cross-Cultural Contexts, Hatem Nazir Akil
Electronic Theses and Dissertations
Do two people, coming from different cultural backgrounds, see the same image the same way? Do we employ technologies of seeing that embed visuality within relentless cultural and ideological frames? And, if so, when does visual difference become a tool for inclusion and exclusion? When does it become an instrument of war? I argue that we‘re always implicated in visuality as a form of confirmation bias, and that what we see is shaped by preexisting socioideological frames that can only be liberated through an active and critical relationship with the image. The image itself, albeit ubiquitous, is never unimplicated - …
The American School Discipline Debate And The Persistence Of Corporal Punishment In Southern Public Schools, David M. Hargrove
The American School Discipline Debate And The Persistence Of Corporal Punishment In Southern Public Schools, David M. Hargrove
Electronic Theses and Dissertations
The dissertation examines the history of American school discipline and corporal punishment in southern public schools. Pedagogical literature, court reports, and popular fiction show that school discipline was a controversial topic throughout American history. The conflict over corporal punishment in schools led to a 1976 Supreme Court decision, Ingraham v. Wright, affirming the power of educators to use corporal punishment. When the school discipline debate peaked late in the twentieth century, most American schools no longer used corporal punishment but southern educators continued to paddle students, especially African American school children. By the twenty-first century, southern city schools adopted non-violent …
Taking Parties Seriously: Gendered Sexuality And Hook Up Culture At Greek Social Events, Brian Michael Knop
Taking Parties Seriously: Gendered Sexuality And Hook Up Culture At Greek Social Events, Brian Michael Knop
Electronic Theses and Dissertations
This thesis is a qualitative sociological analysis of gender and sexuality at Greek parties and in the broader Greek system in order to better understand hooking up and rape culture. While past work on rape culture has tended to look at fraternities as isolated organizations (Boswell and Spade 1996, Sanday 1990), this research takes into consideration that sororities and fraternities are constantly interacting within the Greek system and therefore must be analyzed together. I intervie14 sorority and fraternity members in order to uncover how Greek members interpret the behaviors, norms, and interactions at organized parties and in the broader Greek …
Listening To The Voices Of Preschool Aged Children Experiencing Homelessness: A Qualitative Approach, Maureen Turner
Listening To The Voices Of Preschool Aged Children Experiencing Homelessness: A Qualitative Approach, Maureen Turner
Theses and Dissertations
This exploratory, three phase qualitative research project gives a voice to preschool aged children experiencing homelessness to identify the significant relationships in their lives. Goals of this research included the exploration of: the central relationships of children experiencing homelessness, who children identify as important people in those relationships, how they describe those relationships, and how those relationships were formed. This research approach utilized a community participatory model in which the children's mothers contributed to the direction of the research project through group interviews. Children were observed for four months and then interviewed while completing three activities. The results suggested three …
Factors Related To Special Education Teacher Job Commitment: A Study Of One Large Metropolitan School District In Southern California, Joseph David Green
Factors Related To Special Education Teacher Job Commitment: A Study Of One Large Metropolitan School District In Southern California, Joseph David Green
Theses and Dissertations
Researchers have focused their attention on the subject of special education teacher attrition for many years. While these researchers have made valuable findings, the need to abate the staggering numbers of special education teachers who leave the field still exists. Districts desiring to retain their teachers must place greater emphasis on the development of evidence-based strategies to reduce teacher attrition (Billingsley, 2004). The purposes of this study were to: (a) provide an overview of the extent to which, if at all, perceptions of job commitment among current special education teachers in a large metropolitan school district in Southern California differ …
Special Education In Christian Schools: Post-Professional Development Support, Julie M. Lane
Special Education In Christian Schools: Post-Professional Development Support, Julie M. Lane
Theses and Dissertations
Private schools are not required to provide special education services to students who have been identified as needing such services. No prior research shows what programs exist in Christian private schools and how services are provided. This study sought to understand Christian educators' experiences and obstacles when developing a special education program. Participants attended a 1-week summer institute that provided instruction in key areas of special education services, disabilities, and instruction pertinent to serving children with special needs. Participants demonstrated an increase in knowledge and skills following the institute. The institute coordinator provided afterward 3 months of support through a …
Women And Work-Life Balance: A Phenomenological Qualitative Analysis Of Identity, Relational Style, Adaptive Style, And Drive And Motivation, And The Role Of Faith From The Narrative Life-Story Framework, Elizabeth Krymis
Theses and Dissertations
The purpose of this study is to review the literature regarding the plurality of roles of women, including work-life balance issues. The purpose of this study is also to share insights regarding the role of faith in women's identity, relational style, drive and motivation, and adaptive style. This phenomenological study used the narrative life-course framework to gain understanding of eleven women's lives as they seek balance in work and life. Four themes were selected based on a previous study by Giele, and include identity, relational style, drive and motivation, and adaptive style. The findings indicate that for those who value …
A Phenomenological Study Of Competing Priorities And African American Women Striving To Achieve Work-Life Balance, Gayle Colston Barge
A Phenomenological Study Of Competing Priorities And African American Women Striving To Achieve Work-Life Balance, Gayle Colston Barge
Theses and Dissertations
Organizations must address a myriad of issues from diversity initiatives to ensuring that work-life programs are responsive to the needs of its fastest growing segment--women of color of which African American women are the largest minority group. Despite the significance of their presence, research to date on the topic of work-life balance and family issues is based primarily on the experiences of middle-class white women. All women struggle with issues related to work-life conflict. Missing from this dialogue are the voices of African American women. Despite evidence that work is a significant domain in their lives, researchers have limited information …
The Application Of Cultural Values By Contemporary Alaska Native Leaders And Alaska Native Corporations: Individual And Organizational Implications, Lorraine Henry
Theses and Dissertations
This study examined the influence of traditional Alaska Native cultural values on current business practices within Alaska Native Corporations (ANCs). Five past and eight current chief executive officers of ANCs were interviewed to determine the impact of traditional Alaska Native cultural values on the ANCs. Key issues were identified by both samples. Basic assumptions of each sample also were determined. Values driving both samples additionally were identified. The study findings revealed substantial similarities from the two sets of leaders. It was concluded that reconciling the two different value systems (Western and Alaska Native) appears to have been achieved by blending …
Creating An Image, Shaping A Destination In Chachapoyas, Peru, Charles Hoadley
Creating An Image, Shaping A Destination In Chachapoyas, Peru, Charles Hoadley
Graduate Student Theses, Dissertations, & Professional Papers
This thesis examines the place image of the Chachapoyas region in northern Peru by identifying themes found in tourism guidebooks and websites. Photographs and written descriptions of Chachapoyas were found to emphasize certain features of the region while avoiding or hiding others. To further inform the discussion of the place image of Chachapoyas interviews were conducted with international tourists visiting the region. These interviews indicate that Chachapoyas does not have the same level of recognition as sites in southern Peru. The purveyors of representations of Chachapoyas have tried to appropriate the intrigue of a place myth characterized by lost civilizations …

Stories In Pictures (And Non-Pictorial Objects): A Narratological And Cognitive Psychological Approach, Michael Ranta
Stories In Pictures (And Non-Pictorial Objects): A Narratological And Cognitive Psychological Approach, Michael Ranta
Contemporary Aesthetics (Journal Archive)
Narratological studies have frequently focused upon linguistic structures, considered to be paradigmatic cases of narrativity, while pictorial signs, such as icons and symbols or indices, have received comparably much less attention. In this paper, however, some basic and regularly occurring narrative aspects of pictures and non-pictorial objects will be presented and discussed.
Rule Of Law In Haiti Before And After The 2010 Earthquake, James D. Wilets, Camilo Espinosa
Rule Of Law In Haiti Before And After The 2010 Earthquake, James D. Wilets, Camilo Espinosa
Intercultural Human Rights Law Review
When discussing the myriad challenges facing Haiti in the wake of the devastating 2010 earthquake, it is difficult to prioritize the needs of a country where basic needs such as shelter and basic medical care compete for long-term needs such as education, good governance, and economic reconstruction and growth. The current immediate and emergent needs of Haiti in the face of its national calamity have been well identified by international aid bodies and national leaders, and there has been a considerable literature on those needs. What is of equal importance in the long run, however, is building a solid foundation …

More Similar Than Different? Exploring Cultural Models Of Depression Among Latino Immigrants In Florida, Dinorah Martinez Tyson, Heide Castaneda, Milagro Porter, Marisel Quiroz, Iraida Carrion
Anthropology Faculty Publications
The Surgeon General's report, “Culture, Race, and Ethnicity: A Supplement to Mental Health,” points to the need for subgroup specific mental health research that explores the cultural variation and heterogeneity of the Latino population. Guided by cognitive anthropological theories of culture, we utilized ethnographic interviewing techniques to explore cultural models of depression among foreign-born Mexican (), Cuban (), Columbian (), and island-born Puerto Ricans (), who represent the largest Latino groups in Florida. Results indicate that Colombian, Cuban, Mexican, and Puerto Rican immigrants showed strong intragroup consensus in their models of depression causality, symptoms, and treatment. We found more agreement …

Literature Meets Biology: An Evolutionary Approach To Literary Studies, Samantha Reneé Dwyer
Literature Meets Biology: An Evolutionary Approach To Literary Studies, Samantha Reneé Dwyer
Graduate Student Theses, Dissertations, & Professional Papers
The following thesis engages with the relatively young development in literary studies, called evocriticism, which uses scientific perspectives to look at literature. It first gives an overview of the current state of English departments and their decline in numbers, budgets, and cultural relevancy, mostly due to outdated modes of literary criticism and theory. It then introduces evocriticism as a new paradigm for studying literature. Literature and the arts are studied as human behaviors with possible adaptive benefits. Individual texts are interpreted through a scientific lens, using the theory of evolution to find cultural and biological human universals that can help …
Commitment Beyond Morality: American Complicity In The Massacre At El Mozote, El Salvador, 1981, Dustin Hill
Commitment Beyond Morality: American Complicity In The Massacre At El Mozote, El Salvador, 1981, Dustin Hill
Online Theses and Dissertations
In order to highlight the complicity of the American government, this thesis will discuss in depth the most important massacre perpetrated by the Salvadoran military. While the American government maintained publicly that respect for human rights was one of the main goals of its mission in El Salvador, the six billion dollars of aid and American actions in the region belied another reality. This examination argues that it is clear that the massacre at El Mozote in late 1981 was the direct result of U.S. foreign policy initiatives. Although the Americans kept themselves insulated to provide for plausible deniability, the …
The Culture Of A Public School's Approach To Children With Asd: An Ethnographical Study, Lisa Mccarthy
The Culture Of A Public School's Approach To Children With Asd: An Ethnographical Study, Lisa Mccarthy
Online Theses and Dissertations
The purpose of this ethnographic study is to understand the culture of Westridge Elementary School (WRE), and its approach to the increasing numbers of mainstreamed students with special needs; in particular students identified with Autism Spectrum Disorders (ASD). The researcher examined the language, norms, and rituals of WRE, and how children with ASD are involved. Data from this research was collected through five face-to-face interviews, as well as participant observations, which were collected over a 2-3 week period in the spring and fall of 2010. Photographs of the school environment, along with the collection of artifacts, were also used to …

The New Old Legal Realism, Mitu Gulati, Tracey E. George, Ann Mcginley
Faculty Scholarship
Do the decisions of appellate courts matter in the real world? The American judicial system, legal education, and academic scholarship are premised on the view that they do. The authors want to reexamine this question by taking the approach advocated by the original Legal Realists. The current project seeks to add to our knowledge of the relevance of case law by focusing on an area that has received little examination: how pronouncements about employment discrimination law by appellate courts translate into understandings and behavior at the ground level. As our lens, we use evidence of how people talk about the …
The Political (And Other) Safeguards Of Religious Freedom, Richard W. Garnett
The Political (And Other) Safeguards Of Religious Freedom, Richard W. Garnett
Journal Articles
This essay is a contribution to a symposium marking the 20th anniversary of the Supreme Court’s still-controversial decision in Employment Division v. Smith. That decision, it is suggested, should not be read as reflecting or requiring hostility or indifference towards claims for legislatively enacted accommodations of religion. Smith is not an endorsement of religion-blind neutrality in constitutional law; instead, it assigns to politically accountable actors the difficult, but crucially important, task of accommodating those whose religious exercise would otherwise be burdened by generally applicable laws. The essay goes on to suggest several things that must be true of our law …

Prerequisites In Behavioral Science And Business: Opportunities For Dental Education., David G. Dunning, Brian M. Lange, Robert D. Madden, Koko K. Tacha
Journal Articles: College of Dentistry
There is increasing pressure on recent dental school graduates to understand and successfully utilize patient management and business management strategies to run a productive dental office. Dental schools are faced with the dilemma to either add more credit hours in their already crowded curriculum or adjust predental school requirements. All fifty-nine U.S. dental schools were assessed online to determine admission requirements in the areas of behavioral science and business education. Results show that only 11.9 percent of the schools require prerequisite course work in behavioral science and no school requires prerequisite course work in business. However, 64.4 percent and 30.5 …
Creating Social Networks: Resettlement Center For Burmese Refugees, Kelly Lynne Clarke
Creating Social Networks: Resettlement Center For Burmese Refugees, Kelly Lynne Clarke
Architecture Theses and Projects
The refugee resettlement program in the United States must encourage both the formation of refugee communities and integration within the larger community. I propose a multiuse building to strengthen refugee communities [bonding social networks] and connect refugees to the larger community [bridging social networks]. Both of these connections are essential for refugees to become integrated in a community. The building will be run by Lutheran Social Services who currently assists in the resettlement of refugees in the Springfield, Massachusetts area, with assistance in funding from the Wilson-Fish Discretionary Grant Program which provides financial support for alternative models of resettlement.

From Fur Baby To Chick Magnet: A Sociological View Of Dogs And Their People, Ariel Teresa Leigh Petersen
From Fur Baby To Chick Magnet: A Sociological View Of Dogs And Their People, Ariel Teresa Leigh Petersen
Undergraduate Theses, Professional Papers, and Capstone Artifacts
Since their domestication, dogs have played an important role in human society. People put them to work hunting game, herding livestock and guarding the home, and also keep them as companions. As dogs increasingly occupy a meaningful position in the lives of their owners, the startling lack of research on dog-human interaction becomes increasingly apparent.
This research discovers different ways people relate to their dogs, and the meaning dogs hold for their owners. While conducting observations, I identified and interviewed owners who exhibited an emotionally meaningful attachment to their dogs. I then used Glaser and Strauss’ grounded theory approach to …
